(स(cid:27)(cid:24) पटन(cid:4) (cid:29)(cid:29)(cid:30)) पटन(cid:4)(cid:31) श१!व(cid:4)र(cid:31) 28 (cid:22)सत(cid:24)बर 2018 अल्पसंख्यक कल्याण विभाग ——— vf/klwpukvf/klwpukvf/klwpukvf/klwpuk 22220000 flrEcj 2018flrEcj 2018flrEcj 2018flrEcj 2018 सं॰ अ॰स॰क॰-01 (छात्रावास)-119/2016-1527—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल ''छात्रावास प्रबंधक, अल्पसंख्यक कल्याण संवग'' में भर्त्ती की प्रक्रिया तथा सेवा शर्त्ताें को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

1. संक्षिप्त नाम, विस्तार और प्रारम्भ।- (i) यह नियमावली ''छात्रावास प्रबंधक, अल्पसंख्यक कल्याण संवर्ग नियमावली, 2018'' कही जा सकेगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह तुरत प्रवृत होगी। 2. परिभाषाएँ । - जब तक कि संदर्भ अथवा विषय से अन्यथा अपेक्षित न हो इस नियमावली में। :-

(i) ''नियुक्ति प्राधिकार'' से अभिपे्रत है प्रधान सचिव/सचिव, अल्पसंख्यक कल्याण विभाग (ii) ''संवर्ग'' से अभिप्रेत है छात्रावास प्रबंधक, अल्पसंख्यक कल्याण संवर्ग (iii) ''सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (iv) ''आयोग'' से अभिप्रेत है बिहार तकनीकी कर्मचारी चयन आयोग; (v) ''विभाग'' से अभिप्रेत है बिहार सरकार का अल्पसंख्यक कल्याण विभाग;

3. संवर्ग का गठन। - यह संवर्ग एक राज्यस्तरीय होगा। इस संवर्ग में निम्नलिखित पद होंगे -

संवर्ग के स्वीकृत पदों की संख्या वही होगी जो सरकार द्वारा समय-समय पर स्वीकृत अथवा अवधारित की जाय।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 28 (cid:22)सत(cid:24)बर 2018 4. संवर्ग में प्रवेश बिन्दु एवं सम्पुष्टि की प्रक्रिया।-

(1) संवर्ग की मूल कोटि का पद छात्रावास प्रबंधक, अल्पसंख्यक कल्याण का पद होगा, जिसपर आयोग द्वारा अनुशंसित मेधासूची से नियुक्ति की जाएगी।

(2) इस पद पर सीधी भर्ती की न्यूनतम शैक्षणिक योग्यता, किसी मान्यता प्राप्त विश्वविद्यालय/ संस्थान से (i) बी.एस.सी. (आतिथ्य एवं होटल प्रशासन) या (ii) स्नातक तथा होटल मैनेजमेंट में पोस्ट ग्रेजुएट डिप्लोमा होगी। सीधी भर्ती के लिए प्रत्येक वर्ष की 1ली अप्रैल को उपलब्ध रिक्ति की आरक्षण कोटिवार अधियाचना आयोग को उपलब्ध करायी जायेगी। सीधी भर्ती के लिए चयन की प्रक्रिया का निर्धारण आयोग द्वारा किया जायेगा।

(3) छात्रावास प्रबंधक, अल्पसंख्यक कल्याण को इस पद पर नियुक्ति की तिथि से परिवीक्षाधीन घोषित किया जायेगा। परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा/कार्यकलाप संतोषजनक रहने, विभागीय दायित्वों का पूर्ण निर्वहन करने तथा अवधारित विभागीय परीक्षा में उतीर्णता प्राप्त करने पर छात्रावास प्रबंधक, अल्पसंख्यक कल्याण के पद पर उनकी सेवा सम्पुष्टि की जायेगी। परीक्ष्यमान अवधि में सेवा संतोषजनक नहीं रहने पर लिखित रूप से अभिलिखित किये जा सकने वाले कारणों से परीक्ष्यमान अवधि को एक वर्ष के लिये बढ़ाया जा सकेगा। विस्तारित अवधि में भी कार्यकलाप संतोषजनक नहीं रहने पर परिवीक्षाधीन व्यक्ति को सेवा से पदच्यूत कर दिया जायेगा।

