1. संक्षिप्त नाम, विस्तार और प्रारंभ।
क्षिप्त नाम, विस्तार और प्रारंभ।-यह नियमावली बिहार सड़क सुरक्षा निधि नियमावली, 2017 कही नियमावली, 2017 कही जा सकेगी।

2. परिभाषाएँ।- जब तक कि सं
जब तक कि संदर्भ से अन्यथा अपेक्षित न हो, इस नियमावली में -
(क) ''उपकर'' से अभिप्रेत है बिहार मोटर वाहन कराधान अधिनियम, 1994 के अधीन उद्गृहीत से अभिप्रेत है बिहार मोटर वाहन कराधान अधिनियम, 1994 के अधीन उद्गृहीत से अभिप्रेत है बिहार मोटर वाहन कराधान अधिनियम, 1994 के अधीन उद्गृहीत उपकर; (ख) "शमन फीस" ''(समझौता फीस)" से अभिप्रेत है मोटर वाहन अधिनियम, 1988 की धारा 200 के ''(समझौता फीस)" से अभिप्रेत है मोटर वाहन अधिनियम, 1988 की धारा 200 के अधीन संगृहीत फीस; अधीन संगृहीत फीस;
(ग) ''परिषद्'' से अभिप्रेत है मोटर वाहन अधिनियम, 19

(छ) इस नियमावली में प्रयुक्त किन्तु अपरिभाषित शब्दों एवं अभिव्यक्तियों के अर्थ क्रमषः वही हाेंगे, जो मोटर वाहन अधिनियम, 1988 (1988 का अधिनियम संख्या, 59), केन्द्रीय मोटर वाहन नियमावली, 1989, बिहार मोटर वाहन नियमावली, 1992 और बिहार मोटर वाहन करारोपण अधिनियम, 1994 एवं इसके अधीन निर्मित नियमावली में क्रमषः उनके प्रति समनुदेषित किए गए हो।
3. बिहार सड़क सुरक्षा निधि की स्थापना एवं प्रबंधन।- बिहार सड़क सुरक्षा निधि नामक एक निधि होगी। यह निधि बिहार सड़क सुरक्षा परिषद् में निहित होगी। निधि के उचित प्रबंधन के लिए परिषद् और लीड एजेन्सी जिम्मेवार होगी और इसके उपयोग के लिए उपयुक्त तंत्र विकसित करेगी। बिहार मोटर वाहन कराधान अधिनियम, 1994 (समय-समय पर यथा संषोधित) की धारा 6क और 6ख के अधीन विनियोजित राशि, निधि में जमा की जाएगी। यह निधि व्यपगत नही होगी। निधि को स्थापित करनेवाली सभी राशि प्राप्ति बजट शीर्ष में जमा की जायेगी। निधि का खाता किसी राष्ट्रीयकृत बैंक में परिवहन विभाग के प्रधान सचिव/सचिव द्वारा खोला जाएगा। यह खाता, संयुक्त रूप से परिवहन विभाग के प्रधान सचिव/सचिव और परिषद् के सचिव के द्वारा प्रचालित किया जाएगा। निधि के निमित परिषद् के सचिव निकासी एवं व्ययन पदाधिकारी होगें। परिषद्, जिला सड़क सुरक्षा समिति को, बिहार सड़क सुरक्षा निधि के एक अंष को उप-आवंटित कर सकेगी।
4. जिला सड़क सुरक्षा निधि का प्रशासन।- जिला के किसी राष्ट्रीयकृत बैंक में अलग से, स्वीकृत योजनाओं को लागू करने हेतु प्राप्त निधि के लिए, खाता खोली जाएगी। यह खाता संयुक्त रूप से अध्यक्ष एवं सचिव, जिला सड़क सुरक्षा समिति के द्वारा प्रचालित की जायेगी। परिषद् द्वारा स्वीकृत योजनाआें के लिए इस निधि का उपयोग की जायेगी। जिला सड़क सुरक्षा समिति के सचिव निकासी एवं व्ययन पदाधिकारी होगें।
5. निधि की उपयोगिता के लिए प्रक्रिया।-वित्तीय सहायता के अनुरोध के साथ, प्राक्कलन संबंधित विभाग के या जिला द्वारा, नामित विभागों के समन्वय समिति अथवा संबद्ध जिला सड़क सुरक्षा समितियों के माध्यम से परिषद् के सचिव को भेजा जाएगा;
