12, परिषिष्ट-25 के प्रावधानों के तहत प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-

के लिए निम्नलिखित नियमावली बनाते हैंः- सं॰ 3/पु0प्रयो0-01/2017, गृ0आ0-2747—भारत संविधान के अनुच्छेद-309 के परन्तुक एवं पुलिस भारत संविधान के अनुच्छेद-309 के परन्तुक एवं पुलिस सं॰ 3/पु0प्रयो0-01/2017, गृ0आ0-2747 क्तयों का प्रयोग करते हुए बिहार-राज्यपाल हस्तक भाग-03, नियम-12, परिषिष्ट-25 के प्रावधानों के तहत प्रदत्त शि एतद द्वारा गृह विभाग (पुलिस शाखा) के नियंत्रणाधीन अपराध अनुसंधान विभाग के बिहार संदिग्ध लेख्य परीक्षक एतद द्वारा गृह विभाग (पुलिस शाखा) के नियंत्रणाधीन अपराध अनुसंधान विभाग के बिहार संदिग्ध लेख्य परीक्षक एतद द्वारा गृह विभाग (पुलिस शाखा) के नियंत्रणाधीन अपराध अनुसंधान विभाग के बिहार संदिग्ध लेख्य परीक्षक संवर्ग में भर्ती की प्रक्रिया तथा अन्य सेवा-शर्तो को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैंः- संवर्ग में भर्ती की प्रक्रिया तथा अन्य सेवा-शर्तो को विनियमित करने संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - यह नियमावली '' बिहार राजकीय संदिग्ध लेख्य परीक्षक

बिहार राजकीय संदिग्ध लेख्य परीक्षक संवर्ग 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ (भर्ती एवं सेवा शर्त) नियमावली, 2018'' कही जा सकेगी। (भर्ती एवं सेवा शर्त) नियमावली, 2018'' कही जा सकेगी।

) इसका विस्तार राज्य सरकार के कर्मियों तक सीमित रहेगा।

परिभाषाएं। -जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में-

(i) इसका विस्तार राज्य सरकार के कर्मियों तक सीमित रहेगा। (ii) यह तुरत प्रवृत होगी। 2. परिभाषाएं। -जब तक संदर्भ में अन्यथा (i) ''राज्यपाल'' से अभिप्रेत है राज्यपाल, बिहार; ''राज्यपाल'' से अभिप्रेत है राज्यपाल, बिहार; (ii) ''सरकार'' से अभिप्रेत है बिहार सरकार; ''सरकार'' से अभिप्रेत है बिहार सरकार; (iii) ''विभाग'' से अभिप्रेत है गृह विभाग (आरक्षी षाखा), ''विभाग'' से अभिप्रेत है गृह विभाग (आरक्षी षाखा), (iv) ''राजस्व पर्षद्‌'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग के अधीन राजस्व पर्षद्‌; राजस्व पर्षद्‌'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग के अधीन राजस्व पर्षद्‌; राजस्व पर्षद्‌'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग के अधीन राजस्व पर्षद्‌; (v) ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग; (vi) ''संवर्ग'' से अभिप्रेत है (vii) ''संवर्ग के सदस्य'' से अभिप्रेत है

''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग; ''संवर्ग'' से अभिप्रेत है बिहार संदिग्ध लेख्य परीक्षक संवर्ग; संवर्ग में इस नियमावली के ''संवर्ग के सदस्य'' से अभिप्रेत है बिहार संदिग्ध लेख्य परीक्षक संवर्ग में इस नियमावली के उपबधों के अधीन पूर्व से नियुक्त एवं नियमित रूप से कार्यरत व्यक्ति। उपबधों के अधीन पूर्व से नियुक्त एवं नियमित रूप से कार्यरत व्यक्ति। (viii) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है राज्य सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है राज्य सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है राज्य सरकार द्वारा विभागीय प्रोन्नति के लिए सम्यक रूप से गठित समिति। रूप से गठित समिति।

(ix) ''नियुक्ति प्राधिकार'' से अभिप्रेत है राज्यपाल, बिहार।

कार'' से अभिप्रेत है राज्यपाल, बिहार।2 ॢबह(cid:4)र गजट (cid:28)[स(cid:4)ध(cid:4)रण(cid:29)(cid:30) (cid:24) [(cid:10)'ल 2(cid:15)1# ( x) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है गृह विभाग (आरक्षी शाखा) (xi) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष। 3. सेवा का गठन। - (1) इस संवर्ग में निम्नांकित पद होंगेः -

