भारत-गणराज्य के अड़सठवें वर्ष में बिहार राज्य विधानमंडल द्वारा निम्नलिखित रूप में यह अधिनियमित होः- 1111.... संक्षिप्त नाम, विस्तार और प्रारम्भ।-संक्षिप्त नाम, विस्तार और प्रारम्भ।-संक्षिप्त नाम, विस्तार और प्रारम्भ।-संक्षिप्त नाम, विस्तार और प्रारम्भ।- (1) यह अधिनियम बिहार पंचायत राज (संशोधन) अधिनियम, 2017 कहा जा सकेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा, सिवाय उन क्षेत्रों के जहाँ बिहार नगरपालिका अधिनियम, 2007 (बिहार अधिनियम, संख्या 11, 2007) या कैन्टोनमेन्ट अधिनियम, 1924 (अधिनियम II, 1924) के उपबंध लागू हैं।
(3) यह तुरंत प्रवृत होगा।
बिहार अधिनियम 6, 2006 की धारा 25 का संशोधन- (1) उप-धारा (1) निम्नवत् प्रतिस्थापित की 2222.... बिहार अधिनियम 6, 2006 की धारा 25 का संशोधन- (1) बिहार अधिनियम 6, 2006 की धारा 25 का संशोधन- (1) बिहार अधिनियम 6, 2006 की धारा 25 का संशोधन- (1)
जायेगीः- - - -
''(1) सरकार द्वारा इस संबंध में बनाये गये नियमों के अध्यधीन प्रत्येक ग्राम पंचायत अपने कृत्यों के प्रभावी निर्वहन हेतु निम्नलिखित समितियों का गठन करेगी :-
(i) योजना, समन्वय एवं वित्त समिति- धारा 22 में वर्णित विषयों सहित ग्राम पंचायत से संबंधित सामान्य कृत्यों के करने के लिए, अन्य समितियों के कार्याें का समन्वय तथा अन्य समितियों के प्रभार में नहीं रहने वाले शेष कार्यों के सम्पादन के लिये;
(ii) उत्पादन समिति - कृषि, पशुपालन, डेयरी, कुक्कुट पालन, मत्स्य पालन, वानकी संबंधी प्रक्षेत्र, खादी, ग्राम या कुटीर उद्योग एवं गरीबी उपशमन संबंधी कार्याें का अनुश्रवण एवं पर्यवेक्षण;
(iii) सामाजिक न्याय समिति- निम्न कार्यों का अनुश्रवण एवं पर्यवेक्षणः- (क) अनुसूचित जातियों एवं अनुसूचित जनजातियों तथा कमजोर वर्गों के शैक्षणिक,
आर्थिक, सामाजिक, सांस्कृतिक और अन्य हितों का संवर्धन,
(ख) ऐसी जातियों और वर्गों को सामाजिक अन्याय एवं सभी प्रकार के शोषण से बचाने
संबंधी कार्य,
(ग) महिलाओं एवं बच्चों का कल्याण। (iv) शिक्षा समिति - प्राथमिक, माध्यमिक एवं जन शिक्षा, पुस्तकालय एवं सांस्कृतिक कार्यकलापों से संबंधित कार्याें का अनुश्रवण एवं पर्यवेक्षण;
(v) लोक स्वास्थ्य, परिवार कल्याण एवं ग्रामीण स्वच्छता समिति - लोक स्वास्थ्य, परिवार कल्याण एवं ग्रामीण स्वच्छता संबंधी कार्याें का अनुश्रवण एवं पर्यवेक्षण;
(vi) लोक निर्माण समिति - ग्रामीण आवास, जलापूर्ति स्रोतों, सड़क एवं आवागमन के अन्य माध्यमों, ग्रामीण विद्युतीकरण एवं संबंधित कार्यों सहित सभी प्रकार के निर्माण एवं अनुरक्षण संबंधी कार्याें का अनुश्रवण एवं पर्यवेक्षण।
(2) उप-धारा (2) को निम्नवत् प्रतिस्थापित किया जायेगाः- उप-धारा (2) को निम्नवत् प्रतिस्थापित किया जायेगाः- उप-धारा (2) को निम्नवत् प्रतिस्थापित किया जायेगाः- उप-धारा (2) को निम्नवत् प्रतिस्थापित किया जायेगाः- ''(2)(i) धारा 25 की उपधारा (1) के खंड (i) से (v) में वर्णित स्थायी समितियों का गठन चुनाव द्वारा ग्राम पंचायत के निर्वाचित सदस्यों के बीच से किया जाएगा। ऐसी प्रत्येक समिति में अध्यक्ष सहित कम-से-कम तीन और अधिक-से-अधिक पाँच सदस्य होंगे। (ii) लोक निर्माण समिति में ग्राम पंचायत के विभिन्न वार्डो से निर्वाचित सभी ग्राम पंचायत सदस्य (वार्ड मेम्बर) सदस्य होंगे।
