मानव समाज को आधुनिकता प्रदान करने में सबसे बड़ा योगदान संचार क्रांति का है। संचार क्रांति ही वह मानव समाज को आधुनिकता प्रदान करने में सबसे बड़ा योगदान संचार क्रांति का है। संचार क्रांति ही वह मानव समाज को आधुनिकता प्रदान करने में सबसे बड़ा योगदान संचार क्रांति का है। संचार क्रांति ही वह माध्यम है, जिसके द्वारा आज पूरा विश्व समुदाय एक सूत्र में पिरोया जा सका है, इसमें सबसे बड़ा योगदान इन्टरनेट माध्यम है, जिसके द्वारा आज पूरा विश्व समुदाय एक सूत्र में पिरोया जा सका है, इसमें सबसे बड़ा योगदान इन्टरनेट माध्यम है, जिसके द्वारा आज पूरा विश्व समुदाय एक सूत्र में पिरोया जा सका है, इसमें सबसे बड़ा योगदान इन्टरनेट व्यक्ति विश्व के किसी भी कोने से किसी भी समय किसी से एवं मोबाईल का है। इन दोनों माध्यमों से आज कोई भी व्यक्ति विश्व के किसी भी कोने से किसी भी समय किसी से एवं मोबाईल का है। इन दोनों माध्यमों से आज कोई भी भी सम्पर्क स्थापित कर सकता है।

इस उपयोगिता को ध्यान में रखते हुए हमारे देश के आम नागरिक आज मोबाईल फ्रेंडली हो चुके है तथा इस उपयोगिता को ध्यान में रखते हुए हमारे देश के आम नागरिक आज मोबाईल फ्रेंडली हो चुके है तथा इस उपयोगिता को ध्यान में रखते हुए हमारे देश के आम नागरिक आज मोबाईल फ्रेंडली हो चुके है तथा इससे हमारा राज्य भी अछूता नहीं है। यदि हमारे राज्य की आबादी 10 करोड़ है त ो इसमें से मोबाईल फ्रेंडली लगभग इससे हमारा राज्य भी अछूता नहीं है। यदि हमारे राज्य की आबादी 10 करोड़ है तो इसमें से मोबाईल फ्रेंडली लगभग 3 करोड़ लोग हैं। इतनी अधिक मोबाईल के उपयोग का परिणाम यह है कि मोबाईल से संबंधित कम्पनियाँ प्रायः हर 3 करोड़ लोग हैं। इतनी अधिक मोबाईल के उपयोग का परिणाम यह है कि मोबाईल से संबंधित कम्पनियाँ प्रायः हर 3 करोड़ लोग हैं। इतनी अधिक मोबाईल के उपयोग का परिणाम यह है कि मोबाईल से संबंधित कम्पनियाँ प्रायः हर जगह मोबाईल टॉवर को अधिष्ठापित कर रही है या करना चाहती है। यदि यह सफल हो जाता है तो प्रतिदिन ''कॉल जगह मोबाईल टॉवर को अधिष्ठापित कर रही है या करना चाहती है। यदि यह सफल हो जाता है तो प्रतिदिन जगह मोबाईल टॉवर को अधिष्ठापित कर रही है या करना चाहती है। यदि यह सफल हो जाता है तो प्रतिदिन ड्रॉप'' की शिकायत स्वतः समाप्त हो जायेगी।

मोबाईल टॉवर के कम्पनियों के द्वारा इस सम्बन्ध में यह शिकायत प्राप्त हो रही है कि राज्य में दूरसंचार 2. मोबाईल टॉवर के कम्पनियों के द्वारा इस सम्बन्ध में यह शिकायत प्राप्त हो रही है कि राज्य में दूरसंचार मोबाईल टॉवर के कम्पनियों के द्वारा इस सम्बन्ध में यह शिकायत प्राप्त हो रही है कि राज्य में दूरसंचार कम्पनियों के आधारभूत ढ़ाँचा को विकसित किये वगैर ''कॉल ड्रॉप'' समस्या का समाधान पाना मुश्किल है। कम्पनियों के आधारभूत ढ़ाँचा को विकसित किये वगैर