(2) परिषद् के सचिव द्वारा प्राप्त सभी प्राक्कलनों को संवीक्षा (परिषोधन) एवं स्वीकृति के लिए कार्यपालक समिति के समक्ष प्रस्तुत की जाएगी;
(3) प्राक्कलनों के स्वीकृति के उपरान्त, परिषद् के सचिव, प्रस्ताव तैयार कर, परिषद् के अध्यक्ष की स्वीकृति प्राप्त करेगें;
(4) इसके पष्चात्, परिषद् के सचिव इसे अंतिम रूप देने, अधिसूचित एवं वितरित करने हेतु परिषद् की बैठक आहूत करेंगे;
(5) इस तरह की अधिसूचित योजनाओं के क्रियान्वयन हेतु परिषद् के सचिव आवष्यक कार्रवाई करेंगे एवं निधि का वितरण संबंधित विभागों एवं जिला को करेंगे;
(6) सभी पणाधारी (स्टेकहोल्डर) विभाग तत्काल कार्य आरंम्भ करेगें और परिषद् के सचिव को नियत समय-सीमा के भीतर उपयोगिता प्रमाण-पत्र और पूर्णता प्रतिवेदन भेजेगें। परिषद् के सचिव प्रत्येक प्रतिवेदन को कार्यपालक समिति के समक्ष रखेंगे।
6. निधि का उपयोगिता।- निधि सभी अथवा इनमें से किसी प्रयोजन के लिए उपयोग में लायी जाएगीः- (क) सड़क सुरक्षा कार्यक्रम; (ख) आधारभूत संरचना का विकास; (ग) सड़क सुरक्षा की बाबत जागरूकता कार्यक्रम; (घ) सड़क सुरक्षा से जुड़े उपकरण की खरीद; (ड़) सड़क सुरक्षा से संबंधित परियोजनाओं पर अनुमोदित अध्ययन और शोध; (च) शैक्षणिक समुदाय की सेवा प्राप्त करने, विषेषज्ञाें, चिन्तकाें, अनुभवी पेषेवराें इत्यादि के लिए निधि उपलब्ध कराना;
(छ) सड़क सुरक्षा से संबंधित प्रशिक्षण कार्यक्रमों का निधिकरण; (ज) अभिघात देखभाल कार्यक्रम और संबंधित क्रियाकलाप; (झ) ब्लैक स्पॉट का सुधार; (ञ) सड़क सुरक्षा से जुड़े विषयों पर ऐसे अन्य व्यय जो राज्य सरकार और राज्य सड़क सुरक्षा परिषद् उचित समझे;
(ट) कोई अन्य प्रयोजन जो विहित किया जाय।
7. पणधारी (स्टेकहोल्डर) विभागों की भूमिका और उत्तरदायित्व।-ऐसे पणधारी विभाग जो सड़क सुरक्षा निधि से वित्तीय सहायता प्राप्त करते हैं, स्वीकृत स्कीमों के कार्यान्वयन और पर्यवेक्षण के लिए बिहार सड़क सुरक्षा निधि नियमावली में विहित प्रावधानों के अनुसार उत्तरदायी होंगे।
8. व्यय।-सड़क सुरक्षा निधि के प्रशासन के सभी व्यय में बिहार सड़क सुरक्षा नीतियों के प्रभावी कार्यान्वयन को सुनिश्चित करने के लिए विशेषज्ञों, चिंतको, अनुभवी वृत्तिकों, युवा एवं विद्यार्थी आदि पर उपगत व्यय सम्मिलित हैं। संविदात्मक स्टाफ और तदर्थ कर्मचारियों के वेतन और भत्ते इस निधि से पूरा किए जायेंगे।
9. लेखे।-निधि के लेखे परिषद् के सचिव द्वारा ऐसी रीति से संधारित किए जायेंगे जो विहित की जाय।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 20 अ(cid:16)ील 2017 10. लेखापरीक्षा।-बिहार सड़क सुरक्षा निधि और जिला सड़क सुरक्षा निधि के आय-व्यय का लेखा समुचित रूप से संधारित किया जाएगा। बिहार वित्त नियमावली के अनुसार महालेखापरीक्षक और वित्त विभाग द्वारा नियमित रूप से लेखा की लेखापरीक्षा की जाएगी।
