सं0 3/स्था. 1-03/2014-01— भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल ''बिहार अधीनस्थ खेल एवं युवा संवर्ग'' में भर्त्ती एवं सेवा शर्त्ताें को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

बिहार अधीनस्थ खेल एवं युवा संवर्ग नियमावली-2018

अध्याय-1

प्रारम्भिक

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ - (1) यह नियमावली ''बिहार अधीनस्थ खेल एवं युवा संवर्ग नियमावली (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2018'' कही जा सकेगी।

(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगा। 2. परिभाषाएँ-जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में- (i) राज्य सरकार से अभिप्रेत है बिहार सरकार (कला, संस्कृति एवं युवा विभाग); (ii) नियुक्ति प्राधिकार से अभिप्रेत है, नियंत्री विभाग के प्रधान सचिव/सचिव; (iii) नियंत्री विभाग से अभिप्रेत है कला, संस्कृति एवं युवा विभाग; (iv) सदस्य से अभिप्रेत है ''बिहार अधीनस्थ खेल एवं युवा संवर्ग''में नियुक्त व्यक्ति; (v) संवर्ग से अभिप्रेत है ''बिहार अधीनस्थ खेल एवं युवा संवर्ग''; (vi) आयोग से अभिप्रेत है ''बिहार कर्मचारी चयन आयोग''।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 1(cid:18) फरवर(cid:21) 2(cid:23)1(cid:24) 3. संवर्ग की संरचना - (1) यह संवर्ग कला, संस्कृति एवं युवा विभाग के प्रशासनिक नियंत्रणाधीन में बिहार खेल एवं युवा सेवा के अधीनस्थ संवर्ग होगी।

(2) इस संवर्ग में क्रीड़ा प्रशिक्षक (विभिन्न खेल अनुसार) का पद होगा। क्रीड़ा प्रशिक्षक के पदों की संख्या तथा वेतनमान का अवधारण बिहार सरकार/वित्त विभाग द्वारा समय-समय पर किया जायेगा।

(3) इस नियमावली के प्रवृत्त होने की तिथि को क्रीड़ा प्रशिक्षकों के पदों पर पूर्व से नियुक्त एवं कार्यरत पदाधिकारी स्वतः इस संवर्ग के सदस्य समझे जायेंगे।

अध्याय-2

भर्त्ती

4. अहर्ताएँ- (1) उम्मीदवार की न्यूनतम शैक्षणिक योग्यता किसी भी विषय में स्नातक उत्तीर्ण होगी। (2) उम्मीदवार को युवा कार्यक्रम एवं खेल मंत्रालय, भारत सरकार के अधीनस्थ भारतीय खेल प्राधिकरण द्वारा संचालित राष्ट्रीय क्रीड़ा संस्थान से संबंधित खेल विधा में डिप्लोमा इन कोचिंग अथवा लक्ष्मीबाई राष्ट्रीय शारीरिक शिक्षण संस्थान, ग्वालियर से डिप्लोमा इन कोचिंग में स्नातकोत्तर पाठ्‌यक्रम उर्त्तीण होना चाहिए।

(3) उम्मीदवार की न्यूनतम आयु 21 वर्ष और अधिकतम आयु वही होगी जैसा कि राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित किया जायेगा।

5. आरक्षण :- संवर्ग में नियुक्ति एवं प्रोन्नति के लिए राज्य सरकार द्वारा समय समय पर विहित आरक्षण के प्रावधान लागू होंगे।

6. रिक्तियों का विज्ञापन अनिवार्य रूप से किया जाना - (1) इस संवर्ग में नियुक्ति हेतु उपलब्ध रिक्तियों के विरूद्ध विज्ञापन के द्वारा, आवेदन अनिवार्य रूप से आमंत्रित किए जाएँगें।

(2) प्रशासी विभाग प्रत्येक वर्ष अप्रैल माह में इस संवर्ग में सीधी नियुक्ति द्वारा भरी जाने वाली रिक्तियों की संख्या निर्धारित करेगा तथा इस प्रकार निर्धारित रिक्तियों की सूचना बिहार कर्मचारी चयन आयोग को देगा, परन्तु यदि किसी वर्ष में अधियाचना देने या सीधी नियुक्ति द्वारा पद भरने की कार्रवाई नहीं की जाती है, तब भी सीधी नियुक्ति द्वारा भरे जाने वाले पदों की गणना वर्षवार की जायेगी और उसे अगले वर्ष के लिए पिछले वर्ष की रिक्ति मानते हुए अग्रणित किया जायेगा। 7. सीधी भर्ती का स्रोत - इस संवर्ग की मूल कोटि के शत-प्रतिशत पद सीधी भर्ती से भरे जायेंगे। 8. चयन का आधार-क्रीड़ा प्रशिक्षक (मूल कोटि) के पद, बिहार कर्मचारी चयन आयोग के द्वारा, विभाग की अधियाचना के आलोक में, परीक्षा/साक्षात्कार के माध्यम से भरे जायेंगे।