(iii) प्रत्येक समिति अपने दायित्वाें के प्रभावी निर्वहन हेतु विशेषज्ञों एवं जनहित से प्रेरित व्यक्तियों में से अधिक-से-अधिक दो सदस्यों को सहयोजित (कोऑप्ट) कर सकेगी। (3) उप-उप-उप-उप-धारा (3) को निम्नवत् प्रतिस्थापित किया जायेगाः- धारा (3) को निम्नवत् प्रतिस्थापित किया जायेगाः- धारा (3) को निम्नवत् प्रतिस्थापित किया जायेगाः- धारा (3) को निम्नवत् प्रतिस्थापित किया जायेगाः-
''(3) मुखिया योजना, समन्वय एवं वित्त समिति तथा लोक निर्माण समिति का पदेन सदस्य एवं अध्यक्ष होगा। उप-मुखिया सामाजिक न्याय समिति का पदेन सदस्य एवं अध्यक्ष होगा। मुखिया प्रत्येक अन्य समिति के लिए इसके निर्वाचित सदस्यों के बीच से अध्यक्ष नामित करेगा।'' परन्तु यह कि प्रत्येक समिति में कम-से-कम एक महिला सदस्य होगी और यह कि सामाजिक न्याय समिति का एक सदस्य उपलब्धता के अध्यधीन अनुसूचित जाति या अनुसूचित जनजाति का सदस्य होगा। (4) उप-धारा (5) को निम्नवत् प्रतिस्थापित किया जाये उप-धारा (5) को निम्नवत् प्रतिस्थापित किया जायेगा :- गा :- गा :- गा :- उप-धारा (5) को निम्नवत् प्रतिस्थापित किया जाये उप-धारा (5) को निम्नवत् प्रतिस्थापित किया जाये ''''''''(5) पंचायत सचिव योजना, समन्वय एवं वित्त समिति तथा लोक निर्माण समिति का सचिव होगा। जिला पदाधिकारी या उनके द्वारा इसके लिए प्राधिकृत कोई अन्य पदाधिकारी, अन्य स्थायी समितियाें के सचिव के रूप में कार्य करने के लिए किसी सरकारी सेवक को नामित करेगा।''3 (cid:1)बहार गजट (असाधारण), 4 िसत!बिसत!बिसत!बिसत!बरररर 2017 बिहार अधिनियम 6, 2006 की धारा 26 का संशोधन ।- (1) अधिनियम की धारा 26 की उप-धारा (5) के 3333.... बिहार अधिनियम 6, 2006 की धारा 26 का संशोधन ।- (1) अधिनियम की धारा 26 की उप-धारा (5) के बिहार अधिनियम 6, 2006 की धारा 26 का संशोधन ।- (1) अधिनियम की धारा 26 की उप-धारा (5) के बिहार अधिनियम 6, 2006 की धारा 26 का संशोधन ।- (1) अधिनियम की धारा 26 की उप-धारा (5) के खण्ड (क) को निम्नवत् प्रतिस्थापित किया जायेगाः- खण्ड (क) को निम्नवत् प्रतिस्थापित किया जायेगाः- खण्ड (क) को निम्नवत् प्रतिस्थापित किया जायेगाः- खण्ड (क) को निम्नवत् प्रतिस्थापित किया जायेगाः- ''(क) केन्द्र या राज्य सरकार द्वारा दिया गया अंशदान या अनुदान, यदि कोई हो, जिसमें केन्द्रीय वित्त आयोग या राज्य वित्त आयोग की अनुशंसा के आधार पर प्राप्त अनुदान भी सम्मिलित है।'' (2) अधिनियम की धारा-26 की उप-धारा (6) के पश्चात् एक नई उप-धारा (7) निम्नवत् अन्तःस्थापित की अधिनियम की धारा-26 की उप-धारा (6) के पश्चात् एक नई उप-धारा (7) निम्नवत् अन्तःस्थापित की अधिनियम की धारा-26 की उप-धारा (6) के पश्चात् एक नई उप-धारा (7) निम्नवत् अन्तःस्थापित की अधिनियम की धारा-26 की उप-धारा (6) के पश्चात् एक नई उप-धारा (7) निम्नवत् अन्तःस्थापित की जायेगीः-जायेगीः-जायेगीः-जायेगीः- ''(7) ग्राम पंचायत क्षेत्र के साम्योचित विकास हेतु सरकार को समय-समय पर ग्राम पंचायत निधि से राशि के उपयोग एवं व्यय के संबंध में ग्राम पंचायत को निदेश देने की शक्ति होगी तथा सरकार का ऐसा निदेश ग्राम पंचायत के लिए बाध्यकारी होगा।''
