बिहार भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार (संशोधन) नियमावली, 2018
सं0 14/डी0एल0ए0-भू-अर्जन एवं पुनर्वास (नीति-14)-32/2014 (खण्ड-1)114/रा0—केन्द्रीय भू-अर्जन, पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार अधिनियम, 2013 की धारा 109 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्द्वारा बिहार भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार नियमावली, 2014 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैः- 1. संक्षिप्त नाम, विस्तार और प्रारंभ।-(1) यह नियमावली बिहार भूमि अर्जन, पुनर्वास और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार (संशोधन) नियमावली, 2018 कही जा सकेगी;
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा; (3) यह तुरन्त प्रवृत्त होगी।
2. उक्त नियमावली, 2014 के नियम 4 में संशोधनः-
(1) उक्त नियमावली, 2014 के नियम 4 का उपनियम (2) एवं (3) एतद द्वारा विलोपित किये जाते है।
(2) उक्त नियमावली, 2014 के नियम 4 के उपनियम (6) में निम्नलिखित परन्तुक जोड़ा जाएगाः-
''परन्तुक किसी जिले में उपलब्ध आकस्मिकता व्यय की राशि को प्रधान सचिव, राजस्व एवं भूमि सुधार विभाग का अनुमोदन प्राप्त कर निदेशक, भू-अर्जन, बिहार आवश्यकतानुसार अन्य जिला भू-अर्जन कार्यालयों तथा भू-अर्जन निदेशालय, बिहार, पटना को उप आवंटित कर सकेंगे।''
(3) उक्त नियमावली, 2014 के नियम 4 के उपनियम (8) के बाद निम्नलिखित नया उपनियम (9) में जोडा जाएगा।2 ॢबह(cid:4)र गजट (cid:23)[स(cid:4)ध(cid:4)रण(cid:25)(cid:30) 6 फरवर' 2(cid:24)1" ''(9) परियोजनाओं हेतु भू-अर्जन/अधिग्रहण के विषय में प्रस्ताववार/मौजावार स्थापना मद एवं आकस्मिकता व्यय की राशि निम्नलिखित रूप में विनिनिश्चत की जायगी :-

| 1 | प्रतिकर की राशि ` 100.00 करोड़ तक | 10 प्रतिशत् | 1 प्रतिशत् अथवा ` 10.00 लाख, जो भी उच्चतर हो। |
| 2 | प्रतिकर की राशि ` 100.00 करोड़ से अधिक तथा 200.00 करोड़ तक | 7 प्रतिशत् | 1 प्रतिशत् अथवा ` 10.00 लाख, जो भी उच्चतर हो। |
| 3 | प्रतिकर की राशि ` 200.00 करोड़ से अधिक तक | 5 प्रतिशत् | 1 प्रतिशत् अथवा ` 10.00 लाख, जो भी उच्चतर हो। |
यह प्रावधान वैसे मामलों में प्रभावी नहीं होगा, जिनमें सक्षम प्राधिकार के स्तर से प्राक्कलन/पंचाट की स्वीकृति की कार्रवाई की जा चुकी है।

The Bihar Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Amendment) Rules, 2018.

In exercise of the powers conferred under section 109 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, the Governor of the State of Bihar is hereby pleased to make the following Rules to amend the Bihar Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Rule, 2014:-
1. Short title, extent and commencement.—(1) These rules may be called the Bihar Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Amendment) Rules, 2018.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.
2. Amendment in Rule 4 of the said Rule, 2014:-
(1) The sub-rule (2) and (3) of Rule 4 of the said Rules, 2014 are hereby
deleted.
(2.) The following proviso will be added in sub rule 4(6) of Rule 4 of
mention Rule 2014:-
"Proviso" the Director, Land Acquisition, Bihar will re-allocate, as per need, the amount of contingency charges available in a district to another District Land Acquisition Offices and Directorate of Land Acquisition, Bihar, Patna with the approval of the Principal Secretary, Revenue and Land Reforms Department.
(3) The following new sub-rule (9) will be added after sub rule (8) of rule
4 of the said Rules, 2014:-
"(9) The Amount of Establishment levies and Contingency expenditure in the matters of land acquisition/acquisition for projects, will be determined proposal-wise/village-wise in the following manners:-

| 2 | Compensation amount more than ` 100.00 crore & up to ` 200.00 crore | 7 percent | 01 percent or ` 10.00 lakh, whichever is higher. |
| 3 | Compensation amount above ` 200.00 crore | 5 percent | 01 percent or ` 10.00 lakh, whichever is higher. |
This provision would not be effective in such cases in which estimate/award has been sanctioned at the level of competent authority.
