सं॰-एम-4-48/2012(खंड-I)—9230/वि॰, भारतीय संविधान के अनुच्छेद 283(2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार वित्त नियमावली, 1950 (समय-समय पर यथा संशोधित) का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम, विस्तार और प्रारंभ- (1) यह नियमावली बिहार वित्त (संशोधन) नियमावली, 2017 कही जा सकेगी ।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा । (3) यह तुरंत प्रवृत होगी ।
2. बिहार वित्त नियमावली, 1950 (समय-समय पर यथा संशोधित) के नियम-30 का उपनियम-(xx) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-
''(xx) GeM Portal पर उपलब्ध सामग्रियों एवं सेवाओं की अधिप्राप्ति अनिवार्य रूप से सभी विभागों द्वारा, आवश्यकतानुसार की जायेगी । GeM Portal से सामग्रियाें का क्रय एवं सेवाओं की अधिप्राप्ति निम्नलिखित रीति से की जायेगीः-
(क) आवश्यक गुणवत्ता, विशिष्टियों एवं आपूर्त्ति-अवधि को ध्यान में रखते हुए ````50,000/- तक GeM Portal पर उपलब्ध किसी भी आपूर्त्तिकर्ता के माध्यम से ।
(ख) आवश्यक गुणवत्ता, विशिष्टियों एवं आपूर्त्ति-अवधि को ध्यान में रखते हुए ````50,000/- से अधिक एवं ````30,00,000/- तक, कम से कम तीन विभिन्न निर्माताओं के उपलब्ध आपूर्तिकत्तों में से न्यूनतम कीमत रखने वाले आपूर्तिकर्त्ता के माध्यम से । सक्षम प्राधिकारी के निर्णय से, GeM Portal पर उपलब्ध online bidding एवं online reverse auction का उपयोग भी इसके लिए किया जा सकता है ।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 27 नव(cid:19)बर 2(cid:21)1(cid:23) (ग) आवश्यक गुणवत्ता, विशिष्टियों एवं आपूर्त्ति-अवधि को ध्यान में रखते हुए ````30,00,000/- से अधिक के लिए, अनिवार्य रूप से निविदा द्वारा GeM Portal पर उपलब्ध online bidding एवं online reverse auction का उपयोग करते हुए न्यूनतम कीमत रखने वाले आपूर्तिकर्ता से ।
(घ) GeM Portal के Terms एवं Condition के अनुसार सभी विक्रेताओं एवं Portal पर निबंधित अन्य विक्रेताओं को, और जिन्होंने अपनी विशिष्ट सामग्रियों/सेवा कोटि के अधीन ऑफर दिये हों, online bidding एवं online reverse auction हेतु आमंत्रण उपलब्ध होगा । (ड़) उपरोक्त आर्थिक अधिकतम सीमा केवल GeM Portal के माध्यम से क्रय पर लागू होंगे । GeM Portal से बाहर क्रय के लिए, यदि कोई हो, तो बिहार वित्त नियमावली, 1950 के सुसंगत नियम लागू होंगे ।
(च) सरकारी क्रेता, आपूर्त्ति आदेश/क्रयादेश निर्गत करने के पूर्व, GeM पर उपलब्ध Business Analytics (BA) तकनीक का प्रयोग करते हुए, GeM Portal पर अंतिम रूप में अंकित क्रय राशि जिसमें विभाग द्वारा पूर्व में क्रय की गई राशि शामिल हो, के द्वारा उचित मूल्य सुनिश्चित कर सकेंगे ।
(छ) कुल मांगों के आकलित मूल्य के संद्धर्भ में, GeM Portal पर L-1 खरीद/ online bidding/online reverse auction अथवा आवश्यक उच्चतर पदाधिकारियों की स्वीकृति प्राप्त करने की अनिवार्यता से बचने हेतु वस्तुओं की मांग को छोटे टुकड़ों में क्रय के लिए विभाजित नहीं किया जायेगा ।
(ज) उपर्युक्त खंड-(क) से (छ) के अनुसार GeM Portal से सामग्रियों के क्रय अथवा सेवा अधिप्राप्ति हेतु प्रक्रिया राज्य में उस तिथि से लागू होगी, जो वित्त विभाग द्वारा इस हेतु अधिसूचित की जाय और विभिन्न स्तर के कार्यालयों हेतु विभिन्न तिथियाँ नियत की जा सकेगी ।
(झ) आपवादिक परिस्थितियों में, यथा-अतिविशिष्ट व्यक्तियों का राज्य में परिभ्रमण अथवा प्राकृतिक आपदा यथा-बाढ़, भूकंप आदि की स्थिति में जहां सामग्रियों/सेवाओं की अधिप्राप्ति तुरंत आवश्यक हो वहाँ सक्षम प्राधिकार यथा-राज्य स्तर पर प्रधान सचिव/सचिव एवं जिला स्तर पर संबंधित जिला पदाधिकारी की मंजूरी प्राप्त कर GeM Portal से बाहर भी खरीददारी की जा सकेगी ।
() Online Portal Government e-Market Place (GeM) से सामग्रियों/सेवाओं की अधिप्राप्ति के लिए वित्त विभाग अनुषांगिक कार्रवाई हेतु आवश्यक मार्गदर्शन निर्गत कर सकेगा ।''

