सं॰ 3/एम0-34/2017-14393-सा0प्र0—भारत संविधान के अनुच्छेद, 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल "राजपत्रित पदाधिकारियों की विभागीय परीक्षा नियमावली, 1961" में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं -
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (1) यह नियमावली "राजपत्रित पदाधिकारियों की विभागीय परीक्षा (संशोधन) नियमावली, 2017" कही जा सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत होगी। (4) यह राज्य के राजपत्रित पदाधिकारियों एवं अन्य अराजपत्रित पदाधिकारियों एवं कर्मचारियों (समूह 'घ' कर्मियों को छोड़कर) पर लागू होगी।
2. उक्त नियमावली, 1961 का नियम-1 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा-
"1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (1) यह नियमावली "राज्य के राजपत्रित पदाधिकारियों एवं अन्य अराजपत्रित पदाधिकारियों एवं कर्मचारियों (समूह 'घ' कर्मियों को छोड़कर) की विभागीय परीक्षा नियमावली, 1961" कही जा सकेगी।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना निर्गत होने की तिथि से प्रवृत होगी।"
3. उक्त नियमावली, 1961 के नियम-4 में प्रयुक्त "राँची" शब्द को एतद्द्वारा विलोपित किया जाता है। 4. उक्त नियमावली, 1961 के भाग-1 में जहाँ कहीं भी "राजपत्रित पदाधिकारी" शब्द प्रयुक्त हुए हैं, उन्हें शब्द "राज्य के राजपत्रित पदाधिकारियों एवं अन्य अराजपत्रित पदाधिकारियों एवं कर्मचारियों (समूह 'घ' कर्मियों को छोड़कर)" द्वारा प्रतिस्थापित किया जाएगा।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 15 नव(cid:21)बर 2(cid:23)1(cid:24) 5. उक्त नियमावली, 1961 के भाग-1 के नियम-12 के उप-नियम-(2) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-
"(2) सरकार के सभी विभाग, अपने नियंत्रणाधीन पदाधिकारियों/कर्मचारियों की सेवा/संवर्गों की विभागीय परीक्षा के लिए, संबंधित नियमावली में प्रावधान कर सकेगा। विभागीय परीक्षा के पाठ्यक्रम, राजस्व पर्षद की केन्द्रीय परीक्षा समिति द्वारा सम्बन्धित विभाग के परामर्श से तथा सामान्य प्रशासन विभाग के अनुमोदन से निर्धारित किया जा सकेगा।" 6. उक्त नियमावली, 1961 के भाग-1 में जहाँ कहीं भी "बिहार असैनिक सेवा (कार्यपालिका शाखा) एवं बिहार कनीय असैनिक सेवा" शब्द प्रयुक्त हुए हैं, उन्हें "बिहार प्रशासनिक सेवा" द्वारा प्रतिस्थापित किया जाएगा।
7. उक्त नियमावली, 1961 के भाग-2 के नियम-14 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा- "14. सेवा/संवर्ग नियमावली में निहित विभागीय परीक्षा के प्रावधान के आलोक में, केन्द्रीय परीक्षा समिति, राजस्व पर्षद, बिहार द्वारा एतदर्थ पाठ्यक्रम/प्रक्रिया को अधिसूचित एवं समय-समय पर संशोधित किया जा सकेगा।"
8. अभिभावी प्रभाव।- इस नियमावली में राज्य सरकार के किसी नियमावली/सेवा/संवर्ग नियमावली के किसी प्रावधान के प्रतिकूल रहते हुए भी, इस नियमावली के प्रावधानों का अभिभावी प्रभाव होगा।
9. प्रासंगिक संवर्ग नियमावलियों के संगत प्रावधानों का निरसन।- राज्य सरकार की सुसंगत सेवा/संवर्ग नियमावलियों के सुसंगत प्रावधान इस हद तक निरसित समझे जायेंगे।

सं॰ 3/एम0-34/2017-14394, अधिसूचना संख्या 14393 दिनांक 15 नवम्बर 2017 का निम्नलिखित अँगरेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन अंगे्रजी भाषा में उसका प्राधिकृत पाठ समझा जाय।

No-3/M-34/2017-14393-GAD—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar makes the following Rules to amend "Rules for Departmental Examination of Gazetted Officers, 1961" —
1. Short title, extent and commencement.—(1) These Rules may be called the "Departmental Examination of Gazetted Officers (Amendment) Rules 2017".
(2) It shall extend to the whole State of Bihar.
(3) Its shall come into force at once.
(4) It shall be applicable to Gazetted Officers and other non-Gazetted Officers and employees (except Group 'D' Employees) of the State.
2. Rule-1 of said Rules, 1961 shall be substituted by the following-
"1. Short title, extent and commencement.— (1) These Rules may be called the "Departmental Examination of Gazetted Officers and other non- Gazetted Officers and employees (except Group 'D' Employees) of the 3. The word 'Ranchi' used in Rule-4 of said Rules, 1961 is hereby deleted.

In the Part 1 of the said Rules, 1961, wherever the words "Gazetted Officers" have been used, they shall be substituted by the words "Gazetted Officers and other non- Gazetted Officers and employees (except Group 'D' employees) of the State."
5. Sub rule (2) of Rule 12 of Part 1 of the said Rules, 1961 shall be substituted by the following -
"(2) All Departments of the Government may make provision for
Departmental Examination in concerned service/cadre Rules of
Officers/Employees of the Services/Cadres controlled by them. The
syllabus for the Departmental Examination shall be prescribed by the
Central Examination Committee in the Board of Revenue in consultation
with the concerned Department and with the approval of the General
Administration Department."
6. In the Part 2 of the said Rules, 1961, wherever the words "Bihar Civil Service (Executive Branch) and Bihar Junior Civil Service" have been used, they shall be substituted by the words "Bihar Administrative Service".
7. The Rule 14 of Part 2 of the said Rules, 1961 shall be substituted by the following-
"14. In view of provision of the Departmental Examination vested in
service/cadre rules, syllabus/procedure shall be notified and amended
from time to time, for this purpose, by the Central Examination
Committee, Board of Revenue, Bihar."
8. Over-riding effect.- Notwithstanding any provision contained in these rules, repugnant to any of the provisions of any rules, in a Service/Cadre Rules of the State Government, the provisions of these Rules shall have over-riding effect.
9. Repeal of relevant provisions of relevant Service/Cadre Rules.— The relevant provisions of relevant Service/Cadre Rules of the State Government shall be deemed to be repealed to this extent.
