सं0 16/एम.1-03/2008-1282(आ0चि0)—भारत के संविधान के अनुच्छेद 309 परन्तुक में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल "बिहार जिला आयुष चिकित्सा/ राज्य आयुष चिकित्सा सेवा (नियमित/अनुबंध के आधार पर नियुक्ति एवं सेवाषर्त्त) नियामवली 2010" का संशोधन करने हेतु निम्नलिखित नियमावली बनाते है : -
1. संक्षिप्त नाम एवं प्रारम्भ ।- (1) यह नियमावली "बिहार जिला आयुष चिकित्सा/राज्य आयुष चिकित्सा सेवा (नियमित/अनुबंध के आधार पर नियुक्ति एवं सेवाषर्त्त) (संषोधन) नियमावली, 2017" कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह अधिसूचित होने की तिथि से प्रवृत्त होगी।
2. नियम-4 का खंड ङ को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
(i) भर्ती ।- इस सेवा में नियुक्ति मूल कोटि में आयुष (आयुर्वेद, यूनानी एवं होमियोपैथी) चिकित्सा पदाधिकारी के पद पर, सीधी भर्ती से, आयोग की अनुशंसा के आधार पर की जाएगी। नियमित नियुक्ति में विलम्ब होने की दशा में, आवश्यकतानुसार लोकहित में, सरकार द्वारा संविदा के आधार पर सीमित अवधि के लिए नियुक्ति की जा सकेगी। संविदा के आधार पर नियुक्ति, सामान्य प्रशासन विभाग द्वारा विनिश्चित मापदंड के अनुसार की जायेगी।
(ii) अर्हताएँ ।- (1) इस सेवा में नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता आयुर्वेद, यूनानी एवं होमियोपैथी चिकित्सा पद्धति क्रमशः बी0ए0एम0एस0/बी0यू0एम0एस0/बी0एच0एम0एस0 की डिग्री होगी, जो विधि द्वारा स्थापित विश्वविद्यालय से निर्गत एवं सी0सी0आई0एम0/सी0सी0एच0 के द्वितीय अनुसूची में सम्मिलित हो : परन्तु आयुष (आयुर्वेद, यूनानी एवं होमियोपैथी) चिकित्सा विज्ञान के किसी विषय में स्नातकोत्तर अथवा उच्चतर उपाधि धारकों एवं बिहार के किसी सरकारी अस्पताल में नियमित/अनुबंध के आधार पर नियुक्त चिकित्सकों को कार्यानुभव के लिए अधिमानता दी जा सकेगी।
(2) अभ्यर्थी को राज्य सरकार द्वारा विधि द्वारा स्थापित संबंधित विधा के बोर्ड/परिषद से स्थायी निबंधन प्राप्त होना आवश्यक होगा।
(3) नियुक्ति के लिए आयु सीमा वही होगी, जो सरकार द्वारा, समय-समय पर, अवधारित की जाय।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 2(cid:18) नव(cid:21)बर 2(cid:22)1(cid:24) परन्तु अनुबंध के आधार पर नियुक्ति चिकित्सक अभ्यर्थियों को, अधिकतम आयु सीमा, में छूट देने की शक्ति प्रशासी विभाग में निहित होगी।
(iii) भर्ती की प्रक्रिया ।- (1) विभाग, वर्ष की 1ली अप्रैल की स्थिति के आधार पर रिक्तियों की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा।
(2) आयोग, विभाग से सीधी भर्ती द्वारा भरी जानेवाली रिक्तियों की सूचना एवं भर्ती की अधियाचना प्राप्त होने पर, सीधी भर्ती से भरी जानेवाली रिक्तियों की संख्या ऐसी रीति से विज्ञापित करेगा जैसा वह उचित समझे और पात्र उम्मीदवारों से आवेदन आमंत्रित करेगा तथा मेधासूची निम्नलिखित आधार पर तैयार करेगा :-

