सं॰ 03/एम॰ 11/2017-3127/सा॰प्र॰,—भारत-संविधान के अनुच्छेद- 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, सरकारी सेवकों को विभागीय परीक्षा की उत्तीर्णता से विमुक्ति प्रदान करने हेतु निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम एवं प्रारम्भ।- (1) यह नियमावली ''बिहार सरकारी सेवक विभागीय परीक्षा की उत्तीर्णता से विमुक्ति नियमावली, 2018'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगा।

2 परिभाषाएँ।- जब तक कि संदर्भ में अन्यथा अपेक्षित न हो इस नियमावली में -

(i) "राज्य सरकार" से अभिप्रेत है बिहार सरकार, (ii) "सरकारी सेवक" से अभिप्रेत है, वह व्यक्ति जो स्थायी रूप से सृजित पद के विरूद्ध नियमित रूप से सरकारी सेवक के रूप में नियुक्त हो और जिसकी विभागीय परीक्षा की उत्तीर्णता से विमुक्ति पर इस नियमावली के प्रावधानों के अनुसार विचार किया जा रहा हो।

(iii) "नियुक्ति प्राधिकार" से अभिप्रेत है किसी सरकारी सेवक द्वारा धारित पद हेतु विहित नियुक्ति नियमावली/अथवा अन्य अनुदेश में घोषित नियुक्ति प्राधिकार;

(iv) "संवर्ग नियंत्री प्राधिकार" से अभिप्रेत है किसी सरकारी सेवक द्वारा धारित पद हेतु गठित सेवा/संवर्ग नियमावली में विहित नियुक्ति प्राधिकार;

(v) ''विभाग'' से अभिप्रेत है इस नियमावली के अधीन विचाराधीन सरकारी सेवक का पैतृक विभाग; (vi) "केन्द्रीय परीक्षा पर्षद" से अभिप्रेत है विभिन्न पदों पर नियुक्त सरकारी सेवकों के लिये विभागीय परीक्षा के संचालन एवं नियमन हेतु कार्मिक एवं प्रशासनिक सुधार विभाग की अधिसूचना संख्या 13559 दिनांक 10.10.1961 में विहित केन्द्रीय परीक्षा पर्षद;

(vii) "विहित परीक्षा" से अभिप्रेत है राज्य सरकार के अधीन कार्यरत सरकारी सेवक के लिये विहित ''हिन्दी टिप्पण/प्रारूपण परीक्षा'',''कम्प्यूटर परीक्षा'' अथवा "विभागीय परीक्षा";

(viii) "विभागीय परीक्षा" से अभिप्रेत है "राजपत्रित पदाधिकारियों के लिये विभागीय परीक्षा नियमावली, 1961" अथवा अन्य सेवा नियमावलियों में विहित विभागीय परीक्षा;

(ix) "हिन्दी टिप्पण/प्रारूपण परीक्षा" से अभिप्रेत है "बिहार सरकारी सेवक (हिन्दी परीक्षा) नियमावली, 1968" के तहत मंत्रिमंडल सचिवालय के अधीन राजभाषा निदेशालय द्वारा आयोजित हिन्दी टिप्पण/प्रारूपण परीक्षा;

(x) "कम्प्यूटर परीक्षा" से अभिप्रेत है "बिहार सरकारी सेवक (समुपष्टि के लिए कम्प्यूटर सक्षमता) नियमावली, 2011" के अधीन आयोजित कम्प्यूटर सक्षमता जाँच परीक्षा।

3 सरकारी सेवक की विहित परीक्षा में उत्तीर्णता से विमुक्ति पर संबंधित कर्मचारी द्वारा उसके लिए आवेदन समर्पित करने पर ही विचार किया जाएगा। विमुक्ति आदेश 50 वर्ष की आयु पूरी होने के उपरांत आवेदन की तिथि से प्रभावी होगा।