समस्या का समाधान पाना मुश्किल है। ें राज्य सरकार के द्वारा राज्य में दूरसंचार सेवा प्रदाता कम्पनियों/ आधारभूत संरचना 3. वर्णित स्थिति में राज्य सरकार के द्वारा राज्य में दूरसंचार सेवा प्रदाता कम्पनियों/ आधारभूत संरचना ें राज्य सरकार के द्वारा राज्य में दूरसंचार सेवा प्रदाता कम्पनियों/ आधारभूत संरचना कम्पनियों के आधारभूत संरचना के विकास के लिये सरकारी भूमि/भवनों पर दूरसंचार टॉवर स्थापित किये जाने की कम्पनियों के आधारभूत संरचना के विकास के लिये सरकारी भूमि/भवनों पर दूरसंचार टॉवर स्थापित किये जाने की कम्पनियों के आधारभूत संरचना के विकास के लिये सरकारी भूमि/भवनों पर दूरसंचार टॉवर स्थापित किये जाने की स्वीकृति निम्न प्रावधानों के साथ प्रदान की जाती है :-ं स्वीकृति निम्न प्रावधानों के साथ प्रदान की जाती है :-ं

(i) दूरसंचार सेवा प्रदाता कम्पनियों/ आधारभूत संरचना कम्पनियों के अनुरोध पर विभिन्न विभागों की सेवा प्रदाता कम्पनियों/ आधारभूत संरचना कम्पनियों के अनुरोध पर विभिन्न विभागों की सेवा प्रदाता कम्पनियों/ आधारभूत संरचना कम्पनियों के अनुरोध पर विभिन्न विभागों की सरकारी भूमि/भवनों की छत दूरसंचार टॉवर एवं सबंधित ढ़ाँचा की स्थापना के लिये एकरारनामा सरकारी भूमि/भवनों की छत दूरसंचार टॉवर एवं सबंधित ढ़ाँचा की स्थापना के लिये एकरारनामा सरकारी भूमि/भवनों की छत दूरसंचार टॉवर एवं सबंधित ढ़ाँचा की स्थापना के लिये एकरारनामा के अन्तर्गत उपलब्ध करायी जा सकेगी। सभी शहरी स्थानीय निकायों के परिसर एवं भूमि के अन्तर्गत उपलब्ध करायी जा सकेगी। सभी शहरी स्थानीय निकायों के परिसर एवं भूमि के मामले के अन्तर्गत उपलब्ध करायी जा सकेगी। सभी शहरी स्थानीय निकायों के परिसर एवं भूमि में भूमि/भवन उपलब्ध कराने की सहमति कार्यपालक पदाधिकारी द्वारा दी जायेगी। जिला परिषद्‌ में भूमि/भवन उपलब्ध कराने की सहमति कार्यपालक पदाधिकारी द्वारा दी जायेगी। जिला परिषद्‌ में भूमि/भवन उपलब्ध कराने की सहमति कार्यपालक पदाधिकारी द्वारा दी जायेगी। जिला परिषद्‌ के मामलों में उप विकास आयुक्त-सह- मुख्य कार्यपालक पदाधिकारी, प्रखण्ड परिसरों के मामले में के मामलों में उप विकास आयुक्त-सह- मुख्य कार्यपालक पदाधिकारी, प्रखण्ड परिसरों के मामले में के मामलों में उप विकास आयुक्त-सह- मुख्य कार्यपालक पदाधिकारी, प्रखण्ड परिसरों के मामले में द्वारा निर्णय लेकर सहमति प्रखण्ड विकास पदाधिकारी एवं ग्राम पंचायतों के मामलों में ग्राम पंचायत द्वारा निर्णय लेकर सहमति प्रखण्ड विकास पदाधिकारी एवं ग्राम पंचायतों के मामलों में ग्राम पंचायत2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 22 अगःत 2017 दी जायेगी। अन्य सभी प्रकार की सरकारी भूमि/भवनों पर टॉवर एवं सम्बद्ध आधारभूत ढ़ाँचा स्थापित करने की सहमति जिला पदाधिकारी द्वारा दी जायेगी। जिला पदाधिकारी संबंधित विभाग के जिला स्तरीय पदाधिकारी की अनुशंसा प्राप्त करके निर्णय लेगें।

