सं॰ 2/स्था0-01-24/2008/2347/आ0प्र0—आपदा प्रबंधन अधिनियम 2005(2005 का 53) की धारा-14 एवं 78 में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल आपदा प्रबंधन (राज्य प्राधिकरण के सदस्यों की पदावधि और सेवा की शर्ते तथा भत्तों की संदाय) नियमावली 2008 समय-समय पर यथा संशोधित में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ। (1) यह नियमावली आपदा प्रबंधन (राज्य प्राधिकरण के सदस्यों की पदावधि और सेवा की शर्तें तथा परामर्शदातृ समिति के सदस्यों की भत्तों का संदाय) (संशोधन) नियमावली, 2018 कही जा सकेगी । (2) यह नियमावली तुरंत प्रवृत्त होगीः

परंतु प्राधिकार के विद्यमान उपाध्यक्ष एवं सदस्यों के मामले में यह उनके अपने पद पर योगदान की तिथि से प्रवृत्त समझी जाएगी।

2. आपदा प्रबंधन (राज्य प्राधिकरण के सदस्यों की पदावधि और सेवा की शर्तें तथा भत्तों का संदाय) नियमावली -2008 के नियम 4 का उपनियम (v) (b) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

(v)(b) राज्य प्राधिकरण के पूर्णकालिक सदस्य के रूप में नामित व्यक्ति अपनी स्वेच्छा से निम्न विकल्प का चयन कर सकते हैं :-

बिहार सरकार में प्रधान सचिव से उच्चतर पदाधिकारियों सहित प्रधान सचिव को, जो इस पद पर नियुक्त हाें, अनुमान्य वेतन (यदि सेवानिवृत पदाधिकारी हों तो सेवानिवृत की तिथि को अनुमान्य वेतन से पेंशन की राशि घटाकर), महंगाई भत्ता, आवास भत्ता (यदि सरकारी आवास उपलब्ध न हो तो), चिकित्सा सुविधाएँ, यात्रा भत्ता, यात्रा रियायत भत्ता तथा अखिल भारतीय सेवाएँ (अवकाश) नियमावली, 1955 के अनुसार सरकारी सेवकों को अनुमान्य अवकाश। परन्तु यह कि सेवानिवृति की तिथि को धारित पद, जो प्रधान सचिव से उच्चतर भी हो सकता है, के वेतनमान में प्राप्त मूल वेतन घटाव मूल पेंशन (Commutation सहित) से कम राशि देय नहीं होगा।

अथवा,

बिहार राज्य के राज्यमंत्री को अनुमान्य वेतन, दैनिक भत्ता एवं पेंशन (यदि सेवानिवृत पदाधिकारी हों तो महंगाई राहत घटाकर) एवं बिहार के मंत्री (वेतन एवं भत्ते) नियमावली 2006 (समय-समय पर यथा संशोधित) के अनुसार राज्य मंत्री को अनुमान्य आवास, चिकित्सा सुविधाएँ एवं यात्रा भत्ता।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 30 vxLrvxLrvxLrvxLr 2018 परंतु, उपाध्यक्ष एवं सदस्यों की नियुक्ति के पश्चात्‌ उनके वेतन एवं भत्ते अथवा अन्य सेवा शर्तों में उनके हित विरूद्ध कोई परिवर्तन नहीं किया जायेगा।

No. 2/Stha-01-24/2008 -2347/DM—In exercise of Powers conferred by section-14 &78 of the Disaster Management Act, 2005 (53 of 2005), the Governor of Bihar is pleased to make the following Rules to amend the Disaster Management (Term of Office and Conditions of Service of the Members of the State Authority and Pay and Allowances to the Members of the Advisory Committee), Rules 2008 - (As amended from time to time) 1. Short title, extent and commencement :-

(1) These rules may be called the Disaster Management (Term of Office and Conditions of Services of Members of the State Authority and Pay and Allowances to the Members of the Advisory Committee) (Amendments) Rules -2018.

(2) It shall come into force at once:

Provided that in case of existing vice chairman and members of the authority, it shall be deemed to be come into force from their dates of assuming their posts.

2. The sub-rule (v)(b) of rule 4 of the Disaster Management (Term of Office and Condition of Service of the Members of the State Authority and Pay and Allowances to the Members of the Advisory Committee) Rules, 2008 shall be substituted by the following:-

"(v) (b) A person nominated as a full time member of the State Authority shall exercise his/her option to choose either :-

Pay (minus pension to the last pay drawn in the case of a retired officer), dearness allowance, House rent Allowance (in case Govt. accommodation is not available), medical facilities, travelling allowance, leave travel concession as admissible to a Principal Secretary including officials higher than Principal Secretary in the Government of Bihar and leave as admissible to a Government servant under the All India Services (Leave) Rules, 1955:

Provided that the amount less than the basic pay received minus original pension (with commutation) in the pay scale of the post which he/she hold at the time of retirement, which may be higher than the Principal Secretary shall not be payable.

or,

Pay, daily allowance as admissible to a Minister of State in the Government of Bihar, and pension (without dearness relief in case of a Member who is a retired officer), accommodation, medical facilities, travelling allowance as admissible to a Minister of State in the Government of Bihar in accordance with the Ministers of Bihar (Pay & Allowances), Rules 2006, (as amended from time to time):

Provided that, no change will be made to the pay and allowances or other service conditions of the Vice Chairman/ Member to their disadvantage after their appointment."
