एस0ओ0 152 दिनांक 14 मार्च 2018—माननीय सर्वोच्च न्यायालय, नई दिल्ली द्वारा W.P (Civil) No.- 699/2016 (अश्विनी कुमार उपाध्याय बनाम भारत सरकार एवं अन्य) में दिनांक 01.11.2017 एवं 14.12.2017 को पारित आदेश के अनुपालन में बिहार राज्य सरकार, पटना उच्च न्यायालय के परामर्श से निर्वाचित सांसदों (एम0पी0) एवं विधायकों (एम0एल0ए0) से संबंधित सत्र न्यायालयों, विशेष न्यायालयों अथवा मजिस्टे्रट के न्यायालयों के द्वारा विचारणीय सभी आपराधिक मामलों के विचारण हेतु श्री परशुराम सिंह यादव, अपर जिला एवं सत्र न्यायाधीश-IX, पटना के न्यायालय को विशेष न्यायालय के रूप में अभिहित करती है, जिसकी अधिकारिता बिहार राज्य की स्थानीय सीमाएँ होगी।2.तदनुसार, बिहार राज्य के अन्य सभी न्यायालयों के समक्ष लंबित, निर्वाचित सांसदों (एम0पी0) एवं विधायकों (एम0एल0ए0) से संबंधित, सभी आपराधिक मामले/विचारण उक्त अभिहित विशेष न्यायालय में अंतरित हो जाऐंगे। 3.यह अधिसूचना तुरंत प्रवृत्त होगी। ¼la0la0&,@,DV&01@2018&2574@ts0½ बिहार-राज्यपाल के आदेश से, lqjsUnz izlkn 'kekZ] सरकार के सचिव। 2 ॢबह(cid:4)र गजट (cid:25)[स(cid:4)ध(cid:4)रण(cid:27)(cid:30) 14 म(cid:4)चZ 2(cid:26)1! 14 ekpZ 2018 एस0ओ0 153, एस0ओ0 152 दिनांक 14 मार्च 2018 का अंगे्रजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद-348 के खण्ड(3) के अधीन उसका प्राधिकृत पाठ समझा जायेगा।

S.O. 152. Dated 14th March 2018— In compliance of the order dated 01.11.2017 and 14.12.2017 passed by Hon'ble Supreme Court, New Delhi, in W.P (Civil) No.-699/2016 (Ashwini Kumar Upadhyay vs Union of India & Anr), State Government of Bihar, in consultation with the High Court of Judicature at Patna, designate the Court of Sri Parshuram Singh Yadav, Additional District and Sessions Judge-IX, Patna, as the Special Court for trial of all criminal cases triable by Sessions Courts, Special Courts or Magisterial Courts relating to the elected Members of Parliament (M.Ps) and Members of Legislative Assembly (M.L.As), whose Jurisdiction will be the local limits of the State of Bihar.

2.Accordingly, all pending criminal cases/trials related to elected Members of Parliament (M.Ps) and Members of Legislative Assembly (M.L.As), before all other courts of the State of Bihar will be transferred to the said designated Special Court.

3.This Notification shall come into force at once.