(ii) दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों के द्वारा आधारभूत संरचना के विकास के लिये उनके द्वारा दूर संचार टॉवर को स्थापित करने हेतु सरकारी भूमि/भवनों का आवंटन खुली निविदा के माध्यम से की जायेगी। साथ-ही-साथ दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों के द्वारा तीन स्तरों पर निलामी हेतु सुरक्षित राशि निम्न्‌ रूप में जमा की जायेगी :-

(iii) जिले में दूरसंचार सुविधाओं का विकास सुनिष्चित करने के लिये जिलाधिकारी सभी दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों के प्रतिनिधियों के साथ बैठक कर के उनकी आवष्यकता का आकलन करके सभी विभागों/स्थानीय निकायों से समन्वय करके समुचित तरीके से भूमि/भवन की उपलब्धता सुनिष्चित करायेगें। जिलाधिकारी इस प्रयोजन हेतु नोडल पदाधिकारी होगें।

(iv) दूरसंचार सेवा प्रदाता कम्पनियाँ/आधारभूत संरचना कम्पनियाँ सृजित की जाने वाली संरचना की सुरक्षा के लिये मूल रूप से जिम्मेदार होंगे। वे भूकम्परोधी गुणवत्तायुक्त संरचना स्थापित करेगी। साथ ही साथ स्थापित की जाने वाली संरचना के लिये समुचित सुरक्षा घेरा स्थापित करेगी। (v) दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों द्वारा सुरक्षा के दृष्टिकोण से संरचना सुरक्षित होने का प्रमाण-पत्र कार्य पूर्ण होने पर समर्पित किया जाएगा, जिले के भवन प्रमंडल के कार्यपालक अभियंता द्वारा इसकी जाँच करके संतुष्ट हो लिया जाएगा। कार्यपालक अभियंता, भवन प्रमंडल को 30 दिनों के अंदर अपना अभिमत संसूचित करना होगा। यदि इस अवधि में अभिमत संसूचित नहीं होता है तो दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों द्वारा दिये गये प्रमाण-पत्र को स्वतः मान्य माना जायेगा।

(vi) विद्यालयों, कॉलेजों, अस्पताल एवं आंगनबाड़ी परिसरों के 100 मीटर की त्रिज्या में दूरसंचार टॉवर स्थापित नहीं किये जायेगें। सुरक्षा के दृष्टिकोण से प्रखण्ड परिसरों एवं थानों में टॉवर स्थापित किये जा सकेगें। साथ ही वैसे भूमि एवं भवन पर टॉवर स्थापित नहीं किये जायेगें, जहाँ पूर्व में अनुमति दी जा चुकी है।

(vii) सम्पत्ति सृजन या संधारण की प्रक्रिया में सरकारी भूमि/भवन को होने वाली किसी भी क्षति की पुर्नस्थापना, दूरसंचार सेवा प्रदाता कम्पनियों/आधारभूत संरचना कम्पनियों द्वारा अपने खर्च पर की जायेगी। साथ ही साथ किसी प्रकार की दुर्घटना या क्षति के लिये वे समुचित क्षतिपूर्त्ति सुनिश्चित करेगी।

(viii) बिहार सरकार आवश्यकतानुसार इन टॉवरों में निःशुल्क कैमरे या अन्य उपस्कर (Equipment) लगा सकेगी।

(ix) इस प्रकार अनुमति प्राप्त स्थापित किये गये दूरसंचार ढ़ाँचा का उपयोग आवेदक से भिन्न अन्य दूरसंचार कम्पनियाँ भी कर सकेगी। चूँकि चयनित कंपनियों को मोबाईल टॉवर स्थापित करने हेतु सरकारी भूमि/भवनों के उपयोग की अनुमति खुली निविदा के माध्यम से दी जानी है, इस कारण से ''दूरसंचार सेवा प्रदात्ता कम्पनियाँ/आधारभूत संरचना कम्पनियाँ'' के साथ टॉवर/आधारभूत संरचना साझा करने का अधिकार सफल निविदादाता का होगा एवं इसके लिए अतिरिक्त राशि नहीं ली जाएगी।