सरकार द्वारा विनिष्चित की जाय।

(2) यह संवर्ग राज्य स्तरीय संवर्ग होगी और गृह विभाग (पुलिस षाखा) के अधीन होगी।

अध्याय-II

नियुक्ति

4. नियुक्ति।- (1) इस संवर्ग की मूल कोटि के राजकीय सदिग्ध लेख्य परीक्षक के सभी पद आयोग की अनुषंसा पर सीधी नियुक्ति द्वारा भरे जायेंगे।

(2) नियुक्ति एवं प्रोन्नति के लिए राज्य सरकार द्वारा समय-समय पर, यथा अधिसूचित आरक्षण के प्रावधान इस संवर्ग में लागू होंगे।

5. सीधी नियुक्ति हेतु अर्हता एवं प्रक्रिया।- (1) उम्र सीमा। सीधी भर्ती के लिए उम्मीदवार की न्यूनतम आयु, आवेदन आमंत्रित करने वाले वर्ष के एक अगस्त को, इक्कीस वर्ष से कम नहीं होगी। अधिकतम आयु सीमा वही होगी जो राज्य सरकार (के सामान्य प्रषासन विभाग द्वारा) समय-समय पर नियत की जाए।

(2) शैक्षणिक अर्हता-इस संवर्ग की मूल कोटि में नियुक्ति के लिए अहर्ता किसी मान्यता प्राप्त विष्वविद्यालय से प्राप्त रसायन विज्ञान या भौतिकी विज्ञान या गणित या फोरेंसिक विज्ञान में स्नातकोत्तर डिग्री या समकक्ष होगी।

(3) लिखित परीक्षा।- आयोग, अपनी विहित प्रक्रिया के अनुसार अभ्यर्थियों का चयन कर सकेगा। एतदर्थ विषय/पाठयक्रम/अंक (साक्षत्कार एवं आवष्यकतानुसार लिखित परीक्षा के लिए) का निर्धारन आयोग के परामर्ष से विभाग द्वारा किया जा सकेगा।

(4) साक्षात्कार।-लिखित परीक्षा में प्राप्त अंकों के आधार पर चयनित अभ्यर्थियों का साक्षात्कार, आयोग, अपनी विहित प्रक्रिया के अनुसार संचालित कर सकेगा।

(5) चिकित्सा परीक्षा।- अभ्यार्थियों की चिकित्सा जाँच आयोग द्वारा निर्धारित प्रावधान के अनुसार की जाएगी। इसमें विषेष रूप से बिना चष्मा के दृष्टि सामान्य होनी चाहिए।

(6) रिक्तियों की गणना एवं आयोग को इसकी सूचना।-प्रत्येक वर्ष की पहली अप्रैल तक विभाग उस वर्ष ''राजकीय संदिग्ध लेख्य परीक्षक संवर्ग'' में सीधी नियुक्ति द्वारा भरी जाने वाली रिक्तियाँ की गणना करेगा और उसके अनुसार सीधी नियुक्ति द्वारा भरी जाने वाली रिक्तियों की अधियाचना आयोग को 30 अप्रैल तक प्रेषित करेगा

(7) नियुक्ति। - आयोग अधियाचित रिक्तियों के विरूद्ध संयुक्त अथवा पृथक रूप से प्रतियोगिता परीक्षा आयोजित कर विहित प्रक्रिया के अधीन चयनित अभ्यर्थियों की मेघा एवं आरक्षण कोटिवार अनुषंसा विभाग को करेगा।

अध्याय-III

वरीयता, सम्पुष्टि एवं प्रोन्नति

6. वरीयता।-इस नियमावली के अधीन सीधी भर्ती द्वारा नियुक्त किये गए सदस्यों की आपसी वरीयता, आयोग द्वारा अनुषंसित मेघा सूची के आधार पर, विनिष्चित की जाएगी।