No. M-4-48/2012(Part-I) 9230/F — In exercise of the powers conferred under Article 283(2) of the Indian Constitution, the Governor of Bihar is pleased to make the following Rules to amend the Bihar Financial Rules, 1950 (as amended from time to time):-
1. Short title, extent and commencement.- (1) These may be called The Bihar Financial (Amendment) Rule, 2017.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Subrule (xx) of the Bihar Finanacial Rules, 1950 (as amended from time to time) shall be substituted by the following:-
"(xx) All the departments would be required to compulsarily procure Goods/Services available on the GeM Portal as per their requirement. The Procurement of Goods/Services through the GeM Portal would be made in the following manner:-
3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 27 नव(cid:19)बर 2(cid:21)1(cid:23)(a) Up to `50,000/- through any of the available suppliers on the GeM, meeting the requisite quality, specification and delivery period.
(b) Above `50,000/- and up to `30,00,000/- through the GeM Seller having lowest price amongst the available sellers, of at least three different sellers, of at least three different manufactures, on GeM, meeting the requisite quality, specification and delivery period. The tools for online bidding and online reverse auction available on GeM can be used by the buyer if decided by the competent authority.
(c) Above `30,00,000/- through the supplier having lowest price meeting the requisite quality, specification and delivery period after mandatorily obtaining bids, using online bidding or reverse auction tool provided on GeM.
(d) The invitation for the online e-bidding/reverse auction will be available to all the existing Sellers or the other Sellers registered on the Portal and who have offered their goods/services under the particular product/service category, as per terms and conditions of GeM.
(e) The above mentioned monetary ceiling is applicable only for purchases made through GeM. For purchases, if any, outside GeM, relevant rules of the Bihar Financial Rules, 1950 shall apply.
(f) The Government Buyers may ascertain the reasonableness of prices before placement of order using the Business Analytics (BA) tools available on GeM including the Last Purchase Price on GeM, Department's own Last Purchase Price etc.
(g) A demand for goods shall not be divided into small quanitities to make piecemeal purchases to avoid procurement through L-1 Buying/bidding/reverse auction on GeM or the necessity of obtaining the sanction of higher authorities required with reference to the estimated value of the total demand.
(h) The procedures of Procurement of goods and services through GeM Portal as above clauses (a) to (g) would be effective from such date as would be notified by the Department of Finance and different dates may be fixed for different level of offices.
(i) In exceptional circumstances such as State visit of very important persons or at the time of nature calamities such as flood, earthquake etc. when it is essential to procure the goods/services immediately the purchase can be made outside the GeM Portal after getting the sanction of the competent authority i.e. the Principal Secretary/Secretary at the State level and the District Magistrate at the District level.
(j) The Finance Department may issue required guidelines for incidental action for procurement of goods/services through online portal Government e-Market Place (GeM).