(x) टॉवर स्थापित करने के लिये स्वीकृति प्राधिकार एवं दूरसंचार सेवा प्रदात्ता कम्पनियाँ/आधारभूत संरचना कम्पनियाँ के मध्य एकरारनामा संपादित होगा। प्रारम्भिक अनुमति 5 वर्ष के लिये दी जायेगी। 5 (पाँच) वर्षों के उपरांत प्रारंभिक शुल्क में 50% वृद्धि के आधार पर पुनः पाँच वर्षों के लिए अनुमति विस्तारित की जा सकेगी, जो आगे भी क्रमिक रूप से उसी सिद्धांत के आधार पर विस्तारित की जा सकेगी। अर्थात्‌ 5 वर्षों के उपरांत अनुमति विस्तारित होने पर, पुनः प्रारंभिक शुल्क 50% की वृद्धि के साथ जमा की जानी होगी एवं इस वर्द्धित राशि का 20% सालाना आवर्त्ती शुल्क अगले 5 वर्षों के लिए निर्धारित होगी। दूरसंचार सेवा प्रदात्ता कम्पनियाँ/आधारभूत संरचना3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 22 अगःत 2017 कम्पनियाँ बिहार सरकार एवं भारत सरकार द्वारा समय-समय पर प्रतिपादित किये जाने वाले नियम, अधिनियम एवं आदेशों का पालन सुनिश्चित करेगें।

(xi) इस नीति के तहत स्थापित होने वाली दूरसंचार आधारभूत संरचना पर नगर विकास एवं आवास विभाग द्वारा निरूपित "बिहार संचार मीनार एवं संबंधित संरचना नियमावली, 2012" एवं अन्य संगत विधान भी लागू रहेंगे। उक्त नियमावली में विहित सक्षम प्राधिकार द्वारा 30 दिनों के अन्दर अपना अभिमत/निर्णय संसूचित करने की अपेक्षा होगी।

(xii) मोबाईल टॉवर अधिष्ठापन से संबंधित तकनीकी विषयों पर समय-समय पर सूचना प्रावैधिकी विभाग द्वारा दिशा-निदेश जारी किए जा सकेंगे।

(xiii) आवर्त्ती शुल्क का भुगतान नहीं होने की दशा में लाईसेंस एकरारनामा में विहित नोटिस देकर एकरारनामा समाप्त किया जा सकेगा। बकाये शुल्क आदि तथा उस पर उद्‌भूत सूद राजस्व के बकाये के रूप में लोक माँग अधिनियम, 1914 के अन्तर्गत वसूलनीय होगी।

(xiv) उपरोक्त विन्दुओं को समाविष्ट करते हुए एक मॉडल लाईसेंस एग्रीमेन्ट प्रारूप तैयार किया गया है, जो संकल्प के साथ संलग्न है।

4. उक्त संकल्प को दिनांक 08.08.2017 को मद्‌ संख्या-21 के रूप में मंत्रिपरिषद्‌ के द्वारा स्वीकृति प्रदान की गयी है।

आदेश ः- आदेश दिया जाता है कि इस संकल्प को राजकीय राजपत्र के असाधारण अंक में प्रकाशित किया जाय और इसकी प्रति सभी विभाग/विभागाध्यक्ष/प्रमंडलीय आयुक्त/जिलाधिकारी/ अनुमंडलाधिकारी को सूचना एवं आवश्यक कार्रवाई हेतु भेजी जाय।

बिहार-राज्यपाल के आदेश से, राहुल सिंह, सरकार के सचिव।4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 22 अगःत 2017 MODEL LICENSE AGREEMENT This Agreement is made at < Name of place> on this ………………….day of June 2017 By and Between:

, hereinafter called the "LICENSOR" which expression shall unless excluded by or repugnant to the context be deemed to include his successor in office, administrators and permitted assignees of the ONE PART;

And Telecom / ISP LTD , a company registered and/ or incorporated under the provisions of the Companies Act,1956,having its registered office at "xxxxxxxxxxxxxxxx",and having its circle office at XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX" hereinafter referred to as the 'LICENSEE"(which expression shall, unless excluded by or repugnant to the subject or context, be deemed to mean and include its officers, directors, successors-in-office, successors-in-interest and assignee) of the OTHER PART.

