सं0 31/आ॰प्र॰-03/2017-665—बंगाल नौ घाट अधिनियम, 1885 के अधीन दरभंगा प्रमंडल के अन्तर्गत आने वाले जिलों में नावों के परिचालन हेतु संलग्न नियमावली अधिसूचित किया जाता है।

यह नियमावली बंगाल नौ घाट अधिनियम, 1885 के अधीन आदर्श नियमावली, 2018 कहा जायेगा। आदेशः- आदेश दिया जाता है कि इस नियमावली को सर्व-साधारण की जानकारी हेतु इसके हिन्दी एवं अंग्रजी प्रति को बिहार राजपत्र के आसाधरण अंक में प्रकाशित की जाय।

आदेश से, मयंक बरबड़े, आयुक्त।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 बंगाल नौ-घाट अधिनियम, 1885 के अधीन नियमावली, 2018 परिचय नौका दुर्धटना इतनी आम हो गयी है कि देशी नावों से यात्रा करने वालों की सुरक्षा सुनिश्चित करने के लिए अपायों साधनों की तलाश करना अति महत्वपूर्ण मुद्‌दा बन गया है। अधिकांश नौकाएँ अनावृत्त है और उनमें सवारियों एवं सामान के लिए अपेक्षित न्युनतम स्थान के अतिरिक्त शायद ही कोई स्थान रहता है। आने वाले काफी समय तक पारम्परिक बनावट वाली लकड़ी की देशी नावों का प्रचलन नियत है। इसलिये, देशी नावों पर नियंत्रण रखना आवश्यक है ताकि उन्हें यथासंभव जल में चलाने योग्य रखा जाए तथा परिवहन का सुरक्षित साधन उपलबध हो। जीवन की अपेक्षित सुरक्षा हो इसके लिए आवश्यक है कि नावों का भली भांति रख-रखाव हो एवं वे जीवन एवं अग्नि रक्षक न्यूनतम उपकरणों से सज्जित हों। बांछित सुरक्षा के लिए नावों के निरीक्षण की अनिवार्य व्यवस्था आवश्यक है। इसके अतिरिक्त यह भी आवश्यक है कि नावों में पर्याप्त सुरक्षित उत्प्लावकता हो, उनके विस्तार परिमित हो, टनेज, माल एवं यात्री ढोने की क्षमता का सही-सही आवकलन हो। लदान रेखा बने चिन्हित करने के लिए शीर्षन्तर काूे निर्धारित करना है और वह किसी भी परिस्थिति में डुबोयी नहीं जायगी, नाव को संचालित करने के लिए आवश्यक न्यूनतम नाविक दल एवं नाव में न्यूनतम सुरक्षा उपकरणों की उपलब्धता विनिर्दिष्ट करना आवश्यक है। इन सभी उपयों से नाव निश्चित रूप से सुरक्षित हो जाऐंगे। ऐसे उपायों को तभी क्रियान्वित किया जा सकता है, जब नावे रजिस्ट्रीयकृत और अनुज्ञप्त होगी। देशी नौकाओं का रजिस्ट्रीकरण और लाईसेंस युक्त करने से बाढ़ एवं तुफान जैसी प्राकृतिक आपदाओं की स्थिति में बचाव के प्रयोजनार्थ अध्यपेक्षा करने में सहूलियत होगी।

बिहार राज्य में बंगाल नौ-घाट अधिनियम, 1885 लागू है। वर्त्तमान नियमावली बनाने में सभी सुरक्षा घटकों को दृष्टिगत रखा गया है। बंगाल नौ-घाट अधिनियम, 1885 एवं भारतीय दण्ड संहिता में विहित शास्तियाँ एवं दांडित प्रक्रिया लागू होंगी।

नियमावली-2018 1. ये बंगाल नौ-घाट अधिनियम, 1885 के अन्तर्गत नियमावली 2018 है। यह नियमावली दरभंगा प्रमंडल अन्तर्गत तीनों जिला यथा दरभंगा, मधुबनी एवं समस्तीपुर में तत्काल प्रभाव से प्रवृत्त होगा।

2. परिभाषाएँ :-इन नियमों में जब तक की संदर्भ में अन्यथा अपेक्षित न हो :-

(क) ''नाव'' से अभिप्रेत है बीस ब्रिटिश अश्व-शक्ति से कम शक्ति के इंजन युक्त यंत्र चालित जलयानों सहित भुट-भुटी, नाव डेंगी, घाटाहा, लाँग टेल ड्राइव आदि जैसे किसी भी नाम से पुकारे जाने वाले 15 मीटर तक लम्बे जलयान।

(ख) ''यात्री नाव'' से अभिप्रेत है कोई नाव, जो सामान्यतः 'नाविक' अथवा 'मॉझी' अथवा बोटमैन से भिन्न व्यक्तियों को ढोती है।

(ग) ''मालवाहक नाव'' से अभिप्रेत है कोई नाव जो सामान्यः पशुओं समेत सभी प्रकार की चल या व्यक्तिगत्‌ सम्पत्ति ढोती है।

(घ) ''वर्ग-I नाव'' से अभिप्रेत है सीधी कीलयुक्त जहाजनुमा लोहा या लकड़ी या फाईबर रीइनफोरर्ड प्लास्टिक या फेरो सिमेंट से निर्मित लम्बी पतली डेंगी या उत्प्लाव।

(ड़) ''वर्ग- II नाव'' से अभिप्रेत है अनावृत देशी नौकाएँ या सेल बोट्‌स या वर्ग-1 नाव से भिन्न अन्य नाव। (च) 'प्रपत्र' से अभिप्रेत है इन नियमों के साथ संलग्न प्रपत्र (छ) ''वाह्‌य बोर्ड मोटर'' से अभिप्रेत है नाव को यंत्रवत्‌ चलाने हेतु प्रयोग किया जाने वाला इंजन और इसमें लाँग टेल तथा अन्य सदृश साधन शामिल है।

(ज) ''निबंधन पदाधिकारी'' से अभिप्रेत है बिहार मोटर गाड़ी नियमावली, 1992 के नियम 2 में यथापरिभाषित जिला परिवहन पदाधिकारी या निबंधन कार्य सम्पादित करने हेतु जिला दण्डाधिकारी द्वारा प्राधिकृत कोई अन्य व्यक्ति।

(झ) ''नाव सर्वेक्षक'' से अभिप्रेत है बिहार मोटर गाड़ी नियमावली, 1992 के नियम 2 में यथापरिभाषित मोटर यान निरीक्षक, नारव सर्वेक्षण में प्रशिक्षित नाव सर्वेक्षक के कार्यो को सम्पादित करने हेतु जिला दण्डाधिकारी द्वारा प्राधिकृत नाव सर्वेक्षण में प्रशिक्षित कोई अन्य व्यक्ति इसमें शामिल है।

