सं॰ 4/परिधा0-13-04/2013-301(4)—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्य ''बिहार परिधापक संवर्ग नियमावली, 2014'' का संशोधन करने के लिए निम्नलिखित नियमावली बनाते हैं :-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ ।- (1) यह नियमावली ''बिहार परिधापक संवर्ग (संशोधन) नियमावली 2018 कही जा सकेगी । (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह तुरंत के प्रभाव से प्रवृत होगी । 2. बिहार परिधापक संवर्ग नियमावली, 2014 के नियम-6 का प्रतिस्थापन ।-उक्त नियमावली के नियम-6 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''6. अर्हताएँ ।- (1) मूल कोटि के पद पर सीधी भत्र्ती के लिए न्यूनतम शैक्षणिक अर्हता इंटरमीडियेट/2 (भौतिक विज्ञान, रसायनशास्त्र, जीव विज्ञान, अंग्रेजी के साथ) एवं सरकार द्वारा मान्यता प्राप्त संस्थान से सर्टिफिकेट कोर्स में उत्तीर्ण होना आवश्यक होगा :-

(2) परिधापक संवर्ग में सीधी भत्र्ती के लिए न्यूनतम आयु सीमा 18 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाए । संबंधित वर्ष की 1ली अगस्त उम्र के अवधारणार्थ, कट ऑफ डेट माना जायेगा ।''

3. बिहार परिधापक संवर्ग नियमावली, 2014 के नियम-7 का प्रतिस्थापन ।- उक्त नियमावली के नियम-7 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा । :-

''7. भत्र्ती की प्रक्रिया ।- (1) नियुक्ति प्राधिकार, वर्ष की 1ली अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर एवं रोस्टर क्लीयरेन्स करा कर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा ।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 म(cid:4)चZ 2(cid:22)1(cid:23) (2) बिहार तकनीकी कर्मचारी चयन आयोग परीक्षा संचालन नियमावली, 2010 के प्रावधानों के अनुसार इण्टर स्तरीय प्रतियोगिता परीक्षा के लिए रिक्तियों में इन अधियाचित रिक्तियों को आयोग जोड़ेगा और तद्‌नुसार इन अधियाचित रिक्तियों को भी विज्ञापित करेगा । परीक्षा पाठ्‌यक्रम एवं प्रक्रिया का अवधारण आयोग द्वारा किया जायेगा।

(3) इण्टर स्तरीय प्रतियोगिता परीक्षा के परिणाम के आधार पर आयोग मेधासूची तैयार करेगा । मेधासूची तैयार करने के क्रम में आयोग सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित आरक्षण कोटिवार न्यूनतम अहर्तांक का अनुपालन करेगा । तत्पश्चात्‌ अधियाचित रिक्तियों के अनुरुप, आरक्षण कोटिवार, अनुशंसा आयोग नियुक्ति प्राधिकार को भेजेगा ।

अनुशंसा भेजने के पूर्व आयोग द्वारा नियुक्ति प्राधिकार के सहयोग से, अभ्यर्थियों के प्रमाणपत्रों की जाँच के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृत्त का सत्यापन करा लिया जायेगा ।

(4) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन आवश्यक होगा ।

4. बिहार परिधापक संवर्ग नियमावली, 2014 के परिशिष्ट-1 का प्रतिस्थापन ।-उक्त नियमावली के परिशिष्ट-1 का निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

परिशिष्ट-1 {नियम-2 (vi), 4, 13, 16, 17 द्रष्टव्य} परिधापक संवर्ग का सोपान

समय-समय पर निर्धारित किया जाय ।

सं॰ 4/परिधा0-13-04/2013-302(4) अधिसूचना सं॰ 301(4) दिनांक 12 मार्च 2018 का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से एतद्‌द्वारा प्रकाशित किया जाता है जो भारत संविधान के अनुच्छेद 348 के खंड (3) के अधीन अंग्रेजी भाषा के उक्त अधिसूचना का प्राधिकृत पाठ समझा जायेगा ।

No. 4/परिधा0-13-04/2013-301(4)—In exercise of the powers conferred by proviso to Article 309 of the constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to amend the Bihar Dresser Cadre Rules 2014.

1. Short title, extent & commencement— (1) These Rules may be called the "Bihar Dresser Cadre (Amendment) Rules, 2018. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with immediate effect. 2. Substitution of Rule-6 of the Bihar Dresser Cadre Rules, 2014 - Rule - 6 of the said Rules, 2014 shall be substituted by the following—

"6. Qualifications — (1) For direct recruitment to the posts of basic category, minimum educational qualification shall be pass in intermediate/+2 (with Physics, Chemistry, Biology and English) and to pass in certificate Course from a Government recognized institution, will be compulsory.

(2) For Direct recruitment in the Dresser Cadre, minimum age-limit shall be 18 years and maximum age limit shall be the same as may be determined reservation, categorywise by the Government from time to time. 01 August of the concerned years shall be deemed to be the cut of Date for determination of Age." (3) Substitution of Rule-7 of the Bihar Dresser Cadre Rules 2014:- "Rule-7 of the said Rules, 2014 shall be substituted by the following :-

"7.Procedure of Recruitment— (1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting Roster Clearance, shall send reservation categorywise requisition to the Commission, latest by 30th April.

(2) In accordance with Bihar Technical Staff Selection Commission Examination Conduct Rules 2010, commission will add the requisite vacancies in vacancies forInter Level Competitive Examination and accordingby, The Commission shall advertise the vacancies. Commission Syllabus and procedure of Examination will be determined by the Commission.

(3) The Commission will prepare merit list on the basis of result of Inter level Competitive Examination. In course of preparation of merit list, the commission will comply with the minimum qualifying marks prescribed reservation categorywise, by the Government (General Admistrative Department) from time to time. There after the Commission will send recommendation reservation categorywise to the Appointing Authority, in conformity with requisition of the vacancies. Before sending the recommendations, antecedents of the recommended candidates, after verification of their certificates, will be verified by the Commission with the help of the Appointing Authority.

(4) Compliance of instructions, issued by the Government, from time to time, with respect to the procedure of appointment, after recommendation of the Commission, shall be compulsory".

4. Substitution Appendix 1 of the Bihar Dresser Cadre Rules 2014. - Appendix 1 of the said Rules shall be substituted by the following—

Chain of Posts of Dresser Cadre.

Categories shall be the same as may be determined by the Government from time to time."