9. परीक्षा के विषय एवं पाठ्‌यक्रम-बिहार कर्मचारी चयन आयोग द्वारा संचालित की जानेवाली परीक्षा के विषय/साक्षात्कार एवं पाठ्‌यक्रम का अवधारण शैक्षणिक एवं तकनीकी योग्यतानुसार नियंत्री विभाग द्वारा आयोग के परामर्श से, किया जायेगा।

10. चिकित्सा परीक्षा-नियुक्ति के लिए चयनित प्रत्येक अभ्यर्थी को राज्य सरकार के द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा परीक्षा के लिए जाना होगा। पदीय कर्त्तव्यों को दक्षतापूर्वक निष्पादित करने की दृष्टि से, जो अभ्यर्थी अपनी अपेक्षित शारीरिक दक्षता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में असफल होगा, उसे नियुक्त नहीं किया जायेगा। प्रशासी विभाग स्वयं इस प्रयोजनार्थ वस्तुनिष्ठ मानदण्ड अवधारित करेगा।

11. आयोग द्वारा अभ्यर्थियों की अनुशंसा-बिहार कर्मचारी चयन आयोग, लिखित परीक्षा/साक्षात्कार में प्राप्त अंको के आधार पर एक मेधा सूची तैयार करेगा। तैयार की गयी ऐसी सूची में से आयोग अभ्यर्थियों की उतनी संख्या की अनुशंसा राज्य सरकार को करेगा, जितनी संख्या में रिक्तियाँ आयोग को प्रतिवेदित की गयी हों। 12. परीक्ष्यमान अवधि एवं सम्पुष्टि - (1) मौलिक पद पर नियुक्त प्रत्येक क्रीड़ा प्रशिक्षक, पदग्रहण की तिथि से दो वर्षाें की अवधि तक परिवीक्षा पर रहेंगे। संतोषजनक प्रशिक्षण कार्य नहीं रहने पर अभिलिखित किये जाने वाले कारणों से परिवीक्षा अवधि अधिकतम एक वर्ष के लिए नियुक्ति प्राधिकार द्वारा बढ़ायी जा सकेगी।

(2) सरकार परिवीक्षा अवधि के दौरान या उसकी समाप्ति पर इस संवर्ग में भर्त्ती किये गये ऐसे किसी क्रीड़ा प्रशिक्षक की नियुक्ति समाप्त कर सकती है, यदि उक्त क्रीड़ा प्रशिक्षक अन्य कारणों से इस संवर्ग में नियुक्ति के योग्य न हो।

(3) समय-समय पर सरकार द्वारा अधिसूचित प्रशिक्षण हेतु प्रशिक्षु को विहित अनिवार्य प्रशिक्षण प्राप्त करना होगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 1(cid:18) फरवर(cid:21) 2(cid:23)1(cid:24) (4) सम्पुष्टि, वार्षिक वेतन वृद्धि एवं प्रोन्नति, परिवीक्षा अवधि में विहित प्रशिक्षण पूरा करने एवं समय-समय पर राज्य सरकार द्वारा निर्धारित मानदण्डों के आधार पर परीक्षाओं में उर्त्तीण होने के पश्चात्‌ ही देय होगा।

13. प्रोन्नति - (1) बिहार अधीनस्थ खेल एवं युवा संवर्ग के क्रीड़ा प्रशिक्षकों को बिहार खेल एवं युवा संवर्ग के मूल कोटि के 25% पदों पर प्रोन्नति दी जायेगी। प्रोन्नति हेतु विभागीय प्रोन्नति समिति की अनुशंसा पर विचार किया जा सकेगा। विभागीय प्रोन्नति समिति अलग से सामान्य प्रशासन विभाग द्वारा, समय-समय पर, निर्गत संकल्पों/अनुदेशों का ध्यान रखते हुए गठित की जायेगी।

(2) कालावधि -मूल कोटि से उच्चतर कोटि/कोटियों में प्रोन्नति के प्रयोजनार्थ, सामान्य प्रशासन विभाग द्वारा कालावधि निर्धारण के संबंध में समय-समय पर निर्गत निदेशों का अनुपालन आवश्यक होगा।