() यहाँ अपरिभाषित किसी विशिष्ट शब्द का वही अर्थ है जो बंगाल नौ घाट अधिनियम, 1885 तथा अन्तर्देशीय जलयान अधिनियम, 1917 अथवा उसके अन्तर्गत गठित किसी नियमावली में परिभाषित है। (ट) ''नाविक'' अथवा ''माँझी'' से अभिप्रेत है, जो अनुज्ञापित नाव को परिचालित करने की अर्हता रखता हो। 3. मालवाहक और यात्री नावों का निबंधन तथा अनुज्ञापन

कोइ्र भी व्यक्ति, चाहे स्वामी या सेवक के रूप में माल या यात्री ढोने के लिये चाहे किराये पर या बिना किराये के नियमित या, कभी-कभी, नदियों, नहरों झीलों, जलभंडारों या अन्य जलाशयों में सेवा परिचालित नहीं करेगा, जबतक कि-3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 (क) प्रपत्र-II में नाव के निबंधन की और प्रपत्र- III में अनुज्ञप्ति की मंजूरी दे दी गयी है, और (ख) इन नियमों के साथ संलग्न परिशिष्ट 'क' में विनिर्दिष्ट निबंधन स्थल के परिधायक अक्षर समूह और आवंटित निबंधन संख्या नाव के दोनों तरफ 75 से0मी0 ऊँचा और दो से0मी0 चौड़ा के अन्यून आकृति में सफेद रंग से पेंट न कर दिया गया हो।

परन्तु यह कि सम्प्रति परिचालित हो रही नावों के संदर्भ में, गजट अधिसूचना से 30 दिनों के अन्दर नाव स्वामी नाव का निबंधन और अनुज्ञापन करा लेंगे। 4. निबंधन हेतु आवेदन पत्र

(1) नाव के निबंधन हेतु आवेदन प्रपत्र-IV में नाव स्वामी द्वारा निबंधन पदाधिकारी को लिखित में दिया जायगा।

(2) नाव के निबंधन हेतु आवेदन प्राप्त होने पर, निबंधन पदाधिकारी नियम 22 के तहत्‌ यथापेक्षित नाव की मापी के लिए नाव सर्वेक्षक को निदेश देगा और नियम 32 में विहित शुल्क की अदायगी पर विशिष्टियों की प्रतिष्टि प्रपत्र-I में संधारित होने वाली निबंधन पंजी में करेगा।

(3) प्रत्येक निबंधन प्रमाण पत्र या नवीकरण प्रपत्र-II में होगा।

5. स्वामित्व हस्तान्तरण

(क) जब कभी इन नियमों के तहत्‌ निबंधित नाव का स्वामित्व हस्तान्तरण किया जाता है, हस्तान्तरण से 14 दिनों के अन्दर हस्तान्तरणकर्त्ता हस्तान्तरण के तथ्य निबंधन पदाधिकारी को लिखित रूप में सूचित करेगा और

(ख) नियम 32 में विहित शुल्क के साथ पृष्ठांकन हेतु निबंधन प्रमाण-पत्र और (ग) ये हस्तान्तरण निबंधन पदाधिकारी द्वारा नामांतरित किये जायेंगे।

6. निबंधन का रद्‌दीकरण

नाव की निबंधन संख्या एक पहचान संख्या के रूप में उसके सम्पूर्ण कार्यरत जीवन के लिए प्रभावी रहेगा, जबतक कि

(क) नाव स्वामी के अनुरोध पर इसे रद्ध नही कर दिया जाता, या (ख) नाव की अनुज्ञप्ति लगातार दो वषो्र तक नवीकृत नहीं करायी जाती, या (ग) नाव सर्वेक्षक द्वारा नाव को अग्रतर सेवा के अयोग्य घोषित नही कर दिया जाता। या (घ) नाव पर खुदे संख्या मिट नहीं जाते।

7. लोड लाइन चिन्हित किया जाना

(1) गहराई को रेखांकित करने के लिये प्रत्येक नाव में काले पृष्टभूमि में सफेद रंग से पेंट किया हुआ 30 से0मी0 लम्बा, 15 से0मी0, चौड़ा, 2.5 से0मी0 खुदा या जड़ा स्पष्ट चिन्ह के द्वारा लोड लाईन इंगित रहेगा।

(2) मुक्तांश या सम्पूर्ण क्षमता से लदान पर डुब सकने वाली अधिकतम्‌ लोड लाईन नाव सर्वेक्षक के समक्ष निबंधन के समय नौका स्वामी द्वारा चिन्हित किया जायगा।

8. नाव के अनुज्ञापन हेतु आवेदन

(1) नयी अनुज्ञप्ति अथवा नवीकरण हेतु आवेदन नाव सर्वेक्षक को निबंधन पदाधिकारी को प्रतिलिपि सहित लिखित में दिया जायेगा।

(2) सर्वेक्षक आवेदन प्राप्ति से 30 दिनों के अंदर सर्वेक्षण प्रतिवेदन निबंधन पदाधिकारी को समर्पित करेगा। (3) आवेदक उस स्थान एवं समय पर नाव उपस्थापित करेगा जैसा नाव सर्वेक्षक परिचालन स्थल को प्राथमिकता देते हुए नाव के अनुज्ञापन के प्रयोजनार्थ निदेशित करेगा।

9. नाव अनुज्ञप्ति की शत्ते

किसी नाव के संदर्भ में अनुज्ञप्ति की मंजूरी नहीं दी जायगी जब तक कि नाव का सर्वेक्षण नाव सर्वेक्षक द्वारा नहीं कर लिया गया हो और यह स्वयं को संतुष्ट न कर लिया हो कि निम्नांकित शर्त्ते पूरी कर ली गई है यथा- (क) कि नाव अच्छी हालत में है और माल एवं यात्री ढोने के उपयुक्त है और इन नियमों के अनुरूप है : (ख) कि इन नियमों के नियम 22 के उपनियम 4 के तहत्‌ विहित तरीके से नाव का टनेज निर्धारित किया गया है।

(ग) कि ऐसे नाव के सुरक्षित परिचालन के लिए बांछित चालक-दल की संख्या इन नियमों के नियम 25 एवं 26 में विहित मापदंड के अनुरूप है।

(घ) कि ऐसे नाव में जमा पानी को पम्प करने, उलीचने अथवा अन्य रीति से निष्कासन के लिए पर्याप्त उपकरण और सुरक्षित नौकायन के लिए कारगर जमीनी टैक्ल, एन्करिंग तथा अन्य उपकरण और आवश्यक प्रकाश श्रोत उपलब्ध है।

(ड़) कि इन नियमों के नियम 23 के उपनियम 2 में विहित तरीके से पूरी क्षमता से लदी नाव का मुक्तांश का निर्धारण किया जाता है।

(च) कि नाव में न्यून्तम दो जीवन रक्षक छल्ले एवं एक प्राथमिक चिकित्सा पेटी उपलबध है। (छ) कि नाव, यदि इंजनयुक्त हो, में अग्निशामक उपलब्ध है।4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 (ज) कि यात्री-नाव के मामले में, सवार किए जा सकने वाले यात्रियों की अधिकतम संख्या मुख्य स्थान पर यात्रियों के सूचना हेतु चिन्हित की गयी है।