(4) सीधी भर्ती से नियुक्त पदाधिकारी को राजभाषा निदेशालय द्वारा आयोजित हिन्दी-टिप्पण/ प्रारूपण परीक्षा में एक वर्ष के अन्दर उत्तीर्णता प्राप्त कर लेने के पश्चात्‌ ही वार्षिक वेतन वृद्धि देय होगा। प्रथम वेतन वृृद्धि के पश्चात्‌ अगली वेतन वृृद्धि विभागीय परीक्षा उत्तीर्ण होने पर ही दी जा सकेगी।

5. विभागीय परीक्षा के लिए विषय, पाठ्‌यक्रम एवं प्रक्रिया का निर्धारण केन्द्रीय परीक्षा समिति, राजस्व पर्षद, बिहार, पटना द्वारा किया जा सकेगा।

6. आरक्षण।- सरकारी सेवाआें में नियुक्ति/प्रोन्नति हेतु राज्य सरकार द्वारा निर्धारित आरक्षण संबंधी नीति/रोस्टर का अनुपालन आवश्यक होगा।

7. संवर्ग के सदस्यों पर प्रशासनिक नियंत्रण।-

(1) संवर्ग का प्रशासी विभाग अल्पसंख्यक कल्याण विभाग, होगा जो संवर्ग के सदस्यों पर प्रशासनिक नियंत्रण रखेगा।

(2) परिचालनात्मक (ऑपरेशनल) नियंत्रण-छात्रावास प्रबंधक, अल्पसंख्यक कल्याण संबंधित जिले के जिला अल्पसंख्यक कल्याण पदाधिकारी के परिचालनात्मक नियंत्रण में रहेंगे।

8. वरीयता का निर्धारण।- आयोग की अनुशंसा के आधार पर नियुक्त छात्रावास प्रबंधक, अल्पसंख्यक कल्याण की पारस्परिक वरीयता आयोग द्वारा निर्धारित मेधासूची के अनुरूप होगी।

9. प्रकीर्ण विषय।- इस नियमावली या इस नियमावली केे अधीन जारी किये गये आदेशों से अनाच्छादित मामलों के संबंध में इस सेवा के सदस्य राज्य सरकार के समुचित स्तर के कार्मिकों के संबंध में लागू संहितायें/ नियमावली/संकल्प/अनुदेश द्वारा शासित होंगे।

10. निर्वचन।- इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई शंका उत्पन्न होने पर विषय विभाग को निदेशित किया जायेगा और इस संबंध में विभाग द्वारा विधि विभाग के परामर्श के पश्चात्‌ किया गया विनिश्चय अंतिम होगा।

11. विनियमावली बनाने की शक्ति।- इस नियमावली में विहित प्रावधानों को क्रियान्वित करने के लिए राज्य सरकार द्वारा विनियमावली का गठन किया जा सकेगा।

12. कठिनाई दूर करने की शक्ति।- प्रधान सचिव/सचिव, अल्पसंख्यक कल्याण विभाग, बिहार, पटना इस नियमावली के किसी भी प्रावधान को क्रियान्वित करने में उत्पन्न होने वाली कठिनाईयों को सरकार के अनुमोदन से ऐसे सामान्य या fo'ksष आदेश द्वारा जो इस नियमावली के प्रावधानों से असंगत न हो, विधि विभाग से परामर्श के पश्चात्‌ दूर कर सकेंगे।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 28 (cid:22)सत(cid:24)बर 2018 13. निरसन एवं व्यावृति।-

(1) इस संवर्ग के संबंध में विभाग द्वारा समय-समय पर पूर्व में निर्गत सभी संकल्प/ नियमावली/आदेश आदि एतद्‌द्वारा निरसित किये जाते हैं।

(2) ऐसे निरसन के होते हुए भी पूर्व में निर्गत संकल्प/नियमावली/आदेश आदि के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्ति का प्रयोग करते हुए किया गया समझा जाएगा, मानो यह नियमावली उस तिथि को प्रवृत्त थी, जिस तिथि को ऐसा कोई कार्य या ऐसी कोई कार्रवाई की गई थी।

No. M.W.D.-01(Hostel)-119/2016-1527—In exercise of the power conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules for regulating the process of recruitment and service conditions of "Hostel Manager, Minority Welfare Cadre" :-

1. Short title, extent and commencement :-

(i) These rules may be called the "Hostel Manager, Minority Welfare Cadre Rules, 2018."