AND WHEREAS the licensor does represent that the land of the State Government or the terrace of the State Government buildingbearing the details as following is in the sole and exclusive possession of the Licensor and he is the sole and lawful owner of the same.

@AND WHEREAS the licensee is engaged in the business of providing cellular telephone service and for the aforesaid purpose required to set up cellular / microwave antennae and other related equipment's on the terrace of the state government building.

@@AND WHEREAS the licensee is desirous of using on license in a portion of a terrace admeasuring 100 Sq. Ft of the said property or land admeasuring 500 Sq. Ft (approx.) for the purpose of installation of a cellular pole infrastructure, GSM and microwave antennae, and other related equipment's for the purpose of setting up a chain of communication network.

@@@AND WHEREAS the Licensor has thus agreed to permit the use of the said terrace of the said property or the said land as mutually decided on license for the aforesaid purpose on and subject to the terms and conditions hereinafter contained.

NOW THEREFORE THIS LICENSE DEEDWITNESSETH AS FOLLOWS:

1. That the Licensor has good and valid power, right, authority and no objection to grant the license in favors of Licensee

2. The Licensor hereby grants on license to the Licensee for an area admeasuring 500 Sq. Ft in case of a government land, or 100 Sq. Ft (Approx.) at the roof top of the building and 100 Sq. Ft at the ground (for DG) as shown in the attached layout, including the access to the property as shown in the attached layout,on the building of any state government building (hereinafter referred to as licensed premises) for the installation of a cellular pole tower and microwave antennas and other related equipment's on the said premises.< @- strike down if not applicable>

3. That the Licensee shall also be entitled to make appropriate earthing pit(s) for providing earthing, and to connect the said pit(s) to the antenna and equipment's in such a manner as is necessary and appropriate for the purpose of providing earthing to the antenna, its related equipment's and to the building with the consent of the landlord as to specific location earthing pit.

4. In consideration of the Licensor permitting the license to use the licensed premises, the licensee has agrees to pay the Licensor the license fee as under:-

5. The licensee agrees to make payment of Rs...……………. as Onetime fee, along with payment of Rs …………………… as annual recurringlicense fee to the licensor. a. The annual license fee shall be payable in advance and at the commencement of each contract year.

b. The above said license fee is exclusive of present & future tax i.e. all present and future property tax shall be paid by the Licensor only, but any taxes on the license fee shall be borne by the Licensee.

6. This license shall be for the period of Five (5) years commencing from xx.xx.xxxx and be in force till xx.xx.xxxx and/or before the liquidation process. This license shall be irrevocable for the said term from the date of commencement provided always however,that the Licensee shall have the right to terminate this license by giving to the Licensor three months prior notice in writing at any time during the currency of this license and Licensor(s) shall have also the right to terminate the same by giving to the Licensee three months prior notice in writing at any time during currency of this license.

7. For the purpose of the Agreement,ayear shall mean the period of 12 months beginning from the date of commencement of the license.

8. The Licensor shall for the aforesaid purpose allow the employees/workers of Local/concerned electric authorities or any other agency to carry out the work of installation of the electric meters or any other necessary equipment's and antenna etc.only on the licensed property. The Licensee shall have the right to install necessary cable and wire /fiber equipment's for the purpose of transmitting the power supply from meter to its antenna and other equipment's as per agreed drawings.

9. Licensee shall ensure that the antennas and its related equipment's are properly installed in such a manner so as to avoid any kind of inconvenience to the other occupants of the building and terrace.