(झ) कि समिति बोर्ड के समरूप उपकरणों से चालित यात्री नावों के संदर्भ में नियम के तहत वांछित शर्त्ते अनुपालित है।

(ञ) सामान्यतः नाव सूर्योदय एवं सूर्यास्त के बीच परिचालित की जाएगी।

परन्तु यह कि आपातस्थिति में रात्रि उपयोग के लिए, विशेष प्रकाश व्यव्स्था जो नाव सर्वेक्षक द्वारा अनुमोदित की जाएगी आवश्यक होगी। 10. नौका अनुज्ञप्ति का निर्गमन

यदि नियम 8 एवं 9 में निहित शर्त्ते पूरी होती है तथा नियम-32 द्वारा विहित आवश्यक शुल्क का भुगतान कर दिया गया हो, नाव सर्वेक्षक -

(क) नाव मालिक को प्रपत्र-III में अनुज्ञप्ति निर्गत करेगा, जिसमें नाव की विशिष्टियाँ तथा प्रभारी नाविक या मॉझी का नाम अंकित होंगें।

(ख) प्रपत्र-I में संधारित निवंधन पंजी में नाव संबंधी आवश्यक विशिष्टियाँ अंकित कराएगा।

11. अनुज्ञप्ति की कालावधि

इस नियमावली के तहत प्रस्वीकृत प्रत्येक अनुज्ञप्ति प्रस्वीकृति की तिथि से तीन वर्ष के लिए मान्य होगा यदि इस नियमावली के प्रावधानों के तहत निरस्त नहीं कर दिया जाय।

12. अनुज्ञप्ति का हस्तांतरण

इस नियमावली के तहत प्रस्वीकृत अनुज्ञप्ति का हस्तांतरण नहीं होगा।

13. नाव अनुज्ञप्ति के नवीकरणर हेतु आवेदन

(1) नाव मालिक या उसके प्राधिकृत अभिकर्त्ता वर्ग-1 नाव के अनुज्ञप्ति के नवीकरण के लिए नाव सर्वेक्षक के पास लिखित आवेदन दिया जायगा जिसकी प्रति निबंधन पदाधिकारी को दी जायगी।

(2) वर्ग-II नाव के अनुज्ञप्ति की नवीकरण के लिए नाव मालिक या नाव के नाविक या मांझी के द्वारा स्वयं उपस्थित होकर आवेदन दिया जाएगा।

(3) अनुज्ञप्ति नवीकरण से पूर्व नाव सर्वेक्षण जाँच हेतु, परिचालन स्थल को प्राथमिकता देते हुए, नाव उपस्थापित करने की अपेक्षा करेगा, और यदि वह पाता है कि नाव नियम-9 में निर्दिष्ट शर्त्तो को पूरा करती है, एक वर्ष की अवधि के लिए मान्य अनुज्ञप्ति का नवीकरण कर सकेगा जिसके लिए नियम-32 में विहित शुल्क भुगतेय होगा।

(4) यदि मालिक, अभिकर्त्ता, नाविक या मांझी द्वारा नावों की अनुज्ञप्ति नवीकरण हेतु अनुज्ञप्ति की समाप्ति की तिथि से एक माह के अंदर आवेदन देने में असफल रहता है तो विहित दर का दुगुना दण्ड सहित अनुज्ञप्ति शुल्क अधिरोपित किया जायगा।

14. मांगे जाने पर अनुज्ञप्ति का उपस्थापन

(क) प्रत्येक परिचालित अनुज्ञप्ति नाव पर उसकी अनुज्ञप्ति रखी जाएगी जिसे पुलिस या जिला दण्डाधिकारी या जिला दण्डाधिकारी द्वारा विधिवत प्राधिकृत किसी पदाधिकारी या निबंधन पदाधिकारी या नाव-सर्वेक्षण द्वारा मांगे जाने पर प्रस्तुत किया जाएगा।

(ख) यात्री नाव के मामले में किसी यात्री द्वारा जांच हेतु मांग करने पर अनुज्ञप्ति प्रस्तुत करनी होगी। 15. अनानुज्ञापित नाव

यदि नाविक या मांझी नियम 14 में यथापेक्षित अनुज्ञप्ति प्रस्तुत नहीं कर पाता तो नाव अनानुज्ञापित मानी जा सकेगी जबतक की निबंधन पदाधिकारी या उनकी अनुपस्थिति में नौंका सर्वेक्षक को संतोषप्रद स्पीष्टीकरण नहीं दिया जाता। ऐसी स्थिति में अनुज्ञप्ति निर्गमन हेतु उसे निर्धारित शुल्क की तिगुनी राशि दण्ड के रूप में भुगतान करना होगा। 16. पुनर्सर्वेक्षण

जिला दण्डाधिकारी या निबंधन पदाधिकारी किसी भी समय अनुज्ञापित नौका को बिना किसी शुल्क के पुनर्सर्वेक्षण कराने हेतु नौका मालिक को आदेश दे सकेगा। 17. अनुज्ञप्ति का निरस्तीकरण

किसी नौका को प्रस्वीकृत अनुज्ञप्ति निरस्त किया जा सकेगा-

(क) जब कभी नाव सर्वेक्षक का यह मत हो की नाव उन उद्‌देश्यों, जिसके लिए वह अनुज्ञपित की गयी है, के लिए अयोग्य है

(ख) यदि नौका मालिक या उसके अभिकर्त्ता या नाव के प्रभारी किसी नाविक या मांझी द्वारा अनुज्ञप्ति की शर्तो अथवा नियमों का उल्लंघन किया गया है।

(ग) किसी भी समय, यदि जिला दण्डाधिकारी समुचित एवं पर्याप्त कारणों से ऐसा करना उपयुक्त समझते हो।5 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 18. द्वितीयक अनुज्ञप्ति

यदि किसी नौका को प्रस्वीकृत अनुज्ञप्ति खो जाती है, निबंधन पदाधिकारी, उक्त नाव के स्वामी अथवा प्राधिकृत अभिकर्त्ता के आवेदन पर मूल अनुज्ञप्ति का द्वितीयक प्रति जारी कर सकेगा, जिसके लिए नियम-32 में विहित मानक के अनुसार शुल्क आदेय होगा। 19. भार जल आरेख सूचक चिहन को नाव के लदान द्वारा पानी में डुबाने पर निषेध :-

माल वाहक अनुज्ञापित नाव का स्वामी या उसका अभिकर्त्ता या प्रभारी नाविक या मांझी उक्त नाव पर ऐसे लदान की अनुमति नही देगा जिसके भारजल आरेख सूचक चिन्ह जल में डूब जाय। 20. अनुज्ञापित नाव के दुर्घटनाग्रस्त होने पर ही की जाने वाली कार्रवाई :-

