सं॰ 21/बी॰पी॰एस॰सी॰(स्था॰)-11/2018-10757/सा॰प्र॰—भारत संविधान के अनुच्छेद-320 के खंड-3 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल ''बिहार लोक सेवा आयोग (कार्य-सीमन) विनियमावली, 1957 (समय-समय पर यथा संशोधित) में निम्नलिखित संशोधन करते हैं :-
संशोधन
उक्त विनियमावली में विनियम-7(स) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा ; यथा- 7(स) राज्य सेवाओं/संवर्गों के विभिन्न वेतनमान के पदों पर नियुक्तियों के मामलों में, निम्नलिखित को छोड़कर, आयोग से परामर्श करना आवश्यक नहीं होगा-
(i) राज्य सेवाओं/संवर्गों की मूल श्रेणी (बेसिक ग्रेड) के पदों पर नियुक्ति;
परन्तु, सहायक अभियंता, चिकित्सक एवं पशु-चिकित्सक - पदों पर नियुक्तियों के मामलों में आयोग से परामर्श करना आवश्यक नहीं होगा;
(ii) किसी भी सेवा/संवर्ग के उच्चतम वेतनमान के पद पर नियुक्ति/प्रोन्नति ; (iii) किसी भी सेवा/संवर्ग के किसी विभागाध्यक्ष के पद पर नियुक्ति/प्रोन्नति; परन्तु, यह अखिल भारतीय सेवाओं के पदाधिकारियों की विभागाध्यक्ष के पद पर नियुक्तियों/प्रोन्नतियों के मामले में लागू नहीं होगा।
2. सहायक अभियंता, चिकित्सक एवं पशु चिकित्सक-पदों पर नियुक्ति के संबंध में विभिन्न विभागों द्वारा अधिसूचित प्रावधान इस हद तक संशोधित समझे जायेंगे।
3. यह तुरंत के प्रभाव से प्रवृत्त होगा। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 30 vxLrvxLrvxLrvxLr 2018 9 vxLr9 vxLr9 vxLr9 vxLr 2018201820182018 सं॰ 21/बी॰पी॰एस॰सी॰(स्था॰)-11/2018-10758/,सा॰प्र॰ सामान्य प्रशासन विभाग, बिहार, पटना की अधिसूचना संख्या 10757 दिनांक 09.08.2018 का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन अँग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जायेगा।

No.-21/B.P.S.C.(Estt.)-11/2018-10758/Ka—In exercise of the powers conferred by the proviso to clause (3) of Article 320 of the Constitution of India, the Governor of Bihar is pleased to make the following amendment in the Bihar Public Service Commission (Limitation of Functions) Regulations, 1957.
AMENDMENT
In the said Regulations, regulation-7(C) shall be substituted as below - 7(C) It shall not be necessary to consult the Public Service Commission in the case of Appointment to the Posts in different Scales of Pay in the State Services/ Cadres except in the following-
(i) In the case of Appointment to the posts in the basic grade of the State Services/Cadres;
provided that it shall not be necessary to consult the Commission in appointments to the posts of Assistant Engineer, Doctor and Veterinary Doctor;
(ii) Appointment/Promotion to the post of Highest Scale of any Service/Cadre;
(iii) Appointment/Promotion to the posts of any Head of the Department of any Service/Cadre;
Provided that, this will not apply in case of Appointments/Promotions of officers of All India Services to the Post of Head of the Department.
2. Provisions notified by the different Departments with regard to the appointment on the posts of Assistant Engineer, Doctor and Veterinary Doctor shall deemed to be amended up to this extent.
3. This will come in to force with immediate effect
