सं॰ 8प/वि0-05-111/2016/8970—बिहार पंचायत राज अधिनियम, 2006, (समय-समय पर यथासंशोधित) की धारा 167 सह-पठित धारा 146 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार जिला योजना समिति का गठन एवं कार्य संचालन नियमावली, 2006 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम, विस्तार और प्रारंभ। - (1) यह नियमावली बिहार जिला योजना समिति का गठन एवं कार्य संचालन (संशोधन) नियमावली, 2017 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाशन की तारीख से प्रवृत्त होगी। 2. बिहार जिला योजना समिति का गठन एवं कार्य संचालन नियमावली, 2006 का नियम 3 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-
''3. समिति के सदस्यों की संख्या।- (1) प्रत्येक जिला योजना समिति के सदस्यों की कुल संख्या, अद्यतन जनगणना के अनुसार, जिले की कुल जनसंख्या के आधार पर, सरकार (पंचायती राज विभाग) द्वारा विनिर्दिष्ट की जायेगी। (2) जिला योजना समिति के लिए विनिर्दिष्ट ऐसे सदस्यों की कुल संख्या के कम-से-कम 4/5 भाग सदस्य, जिला परिषद् और जिले में नगरपालिकाओं के निर्वाचित सदस्यों के बीच से, जिले की ग्रामीण और नगरीय जनसंख्या के अनुपात में, राज्य निर्वाचन आयोग के निदेशन, नियंत्रण एवं पर्यवेक्षण में निर्वाचित किये जायेंगे।
(3) प्रत्येक जिला योजना समिति के लिए, जिला परिषद् तथा शहरी स्थानीय निकायों से निर्वाचित होने वाले प्रतिनिधियों में, यथाशक्य 50 प्रतिशत स्थान महिला प्रतिनिधियों के लिए आरक्षित रहेंगे। जहाँ स्थानीय निकाय से निर्वाचित होने वाले सदस्यों की संख्या मात्र एक होगी, उस स्थान को खुला रखा जायेगा अर्थात ऐसे स्थान से चुने जाने के लिए पुरूष/महिला दोनों प्रतिनिधि अपनी दावेदारी पेश कर सकेंगे।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 [Çत३बर 2(cid:22)1(cid:24) (4) अगर जिला परिषद् अथवा शहरी स्थानीय निकायों से निर्वाचित अनुसूचित जाति, अनुसूचित जनजाति या पिछड़े वर्ग की कोटि का कोई सदस्य किसी जिले की जिला योजना समिति के सदस्य के रूप में निर्वाचित नहीं हो पाता है, तो सरकार, जिला परिषद् के सदस्यों तथा जिले की नगर पंचायत और नगर निगम तथा नगरपालिका पर्षद् के पार्षदों में से अनुसूचित जातियों, अनुसूचित जन-जातियों या पिछड़े वर्ग की कोटियों के सदस्यों को इतनी संख्या में मनोनीत करेगी जितना वह उपयुक्त समझे। (5) जिला परिषद् के अध्यक्ष और जिला मुख्यालय पर अधिकारिता रखने वाले, यथास्थिति, नगर निगम या नगर परिषद् या नगर पंचायत के महापौर या अध्यक्ष जिला योजना समिति के पदेन सदस्य हाेंगे। (6) अगर ग्रामीण जनसंख्या के प्रतिशत के आधार पर, जिला परिषद् से जिला योजना समिति के लिए निर्वाचित होने वाले सदस्यों की विनिर्दिष्ट संख्या से, उक्त जिले की जिला परिषद् के कुल निर्वाचित सदस्यों (अध्यक्ष को छोड़कर) की संख्या कम हो, तो जिला परिषद् के कुल निर्वाचित सदस्यों की संख्या ही, उक्त जिला योजना समिति में जिला परिषद् से निर्वाचित होने वाले सदस्यों की संख्या, मानी जायेगी:
परन्तु अगर किसी स्थानीय निकाय से निर्वाचित होने वाले सदस्यों की विनिर्दिष्ट संख्या एक से कम हो, तो संबंधित जिला योजना समिति के लिए उस निकाय से एक सदस्य अवश्य निर्वाचित किया जायेगा।''

No.8P/Vi-05-111/2016/8970—In exercise of the powers conferred by section 167 read with section 146 of the Bihar Panchayat Raj Act, 2006, (as amended from time to time) the Governor of Bihar is pleased to make the following Rules to amend the Bihar District Planning Committee Constitution and Conduct of Business Rules, 2006 :-
1. Short title, extent and commencement— (1) These Rules may be called "The Bihar District Planning Committee Constitution and Conduct of Business (Amendment) Rules, 2017.
(2) It shall extend to whole of the State of Bihar. (3) It shall come into force from the date of its publication in the official gazette. 2. Rule 3 of the Bihar District Planning Committee Constitution and Conduct of Business Rules, 2006 shall be substituted by the following—
"3. Number of members of the Committee— (1) The total number of members of each District Planning Committee shall be specified by the Government (Panchayati Raj Department) on the basis of total population of the district as per the latest census.
(2) At least 4/5 of such specified total number of the members of a District Planning Committee shall be elected from amongst the members of Zila Parishad and Municipalities in the district, in proportion to the population of the rural areas and of the urban areas in the district under the direction, control and supervision of the State Election Commission.
(3) Fifty percent of the seats, as far as may be, out of the members to be elected from Zila Parishad and urban local bodies for each District Planning Committee shall remain reserved for women representatives. Where the number of the members to be elected from a local body will be only one, that seat shall be kept open, this is to say that both male and female representatives may present their candidature for being elected from such seat.
(4) If no member of Scheduled Castes, Scheduled Tribes or Backward Classes categories from Zila Parishad or urban local bodies is elected as member to the District Planning Committee of a district, the Government shall nominate such number of members from Scheduled Castes, Scheduled Tribes or Backward Classes categories as it deems fit from amongst the members of the Panchayats and Municipalities in the district.
(5) The Adhyaksha of Zila Parishad and the Mayor or President of Municipal Corporation or Municipal Council or Nagar Panchayat, as the case may be, having3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 24 [Çत३बर 2(cid:22)1(cid:24) jurisdiction over the headquarters of the districts, shall be ex-officio members of the District Planning Committee.
(6) If the number of total elected members of Zila Parishad of the said District for the District Planning Committee is less than the total elected members of Zila Parishad (excluding the Adhyaksha) in the said district, on the basis of percentage of rural population then the number of total elected members of the Zila Parishad shall be treated as the numbers of the members to be elected from that Zila Parishad in the said District Planning Committee:
Provided that if number of members specified to be elected from any local body is less than one, one member from that body must be elected for the concerned District Planning Committee.''