बिहार अधिनियम 6, 2006 में नई धारा 170ख और धारा 170ग का अन्तःस्थापन ।- अधिनियम की अधिनियम की अधिनियम की अधिनियम की 4444.... बिहार अधिनियम 6, 2006 में नई धारा 170ख और धारा 170ग का अन्तःस्थापन ।- बिहार अधिनियम 6, 2006 में नई धारा 170ख और धारा 170ग का अन्तःस्थापन ।- बिहार अधिनियम 6, 2006 में नई धारा 170ख और धारा 170ग का अन्तःस्थापन ।- धारा-170क धारा-170क धारा-170क धारा-170क के पश्चात् निम्नलिखित नई धारा 170ख और 170ग अन्तःस्थापित की जायेगीः- के पश्चात् निम्नलिखित नई धारा 170ख और 170ग अन्तःस्थापित की जायेगीः- के पश्चात् निम्नलिखित नई धारा 170ख और 170ग अन्तःस्थापित की जायेगीः- के पश्चात् निम्नलिखित नई धारा 170ख और 170ग अन्तःस्थापित की जायेगीः- ''170ख वार्ड क्रियान्वयन एवं प्रबंधन समिति- ''170ख वार्ड क्रियान्वयन एवं प्रबंधन समिति-(1) वार्ड सभा द्वारा अपने कृत्यों/दायित्वों के निर्वहन हेतु वार्ड ''170ख वार्ड क्रियान्वयन एवं प्रबंधन समिति-''170ख वार्ड क्रियान्वयन एवं प्रबंधन समिति- क्रियान्वयन एवं प्रबंधन समिति का गठन किया जायेगा। संबंधित वार्ड से निर्वाचित ग्राम पंचायत सदस्य उस वार्ड समिति के पदेन अध्यक्ष होंगे। वार्ड क्रियान्वयन एवं प्रबंधन समिति की संरचना, पदावधि आदि वही होगी, जो सरकार द्वारा विहित की जाय।
(2) वार्ड क्रियान्वयन एवं प्रबंधन समिति मुख्यतः निम्नलिखित कृत्यों का निर्वहन करेगीः-
(क) वार्ड सभा के विचारण हेतु वार्ड में चलायी जाने वाली योजनाओं एवं विकास कार्यक्रमों के प्रस्ताव एवं उनकी प्राथमिकता तैयार करना।
(ख) साक्षरता, सार्वजनिक स्वच्छता, स्वास्थ्य, पर्यावरण, प्रदूषण नियंत्रण जैसे विषयों पर जागरूकता पैदा करने हेतु वार्ड सभा को सहयोग करना।
(ग) जलापूर्ति, सार्वजनिक स्वच्छता इकाईयों एवं अन्य सार्वजनिक सुविधा योजनाओं के लिए वार्ड सभा की ओर से उपयुक्त स्थल का चयन करना।
(घ) महामारी तथा प्राकृतिक आपदा की रोक-थाम हेतु वार्ड सभा/ग्राम पंचायत के सामान्य नियंत्रण के अधीन कार्य करना।
(ड़) वार्ड सभा/ग्राम पंचायत द्वारा समय-समय पर सौंपी गयी योजनाओं/ कार्यक्रमों/दायित्वों का क्रियान्वयन।
(3) लोक निर्माण योजनाओं के क्रियान्वयन में वार्ड क्रियान्वयन एवं प्रबंधन समिति अधिनियम की धारा-25(1)(vi) के अधीन गठित लोक निर्माण समिति के अधीन कार्य करेगी।''
समिति द्वारा योजनाओं के क्रियान्वयन हेतु निदेश देने की सरकार की ''170ग वार्ड क्रियान्वयन एवं प्रबंधन''170ग वार्ड क्रियान्वयन एवं प्रबंधन''170ग वार्ड क्रियान्वयन एवं प्रबंधन''170ग वार्ड क्रियान्वयन एवं प्रबंधन समिति द्वारा योजनाओं के क्रियान्वयन हेतु निदेश देने की सरकार की समिति द्वारा योजनाओं के क्रियान्वयन हेतु निदेश देने की सरकार की समिति द्वारा योजनाओं के क्रियान्वयन हेतु निदेश देने की सरकार की शक्तिः-शक्तिः-शक्तिः-शक्तिः-अधिनियम में किसी अन्य बात के होते हुए भी, सरकार ग्राम पंचायत को ग्राम पंचायत निधि से वार्ड के लिए अनुमोदित योजनाओं का क्रियान्वयन वार्ड क्रियान्वयन एवं प्रबंधन समिति के माध्यम से कराने हेतु निदेश दे सकेगी। वार्ड क्रियान्वयन एवं प्रबंधन समिति द्वारा योजनाओं का क्रियान्वयन सरकार द्वारा समय-समय पर निर्गत निदेशों के अनुरूप कराया जायेगा।''