7. परिवीक्षा अवधि।-सभी नयी नियुक्ति परिवीक्षा पर दो वर्षो की अवधी के लिए होगी जिसे लिखित रूप में अभिलिखित किये जाने वाले कारणों से, अगले एक वर्ष के लिए विस्तारित किया जा सकेगा। विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाए जाने पर व्यक्ति की सेवा समाप्त की जा सकेगी।

8. संपुष्टि।- परिवीक्षा अवधि की संतोषजनक समाप्ति तथा राजभाषा विभाग द्वारा आयोजित हिन्दी टिप्पण एवं प्रारूपण परीक्षा में उतीर्णता प्राप्त करने पर सेवा सम्पुष्ट की जा सकेगी।3 ॢबह(cid:4)र गजट (cid:28)[स(cid:4)ध(cid:4)रण(cid:29)(cid:30) (cid:24) [(cid:10)'ल 2(cid:15)1# 9. प्रषिक्षण। - (1) नियुक्त पदाधिकारी निदेषक के मार्गदर्षन में तीन साल तक संदिग्ध लेख्य जाँच कार्य संबंधी तकनीकी एवं प्रयोगिक प्रषिक्षण प्राप्त करेंगे जिसके दौरान उन्हें निम्नलिखित परीक्षाओं को उर्त्तीण करना अनिवार्य होगा :-

(क) एक वर्ष छः महीने के प्रषिक्षण के उपरान्त अपराध अनुसंधान विभाग के पर्यवेक्षण के अधीन आयोजित संदिग्ध दस्तावेज की लिखित परीक्षा, जिसका प्रष्न पत्र किसी भी केन्द्रीय न्यायालयिक विज्ञान प्रयोगषाला (C.F.S.L) से मंगाया जाएगा और परीक्षोपरान्त उत्तर पुस्तिका का मूल्यांकन भी उसी केन्द्रीय न्यायालयिक विज्ञान प्रयोगषाला द्वारा किया जाएगा। यह परीक्षा उत्तीर्ण करना अनिवार्य होगा।

(ख) तीन साल के प्रषिक्षण के उपरान्त अपराध अनुसंधान विभाग की निगरानी में आयोजित संदिग्ध दस्तावेज की लिखित परीक्षा, जिसका प्रष्न पत्र किसी भी केन्द्रीय न्यायालयिक विज्ञान प्रयोगषाला (C.F.S.L) से मंगाया जाएगा और परीक्षोपरान्त, उत्तर पुस्तिका का मुल्यांकन भी उसी केन्द्रीय न्यायालयिक विज्ञान प्रयोगषाला द्वारा किया जाएगा। यह परीक्षा उत्तीर्ण करना अनिवार्य होगा।

(ग) तीन साल के प्रषिक्षण प्राप्त करने एवं उक्त दोनो परीक्षा में उतीर्ण होने के पष्चात राजकीय संदिग्ध लेख्य परीक्षक भारतीय साक्ष्य अधिनियम की धारा-45 में यथा विनिर्दिष्ट प्रवीण सदिग्ध लेख्य परीक्षक होगे तथा सदिग्ध लेख्य परीक्षक के सभी कर्त्तव्य व दायित्वों का निर्वाहन करने हेतु सक्षम हाेंगे।

(घ) राजभाषा विभाग, बिहार सरकार द्वारा आयोजित ''हिन्दी टिप्पणी एवं प्रारूपण परीक्षा'' पास करना अनिवार्य होगा। परीक्षा उतीर्ण होने के उपरान्त ही द्वितीय तथा उसके आगे की वेतनवृद्धि देय होगी।

(2) इस संवर्ग के सदस्य को राज्य सरकार द्वारा प्रषिक्षण के लिए राज्य में या राज्य से बाहर या विदेष में भेजा जा सकेगा।

10. प्रोन्नति। - (1) इस संवर्ग के मूल कोटि के उपर के सभी पद सोपानों पर प्रोन्नति ठीक नीचे के पद सोपानों के सदस्यों में से वरीयता-सह-योग्यता के आधार पर, विभागीय प्रोन्नति समिति के अनुषंसा के आधार पर, की जा सकेगी।

(2) सामान्य प्रषासन विभाग द्वारा विभिन्न पदों पर प्रोन्नति हेतु विहित न्यूनतम, कालावधि पूरा करना तथा अन्य शर्तों, यदि कोई हो, को पूरा करना अनिवार्य होगा।