4 विमुक्ति उन्हीं सरकारी सेवकों को दी जा सकेगी, जिन्होने 50 वर्ष की आयु पूरी कर ली हो और जिन्होंने समय-समय पर आयोजित विहित परीक्षा में भाग लिया हो, और असफल रहे हों अथवा सरकारी कार्याें की अत्यावश्यकताओं के कारणों से विहित परीक्षा का आयोजन ही नहीं किया जा सका हो अथवा उनके 50 वर्ष की आयु पूरा करने के 5 (पाँच) वर्ष पूर्व की निर्धारित अवधि में कभी विभागीय परीक्षा आयोजित नहीं की गयी हो।

5 संबंधित सरकारी सेवक द्वारा धारित पद के कर्त्तव्य-पालन अथवा उसके कार्यक्षमता पर पड़ने वाले प्रतिकूल प्रभाव को ध्यान में रखते हुए विमुक्ति पर विचार किया जायेगा।

6 विमुक्ति के लिये आवेदन करने वाले संबंधित सरकारी सेवक के कार्य मूल्यांकन प्रतिवेदन/चरित्रपुस्त में प्रतिकूल अभ्युक्ति नहीं होनी चाहिये। उनकी सेवा/कार्य संतोषप्रद होना चाहिये। साथ ही उनके विरूद्ध कोई अनुषासनिक/न्यायिक कार्यवाही लंबित नहीं होना चाहिये।

7 किसी विहित परीक्षा में उर्त्तीणता से विमुक्ति पाने का अधिकार आज्ञापक नहीं होगा। किन्तु सक्षम प्राधिकार के लिये विमुक्ति हेतु दिये गये अभ्यावेदन को अस्वीकृत करने का कारण अभिलिखित करते हुए एक आदेश पारित करना अनिवार्य होगा।

8 विमुक्ति का आदेश संबंधित सरकारी सेवक द्वारा धारित पद के लिये विहित नियुक्ति प्राधिकार के अनुमोदन से निर्गत किया जा सकेगा।

9 विनियमावली बनाने की शक्ति।- इस नियमावली में विहित प्रावधानाें को क्रियान्वित करने के लिए राज्य सरकार द्वारा विनियमावली का गठन किया जा सकेगा।

10 शिथिलिकरण की शक्ति।- जहाँ सरकार की राय हो कि ऐसा करना आवश्यक या समीचीन है, वहाँ अभिलिखित किये जाने वाले कारणों से इस नियमावली के किन्हीं प्रावधानों को शिथिल किया जा सकेगा।

11. निर्वचन।- इस नियमावली के किसी उपबंध के निर्वचन के संबंध में शंका उत्पन्न होने पर विषय विभाग को निर्देशित किया जायेगा और इस संबंध में विधि विभाग के परामर्श के पश्चात्‌ विभाग द्वारा किया गया विनिश्चय अंतिम होगा।

12. निरसन एवं व्यावृाि।- (1) इस संबंध में कार्मिक एवं प्रशासनिक सुधार विभाग के परिपत्र संख्या 11691 दिनांक 09.11.1983, परिपत्र संख्या 4674 दिनांक 15.05.1992 एवं परिपत्र संख्या 4368 दिनांक 28.08.2009 तथा समय-समय पर पूर्व में निर्गत अन्य नियमावली/परिपत्र/आदेश आदि एतद्‌ द्वारा निरसित किए जाते हैं। (2) ऐसे निरसन के होते हुए भी, पूर्व में निर्गत नियमावली/परिपत्र/आदेश आदि के अधीन किया गया कोई कार्य या की गई कोई कार्रवाई, इस नियमावली के अधीन किया गया या की गई समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृा थी, जिस तिथि को ऐसा कोई कार्य किया या ऐसी कोई कार्रवाई की गई थी।

सं॰ 03/एम॰ 11/2017-3128/सा॰प्र॰, अधिसूचना सं॰ 3127 दिनांक 06.03.2018 सामान्य प्रशासन विभाग, बिहार, पटना की अधिसूचना संख्या-3135 दिनांक 06.03.2018 का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद्‌ द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन अँग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जायेगा।

No. 3/M-11/2017-3127/GAD— In exercise of the powers conferred under proviso to the Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate exemption of government servents from passing of The Departmental Examination –

1. Short title, extent and commencement.— (1) These Rules may be called the "Bihar Government Servent Exemption from Passing of Departmental Examination Rules, 2018."