5. निरसन एवं व्यावृत्ति - निरसन एवं व्यावृत्ति - निरसन एवं व्यावृत्ति - निरसन एवं व्यावृत्ति - (1) बिहार पंचायत राज (संशोधन) अध्यादेश, 2017 (बिहार अध्यादेश सं0-1, 2017) इसके द्वारा निरसित किया जाता है। (2) ऐसे निरसन के होते हुए भी उक्त अध्यादेश के द्वारा या के अधीन प्रदत्त किसी शक्ति के प्रयोग में किया गया कोई कार्य या की गई कोई कार्रवाई इस अधिनियम द्वारा या के अधीन प्रदत्त शक्तियों के प्रयोग में किया गया या की गई समझी जायेगी, मानो यह अधिनियम उस दिन प्रवृत्त था जिस दिन ऐसा कार्य किया गया था या ऐसी कार्रवाई की गई थी।

THE BIHAR PANCHAYAT RAJ (AMENDMENT) ACT, 2017

ACT
To amend the Bihar Panchayat Raj Act, 2006 (Bihar Act 6, 2006) Be it enacted by the Legislature of the State of Bihar in the Sixty Eighth year of the Republic of India as follows :-
1. Short title, extent and commencement- (1) This Act may be called the Bihar Panchayat Raj (Amendment) Act, 2017.
(2) It shall extend to the whole of the State of Bihar excepting the areas to which the provisions of the Bihar Municipal Act, 2007 (Bihar Act No. 11 of 2007) or Cantonment Act, 1924 (Act II of 1924) apply.
(3) It shall come into force at once. 2. Amendment of section 25 of the Bihar Act, 6 of 2006 - (1) The sub section(1) shall be substituted as follows :-
"(I) Subject to the rules made in this behalf by the Government, a Gram Panchayat shall constitute the following committees for effective discharge of its following functions:- (i) Planning, Co-ordination and Finance Committee - for performing general functions relating to Gram Panchayat including subjects mentioned in section 22, co-ordination of the work of other committees and all residuary functions not under the charge of other committees.
(ii) Production Committee - for monitoring and supervision of functions relating to agriculture, animal husbandry, dairy, poultry and fisheries, forestry-related areas, khadi, village and cottage industries and poverty alleviation programmes.
(iii) Social Justice Committee - for monitoring and supervision of
functions relating to : a. Promotion of educational, economic, social, cultural and other interests of Scheduled Castes, Scheduled Tribes and other weaker sections.
b. Protection of such castes and classes from social injustice
and all forms of exploitation.
c. Welfare of women and children.
(iv) Education Committee - for monitoring and supervision of functions relating to education, including primary, secondary and mass education, libraries and cultural activities.
(v) Committee on Public Health, Family Welfare and Rural Sanitation - for monitoring and supervision of functions relating to public health, family welfare and rural sanitation.