(ii) It shall extend to whole of the state of Bihar. (iii) It shall come into force at once.

2. Definitions.—Unless otherwise required in the context or subject, in these Rules:-

otherwise requires :-

(i) "Appointing Authority" means Principal Secretary/Secretary Minority Welfare Department.

(ii) "Cadre" means Hostel Manager, Minority Welfare Cadre ; (iii) "Government" means the Government of Bihar ; (iv) "Commission" means Bihar Technical Staff Selection Commission ; (v) "Department" means Minority Welfare Department, Bihar ;

3. Constitution of Cadre.— This cadre shall be a state level cadre. The following posts

The number of posts in this Cadre shall be such as sanctioned or determined by the Government from time to time.

4. Entry point into the Cadre and process of confirmation

(1) The post of basic category of the Cadre shall be the post of the Hostel Manager, Minority Welfare, on which appointment will be made from the merit list recommended by the Commission.

(2) The minimum educational qualification for direct recruitment shall be (i) B.Sc (Hospitality and Hotel Administration) or (ii) Graduate and Post graduate diploma in Hotel management from any recognized university/ institution. On the 1st of April every year, reservation category wise requisition for direct requirement against available vacancy shall be made to the Commission. Determination of selection process for direct recruitment shall be made by the Commission.

(3) The Hostel Manager, Minority Welfare shall be declared as probationers from the date of appointment. The probation period shall be of two years. Confirmation of their service to the post of Hostel Manager, Minority Welfare will be made during the probation period only after their being satisfactory service/activities, complete discharge of the departmental liabilities and passing the determined departmental exams. On being not satisfactory service during the probation period, the probation period may be extended for one year with reasons to be recorded in writing. On being not satisfactory service even in the extended period, the probationer shall be dismissed from the service.

(4) Only after passing the Hindi Noting-Drafting Exam conducted by the Raj Bhasha Directorate within a year, annual pay increment will be admissible to the officers appointed by direct recruitment. After the first pay increment, the next increment shall be granted only after passing the Departmental Examination.

5. The subject, syllabus and process for Departmental Examination shall be determined by the Central Examination Committee, Board of Revenue, Bihar.

6. Reservation.—Compliance of reservation policy/roster for the appointment/Promotion in Government services shall be compulsory.

7. Administrative control over members of the cadre.—

(1) The Minority Welfare Department shall be the Controlling Department of the cadre and the Department shall have administrative control over the members of the cadre.

(2) Operational control :- The Hostel Manager, Minority Welfare shall be under the operational control of the District Minority Welfare Officer of the concerned District.

8. Determination of Seniority.—The Inter-se seniority of the Hostel Manager, Minority Welfare shall be in conformity with the merit list determined by the Commission.

9. Miscellaneous matter.—With regard to matters not specifically covered by these Rules or Orders issued under these rules, the members of this Cadre shall be governed by the Codes/Rules/Resolution/Orders applicable to the employees of the appropriate level of the state government.

10. Interpretation.—On arising any doubt with regard to interpretation of any provision of these Rules, the matter will be referred to the Department and the decision taken, after consultation with Law Department, by the department in this respect shall be final.

11. Power to make regulation.—For implementation of the provisions prescribed under these Rules, necessary regulations may be constituted by the state government.

12. Power to remove difficulty.—The Principal Secretary/Secretary, Minority Welfare Department, Bihar, Patna after consultation with the Law Department may remove any difficulty arising in implementing any provision of these Rules by general or special orders not inconsistent with any provision of these Rules, with approval of the government.

13. Repeal and Saving :-

(1) All Resolutions/Rules/Orders already issued by the department in respect of this cadre, from time to time are hereby repealed.

(2) Notwithstanding such repeal, any act done or any action taken in exercise of the powers conferred by such previously issued Resolution/Rules/Order etc. shall deemed to be done or taken under these Rules as if these Rules were in force on the date on which such act was done or such action was taken.