(1) जब कभी नाव में या किसी अन्य नाव के चलते घटित, दुर्घटना के कारण किसी व्यक्ति को गंभीर चोट या संपत्ति की क्षति हो तो नाव का प्रभारी नाविक या मॉझी तुरन्त निकटतम थाना में जाएगा और थाना प्रभारी तथा साथ ही साथ नाव सर्वेक्षक को भी दूर्घटना से संबंधित परिस्थितियों की सूचना देगा : (2) दुर्घटनाओं या अन्य कारणों से नाव के डूबने की स्थिति में नाव स्वामी या नाव परिचालक दल संबंधित प्राधिकार/पुलिस को तुरन्त वस्तुस्थिति से अवगत कराएगा। नाव स्वामी समुचित समय के अंदर नाव को निकालने के लिए आवश्यक कदम उठाएगा।

(3) जिला दण्डाधिकारी या निबंधन पदाधिकारी उसे निकालने के लिए तूरन्त कार्रवाई करेगा तथा इसका लागत व्यय बिहार लोक मांग वसूली अधिनियम 1914 के प्रावधानों के तहत निर्धारित समय के अंदर नाव स्वामी से, वसूली हेतु तुरन्त कार्रवाई करेगा।

21. नाव में एकत्रित पानी का निष्कासन

नाव का चालक दल यह सुनिश्चित करेगा कि नाव के पेंदे में जब-जब पानी एकत्रित हो, पम्प द्वारा या उलीचकर सुरक्षित नौका परिचालन हेतु निष्कासित कर दिया जायगा। 22. नावों की माप

(1) नाव की लम्बाई अन्दर से मस्तूल से पतवार तक मीटर में मापी जाएगी (2) चौड़ाई, नाव के बीचोंबीच डेक शहतीर के नीचे, छत के तख्ते के अंदर से दोनों पाश्वों के बीच मीटर में मापी जायगी, छतविहीनता की स्थिति में कील के उपरी भाग की मापी ली जायगी

(3) गहराई, नाव के बीचोंबीच डेक शहतीर के नीचले तल से छतदार फर्श के तखते के ऊपरी तल तक मापी ली जायगी

(4) निम्नलिखित सूत्र के द्वारा नाव का सकल टनेज निर्धारित किया जाएगा : सकेल टनेज = KV

जहाँ V= नाव में उपार्जित सभी आयाम का कुल आयतन घनमीटर में और K= गुणांक यथा

मध्यवर्ती आयतनों के लिए गुणांक का मान रैखिक अंतः स्थापन के द्वारा प्राप्त किया जा सकता है।6 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 23. लोड लाईन/मुक्तांश निर्धारण-विधि :-

(1) प्रत्येक नाव के बीचोबीच पाश्र्व पृष्ट पर 2.5 से0मी0 गहरा, 15 से0मी0 चौड़ा एवं 30 से0मी0 लम्बा खुदा या जड़ा हुआ और उजले रंग से पुता हुआ मुक्तांश या अधिकतम गहराई सूचक एक स्पष्ट चिह्‌न, जहाँ तक पूर्ण लदान की स्थिति में नाव जल में डुबायी जा सकेगी, रहेगा।

(2) साफ मौसम में गहराई के प्रत्येक मीटर पर 25 से0मी0 की दर से मुक्तांश की गणना की जायगी। मौनसून एवं अन्य बाढ़ के समय मुक्तांश इससे डेढ़ गुणा रहेगा

(3) यदि नाव सवारी और सामान दोनों ढ़ोने के लिए अनुज्ञापित हो, यह उसी तरह से मापित और लोडलाईन से चिन्हांकित की जायगी मानों यह केवल मालवाहन के लिए प्रयुक्त हो।

24. यात्री संख्या निर्धारण की विधि :-

1. (क) यात्रियों की संख्या जो एक यात्री नाव ढो सकता है, निर्धारण के लिए यात्रियों के लिए सुलभ फर्श स्थान का वर्गमीटर में सतही क्षेत्रफल को 1.8 से गुणा किया जाएगा तथा गुणनफल यात्रियों की संख्या होगा, जिसे ढोने के लिए नाव अनुज्ञापित की जा सकेगी या

(ख) जिस नाव में सवारी के बैठने के लिए बेंच या थवार्टस का प्रावधान हो वहाँ बैठने के स्थान के प्रत्येक मीटर लम्बाई के लिए दौ व्यक्ति की दर से ढोये जा सकने वाले यात्रियों की संख्या का निर्धारण किया जाएगाः या

(ग) जब नाव सवारी तथा माल से लोडलाईन तक पूर्णरूपेण लदा हुआ हो, यात्रियों की अधिकतम अनुमान्य संख्या का 2/3 नाव के एक तरफ भेजने तथा शेष 1/3 दूसरे तरफ रखने पर जल के अंदर निमग्न भाग मुक्तांश का 50 प्रतिशत से ज्यादा नहीं होना चाहिए। यदि यह बढ़ जाता है तब सवारियों की अध्णिकतम संख्या में तदनुसार कमी की जाएगी :

(घ) किसी भी परिस्थिति में लोड लाईन डुबाकर नौका का परिचालन नही किया जाएगा या सर्वेक्षक द्वारा विनिर्दिष्ट अधिकतम संख्या से ज्यादा सवारी का वहन नही किया जाएगा।

(ड़) नाव के प्रमुख स्थान पर वहन किए जाने वाले सवारियों की अधिकतम संख्या अंकित किया जाएगा। 2. चालक दल के अतिरिक्त सवारियों की संख्या, जिनका वहन किया जा सकता है, निर्धारण के लिए 12 वर्ष से कम आयु के 2 बच्चों की गिनती एक व्यक्ति के रूप में की जाएगी तथा प्रति 65 कि0ग्रा0 सामान की गिनती एक व्यक्ति के समतुल्य की जायगी।

25. मालवाहक नाव के लिए चालक दल की अनुसूची -

प्रत्येक मालवाहक नाव में न्यूनतम चालक दल निम्नवत्‌ होग :-

(क) 20 टन भार तक नाव के लिए - 2 नाविक

(ख) 20 टन भार से अधिक नाव के लिए - 3 नाविक

26. यात्री नावों के लिए चालक दल की सूची -

प्रत्येक यात्री नाव के परिचालन के समय न्यूनतम चालक दल निम्नवत होंगें :-

(1) 15-30 व्यक्तियों तक को ढोने वाली नाव -2 नाविक

(2) 30 से अधिक व्यक्तियों को ढोने वाले नाव -3 नाविक

परन्तु यह और कि, जब नावों घाट पर बंधी हो तक उन के देखभाल और प्रभार के लिए एक प्रभारी एवं पर्याप्त चालक दल होगा।

27. नाव के प्रभारी व्यक्ति का उत्तरदायित्व -

किसी अनुज्ञापित नाव का स्वामी, अभिकर्त्ता या प्रभारी व्यक्ति यह सुनिश्चित करेगा-

(क) कि इन नियमों के अंतर्गत वांछित चालकदल नाव में उपलबध कराया जाता है।

(ख) कि नाव पूर्णरूप से शुष्क एवं साफ रखी जाती है।

(ग) कि इन नियमों के तहत यथा वांछित निबंधन संख्या सुरपष्ट रूप से अंकित है।

(घ) कि नाव में अनुज्ञप्ति धारित है।

(ड) कि अनुज्ञप्ति में भी विनिर्दिष्ट उपस्कर नाव में रखे गये हैं और अच्दी हालत में संधारित है7 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 (च) कि मालवाहक नाव का लोडलाइन सुस्पष्ट रूप से चिन्हित है।