(vi) Public Works Committee - for monitoring and supervision of functions relating to all kinds of constructions and maintenance including rural housing, sources of water supply, roads and other means of communication, rural electrification and related works." (2) Sub-sections (2) shall be substituted as follows:- "(2)(i) The standing committees mentioned in clause (i) to (v) under sub- section (1) of section 25 shall be constituted by election from5 (cid:1)बहार गजट (असाधारण), 4 िसत!बिसत!बिसत!बिसत!बरररर 2017 among the elected members of the Gram Panchayat. Each such committee shall consist of not less than three and not more than five members including the chairman.
(ii) The Public Works Committee shall consist of all the Gram Panchayat Members (Ward Members) elected from the different wards of the Gram Panchayat as members.
(iii) Each committee can co-opt not more than two members from among experts or public spirited persons for effective discharge of its responsibilities."
(3) Sub-section (3) shall be substituted as follows:-
"(3) The Mukhiya shall be the ex-officio member and chairman of the Planning, Co-ordination and Finance Committee and the Public Works Committee. The Up-Mukhiya shall be the ex-officio member and chairman of the Social Justice Committee. The Mukhiya shall nominate a chairman of each other committee from among its elected members.
Provided that each committee shall have at least one woman member and further, social justice committee shall have a member belonging to the Scheduled Castes or Scheduled Tribes, subject to availability."
(4) Sub-section (5) shall be substituted as follows:-
"(5) Panchayat Secretary shall be the secretary of the Planning, Co- ordination and Finance Committee and Public Works Committee. For other Standing Committees the District Magistrate or any other officer authorised by him in this behalf shall nominate a Government servant to function as secretary."
3. Amendment of Section 26 of the Bihar Act 6 of 2006 .– (1) Clause (a) of sub-
section (5) of section 26 of the Act shall be substituted as follows:-
"(a) Contributions and grants, if any, made by the Central or State Government including grants received on the basis of recommendations of the Central Finance Commission or State Finance Commission."
(2) A new sub-section (7) shall be inserted after sub-section (6) of section-26 of
the Act:- "(7) For equitable development of the Gram Panchayat area, the Government shall be competent to issue necessary instructions to the Gram Panchayat from time to time with respect to utilization and expenditure of money from the Gram Panchayat Fund and such direction shall be binding on the Gram Panchayat."
4. Insertion of new Section 170B and Section 170C in the Bihar Act 6 of 2006 .– The following new Section 170B and Section 170C shall be inserted after Section 170A of the Act, respectively:- "170B Ward Implementation and Management Committee-(1) A Ward Implementation and Management Committee shall be constituted by Ward Sabha for discharge of its functions/ responsibilities. The Gram Panchayat Member elected from the concerned Ward shall be the ex-officio chairman of the Ward Implementation and Management Committee. The composition, tenure etc. of Ward Implementation and Management Committee will be such as may be prescribed by the Government.
(2) Ward Implementation and Management Committee shall mainly discharge the following functions:-
6(cid:1)बहार गजट (असाधारण), 4 िसत!बिसत!बिसत!बिसत!बरररर 2017 (a) To generate proposals and determine the priority of schemes and development programmes for consideration of the Ward Sabha. (b) To assist the Ward Sabha in generating awareness on issues like literacy, public sanitation, health, environment, pollution control etc. (c) To select appropriate locations on behalf of Ward Sabha for water supply, public sanitation units and other public amenity schemes. (d) To work under general control of Ward Sabha/Gram Panchayat for prevention of epidemics and natural calamities.
(e) Execution of schemes/programmes/responsibilities given from time to time by Ward Sabha/ Gram Panchayat.
(3) For execution of public works schemes, the Ward Implementation and Management Committee shall function under the Public Works Committee constituted under section 25 (1)(vi) of the Act."
"170C Power of the Government to issue directions for implementation of schemes by Ward Implementation and Management Committee:- Notwithstanding anything contained in the Act, the Government may issue directions to Gram Panchayat to implement schemes approved for the Ward through Ward Implementation and Management Committee from the Gram Panchayat Fund. The schemes shall be executed by the Ward Implementation and Management Committee in accordance with the directions issued from time to time by the Government."
5. Repeal and Savings - (1) The Bihar Panchayat Raj (Amendment) Ordinance, 2017 (Bihar Ordinance No. 1, 2017) is hereby repealed. (2) Notwithstanding such repeal anything done or any action taken in exercise of any power conferred by, or under the said ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act as if this Act inforce on the day on which such thing was done or action taken.