(3) वरीयता-मूल कोटि में नियुक्त क्रीड़ा प्रशिक्षकों की आपसी वरीयता का अवधारण आयोग द्वारा तैयार की गयी मेधा सूची के आधार पर किया जायेगा।

सामान्य

14. पद-स्थापना- (1) सरकार द्वारा इस संवर्ग के सदस्यों को बिहार राज्य के अंदर किसी भी स्थान पर, पदस्थापित किया जा सकेगा।

(2) संवर्ग के किसी भी सदस्य को किसी गैर-संवर्गीय पद पर, जो उसकी योग्यता के अनुरूप हो, पदस्थापित या प्रतिनियुक्त कर सकेगी।

15. प्रशिक्षण-इस संवर्ग के सदस्य को खेल के उच्च स्तरीय तकनीकी प्रशिक्षण अथवा आयोजन अनुभव के लिए राज्य में अथवा राज्य से बाहर, राज्य सरकार द्वारा निर्धारित अवधि के लिए भेजा जा सकेगा। प्रशिक्षण की समाप्ति पर किये गये मूल्यांकन को विभागीय प्रोन्नति समिति ध्यान में रखेगी।

16. अन्य संवर्ग संबंधी शर्त्तें-इस संवर्ग के लिए अन्य शर्तें यथा अनुशासनात्मक कार्रवाई, अवकाश, देय सेवा निवृति लाभ इत्यादि, जो इस नियमावली में विहित नहीं है, राज्य सरकार के समकक्ष स्तर के कर्मियों के लिए किये गये संबंधित प्रावधानों से नियंत्रित होगा।

17. कला, संस्कृति एवं युवा विभाग के अधीन छात्र एवं युवा कल्याण निदेशालय में पूर्व से नियुक्त क्रीड़ा प्रशिक्षक के पद पर कार्यरत व्यक्ति इस नियमावली के प्रवृत्त होने की तिथि से इस संवर्ग में परिगणित होंगे। 18. निरसन एवं व्यावृति- (1) सभी संबंधित एवं प्रासंगिक नियमावली/संकल्प/आदेश/परिपत्र/निर्णय/ अनुदेश एतद्‌ द्वारा निरसित किये जाते है।

(2) ऐसे निरसन के होते हुए भी, उक्त नियमावली/संकल्प/आदेश/परिपत्र/ अनुदेश आदि के अधीन किया गया कोई कार्य अथवा लिया गया कोई निर्णय इस नियमावली के अधीन किया गया या लिया गया समझा जायेगा, मानो यह नियमावली उस तिथि को प्रवृत्त थी, जिस तिथि को ऐसा कोई कार्य किया गया था अथवा निर्णय लिया गया था।

19. प्रस्ताव में मंत्रिपरिषद्‌ की बैठक दिनांक 06.02.2018 के मद संख्या-11 के रूप में स्वीकृति प्राप्त है।

No-3/स्था. 1-03/2014-01—In exercising the powers conferred under the provide to article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the recruitment and service conditions of the Bihar Subordinate Sports and Youth cadre :-

Bihar Subordinate Sports and Youth Cadre Rules-2018

Chapter-1

Primary

1. Short title, extent and commencement— (1) This rule shall be called Bihar Subordinate Sports and Youth Cadre Rule (Recruitment and Service conditions), 2018.

(2) It shall extend to the whole State of Bihar. (3) It shall come into force at once.

2. Definitions—In these rules, unless otherwise requires in the subject or context - (i) The "State Government" means State of Bihar; (ii) "Appointing Authority" means the Principal Secretary/Secretary of the Controlling Department;

(iii) "Controlling Department" means Department of Art, Culture and Youth; (iv) "Member" means the person appointed in the Bihar Subordinate Sports and Youth Cadre;

(v) "Cadre" means the Bihar Subordinate Sports and Youth Cadre; (vi) "Commission" means Bihar Staff Selection Commission. 3. The Structure of the Cadre— (1) This Cadre shall be Subordinate of the Bihar Sports and Youth Service under the administrative control of the Department of Art, Culture and Youth.

(2) The post of the Sports Coach (in different sports) will be in this cadre. The number and pay scale of the Sports Coach shall be determined by the Government of Bihar (Finance Department) from time to time.

(3) On the date of coming into force of these Rules, officers already appointed and working on the post of Sports Coach automatically shall be deemed to be members of this

Chapter – 2

Recruitment

4. Qualifications — (1) Minimum educational qualification of the candidate shall be the degree of graduate in any subject.

(2) The candidate should be passed in Diploma in Coaching from any of the National Sports Institutions conducted by the Sports Authority of India under the Ministry of Youth Affairs and Sports, Govt. of India or have passed in Post Graduate Diploma in coaching syllabus from Lakshmibai National University of Physical Education, Gwalior.