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force immediately. 2. Definition.— In these Rules, unless otherwise requires in the context —

(i) "State Government" means the Government of Bihar; (ii) "Government Servant" means a person who is regularly appointed as government servant against permanent posts and whose exemption from passing of departmental examination is being considered as per the provisions of these rules;

(iii) "Appointing Authority" means appointing authority decleared in the appointment Rules/or other instructions prescribed for the post held by a government servant.

(iv) "Cadre Controlling Authority" means appointing authority prescribed in the service/cadre rules for the post held by a government servant.

(v) "Department" means the paternal department of the government servant under consideration under these rules;

(vi) "Central Examination Committee" means Central Examination Committee prescribed in notification number 13559 dated 10.10.1961 of Personnel and Administrative Reforms Department for conduct and regulation of The Departmental Examination for The Government Servant appointed against various posts.

(vii) "Prescribed Examination" means "Hindi Noting/Drafting Examination", "Computer Examination" or "Departmental Examination" prescribed for The Government Servant working under State Government.

(viii) "Departmental Examination" means The Departmental Examination for Gazetted officers prescribed in "Rules for the Departmental Examination, 1961" or other service Rules.

(ix) "Hindi Noting/Drafting Examination" means Hindi Noting/Drafting Examination held by The Directorate of Rajbhasha under The "Bihar Government Servant (Hindi Examination) Rules, 1968".

(x) "Computer Examination" means computer competency test held under the "Bihar Government Servant (Computer Competency for Confirmation) Rules, 2011."

3. The exemption from passing in the prescribed examination, of a government servant will be considered only after submission of application these for by the concerned employee. The order of exemption will be effective from the date of application after completion 50 years of age.

4. Exemption will be granted only to those government servants who have completed the age of 50 years and who have participated in the prescribed examination held4 ॢबह(cid:4)र गजट (cid:25)[स(cid:4)ध(cid:4)रण(cid:27)(cid:31) (cid:30) म(cid:4)चZ 2(cid:26)1(cid:30) from time to time but failed, or the prescribed examination had not been held due to exigencies of the government works or the prescribed examination had not been held during five years prior to his attaining the age of 50 years.

5. Having regard of the performance of the duties of the post held by the government servant or adverse effect on work effiency of the concerned government servant, exemption will be considered.

6. There should not be any adverse remarks in Performance Appraisal Report/Character Roll of the concerned government servant applying for exemption. His service/works should be satisfactory. There should be no disciplinary proceeding/ criminal proceeding pending against him.

7. Right to get exemption from passing in any prescribed examination will not be mandatory. It will be compulsory for the competent authority to pass an order recording the reason of rejection of the application submitted for the exemption.

8. The order of exemption shall be issued with due approval of the Appointing Authority prescribed for the post held by concerned government servant.

9. Power to make regulation.— The government may make regulations to implement the provisions prescribed in these rules.

10. Power to relax.— Where the government is satisfied, for good and sufficient reasons or if sufficient cause is shown, to be recorded in writing, the provisions contained in these rules may be relaxed.

11. Interpretation.— Where any doubt arises as to the interpretation of any of the provisions of these rules, the matter will be referred to the department and the decision of the department, after consultation with the Law Department, shall be final.

12. Repeal and saving.—(1) Circular no. 11691 dated 09.11.1983, 4674 dated 15.05.1992 and 4368 dated 28.08.2009, and rules/circulars/orders etc. issued earlier from time to time in this regard are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the said rules/circulars/orders etc shall be deemed to have been done or taken under these rules as if these rules were inforce on the day on which such thing or action was done or taken.