11. परिसंपत्ति।-निधि द्वारा सृजित सभी अस्तियाँ परिषद् की संपत्ति होगी। 12. प्रकीर्ण खंड।-परिषद्, कार्यपालक समिति की सहायता से कोई अन्य कदम उठाने अथवा कोई तंत्र विकसित करने, जो वह उचित समझे, के लिए सक्षम होगी ताकि यह सुनिश्चित किया जा सके कि जिन उद्देश्यों के लिए सड़क सुरक्षा निधि स्थापित की गयी है, वे पूरा हो चुके हैं।
13. नियमावली में संशोधन।-कार्यपालक समिति की अनुषंसा पर नियमावली में संशोधन करने की शक्ति राज्य सरकार में निहित होगी।

No. 1883—In exercise of the powers conferred by Sub Section (1) of Section 135, Sub-Section (2), of Section 138 (2) (I) and Section 212 (1) of the Motor Vehicles Act, 1988 (ACT No. 59 of 1988), The State Government of Bihar purpose to the make The Bihar Road Safety Fund Rules, 2017, the Draft of which is hereby published for information of all persons likely to be affected thereby; and the notice given that the said Draft of Rules will be taken into consideration after the expiry of 30 days from the date on which it is published in the Bihar Gazette.
The objections or suggestion which may be received from any person with respect to the said Draft of Rules before the expiry of the period aforesaid shall be considered by the State Government.
Objections and suggestions, if any, may be sent to the Principal Secretary, Transport Department, Vishweshwaraiya Bhawan, Bailey Road, Patna-800001.
The Draft of Bihar Road Safety Fund Rules, 2017 1. Short title, extent and commencement.— These Rules may be called The Bihar Road Safety Fund Rules, 2017.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with immediate effect. 2. Definitions.—In these Rules, unless otherwise requires in the context —
(a) "Cess" means the cess levied under Bihar Motor Vehicles Taxation Act, 1994; (b) "Compounding Fee" means the fee collected under section 200 of the Motor Vehicles Act, 1988;
(c) "Council" means 'The State Road Safety Council' constituted under Section 215 of the Motor Vehicles Act, 1988;
(d) "Fine" means fine imposed under Bihar Motor Vehicles Taxation Act, 1994 (as amended from time to time);
(e) "Fund" means the Bihar Road Safety Fund constituted under the Bihar Motor Vehicles Taxation Act, 1994, (as amended from time to time) ;
(f) "Year" means the Financial Year; (g) Words and expressions used, but not defined in these rules, shall have the meanings respectively assigned to them in the Motor Vehicles Act, 1988 (Central Act 59 of 1988), the Central Motor Vehicle Rules 1989, the Bihar Motor Vehicles Rules, 1992 and the Bihar Motor Vehicle Taxation Act, 1994, and the rules made there under .