अध्याय-IV

11. अनुषासन, अपील एवं शास्तियाँ।-बिहार, सरकारी सेवक (वर्गीकरण नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संषोधित) के प्रावधान इस संवर्ग के सदस्यों पर लागू होंगे।

12. अवषिष्ट मामले।-जो विषय अथवा बिन्दु इस नियमावली में समाहित नहीं है, उनके संबंध में बिहार पुलिस हस्तक/राज्य सरकार द्वारा प्रासंगिक संहिता/नियमावली संकल्प/निदेष में समकक्ष कर्मियों के संबंध में किए गए प्रावधान इस संवर्ग में भी लागू होगें।

13. कठिनाईयों/षंकाओं का निराकरण।-इस नियमावली के प्रावधानों के कार्यान्वयन के संबंध में कोई कठिनाई/षंका उत्पन्न हो तो उसे संवर्ग के नियंत्री प्राधिकार द्वारा विधि विभाग तथा सामान्य प्रषासन विभाग के परामर्ष के पष्चात दूर किया जा सकेगा।

14. निरसन एवं व्यावृति। -

(1) इस नियमावली के आदेष के पूर्व राजकीय संदिग्ध लेख्य परीक्षक की नियुक्ति से संबंधित सभी नियमावली/संकल्प/आदेष एवं अनुदेष एतद्‌ द्वारा निरसित किए जाते हैं।

(2) ऐसे निरसन के होते हुए भी, उक्त नियमावली, संकल्प, आदेष एवं अनुदेष आदि के अधीन कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

No. 3/P.L.-01/2017-2747—In exercise of powers conferred by the proviso to Article 309 of the Constitution of India read with Rule-12 of Apendix-25 of Part-03 of Bihar Police Manual, the Governor of Bihar is hereby pleased to make the following Rules to regulate the procedure of appointment and other service conditions of Bihar Government Examiner of suspected Documents Cadre of Criminal Investigation Department under the control of Home Department (Police Branch).

1. Short title, extent and commencement— (1). These Rules may be called "Bihar Government Examiner of suspected Documents Cadre (Recruitment and Service Condition) Rules, 2018."

(2) It shall extend to the limit of State Government Employees. (3) It shall come into force at once. 2. Definition- In these rules, unless the context otherwise requires— (1). "Governor" means the Governor of Bihar; (2). "Government" means the Government of Bihar; (3). "Department" means the Home Department (Police Branch); (4). "Board of Revenue" means Board of Revenue under the Revenue and Land Reforms Department;

(5). "Commission" means the Bihar Public Service Commission; (6). "Cadre" means the Bihar Government Examiner of suspected Documents Cadre; (7). "Member of Cadre" means a person already appointed and regularly working in the Bihar Government Examiner of suspected Documents Cadre under the provisions of these Rules;

(8). "Departmental Promotion Committee" means the Committee duly constituted by the State Government for departmental promotion;

(9). "Appointing Authority" means the Governor of Bihar; (10). "Controlling Authority" means Home Department (Police Branch); (11). "Year" means Financial Year, 3. Constitution of Services— (1) There shall be following posts in this Cadre-

be determined by the State Government, from time to time.

(2). This Cadre shall be the cadre of state level and shall be under the Home Department (Police Branch).

Chapter-II

Appointemnt

(4). Appointment— (1). All posts of the Government Examiner of suspected Documents of the basic category of this cadre shall be filled by direct appointment on the recommendations of the Commission.

(2) Provisions of reservation as notified by the State Government from time to time for the appointment and promotion shall apply in this cadre.

(5). Qualifications and procedure of direct appointment- (1). Age limit— Minimum age of the candidate for direct recruitment shall not be less than twenty one year on first August of the year of inviting applications.

Maximum age limit shall be the same as may be fixed by the State Government (General Administrative Department) from time to time.

(2). Educational Qualification—The qualification for the appointment in basic category of this cadre shall be post graduate degree in Chemistry Science or Physics Science or Mathematics or Forensic Science obtained from a recognized university or equivalent.

(3). Written Examination—The Commission may select the candidates as per its prescribed procedure how ever Subject/syllabus /marks therefor, (for the interview and the written examination, if required) may be determined by the department in consultation with the Commission.

