सं॰ 7/स्था0 (अरा0 उ0)-01/2018-3214—भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते है :- 1. स्ंक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह नियमावली "बिहार मद्य निषेध अवर सेवा (भर्त्ती एवं सेवा शर्त्त) (संशोधन) नियमावली, 2018 कही जा सकेगी।
(2.) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3.) यह तुरंत के प्रभाव से प्रवृत्त होगी। 2. "बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017" के नियम-1 (1) में संशोधन। उक्त नियमावली के नियम-1 (1) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-यह नियमावली "बिहार मद्य निषेध अवर सेवा नियमावली, 2017 कही जा सकेगी।
3. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 के नियम 3 (1) में संशोधन। :-उक्त नियमावली के नियम 3 का उपनियम (1) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-
" (1) इस संवर्ग का पद सोपान निम्नवत् होगा :-
(क) मद्य निषेध सिपाही ; (ख) सहायक अवर निरीक्षक, मद्य निषेेध ; (ग) अवर निरीक्षक, मद्य निषेेध ; (घ) निरीक्षक मद्य निषेेध।"
4. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 के नियम 4 में संशोधन।-(1) उक्त नियमावली, 2017 के नियम (4) का उपनियम (3) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
"(3) सहायक अवर निरीक्षक, मद्य निषेेध एवं निरीक्षक, मद्य निषेेध के शत प्रतिशत पद, प्रोन्नति द्वारा, वरीयता-सह-योग्यता के आधार पर क्रमशः मद्य निषेेध सिपाही एवं अवर निरीक्षक, मद्य निषेेध में से भरे जायेंगे।
(2) उक्त नियमावली 2017 के नियम 4 का उपनियम (4) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18 िसत(cid:23)बर 2018" (4) अवर निरीक्षक, मद्य निषेेध के कुल स्वीकृत बल के 50 प्रतिशत पद सीधी भर्त्ती द्वारा भरे जायेंगे। शेष 50 प्रतिशत पद वरीयता-सह-योग्यता के आधार पर, प्रोन्नति द्वारा सहायक अवर निरीक्षक मद्य निषेेध में से भरे जायेंगे। "
5. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 का नियम 11 में संशोधन।- उक्त नियमावली, 2017 का नियम 11 (1) निम्नलिखित द्वारा प्रतिस्थापित किया जाऐगा :-
"11 प्रोन्नति ।-सहायक अवर निरीक्षक, मद्य निषेेध के सभी पद, मद्य निषेेध सिपाही से एवं निरीक्षक मद्य निषेेध के सभी पद अवर निरीक्षक मद्य निषेेध से, वरीयता-सह-योग्यता के आधार पर, प्रोन्नति द्वारा भरे जायेंगे।"
6. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 के नियम 14 में संशोधन।-उक्त नियमावली, 2017 के नियम 14 का उप नियम (2) के खंड (ग) एवं (घ) निम्नलिखित द्वारा प्रतिस्थापित किए जाऐंगे :-
"(ग) निरीक्षक मद्य निषेेध, अवर निरीक्षक मद्य निषेेध एवं सहायक अवर निरीक्षक मद्य निषेेध का स्थानान्तरण/पदस्थापन, राज्य के विभिन्न जिलों एवं उत्पाद प्रमंडलों में आयुक्त उत्पाद, बिहार के द्वारा किया जा सकेगा।
(घ) जिला के अंदर मद्य निषेेध सिपाही, सहायक अवर निरीक्षक मद्य निषेेध, अवर निरीक्षक मद्य निषेेध एवं निरीक्षक मद्य निषेेध का स्थानान्तरण कार्यहित में जिला के सहायक आयुक्त मद्य निषेेध/अधीक्षक मद्य निषेेध के द्वारा किया जा सकेगा।"
7. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 के नियम 15 में संशोधन।ः- उक्त नियमावली, 2017 के नियम-15 का उपनियम (2) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
"(2) निरीक्षक मद्य निषेेध का कार्यक्षेत्र "मद्य निषेेध अनुमंडल" एवं अवर निरीक्षक मद्य निषेेध का कार्य क्षेत्र "मद्य निषेेध अंचल" होगा। मद्य निषेेध अनुमंडल एवं मद्य निषेेध अंचल का क्षेत्र वही होगा जो सरकार द्वारा राजस्व अनुमंडल एवं राजस्व अंचल के क्षेत्र के रूप में परिभाषित या विहित किया गया होें।" 8. बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली, 2017 के नियम 16 में संशोधन। ः-उक्त नियमावली, 2017 के नियम 16 का उपनियम (1) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
"(1) इस संवर्ग के सभी सदस्यों पर बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) के प्रावधान लागू होंगे।"
9. विविध संशोधन।-बिहार उत्पाद अराजपत्रित संवर्ग (भर्त्ती एवं सेवा शर्त्त) नियमावली 2017 में जहाँ कहीं भी पदनाम उत्पाद सिपाही, सहायक अवर निरीक्षक उत्पाद एवं अवर निरीक्षक उत्पाद का प्रयोग किया गया है क्रमशः मद्य निषेेध सिपाही, सहायक अवर निरीक्षक मद्य निषेेध एवं अवर निरीक्षक मद्य निषेेध द्वारा प्रतिस्थापित किये गये समझें जायेंगे।

No 7/Est. (Non.U.) -01/2018-3214— In exercise of the powers conferred by proviso to Article 309 of the Constitution of India the Governor of Bihar is pleased to make the following Rules to amend the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules, 2017 :-
1. Short title, extent and commencement.— (1) These Rules may be called "the Bihar sub-ordinate prohibition service (Recruitment and Service Conditions) (Amendment) Rules, 2018 .