स्पष्टीकरण :-
(क) बी0ए0एम0एस0/बी0यू0एम0एस0/बी0एच0एम0एस0 परीक्षा के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50X0.5=25 अंक दिये जायेंगे।
(ख) नियुक्ति हेतु विचारण के लिए न्यूनतम अर्हतांक 40 होगा।
(3) साक्षात्कार की प्रक्रिया का अवधारण आयोग के द्वारा किया जायेगा। (4) आयोग, मेधासूची तैयार करने के पश्चात, अंतिम अनुशंसा विभाग को भेजेगा। विभाग के स्तर पर भी प्रमाण पत्र एवं स्वास्थ्य की जाँच के पश्चात अनुशंसित अभ्यर्थियों के पूर्ववृत का सत्यापन करा लिया जायेगा।
(5) आयोग आरक्षण कोटिवार मेधासूची तैयार कर याचित अधियाचना के विरूद्ध अपनी अनुशंसा विभाग को उपलब्ध करायेगा।
3. उक्त नियमावली 2010 का नियम-8 एतद्द्वारा विलोपित किया जाता है। 4. उक्त नियमावली 2010 के नियम-9 के खंड (ख) का उपखंड (iv) एवं (v) निम्नलिखित द्वारा क्रमशः प्रतिस्थापित किये जाएगे :- (iv) निदेशक आयुर्वेद, निदेशक होमियोपैथिक एवं निदेशक यूनानी/क्षेत्रीय निदेशक (आयुर्वेद/ होमियोपैथिक/यूनानी)
(v) महानिदेशक आयुष (भारतीय वन सेवा के पदाधिकारी के लिए कर्णांकित पद)।

No. 16/M1-03/2008–1282(Aa.Chi.)—In exercise of powers conferred by Proviso to Article 309 of the Constitution of India, the Governor of Bihar, is hereby pleased to make the following rules to amend "Bihar District Ayush Medical/ State Ayush Medical Service(Appointment on Regular/Contract basis and Service Conditions) Rules 2010" :-
1. Short title, extent and commencement.—(1) These Rules may be called as the" Bihar District Ayush Medical/ State Ayush Medical Service (Appointment on Regular/Contract basis and Service Conditions) (Amendment) Rules 2017". (2) It shall extend to the whole of the state of Bihar. (3) It shall come into force from the date of issue of the notification.
2. Substitution of clause (e) of Rule (4) Chapter-2 of the said Rules 2010 shall be
substituted by the following :-
(i) Recruitment.—In this service, appointment will be made to the post of the Ayush Medical officer (Ayurvedic, Unani and Homeopathy), on the basis of the commission by direct recruitment. In case delay in regular appointment, the contractual appointment may be made by the government in the public interest as per necessity for the limited period. Contractual appointment will be made according to the criteria determined by the General Administration.
(ii) Qualifications.— (1) The minimum educational qualification for this service will be the degree of B.A.M.S./B.U.M.S./B.H.M.S. in Ayurved, Unani and Homeopathy method respectively recognized by the University established under the law and included in the second schedule of C.C.I.M. / C.C.H. :
Provided that preference may be given to those post graduate degree or higher degree holders in any stream of AYUSH(Ayurved, Unani and Homeopathy) and on the basis of work experience to the doctors appointed in the Government Hospitals of Bihar on regular/contractual basis. (2) It will be compulsory for the candidates to obtain permanent registration from the Board / Council of their concerned faculty established under the law by the State Government.
(3) Age limit for appointment will be the same which may be determined by the government from time to time:
Provided that the power to give exemption in maximum age-limit to the Doctor candidates will be vested in the administrative department. (iii) Selection Procedure .— (1) Department, after calculating the vacancy on the basis of position as on 1st April of the year and after roster clearance, will send the category-wise requisition to the Bihar Public Service Commission till April 30.
(2) On receiving requisition from the Department, the Commission will advertise the number vacancies to be filled up by direct recruitment in such a manner as it deem fit and proper and will also invite applications from eligible candidates and prepare a merit- list on the following basis:-

Explanation: -
(a) The determination of the marks to be given to the candidates for B.A.M.S./B.U.M.S./B.H.M.S. examination shall be in multiple of 0.5 of total percent of marks obtained in the examination of the said course. Thus, if a candidate has obtained 50% marks, he/she shall get 50x0.5=25.
(b) Minimum qualifying marks will be 40 for consideration for the appointment.
(3) The interview process will be determined by the Commission. (4) After preparing the category-wise merit-list, the Commission will send the final recommendation to the department. Verification of and antecident of the candidates after Medical test certificates, will be made at the level of the department.
(5) The Commission will provide category-wise merit-list to the Department against the requested requisition.
3. Rule 8 of the said Rules, 2010 is hereby deleted. 4. Sub clause (iv) and (v) of clause (b) of Rule 9 of the said Rules 2010 shall be substituted by the following respectively :-
(iv) Director Ayurveda, Director, Homeopathic and Director, Unani/Regional Director (Ayurveda, Homeopathic and Unani).
(V) Director General, AYUSH (Earmarked for the officer of the Indian Forest Service).