(छ) कि मालवाहक की स्थिति में नाव में इतना सामान नहीं लदा है कि भार जल आरेख सूचक चिह्‌न जल में डूब जाय।

(ज) कि इस नियमावली में विर्निदिष्ट तरीके से सवारियों की अधिकतम संख्या प्रमुखता से अंकित है। (झ) कि नाव में, यदि यात्रियों को ले जा रही हो, उस संख्या, जितने के लिए यह अनुज्ञापित है, से अधिक व्यक्ति नहीं बैठाये जाते है।

() कि नाव सुरक्षित संचालन हेतु आवश्यक प्रकाश श्रोत या लैम्प से सुसज्जित है।

28. वाह्‌य बोर्ड इंजिन से परिचालित नौकाएँ

वाह्‌य बोर्ड इंजिन अथवा समरूप उपकरणों से किसी यात्री नाव का परिचालन नहीं किया जायगा, जबतक कि वह निम्नलिखित शर्त्ते पूर्ण नहीं करती :-

(क) वर्ग-1 नाव के संदर्भ में नौ-सेना से संबंधित (नेवल) वास्तुशिल्पी या भारतीय जहाजरानी रजिस्ट्री या अन्तर्राष्ट्रीय स्तर पर मान्यताप्राप्त वर्गीकरण सोसायटी एवं वर्ग-2 नाव के संदर्भ में नाव सर्वेक्षक क्ष्द्वारा अनुमोदित रूपरेखा के मुताबिक नाव सभी दबावों एवं तनावों को सहन करने के लिये उचित ढंग से निर्मित की गयी हो।

(ख) यह लदान जल स्तर से नीचे उचित रीति से आवृत्त की गयी हो।

(ग) यह प्रत्येक यात्री के लिए बैठने की सुविधा से युक्त है।

(घ) इसमें पर्याप्त संख्या में उलीचक और रक्षक छल्ले उपलब्ध है।

(ड) इसमें प्रति पाँच.यात्रियों के लिए एक भी दर से आकलित किन्तु न्यूनतम दो अनुमोदित (महानिदेशक, जहाजरानी, भारत सरकार द्वारा) उत्प्लावित जीवनरक्षक उपलब्ध है, अगर नाव आन्तरिक तरणशील टंकीयुक्त हो, तो उत्प्लावित जीवनरक्षकों की संख्या आधी रखी जा सकती है बशर्ते न्यूनतम दो अवश्य रखे जाएँ।

(च) इसमें एक सचल अग्निशामक उपलब्ध है।

(छ) पर्याप्त मात्रा में स्वच्छ पेय जल उपलब्ध है और मुफ्‌त आपूर्ति किया जाता है।

(ज) एक अनुमोदित किस्म का प्राथमिक चिकित्सा पेटी उपलब्ध है।

(झ) कि नाव सुरक्षित नौ-संचालन के लिए आवश्यक प्रकाशश्रोत या लैम्पयुक्त है।

() नाव पीछे हटाने वाले यांत्रिक व्यवस्थायुक्त है।

29. यात्री ढोने की अनिवार्यता

किराया हेतु परिचालित किसी अनुज्ञापित नाव का प्रभारी व्यक्ति बिना समुचित कारण के उचित किराया दे रहे यात्री को उस नाव में सवार कराने से इन्कार नहीं करेगा।

30. यात्रियों का अस्वीकारने की शक्ति

टिंडल या मांडी या नाविक किसी व्यक्ति को यात्री के रूप में नाव पर लेने से मना कर सकता है, अगर वह (क) उचित किराया अदा नहीं करता है, या

(ख) विक्षिप्त है, या

(ग) शराब के नशे में मदहोश और स्वयं का ख्याल रखने में अक्षम है, या

(घ) उपद्रवी है और अन्य यात्रियों के लिए परेशानी पैदा करता है, और

(ड) जब नाव अपनी पूरी क्षमता में लदी हुई हों।

31. यात्री-आचरण

(1) कोई यात्री अपने साथ खतरनाक सामग्री या आग्नेयास्त्र या सड़ी-गली सामग्री अथवा अन्य आक्रामक वस्तु कसी नाव पर नहीं ले जायगा।

(2) किसी नाव का कोई यात्री :-

(i) नाविक, मांझी या चालक दल को उनके कर्त्तव्य निष्पादन में व्यवधान नहीं डालेगा, या8 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 (ii) नाव अथवा नाव पर किसी वस्तु को क्षति नहीं पहुँचाएगा अथवा क्षति पहुँचाने का प्रयास नहीं करेगा या (iii) शराब के नशे में मदहोश और उपद्रवी अथवा मदहोश और स्वयं का ख्याल रखने में अक्षम नहीं बनेगा, या

(iv) उत्पाती या अशोभनीय कृत्य अथवा अश्लील या अपमानजनक भाषा का प्रयोग नहीं करेगा, या (v) बिना विधिसम्मत सफाई के किसी यात्री के आराम में खलल नहीं डालेगा।

32. सर्वेक्षण, निबंधन आदि हेतु शुल्क

(क) सर्वेक्षण, निबंधन, अनुज्ञप्ति और जाँच तथा नाविक या मांझी या नाव की बदली का पृष्ठांकन के लिए अनुलग्नक-1 में दिये गये सिड्‌यूल के अनुसार शुल्क अधियोपित किया जायगा।

(ख) समय-समय पर शुल्कों के पुनरीक्षण की शक्ति जिला दण्डाधिकारी मेें निहित होगी

33. नावों की जाँच

सर्वेक्षण के प्रयोजनार्थ किसी नाव की किसी भी उचित समय पर निबंधन पदाधिकारी या नाव सर्वेक्षक अथवा उसकी जगह पर नियुक्त किसी अन्य पदाधिकारी द्वारा जाँच की जा सकेगी।

34. जिला प्राधिकरों को वार्षिक प्रतिवेदन

निबंधन पदाधिकारी प्रतिवर्ष 01ली मई को वैद्य अनुज्ञप्तियुक्त निबंधन नावों की संख्या सहित मालिक एवं नाविक का पता दर्शाते हुए निबंधन पंजी का सार संबंधित जिला दण्डाधिकारी को समर्पित करेगा।

35. सहाय्‌य कार्य हेतु नावों को तैयार रखना

इन नियमों के तहत्‌ निबंधन और अनुज्ञापित सभी नौकाएँ, जहाँ तक व्यवहारिक हो बाढ़ एवं चक्रवातजन्य सहाय्‌य कार्यो के लिये तैयार रखी जाएँगी। जिला दण्डाधिकारी अथवा उसका प्राधिकृत पदाधिकारी परस्पर विमर्शित/जिला दण्डाधिकारी द्वारा निर्धारित किराया के भुगतान के आधार पर ऐसी नौकाओं का अधिग्रहण कर सकेगा, अगर वह लोक प्रयोजनार्थ आवश्यक समझता है।