(2) It shall extend to whole of the State of Bihar. (3) It shall come in to force with immediate effect. 2. Amendment in Rule 1 (1) of the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules 2017: - Sub rule (1) of Rule 1 of the said Rules, 2017 shall be substituted by the following :-These Rules may be called as "the Bihar sub-ordinate prohibition service Rules, 2017."
3. Amendment in Rule 3 (1) of the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules 2017. - Sub rule (1) of Rule 3 of the said Rules, 2017 shall be substituted by the following :-
"(1) Hierarchy of the post of this Cadre shall be as follows :—
(a) Prohibition Constable; (b) Assistant Sub Inspector, Prohibition; (c) Sub Inspector, Prohibition; (d) Inspector, Prohibition."3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18 िसत(cid:23)बर 2018 4. Amendment in Rule 4 of the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules, 2017.- (1) Sub rule (3) of the Rule 4 of the said Rules, 2017 shall be substituted by the following:—
"(3) Cent percent posts of Assistant Sub – Inspector, Prohibitions and Inspector, Prohibition shall be filled up by promotion from the prohibition Constable and Sub Inspector, Prohibition respectively on the basis of seniority – cum eligibility." (2) Sub rule (4) of the Rule 4 of the said Rules, 2017 shall be substituted by the following:-
"(4) 50 percent posts of the total sanctioned strength of Sub-Inspector, Prohibition shall be filled up by direct recruitment . Remaining 50 percent posts shall be filled up by promotion from amongst the Assistant Sub-Inspectors on the basis of seniority cum- eligibility.
5. Amendment Rule 11 of the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules, 2017:- Rule 11 (1) of the said Rules, 2017 shall be substituted by the following:-
"11 Promotion. – (1) All posts of the Assistant Sub-Inspectors, Prohibition shall be filled up by Prohibition Constables and all posts of the Inspector, Prohibition by promotion from the Sub- Inspectors, Prohibition on the basis of Seniority-cum- eligibility."
6. Amendment in Rule 14 of the Bihar Excise Non-Gazetted Cadre (Recruitment and Service Conditions) Rules, 2017.-Clauses (c) and (d) of sub rule (2) of Rule 14 of the said Rules, 2017 shall the substituted by the following :—
"(c) Transfer / Posting of the Inspector, Prohibition, Sub-Inspector, Prohibition and Assistant Sub-Inspector, Prohibition may be made by the Excise Commissioner in the different Districts and Excise Divisions of the state.
(d) Transfer of Prohibition Constables, Assistant Sub-Inspectors, Prohibition and Inspectors, Prohibition may be made within the districts, in the interest of work, by the Assistant Commissioner, Prohibition / Superintendent, Prohibition ."
7. Amendment in Rule 15 of the Bihar Excise Non-Gazetted cadre (Recruitment and Service Conditions) Rules, 2017.- Sub rule (2) of Rule 15 of the said Rules, 2017 shall be substituted by the following:-
"(2) Prohibition Sub-division will be the work area of the Inspector, Prohibition and Prohibition circle will be the work area of the Sub-Inspector. Prohibition Areas of the Prohibition sub-division and Prohibition Circle will be the same as may be defined or prescribed as the areas of the Revenue Sub division and Revenue Circle by the Government .
8. Amendment in Rule 16 of the Bihar Excise Non-Gazetted cadre (Recruitment and Service Conditions) Rules, 2017 .- Sub rule (1) of Rule 16 of the said Rules, 2017 shall be substituted by the following:-
"(1) Provisions of the Bihar Government servant (Classification Control and Appeal) Rules, 2005 (as amended from time to time) shall apply to all the members of this Cadre.
9. Miscellaneous Amendment.–Wherever designations "Excise Constable", "Assistant sub- Inspector, Excise" and "Sub-Inspector, Excise", used in the Bihar Excise Non Gazetted Cadre (Recruitment and Service – Conditions) Rules, 2017 shall be deemed to be substituted by the "Prohibition Constable", "Assistant Sub-Inspector, Prohibition" and "Sub-Inspector, Prohibition" respectively.
