सं॰ एलजी॰-01-24/2017-183 लेजः—बिहार विधान मंडल द्वारा यथापारित का निम्नलिखित अधिनियम, जिसपर महामहिम राज्यपाल दिनांक 31 अगस्त 2017 को अनुमति दे चुके है, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 5 ०सत(cid:20)बर 2(cid:22)1(cid:24) [बिहार अधिनियमबिहार अधिनियमबिहार अधिनियमबिहार अधिनियम 25, 2017] बिहार चिकित्सा (संशोधन) अधिनियम, 2017
बिहार चिकित्सा अधिनियम, 1916 (बिहार अधिनियम II, 1916) का संशोधन करने के लिए अधिनियम ।
भारत गणराज्य के अड़सठवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में अधिनियमित हो :-
1. संक्षिप्त नाम, विस्तार एवं आरंभ।-(1) यह अधिनियम बिहार चिकित्सा (संशोधन) अधिनियम, 2017 कहा जा सकेगा।
(2) इसका विस्तार संपूर्ण बिहार राज्य से होगा। (3) यह बिहार के राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगा।
2. बिहार अधिनियम II, 1916 की धारा 3 एवं धारा 4 का प्रतिस्थापन।-बिहार चिकित्सा अधिनियम, 1916 की धारा-3 एवं धारा-4 क्रमशः निम्नलिखित द्वारा प्रतिस्थापित की जाएगी।
3. बिहार चिकित्सा परिषद् की स्थापना।-बिहार चिकित्सा रजिस्ट्रीकरण परिषद् के रूपमें एक परिषद् की स्थापना की जाएगी और यह परिषद् एक निगमित निकाय होगी और इसे शाश्वत उत्तराधिकार और सामान्य मुहर होगी तथा उक्त नाम से वह वाद ला सकेगी और उस पर वाद लाया जा सकेगा।
4. परिषद् का गठन।- (1) परिषद् दस सदस्यों से मिलकर होगी, यथा :-
(क) सरकार द्वारा नाम निर्दिष्ट किए जाने वाले तीन सदस्य; (ख) आर्यभट्टज्ञान विश्वविद्यालय द्वारा मेडिकल फैकल्टी से नाम निर्दिष्ट दो सदस्य; (ग) राज्य में निवास करने वाले रजिस्ट्रीकृत व्यवसायियों द्वारा और से निर्वाचित एक महिला सदस्य; (घ) बिहार राज्य में निवास करने वाले रजिस्ट्रीकृत व्यवसायियों द्वारा और से निर्वाचित होनेवाले दो सदस्य;
(ड·) भारतीय चिकित्सा संघ की बिहार शाखा के सदस्यों द्वारा और से निर्वाचित होनेवाले दो सदस्य। (2) (i) परिषद् के अध्यक्ष परिषद् के सदस्यों द्वारा और उनके बीच से निर्वाचित किए जाएंगे और उस अवधि के लिए पद धारण करेंगे, जिस अवधि के लिए परिषद् के सदस्यों को निर्वाचित किया जाएगा।
(ii) परिषद् अथवा इसके अधिकारियों द्वारा किए गए किसी कार्य को, केवल उसमें किसी कार्य को, केवल उसमें रिक्ति अथवा परिषद् के गठन में किसी त्रुटि के विद्यमान रहने के आधार पर, प्रश्नगत नही ंकिया जाएगा।
(iii) परिषद् अथवा इसके अधिकारियों द्वारा किए गए किसी कार्य को, केवल इस कारण से अधिनिमान्य नहीं समझा जाएगा कि सदस्यों की संख्या, वैसे कार्य के अनुपालन के समय, इस धारा में विनिर्दिष्ट संख्या तक नहीं थी।
3. व्यावृति।- ऐसे प्रतिस्थापन के होते हुए, बिहार चिकित्सा अधिनियम, 1916 की मूल धारा-3 एवं 4 के अधीन पूर्व में किया गया कुछ भी या की गई कोई कार्रवाई प्रभावित नहीं होगी।

ACT
To amend the Bihar Medical Act, 1916 (Bihar Act II, 1916)
Be it enacted by the Legislature of the State of Bihar in the sixty eighth year of the
Republic of India as follows:-
1. Short title extent and commencement.— (1) This Act may be called as The Bihar Medical (Amendment) Act, 2017. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force from the date of its publication in the Official Gazette of Bihar.
2. Substitution of section, 3 and 4 of the Bihar Act, II, 1916.— Section-3 and section-4 of the Bihar Medical Act, 1916 shall be substituted by the following respectively:-
3. Establishment of the Bihar Medical Council.— A Council shall be establishedas The "Bihar Council of Medical Registration and such council shall be a body corporate and have perpetual succession and a common seal and may,by the said name sue and be sued.
4. Constitution of Council.— (1)The said council shall consist of ten members, namely:-
(a) Three members to be nominated by the Government. (b) Two members to be nominated byAryabhatta Knowledge University from medical faculty.
(c) One female member to be elected by and from such registered practitioners residing in the State.
(d) Two members to be elected by and from the registered practitioners residing in the State of Bihar; and
(e) Two members to be elected by and from the members of the Bihar Branch of the Indian Medical Association.
(2)(i) The President of the council shall be elected by the members of the council from amongst them and shall hold office for a term for which the members of the council will be elected.
(ii) No act done by the Council shall be questioned on the ground merely of the existence of any vacancy in, or any defect in the constitution of the Council.
(iii) No act of the Council or its officers shall be deemed to be invalid by reason only that the number of members did not, at the time of the performance of such act, amount to the number specified in this section.
3. Saving.—Not withstanding such substitution anything done or any action taken previously under original section 3 and 4 of the act shall not be affected.
