No.5/Astha (Vividh) Ksh.-8-58/2014-10253(S)—In exercise of the powers conferred under proviso to Article-309 of the Constitution on India, The Governor of Bihar is pleased to make the following Rules for field offices (circle) to regulate the appointment and service conditions of Amin under the Road Construction Department of State of Bihar :-

1. Short title, extent and commencement.—(1) These Rules may be called the "Bihar Road Construction Department Amin Cadre (Field Establishment) (Recruitment and Service Conditions) Rules, 2017". (2) It shall extend to whole of the State of Bihar, (3) It shall come into force with immediate effect.

2. Definitions.—In these Rules, unless anything is not repugnant to the subject or the context (i) "State Government" means the Government of Bihar; (ii) "Cadre" means Amin of Road Construction Department (Field Establishment); (iii) "Appointing Authority" means the Superintending Engineer of concerned Circle ; (iv) "Cadre Controlling Authority" means Engineer-in chief cum Additional

Commissioner cum Special Secretary of Road Construction Department ;

(v) "Department" means the Road Construction Department; (vi) "Commission" means the Bihar Staff Selection Commission; (vii) "Year" means financial year, the period from 1st April to 31 March;

3. Constitution of Cadre.— (1) There shall be posts of Amin in this cadre which shall be of circle level under Road Construction Department and appointing/controlling authority of which shall be concerned Superintending Engineer of Road Constructions Department. (2) Persons already regularly appointed and working in the said category prior to application of these rules shall automatically be deemed to be included in this service.

4. Age Limit.—The minimum age of the candidate for the post of Amin shall not be less than 18 years as on 1st August of the year in which applications would be invited. The maximum age-limit shall be the same as may fixed, from time to time, by the Department of General Administration of the State Government.

5. Reservation.—The provisions of reservation/roaster determined by the State Government from time to time, shall be applicable to the appointment in this cadre.

6. Appointment.— (1) Direct appointment to the post of Amin will be made on the basis of recommendation received as per the result declared by the Commission by adding marks obtained in Competitive Examination held for the posts of Amin and the marks determined for the experience.

ॢबह(cid:4)र गजट (cid:24)[स(cid:4)ध(cid:4)रण(cid:26)(cid:31) 15 फरवर) 2(cid:25)1# (2)(a) For appointment to the post of Amin, the candidate must have passed the intermediate (10+2) or equivalent examination from any recognized board/ equivalent institution.

(b) Marks will be given to the experienced Amin under the State government on the basis of their experience, The maximum marks for experience will be 25 and 5 marks for experience for each year will be given.

Provided that calculation of experience will be made according the calendar year and more than six months experience will be treated one year and Less than six months experience will be treated zero year.

7. Syllabus for the Written Competitive Examination.— Competitive Examination of 75 marks shall be held by the Commission for the appointment to the post of Amin. There shall be one question paper consisting following three parts:-

(i) Part-1 General knowledge, current affairs, general science and general Hindi-25 marks. (ii) Part-2 General math-25 marks. (iii) Part-3 Question related with Amanat-25 marks.

8. Probation Period.— (1) Every Amin to be appointed against the basic vacant post shall remain on probation for the period of two years from the date of joining.

(2) If the conduct and service of Amin is not found satisfactory after the completion of probation period, the probation period may be extended by the Appointing Authority for further period of one year. If it appears that there is possibility of improvement in the conduct and service. If the conduct and service is not found unsatisfactory even during the extended period, his service may be terminated.

9. Training.— On the basis of decision taken by the Government, it shall be necessary for the Amin to obtain training, from time to time. If any examination is fixed at the end of training it would be compulsory to pass in it.

10. Department Examination and Syllabus.—The Government may fix departmental examination and syllabus, from time to time.

11. Confirmation.— The Amin appointed on probation shall be eligible for confirmation in the service on expiry of the probation period subject to the following conditions-

(i) If the Government has prescribed any Departmental Examination, he must have passed the said examination.

(ii) He has received training to be prescribed, from time to time, and passed the examination, if any, at the end of training.

(iii) His conduct and his service have been found satisfactory during this period. (iv) Passed in Hindi Noting/Drafting Examination/Computer Eligibility Test Examination.

12. Pay-scale.— The pay scale of newly appointed Amin shall be the same as may be fixed by the Government, from time to time.

13. Seniority.—The seniority of the members of this cadre shall be according to merit order of the merit list received from the Commission and it may be determined by following the principle and procedure determined by the General Administration Department of the State Government, from time to time and maintained by the appointing authority.

14. Miscellaneous.— Control of works related to Establishment.- (1) All works related to appointment of the members of this cadre and establishment shall be under the administrative control of the concerned Superintending Engineer, Road Circle of the Road Construction Department. (2) The appointment, posting, transfer, confirmation of service, maintenance of seniority list of members of this cadre and all matters related to establishment shall be under the control of concerned Superintending Engineer as the case may be.

15. Repeal & Saving.— (1) There is no previous cadre Rules maintained for the post of Amin in the Department. Previous circulars relating to appointment issued by the Department are hereby repealed.

(2) Notwithstanding such repeal, appointment made under the earlier Government circulars shall remain valid as if those are issued under the provisions of these rules.
