सं॰ एल0जी0-06-05/2018/7722/जे0—प्रस्तावना।-चूँकि माननीय उच्चत्तम न्यायालय द्वारा अवैध प्राणदंड एवं भीड़ द्वारा हत्या या हिंसा के मामलों में पीड़ितों को प्रतिकर देने हेतु राज्यों को निदेश दिया गया है जिसका अनुपालन आवश्यक एवं समीचीन है।
इसलिए, अब, दण्ड प्रक्रिया संहिता, 1973 (अधिनियम संख्या-2,1974) की धारा-357क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार सरकार अवैध प्राणदंड एवं भीड़ द्वारा हत्या या हिंसा के मामलों में पीड़ितों को प्रतिकर देने हेतुु निम्नलिखित स्कीम बनाती हैः-
1 संक्षिप्त नाम, विस्तार एवं आरंभ ।-
(1) यह स्कीम बिहार अवैध प्राणदंड एवं भीड़ द्वारा हत्या या हिंसा पीड़ित प्रतिकर स्कीम, 2018 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।
(3) यह तुरंत प्रवृत होगी।
2. उक्त स्कीम, 2018 का कार्यान्वयन ।- बिहार पीड़ित प्रतिकर स्कीम, 2014 (समय समय पर यथा संशोधित) के संबंधित प्रावधानो के अनुसार इस स्कीम का भी कार्यन्वयन किया जायेगा।
3. इस स्कीम के अधीन प्रतिकर की संगणना करते समय सरकार शारीरिक उपहत्ति, मनोवैज्ञानिक उपहत्ति की प्रकृति तथा नियोजन एवं शिक्षा के अवसरो की हानि तथा वैध एवं चिकित्सा खर्चो पर उपगत व्यय सहित उपार्जन की हानि का सम्यक ध्यान रखेगी।
4. अवैध प्राणदंड एवं भीड़ द्वारा हत्या/हिंसा की घटना के तीस दिनों की कालावधि के भीतर पीड़ितों के अथवा मृतक के निकट संबंधी को अंतरिम राहत दी जायेगी।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18 िसत(cid:23)बर 2018 5. अवैध प्राणदंड एवं भीड़ द्वारा हत्या या हिंसा के मामलो के त्वरित निपटारे के लिए प्रत्येक जिले में एक त्वरित न्यायालय अभिहित किया जाएगा जो प्रतिदिन मामलों का विचारण कर संज्ञान लेने की तिथि से छह माह के भीतर विचारण को समाप्त करेगा।
6. पीड़ितों अथवा मृतक के निकट संबंधियों को जिला विधिक सेवा प्राधिकार द्वारा मुफ्त विधिक सहायता की जायेगी। पीड़ितों तथा मृतक के निकट संबंधियों को अंतरिम सहायता तथा प्रतिकर की राशि का भुगतान जिला विधिक सेवा प्राधिकार द्वारा किया जायेगा।
7. उक्त स्कीम, 2018 के अधीन प्रतिकर की राशि निम्नलिखित अनुसूचीः-। के अनुसार होगी। अनुसूची-1

सं॰ एल0जी0-06-05/2018/7722/जे0—Preamble.- Whereas the direction has been given by the Hon'ble Supreme Court to the States to make the compensation scheme for the victims of lynching and mob violence compliance which is necessary and expedient.
Now, therefore, in exercise of the powers conferred by section 357A of The Code of Criminal Procedure, 1973, the Government makes the following scheme for giving compensation to the victims of lynching and Mob Violence:—
1. Short title, extent and commencement.— (1) This scheme may be called The Bihar Lynching and Mob Violence Victim Compensation Scheme, 2018.
(2) It shall extend to the whole state of Bihar. (3) It shall come into force at once. 2. Implementation of this Scheme,2018.- Implementation of this scheme shall be made according to the related provisions of the Bihar Victim Compensation Scheme, 2014(as amended from time to time).
3. Under this scheme for computation of compensation, the governments will have regard to the nature of bodily injury, psychological injury and loss of earnings including loss of opportunities of employment and education and expenses incurred on account of legal and medical expenses.
4. Interim relief will be paid to the victim (s) or to the next of kin of the deceased within a period of thirty days of the incident of lynching and mob violence.
5. In each district for speedy disposal of the cases of lynching and mob violence, a Speedy Trial Court will be designated which will conclude the trial after day to day trial basis of the cases within six months from the date of taking cognizance.
6. Free legal aid will be given to the victims or the next kin to deceased by the District Legal Services Authority. Interim relief and payment of amount of the compensation will be made by the District Legal Services Authority to the victim(s) and next kin of the deceased.
7. The amount of compensation under this scheme, 2018 shall be as per the following "schedule 1".—