36. प्रशिक्षण और अभिप्रमाणन

सभी पदनामित नाव सर्वेक्षक (मोटर यान सर्वेक्षक) को राष्ट्रीय अन्तर्देशीय नौ-परिवहन संस्थान, पटना अथवा राज्य सरकार से मान्यताप्राप्त किसी अन्य संस्थान में एक सप्ताह का पाठ्‌यक्रम करना होगा।

37. अनुज्ञापित नाव के नाविक की अहर्ता

अनुज्ञापित नाव के नाविक की अहर्ता परिवहन विभाग अधिसूचना द्वारा निर्धारित कर सकेगा, जिसे बिहार राजपत्र में प्रकाशित किया जायगा।

परन्तु यह कि उक्त अहर्ता का निर्धारण इस नियमावली के प्रभावी होने की तिथि से एक वर्ष के अन्दर कर दिया जायगा।

38. विविध

निरसन और व्यावृतिः-

(1) बंगाल नौ-घाट अधिनियम, 1885 की धारा 15 के तहत्‌ निर्मित आदर्श नियमावली, 1937 के नियम 3 (ड0) और 3(च) तथा उक्त अधिनियम की धारा 22 के तहत्‌ निर्मित आदर्श नियमावली, 1937 के नियम-1 से नियम 11 तक एतद्‌द्वारा निरसित किये जाते हैं।

(2) उक्त निरसन के होते हुए भी निरसित की गयी नियमावली के किसी उपलब्ध के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई, जबतक यह कार्य या कर्रवाई इस नियमावली के उपलब्धों के असंगत न हो, इस नियमावली के तत्सम्बन्धी उपबन्धों के अधीन किया गया या की गयी समझी जायगी।9 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 नव(cid:20)बर 2018 परिशिष्ट-क (नियम-3(ख) देखें) एतद्‌ द्वारा नीचे की तालिका के स्तम्भ (2) में विनिर्दिष्ट जिलों को स्तम्भ (3) की संगत प्रविष्टि में विनिर्दिष्ट अक्षर-समूह इन नियमों के प्रयोजनार्थ प्रत्येक जिले के लिए निबंधन चिन्ह के रूप में उपयोग हेतु आवंटित किया जाता है।

Rules, 2018 Under Bengal Ferries Act, 1885

INTRODUCTION

Boat accidents are so common that it has become a crucial issue to find out ways and means to ensure the safety of those traveling by country boats. Most of the boats are open and hardly have any space except the minimum required to carry men and materials. Wooden country boats with traditional designs are destined to continue for quite some time to come. It is therefore, necessary to exercise control over the country boats so that they are kept as far as practicable, water worthy and provide a safe means of transportation.

In order to achieve the required safety of life it is essential that the boats are maintained in good condition and are equipped with minimum life and fire safety appliances. The compulsory provision of inspections of the boats is necessary for the desired safety. Moreover, it is required that the boats have ample reserve buoyancy, their dimensions are measured; tonnage, cargo and passenger carrying capacity is correctly assessed. The freeboard has to be determined for marking the load line, which shall be not be submerged on any occasion. The minimum crew required to handle the boats has to be stipulated and the minimum safety equipment to be carried has to be specified. All these measures will certainly make the boats safer.

Such measures can only be implemented when the boats are registered and licensed. The registration and licensing of country boats help requisitioning them for rescue purposes in case of nature calamities like floods and tidal waves.

The Bengal Ferries Act, 1885 is in force in the state of Bihar. In framing the present rules all the safety factors have been taken into consideration. Penalties and Criminal procedure prescribed in the Bengal Ferries Act, 1885, the Indian Penal Code will be applicable.

RULES - 2018

1. These are Rules 2018 under the Bengal Ferries Act, 1885. It extends to the whole Darbhanga Division (District-Darbhanga, Madhubani, Samastipur) It shall come into force from the date of publication. 2. Definitions:—

In these rules, unless the context otherwise requires:

a) "Boat" means water craft upto 15metres length, called by whatever name like Bhut- Bhuti, Nav, Dengi, Ghataha, long tail drive etc. including mechanically propelled vessels driven by less than twenty British Horse Power engine;

b) "Passenger boat" means any boat which ordinarily carries persons other than the "Navik" or "Manjhi" or the boatman in charge and the crew;

c) "Cargo boat" means any boat, which ordinarily carries all kinds of movable or personal property including animals;

d) "Class I boats" means barges or floats constructed of iron or wood or Fiber Reinforced Plastic (F.R.P) or Ferro-Cement, ship-shape and with straight keel;

e) "Class II boats" means open country boats, sail boats or a boat other than class I boats; f) "Form" means a Form appended to these rules; g) "Out Board Motor" means engine used to move the boat mechanically and includes long tail and such other devices;

h) "Registration Officer" means, District Transport Officer as defined in Rule 2 of the Bihar Motor Vehicles Rules, 1992 or any other person authorized by the District Magistrate to carry out the registration;

i) "Boat Surveyor" means Motor Vehicle Inspector, as defined in rule 2 of the Bihar Motor Vehicles rules, 1992, trained in Boat Surveying. Boat Surveyor includes an officer authorized by the District Magistrate to perform the functions of the Boat Surveyor, trained in boat surveying.

j) Any term not defined here has the same meaning as defined in Bengal Ferries Act, 1885 and Inland Vessel Act, 1917 or any rule made thereunder.

k) "Navik" or "Manjhi" means persons who are qualified to operate the licensed boat.

Registration and Licensing of Cargo and Passenger Boats:— 3. No person, whether as owner or as servant shall ply a boat to carry goods or passengers whether for hire or not; or whether regularly or occasionally in the rivers, canals, lakes and reservoirs and other water bodies; unless

a) the boat has been granted the registration in Form- II and the license in Form-III; and b) the group of letters specified in Appendix A , appended to these rules indicating the place of registration followed by the registration number assigned is painted on both sides of the Boat in white figures of not less than 15cms in height and 2cms in breadth. Provided that in respect of the boats that are presently in operation, the owner shall get the boat licensed and registered within 30 days of gazette notification.

Application for Registration:—

4. (1) Every application for registration of a boat shall be made in Form- IV in writing to the Registration Officer by the owners of the boat;

(2) On receiving the application for registration of a boat, the Registering Officer shall direct the Boat Surveyor to measure the boat as required under rule 22 of these rules and shall enter the particulars in the Book of Registry to be maintained in Form I on payment of fees specified in Rule 32;

(3) Every certificate of registration or renewal shall be in Form-II. Transfer of Ownership:— 5. (a) Where the ownership of any Boat registered under these rules is transferred, the transferor shall within 14 days of transfer, report the fact of transfer to the Registration Officer in writing; and

(b) the Certificate of Registration for endorsement along with the fees prescribed under Rule 32; and

(c) these transfers shall be mutated by the Registration Officer. Cancellation of Registration:— 6. The Registered number of a boat shall remain in force as an identification number throughout the whole working life of the boat unless:-

a) it is cancelled at the request of the owner; or b) the license of the boat is not renewed continuously for a period of two years; or c) the boat is declared unfit for further service by the Boat Surveyor; or d) the number engraved on the boat is obliterated.

