सं॰ वन अरा॰स्था॰-14/2012-1327/प०व०—भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, बिहार अवर वन सेवा नियमावली, 2013 (समय-समय पर यथा संशोधित) का संषोधन करने हेतु निम्नलिखित नियमावली बनातें है :-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

(1) यह नियमावली ''बिहार अवर वन सेवा (संशोधन) नियमावली, 2018'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह बिहार राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगी।

2. बिहार अवर वन सेवा नियमावली, 2013 के नियम-13 में संषोधन।- उक्त नियमावली के नियम 13 के उपनियम (ii) के बाद निम्नलिखित उपनियम (iii) जोड़ा जाएगा,-

''(iii) संवर्गीय प्रोन्नति हेतु प्रशिक्षण अनिवार्य है। किन्तु विभाग द्वारा प्रशिक्षण की व्यवस्था नहीं किये जाने की स्थिति में एवं कर्मचारी के 10 वर्षों की लगातार सेवा पूर्ण करने की स्थिति में मात्र ए०सी०पी०/एम०ए०सी०पी० एवं प्रोन्नति के उद्देश्य के लिए प्रशिक्षण की अनिवार्यता प्रधान सचिव/सचिव, पर्यावरण एवं वन विभाग शिथिल कर सकेंगे।''

3. बिहार अवर वन सेवा नियमावली, 2013 के परिष्ष्टि-'क' की कंडिका-5(क) का प्रतिस्थापन।- उक्त नियमावली के परिशिष्ट-क की कंडिका-5(क) निम्नलिखित द्वारा प्रतिस्थापित की जाएगीः-

''5-(क) लिखित परीक्षा (1) लिखित परीक्षा के मानक एवं प्रक्रिया का निर्धारण प्रशासी विभाग/आयोग के द्वारा किया जायेगा। (2) ऑन लाईन/कम्प्यूटर आधारित परीक्षा आयोजित करने हेतु अभिकरण का चयन परीक्षा आयोजितकरने वाले संबंधित चयन संस्थान/आयोग द्वारा अपने स्तर से किया जायेगा।'' 4. बिहार अवर वन सेवा नियमावली, 2013 के परिष्ष्टि-'ख' की कंडिका-6(क) का प्रतिस्थापन।- उक्त नियमावली के परिशिष्ट-ख की कंडिका-6(क) निम्न रूप में प्रतिस्थापित की जाएगी- ''़6-(क) लिखित परीक्षा (1) लिखित परीक्षा के मानक एवं प्रक्रिया का निर्धारण प्रषासी विभाग/आयोग के द्वारा किया जाायेगा। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 9 मई 2018 (2) ऑन लाईन/कम्प्यूटर आधारित परीक्षा आयोजित करने हेतु अभिकरण का चयन परीक्षा आयोजित करने वाले संबंधित चयन संस्थान/आयोग द्वारा अपने स्तर से किया जायेगा।'' बिहार-राज्यपाल के आदेश से त्रिपुरारि शरण, सरकार के प्रधान सचिव।

——— The 7th May 2018 No. Van Ara. Astha.14/2012-1327—In exercise of powers conferred by Proviso to Article- 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to amend the Bihar Subordinate Forest Service Rules, 2013 (as amended from time to time) :-

1. Short title, extent and commencement :–

(1) These Rules shall be called the "Bihar Subordinate Forest Service (Amendment) Rules, 2018."

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force with effect from the date of its publication in the Bihar Gazette.

2. Amendment in Rule-13 of the Bihar Subordinate Service Rules, 2013.— The following

Subrule (iii) shall be added after Subrule (ii) of Rule-13 of the said Rules:-

"(iii) Training is compulsory for promotion within the cadre but in case the Department has not made arrangement for training and the employee has completed 10 years of continuous service the Principal Secretary/Secretary, Department of Environment & Forest may relax training for the Purpose of promotion and ACP/MACP only."

3. Substitution of para-5(a) of Appendix-'A' of the Bihar Subordinate Forest Service Rules

2013- Para-5(a) of Appendix- 'A' of the said Rules shall be substituted by the following :-

"5(a)Written Examination –

(1) The standard and procedure for the written Examination shall be determined by the Administrative department/Commission.

(2) Selection of the agency for conducting Online/Computer based examination shall be made by the concerned Institution/Commission responsible for conducting the examination."

4. Substitution of para-6(a) of Appendix-'B' of the Bihar Subordinate Forest Service Rules

2013- Para-6(a) of Appendix- 'B' of the said Rules shall be substituted by the following :-

"6(a)Written Examination-

(1) The standard and procedure for the written Examination shall be determined by the Administrative department/Commission.

(2) Selection of the agency for conducting Online/Computer based examination shall be made by the concerned selection Institution/Commission responsible for conducting the examination."
