एस0ओ0 270 दिनांक 6 नवम्बर 2018—दंड प्रक्रिया संहिता, 1973 (अधिनियम 2 वर्ष 1974) की धारा-11 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार-राज्यपाल, माननीय उच्च न्यायालय, पटना के परामर्श से, सी0बी0आई0 द्वारा अनुसंधानित, दंडाधिकारी द्वारा विचारणीय, सभी मामलों के त्वरित विचारणार्थ, विभागीय अधिसूचना ज्ञापांक- 2218/जे0, दिनांक 01.07.2005 एवं अधिसूचना ज्ञापांक-1534/जे0, दिनांक 13.05.2006 तथा इस विषय पर निर्गत पूर्व अधिसूचनाओं को उपातंरित करते हुए एतद् द्वारा पटना में सी0बी0 आई0 द्वारा अनुसंधानित, दंडाधिकारी द्वारा विचारणीय, सभी वादों (भ्रष्टाचार निवारण अधिनियम, 1988 के अधीन दायर वादों को छोड़कर) के त्वरित विचारणार्थ, पटना स्थित अंशकालिक विशेष न्यायाधीश-I (सी0बी0आई0, पटना) एवं अतिरिक्त विशेष न्यायिक दंडाधिकारी-II (सी0बी0आई0, पटना) के न्यायालयों को मिलाकर, न्यायिक दंडाधिकारी (मुंसिफ) का एक अनन्य विशेष न्यायालय स्थापित करते हैं जिसका क्षेत्राधिकार पूर्व में पटना स्थित उक्त दोनों न्यायालयों के क्षेत्राधिकारों को मिलाकर होगा; तथा पटना स्थित उक्त दोनों न्यायालयों से संबंधित सभी वादों को, एतद् द्वारा पटना में स्थापित अनन्य विशेष न्यायालय में अंतरित करते हैं।
(2) एतद् विषयक पूर्व निर्गत विभागीय अधिसूचना ज्ञापांक-2218/जे॰, दिनांक 01.07.2005 एवं 1534/जे॰, दिनांक 13.05.2006 भ्रष्टाचार निवारण अधिनियम, 1988 (धारा-3) के बदले दंड प्रक्रिया संहिता 1973 की धारा 11 की उपधारा (1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, निर्गत समझा जाए। पूर्व निर्गत उक्त दोनों विभागीय अधिसूचनाओं एवं अन्य संबंधित अधिसूचनाओं को उपर्युक्त हद तक संशोधित किया जाता है।
यह अधिसूचना राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगी। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 6 नव(cid:22)बर 2018 2 uoEcj 2018 एस0ओ0 271, एस0ओ0 270 दिनांक 6 नवम्बर 2018 का अंगे्रजी में निम्नलिखित अनुवाद बिहार राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारतीय संविधान के अनुच्छेद-348 के खण्ड(3) के अधीन उसका प्राधिकृत पाठ समझा जायेगा।

S.O. 270, Date 6th November, 2018— In exercise of the powers conferred by sub section-(1) of section-11 of the Code of Criminal Procedure 1973 (Act 2 of 1974) and modifying the notification memo no.- 2218/J dated 01.07.2005 and notification memo no.-1534/J dated 13.05.2006 of Law Department, Bihar, Patna and other previous notifications issued on the subject for speedy trial of the magisterial trial cases investigated by C.B.I., the Governor of Bihar, in consultation with the Hon'ble High Court of the Judicature at Patna, is hereby pleased to establish one Exclusive Court of Judicial Magistrate (Munsif) at patna, for speedy trial of all the magisterial trial cases (other than cases filed under the Prevention of Corruption Act, 1988) investigated by C.B.I. amalgamating the Courts of Part time Special Magistrate (C.B.I. Patna)-I and Additional Special Judicial Magistrate (C.B.I. Patna)-II situated at Patna whose Jurisdiction shall be consisting of the Jurisdictions of the two aforesaid courts already situated at Patna; and transfer all the cases related to the aforesaid two courts at Patna to the Exclusive Special Court established hereby at Patna.
(2) Previous departmental notifications, issued on the subject, memo no.-2218/J dated 1.7.2005 and 1534/J dated 13.05.2006 should be read and treated issued under sub section (1) of section 11 of the Code of Criminal Procedure 1973 in place of the Section 3 of Prevention of Corruption Act, 1988. The aforesaid two previous departmental notifications and other related notifications are hereby amended to the extent aforesaid.
This notification shall come into force from the date of its publication in the official gazette.