Load Line to be marked:— 7. (1) Every boat shall have her load line indicated by a conspicuous mark of 2.5cms engraved or welded, 15cms wide and 30 cms long and painted white on dark background to indicate the freeboard or greatest depth to which it may be immersed when fully loaded;

(2) The load line shall be marked by the owner in the presence of the boat surveyor at the time of Registration.

Application for Licensing Boats:— 8. (1) Every application for a fresh license or renewal shall be made in writing to the Boat Surveyor with a copy to Registration Officer;

(2) The surveyor shall submit the survey report to the Registration Officer within a period of 30 days from the date of receipt of application;

(3) The applicant shall produce the boat at such time and place as the Boat Surveyor shall direct for the purpose of licensing the boat, preferably at the place of plying.

Conditions of License for Boats:— 9. No license shall be granted in respect of any boat until such boat has been surveyed by the Boat surveyor and he has satisfied himself that the following conditions are fulfilled, namely:-

a) that the boat is in good condition and is suitable for the conveyance of cargo, passengers, and complies with these rules;

b) that the tonnage of the boat is ascertained in the manner prescribed under sub-rule(4) of rule 22 of these rules;

c) that the number of crew required for safe navigation of such boat is in accordance with the scale prescribed under rules 25 and 26 of these rules;

d) that such boat is provided with adequate appliances for the pumping or bailing out or otherwise getting rid of bilge water and with serviceable ground tackle, anchoring and other equipment and lights necessary for safe navigation;

e) that the freeboard of the boat when fully loaded is ascertained in the manner prescribed in sub-rule(2) of Rule 23 of these rules;

f) that the boat is provided with minimum of two approved life buoys and a first aid box; g) that the boat, if fitted with engine, is provided with fire extinguisher; h) that in case of passenger boats, the maximum number of passengers to be carried are marked at a prominent place for information of the passengers;

i) that in case of passenger boats plying with outboard or with similar devices the conditions required in rule 28 are complied with;

j) The boat shall normally ply between sunrise and sunset, Provided that in emergency for night use, special light arrangement will be required which shall be approved by the Boat Surveyor.

Issue of license to a boat:— 10. If the conditions enumerated in Rules 8 and 9 are satisfied and necessary payment of fees as prescribed in Rule 32 of these rules has been made, the Boat Surveyor shall:-

a) issue to the owner a license , which shall contain the particulars of the boat, and the name of the Navik or Manjhi in charge, in Form III;

b) cause the necessary particulars relating to the boat to be entered in the Book of Registry in Form I .

Duration of License:— 11. Every license granted under these rules shall continue in force for a period of three years from the date on which it is granted unless it is revoked under the provisions of these rules.

Transfer of License:— 12. No license granted under these rules shall be transferred. Application for renewal of Boat licenses:- 13. (1) Application for the renewal of a license for a Class-I boat may be made by the owner or his authorised agent in writing to the Boat Surveyor with a copy to Registration Officer; (2) Application for the renewal of a license for a Class –II boat shall be made in person by the owner or Navik or Manjhi of the boat;

(3) The Boat Surveyor before renewing the license shall require the boat to be produced for examination, preferably at the place of plying, and if he is of the opinion that the Boat satisfies the conditions specified under rule 9, may renew licence valid for a period of one year for which a fee as prescribed in rule 32 shall be payable;

(4) If the owner, agent, Navik or Manjhi fails to make application for the renewal of license for the boat within a month from the date of expiry of the license penal license fees at double the rate shall be charged. License to be produced on demand:— 14. (a) Every licensed boat when plying shall carry on board its license which shall be produced when required by the police or any officer duly authorized by the District Magistrate or the Registering Officer or the Boat Surveyor;

(b) In case of a passenger boat the license shall be produced when required by any passenger for inspection.

Unlicensed Boat:— 15. If the Navik or Manjhi of a boat fails to produce the license as required under rule 14, the boat may be treated as an unlicensed boat unless satisfactory explanation is given to the Registration Officer or in his absence to the Boat Surveyor, he shall have to pay penal charge thrice of the rate of the license fees for issue of license.

Resurvey:— 16. The District Magistrate or the Registering officer may, at any time, order a licensed boat to be resurveyed without any charge to the owners.

Revocation of License:— 17. The license granted to any boat may be revoked:-

a) Whenever the boat is in the opinion of the Boat Surveyor unfit for the purpose for which it is licensed;

b) Whenever any breach of the conditions of the license or the rules has been committed by the owner or his agent or by any Navik or Manjhi in charge of the boat;

c) At any time the District Magistrate may deem fit for good and sufficient reasons.

Duplicate License: — 18. If any subsisting license granted in respect of a boat is lost, the registering officer on the application of owner or agent of such boat, may issue a duplicate of the original license for which a fee shall be payable in accordance with the scale prescribed in rule 32.

Boats are not to be loaded so as to submerge the mark indicating the load water line: — 19. The owner or his agent, or the Navik or Manjhi in charge of any licensed cargo boat shall not permit such boat to be loaded so as to submerge the mark indicating the load water line.

Action to be taken when accident occurs on board a licensed boat: — 20. (1) whenever any accident causing serious hurt to any person or material damage to any property occurs on board of, or by means of any boat, the Navik or Manjhi in charge shall at once proceed to the nearest police station and report the circumstances connected with the accident to the officer in charge of the police station and the Boat Surveyor;

(2) In case of sinking of boat due to accidents or otherwise the boat owner or operating personnel shall immediately report the matter to the concerned authority/police. The boat owner shall also take immediate steps within a reasonable time for salvaging the boat; (3) The District Magistrate or Registering officer shall take immediate steps for its salvage and the expenses incurred therefore shall be recovered from the boat owner within a specified time frame under the provisions of the Bihar Public Demands Recovery Act, 1914.

Pumping out of bilge water from boats:— 21. The crew of all boat shall ensure that all bilge water shall be pumped or bailed out or got rid of from a boat as often as possible for safe navigation.

Measurement of the boats:— 22. (1) Length of a boat shall be measured in Meters from the inside of the stempost to the inside of the sternpost;

(2) The breadth shall be measured in Meters from side to side, inside the ceiling plank, under the deck beam amidships, where no ceiling plank is fitted the measurement shall be taken to the upper side of the keel;

(3) The depth shall be measured in meters from the under side of the deck beam amidships to the upper side of the floor ceiling plank, where no ceiling plank is fitted, the measurement shall be taken to the upper side of the keel;

(4) The gross tonnage of the boats shall be determined by the following formula. Gross Tonnage = KV. Where V=Total volume of all earning spaces of the boat in cubic meters and K=The coefficient as tabulated below;

The values for coefficient K for intermediate volumes can be obtained by linear interpolation. 23. Mode of assignment of Load line/ Freeboard—

(1) Every boat shall have on its sides amidships a conspicuous mark 2.5cms deep, 15cms wide and 30 cms long engraved or welded and painted white to indicate the freeboard or greatest depth to which it may be immersed when fully loaded;

(2) The freeboard may be calculated at the rate of 25cms for every meter of depth

during fair weather. During monsoon and other flood season the freeboard

should be 1.5 times of the above;

(3) Whenever a boat is licensed to carry both passengers and cargo it shall be measured and marked with a load line in the same way as though it intended solely for carrying of cargo.