10. Licensee shall be responsible to obtain all the permission/sanction that may be required from the department of Telecommunication and Local/State Authorities for the installations and operations of its antennas and equipment's.

11. The Licensor shall not be responsible or liable in any manner whatsoever for any damage which be caused to any equipment or antenna of the Licensee or injury to any person allowed by the Licensee to gain access to the licensed premises.

12. If the Licensee fails to pay to the Licensor, the one-time feeand the annual recurring license fee hereby reserved in the manner and within the period provided herein, the Licensor shall be entitled to after providing a notice of 90 days, and only if payment remains still unpaid, terminate this agreement and revoke license hereby granted. The licenser shall be entitled to recover the outstanding rent and the interest accrued on the unpaid rent as the state revenue according to the provisions of the Bihar and Orissa Public Demand Recovery Act,1914.

13. The Licensor has and shall continue to comply with all laws, bye-laws, rules, regulations, orders, notification, directions and conditions of the government whether Central, State, Local, or Municipal including "Bihar Communication Towers and Related Structures Rules,2012"withrespect to the licensed property. 14. The License contained herein shall not be determined or affected or in any way prejudiced by any absorption of or by the Licensee, or by any amalgamation or merger thereof or therewith but shall be ensured, and be available for by the absorbing or amalgamated or merged or new entity.

15. The Licensee shall be entitled to install any additional mobile or telecom equipment or goods etc., related to the purpose for which the agreement has been concluded. The Licensee shall also be entitled to remove any/all its equipment's, goods etc., at any time at its sole discretion without any let, hindrance or objection from the Licensor(s) including in the circumstances of the Agreement having been terminated/determined by the Licensee.

16. The Licensor shall have no objection, in case the licensed property is allowed by the Licensee to be used by other telecom operator, for installation of other operator's equipment'salong with equipment installed by the Licensee, provided the Licensee6 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 22 अगःत 2017 shall be responsible for the action of the other operator or its representatives. The cell site (licensed premises) can be shared with other operators from the beginning of this license.

17. Notwithstanding any provision of this agreement, the State Government of Bihar shall have rights to install camera or any equipment on the mobile tower or antenna installed or erected under this agreement.

18. The Licensee shall ensure that no damage is caused to the land, house & property. Save and except any natural disaster, or normal wear and tear, the Licensee shall compensate for any damage that shall be redone or reclaimed.

19. The Licensor shall not have claim, lien or charge on the cellular tower and microwave antennas and other related equipment's along with a DG Set and accessories either for arrears, fees, compensation or otherwise in any circumstances. 20. On the expiry of the term of this Agreement or its earlier determination in accordance with the terms and conditions of this Agreement,the License shall remove and/or cause to be removed its antennae equipment from the licensed premises and shall vacate the licensed premises.

21. At the expiry of the term hereof the parties may extend the duration of this agreement on the same terms and conditions for a further period of 5(five) years subject to the condition that the value of the one-time fee and recurring annual license fee shall be increased by 50% of the existing value. This arrangement may continue at the expiry of every five years of the contract period on the same terms and conditions as mentioned above.

22. Except as otherwise provided in this agreement, the provision of this Agreement may be amended at any time by mutual written consent of the parties hereto.

23. This agreement and the contents hereof supersede each and all agreement, arrangements, understandings, letters, correspondence, representations, etc. between the parties hereto with respect to the subject matter herein.

24. Any notice or communication with reference to the agreement, unless otherwise specified herein, shall be deemed to be validly, sent if dispatched by registered post and acknowledgement due to the other party at their respective address.

25. If any party fails to require performance by the other party of any obligation it shall not affect the right of such party to require performance of the obligation subsequently.

26. In this license agreement unless the context otherwise require any reference to words importing the singular shall include the plural and vice a versa, words importing a gender include every gender and reference to persons include corporate and incorporated.

27. All disputes arising of this agreement shall be subject to the jurisdiction of Patna High Court.

28. The original copy of this license deed shall remain in possession of the Licensor and a copy of the signed agreement shall be handed over to the Licensee.