(3) The minimum age of the candidate shall be 21 years and the maximum age shall be the same as may be determined by the State Government (General Administration Department from time to time).

5. Reservation— Provisions of reservation prescribed by the state government, from time to time, shall be applicable for the recruitment and promotion in the cadre.

6. Advertisement of Vacancies essentially advertised— (1) For appointment in this cadre applications shall be essentially invited, by advertisement, against the available vacancies.

(2) The administrative department shall calculate the number of vacancies to be filled by direct recruitment and shall inform these vacancies to the Bihar Staff Selection Commission in the month of April, every year, but if the action of requisition or filling of the posts by the direct recruitment is not made then the calculation of the posts to be filled up by direct recruitment shall be made on annual basis and will be carry forward of last year. Forward for next year treating the vacancies.

7. Source of the Direct Recruitment— Cent-percent post of basic category of this cadre shall be filled up by direct recruitment.

8. Grounds of Selection—The post of Sports Coaches (basic category) shall be filled up by the Bihar Staff Selection Commission through the examination/interview in light of the requisition of the Department.

9. Subject and Curriculum of the Examination—Subject interview and syllabus of the examination conducted by the Bihar Staff Selection Commission shall be determined by the controlling Department, in accordance with the academic and technical qualifications in consultation with the Commission.

10. Medical Test— Every candidates selected for the appointment shall have to undergo to the medical board constituted by the State Government for the medical test. Such candidates who would fail to satisfy the Medical board with respect to physical efficiency as to the requirement of the execution of his responsibilities for the post, shall not be appointed. The Department itself shall determine objective criterion for the purpose.

11. Recommendation of Candidates by the Commission—The Bihar Staff Selection Commission shall prepare a merit list on the basis of marks obtained in the Written Examination/Interview. Out of such prepared list, the Commission shall recommend such number of the candidates as the vacancies in number have been reported to the commission.

12. Period of Probation and Confirmation— (1) Each Sports Coach appointed to the basic post, shall be on probation for a period of two years from the date of his joining. Probation period may be extended maximum up for one year on being training work not satisfactory with reasons to be recorded in writing by the Appointing Authority.

(2) During the probation period or on its expiry the Government may terminate the appointment of Sports Coach, if the said Sports Coach, is fit for the appointment in this cadre due to other reasons.

(3) The trainee shall have prescribed essential training notified by the Government from time to time for training.

(4) Confirmation, annual pay increment and promotion shall be payable only after the completion of the prescribed training in the probation period and passing the examinations on the basis of criterion determined by the State Government from time to time.

13. Promotion— (1) 25% of the basic grade Sports Coaches of the Bihar Subordinate Sports and Youth Cadre shall be promoted to the 25% posts of the basic category of The Bihar Sports and Youth Cadre. The recommendation of the Departmental Promotion Committee for promotion shall be considered. The Departmental Promotion Committee shall be constituted separately in view of the resolutions/instructions issued by the General Administration Department.

(2) Kalawadhi—For the promotion from basic category to higher category/categories, it will be compulsory to follow the directions issued by the Department of General Administration, from time to time, with regard to the determination of Kalawadhi.

(3) Seniority—Determination of inter seniority of the sports coaches appointed in the basic category shall be made as per the merit list prepared by the Commission.

General

14. Posting— (1) The members of this cadre may be posted anywhere within the State of Bihar by the Government.

(2) The state Government may post or depute any member of this cadre to any non - 15. Training—The members of this cadre may be sent for high level technical training or holding experience of sports within the State or outside for the period determined by the State Government. The Departmental Promotion Committee will have regard to the appraisal made on expiry of the training.

16. Other conditions relating to the cadre—The other conditions relating to the cadre, such as disciplinary action, leave, retirement benefits etc. which are not prescribed in this Rules, shall be regulated as per the provisions specified for employees of the equivalent level of the State Government.

17. The persons already employed and working on the post of the Sports Coach in the Directorate of Student and Youth Welfare under the Department of Art, Culture and Youth, shall be counted in this cadre from the date, of coming into force of these Rules.

18. Repeal & Savings— (1) All concerned and relevant Rules/Resolutions/orders/circulars/decisions are hereby repealed.

(2) Not with standing such repeal, anything done or any action taken under the said Rules/Resolutions/orders/Circular/Decisions, instructions etc. shall be deemed to have been done or taken under the provisions of these rules as if these rules were in force on the day on which such thing or action was done or taken.

19. The proposal has been approved by the Council of Ministers' meeting held on dated 06- 02-2018 in the form of Head number-11.