24. Mode of assessment of number of passengers— (1) (a) To ascertain the number of passengers that a passenger boat may carry, multiply the superficial area in square metres of the floor space available for passengers by 1.8 and the result is the number of passengers that the boat may be licensed to carry; or

( b) Where benches or thwarts are provided the number of passenger to be carried may be calculated at the rate of 2 persons for every running meters of seating accommodation; or (c) When the boat is fully loaded with passenger and cargo upto load line, 2/3rd of the maximum number of allowed passenger to be shifted to one side, while keeping 1/3rd on the other side, the submersed portion in the water should not be more than 50% of freeboard; in case it exceeds, then the maximum number of passenger shall be reduced accordingly;

(d) Under no circumstances any boat can ply with submerged load line or can carry passenger exceeding maximum number specified by the surveyor;

(e) Maximum number of passenger to be carried shall be marked at a prominent place on the Boat;

(2) To ascertain the number of persons in addition to the crew that may be carried, two children below the age of 12 years shall be counted as one person and every 65 Kg weight of luggage shall be counted as equivalent to one person.

Schedule of Crew for Cargo Boats:—

25. Every cargo boat plying shall carry a minimum crew as given below:—

(a) For a boat upto 20 Tons burden – Total 2 Navik (b) Above 20 Tons – Total 3 Navik

Schedule of Crew for Passenger boats:— 26. Every passenger boat when plying shall carry a minimum crew as detailed below:-

(i) Boats to carry upto 15 to 30 persons :- Total 2 Navik ; (ii) Boats to carry more than 30 persons:- Total 3 Navik;

Provided further that when boats are laid up there shall be in charge of them sufficient crew to look after them. Responsibility of a person in charge of a boat:— 27. The owner, agent, or person in charge of any licensed boat shall ensure:-

a) that the boat is provided with the number of crew required under these rules; b) that the boat is kept thoroughly dry and clean; c) that the registration number is kept clearly painted as required under these rules; d) that the license is carried in the boat; e) that the equipment specified in the license is provided and maintained in good condition;

f) that the load line of a cargo boat is kept clearly marked;

g) that the boat, if carrying cargo, is not loaded so as to submerge the mark indicating the load water line;

h) that the number of maximum passengers to be carried is marked prominently as specified in these rules;

i) that the boat, if carrying passengers, does not carry persons in excess of the number for which it is licensed;

j) that the boat is fitted with navigation lights or lamp necessary for safe navigation.

k) that in no circumstances animals will be allowed other passengers to ferry in boat. If any passengers has animals with him, only he will be allowed with animal in the boat besides Navik or Manjhi or Tindal.

Passenger boats plying with outboard Motors:—

28. No passenger boat shall be propelled either by an outboard engine or with similar devices unless it satisfies the following conditions:-

a) the boat is properly constructed to withstand all stresses and strains as per the approved design of an naval architect or Indian Registry of Shipping or any internationally recogonised Classification Society for Class -I boat and by Boat Surveyor for Class II boat;

b) it is properly sheathed below the load water level;

c) it is fitted with seating accommodation for each of the passengers;

d) it is provided with sufficient number of bailers and a rescue quoit;

e) it is provided with approved life buoys (By Director General of Shipping, Government of India) calculated at the rate of one for every 5 passengers with a minimum of two, if boats fitted with internal buoyancy tanks or buoyant seats, the number of life buoys may be reduced by half subject to a minimum of 2;

f) it is provided with a portable fire extinguisher;

g) Sufficient quantity of fresh drinking water is provided and supplied free of cost;

h) a first aid box of an approved type is provided;

i) that the boat is fitted with navigation lights or lamp necessary for safe navigation;

j) has a reversing mechanism fitted .

Compulsion to Carry Passengers:—

29. No person in charge of a licensed passenger boat plying for hire shall, without good reason, refuse to carry in such boat passenger tendering the proper hire.

Power to refuse admission of Passengers:—

30. The Tindal or Manjhi may refuse to admit any person to the boat as a passenger if he, (a) has not paid the reasonable fare; or

(b) is insane; or

(c) is drunk and incapable of taking care of himself; or

(d) is disorderly and causes annoyance to other passengers; and

(e) when the boat is loaded to its full capacity.

(f) wants to ferry in the boat along with animals, when other passengers have been admitted in the boat.

Conduct of Passenger:-

31. (1) No Passenger shall carry any dangerous goods or fire arms or decayed food stuffs or any other offensive articles on any boat;

(2) No passenger on any boat shall :-

(i) obstruct the Navik, Manjhi or crew in the discharge of their duties; or

(ii) damage or attempt to damage the boat or any article on the boat; or

(iii) be drunk and disorderly, or drunk and incapable of taking care of himself; or (iv) commit any nuisance or act of indecency, or use obscene or abusive language; or (v) without lawful excuse, interfere with the comfort of any passenger.

Fees for Survey, registration etc:—

32. (a) The fees shall be leviable for survey, registration, licensing and inspection and endorsing change of navik or manjhis or boats will be as per schedule given in annexure -1;

(b) The District Magistrate shall have power to revise the fees from time to time.

Inspection of Boats:—

33. Any boat at any reasonable time be inspected by the Registration Officer or the boat surveyor or any officer appointed on his behalf for the purpose of survey.

Annual Returns to District Authorities:—

34. The Registering officer shall submit on the first May of every year an extract of the Book of Registry showing the number of boats registered with valid license together with the address of the owner and tidal to the respective District Magistrate.

Boats to be kept ready for relief work:—

35. All boats registered and licensed under these rules shall as far as practicable be kept ready for use in floods and cyclonic relief works. The District Magistrate or his authorized officer may requisition such boats if he feels necessary for public purposes on payment of charges to be negotiated/finalised by the District Magistrate.

Training and Certification—

36. (1) All designated boat surveyor (Motor Vehicle Inspectors) shall undergo one week course for boat surveying at National Inland Navigation Institute, (NINI), Patna or any other institute recogonised by the State Government.

37. Qualifications for a Navik to operate licensed boat—

The qualification of a Navik to operate a licensed boat shall be prescribed by the Transport Department by notification to be published in the State Gazette.

Provided that the qualification shall be prescribed within one year of the commencement of this Rule. Miscellaneous— 38. Repeal & Saving—

(1) Rule 3(e) and 3(f) of Model Rules 1937 made U/S 15 of Bengal Ferry Act, 1885 and rule 1 to rule 11 of Model Rule 1937 made U/S 22 of the said Act are hereby repealed. (2) Notwithstanding the said repeal anything done or any action taken under any of the provisions of these rules so repealed shall, in so far as it is not inconsistent with the provisions of these rules, be deemed to have been done or taken under the corresponding provisions of these rules.