3. Establishment and Management of Bihar Road Safety fund.—There shall be a Fund to be called as "Bihar Road Safety Fund".This fund shall vest in the Bihar State Road Safety Council. The Council and the Lead Agency shall be responsible for the proper management of the Fund and develop proper mechanism for the utilisation of the same. The amount appropriated under Section 6A and 6B of Bihar Motor Vehicles Taxation (Amendment) Act, 2016 shall be credited to the Fund. This Fund shall not lapse. All amounts to be establishing the Fund shall be deposited in the receipt Budget-Head. An account for the Fund shall be opened in any of the Nationalised Bank by the Principal Secretary/Secretary of the Transport Department. This account shall be jointly operated4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 20 अ(cid:16)ील 2017 by the Principal Secretary/Secretary of the Transport Department and the Secretary of the Council. The Secretary of the Council shall be the Drawing and Disbursing Officer for the purpose of the Fund. The Council may sub-allot a part of the Bihar Road Safety Fund to the District Road Safety Committees.
4. Administration of District Road Safety Fund.— A separate account shall be opened in any of the Nationalised Bank of the district for the fund received for the implementation of sanctioned schemes. This account shall be operated jointly by the Chairman and Secretary of the District Road Safety Committee. This Fund shall be utilised for the schemes sanctioned by the Council. The Secretary of the District Road Safety Committee shall be the Drawing and Disbursing Officer.
5. Procedure for utilization of Fund.— Estimate request for financial assistance shall be sent by the concerned department or district to the Secretary of the Council through the designated Co-ordination Committee, or by the concerned District Road Safety Committees.
(2) All the estimates, so received, shall be placed before the Executive Committee for scrutiny and approval by the Secretary of the Council.
(3) After the approval of such estimates, the Secretary of the Council shall, after preparing proposal, obtain the sanction of the Chairman of the Council;
(4) After that, the Secretary of the Council shall convene a meeting of the Council for its finalisation, notification and distribution;
(5) For the implementation of such notified schemes, the Secretary of the Council shall take necessary action and shall disburse the fund to the concerned department or the district.
(6) All stakeholder departments shall start the work immediately and send utilisation certificate and completion report within the stipulated time to the Secretary of the Council. The Secretary of the Council shall place each such report before the Executive Committee.
6. Utilisation of the Fund.—(1) The Fund shall be utilized for all or any of the following purposes:-
(a) road safety programmes; (b) infrastructure development; (c) awareness programmes in respect of road safety; (d) purchases of instruments connected with road safety; (e) Studies and research on approved projects regarding road safety; (f) providing fund for availing the services of educational community, experts, thinkers, experience professionals etc;
(g) funding of training programmes regarding road safety; (h) trauma-care programmes and related activities; (i) rectification of black spots; (j) such other expenditure incidental to road safety as the State Government and the State Road Safety Council may deem fit; (k) any other purposes as may be prescribed;
7. Role and Responsibilities of stakeholders Departments.— Such stakeholders departments who receive financial aid from Road Safety Fund shall be responsible for the execution and supervision of the sanctioned schemes, as per the provisions prescribed in the Bihar Financial Rules. 8. Expenses.— All expenses of administration of the Road Safety fund includes the expenses incurred on experts, thinkers, experienced professionals, youth and student etc. for ensuring effective implementation of Bihar Road Safety Policies. The salary and allowances of the contractual staffs and ad-hoc employees shall be met from the Fund.
9. Accounts.— The accounts of the fund shall be maintained by the Secretary of the Council in such manner, as may be prescribed.
10. Audit.-The account of receipt and expenditure of the Bihar Road Safety Fund shall be properly maintained at State and District level. The Fund shall be audited regularly by Accountant General and Finance Department as per Bihar financial rules.
11. Assets.— All the assets created by the fund shall be the property of the Council.

Miscellaneous Clause.— The Council, with the assistance of the Executive Committee, shall have the power to take any steps or develop any mechanism, which it deems fit, to ensure that the objectives for which the Road Safety Fund is being set up, are achieved.
13. Amendment of Rules.— Power to amend the Rules will vested in the State Government on the recommendation of the Executive Committee.