(4). Interview—The Commission may conduct the interview of the candidates, as per its own prescribed procedure, selected on the basis of marks obtained in written examination.

(5). Medical Test—Medical test of candidates will be conducted as per the provisions determined by the Commission. There should be normal vision specially without spectacles.

(6). Calculation of Vacancies and its information to the Commission—Department shall calculate the vacancies to be filled up by direct recruitment in the Bihar Government Examiner of suspected Documents Cadre, every year up to the 1st April in that year and shall send the requisition of the vacancies to be filled up by direct recruitment by the Commission by 30th April.

(7). Appointment—The Commission shall made merit and the reservation category wise recommendation of the candidates selected under prescribed process after holding combined or separate Competitive Examination to the department against the roaster wise vacant posts, as requisitioned.

CHAPTER-III

Seniority, Confirmation and Promotion

(6). Seniority— Interse Seniority of the members appointed by direct recruitment, under these Rules will be determined on the basis of merit list recommended by the Commission.

(7). Probation Period—All appointment will be on probation for a period of two years which may be further extended for one year with reason to be recorded in writing. The service being found not satisfactory in the extended period also, the service of the person may be terminated.

(8). Confirmation—Service may be confirmed after satisfactory completion of the probation period and qualifying the Hindi Noting and Drafting Examination held by the Rajbhasha Department.

(9). Training— (1). The appointed officers will obtain technical and practical training related to examination work of suspected documents for three years under the guidance of the Director, during which they have to pass compulsorily following examinations—

(a) Written Examination of suspected Documents after one and half year training, under the supervision of Criminal Investigation Department, question papers of which will be called from any Central Forensic Science Laboratory and after examination, answer papers will also be evaluated by the same Central Forensic Science Laboratory. It will be compulsory to Pass this examination.

(b) Written Examination of suspected documents after three year training, under the supervision of Criminal Investigation Department, question papers of which will called from any Central Forensic Science Laboratory and after6 ॢबह(cid:4)र गजट (cid:28)[स(cid:4)ध(cid:4)रण(cid:29)(cid:30) (cid:24) [(cid:10)'ल 2(cid:15)1# examination, answer papers will also be evaluated by the same Central Forensic Science Laboratory. It will be compulsory to pass this examination.

(c) After obtaining three years of training and passing the said both Examinations, The Government Examiner of suspected Documents shall be an expert suspected Document Examiner, as specified in section-45 of the Indian Evidence Act, and shall be competent to discharge all the duties and responsibilities of suspected Document Examiner.

(d) It shall be mandatory to pass Hindi Noting and Drafting Examination held by Rajbhasha Department, Government of Bihar. After passing the said examination only the second and onwards increment of pay will be payable.

(2). The member of this cadre may be sent for training by the State Government within the state or outside the state or to any foreign country.

(10). Promotion-— (1). Promotions to all post of the promotional ladders above the basic category of the cadre shall be made from among the members of the immediate lower ladder, on the basis of seniority-cum-merit on the recommendation of The Departmental Promotion Committee.

(2). It will be complate the prescribed minimum kalawadhi and other conditions, if any, determined by the General Administration Department, for the promotions on various posts, shall be mandatory.

CHAPTER- IV

MISCELLANEOUS

(11). Discipline, Appeal and Punishment—Provisions of Bihar Civil Service (Classification, Control & Appeal) Rules, 2005 (as amended time to time) shall be applicable to the members of this cadre.

(12). Residual Matters—The subjects or points not specifically vested in these Rules, provisions made in Bihar Police Manual/relevant Code/ Rules/Resolutions/Orders, by the State Government for the employees of equivalent rank shall be applicable to the members of this cadre also.

(13). Removal of difficulties/ Doubts—If any difficulty/ Doubt arises as to the interpretation of any of the provision of these Rules, it may be removed by the Controlling Authority of the cadre. after consultation of the Law Department and the General Administration Department.

(14). Repeal and saving—

(1). All the Rules, Resolutions, Orders and Instructions related to the appointment of The Bihar Government Examiner of suspected Documents prior to the commencement to these rules, are hereby repealed.

(2). Notwithstanding such repeal, any act done or any action taken under the Rules, Resolutions, Orders and Instructions prior to the commencement of these rules shall be deemed to be done or taken under these Rules as if it were come into force on the day on which such thing was done or such action was taken.
