सं॰ V/उ०-3-04/2017-3704—भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, बिहार मद्य निषेध सेवा में भर्त्ती की प्रक्रिया एवं सेवा शर्त्तो को विनियमित करने हेतु निम्नलिखित नियमावली बनाते है :-

अध्याय-I : प्रारंभिक

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ-

(1) यह नियमावली ''बिहार मद्य निषेध सेवा (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2018'' कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) इसके प्रवृत होने की तिथि राज्य सरकार द्वारा अलग से अधिसूचित की जाएगी।

2. परिभाषाएँ-जब तक विषय या संदर्भ से अन्यथा अपेक्षित न हो, इस नियमावली में :-

(i) ''राज्य सरकार'' से अभिप्रेत है बिहार सरकार; (ii) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (iii) ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग; (iv) ''विभाग'' से अभिप्रेत है मद्य निषेध, उत्पाद एवं निबंधन विभाग। (v) ''सेवा'' से अभिप्रेत है बिहार मद्य निषेध सेवा। (vi) ''बिहार मद्य निषेध सेवा/सेवा'' से अभिप्रेत है बिहार मद्य निषेध सेवा के विभिन्न पद, यथाः- अधीक्षक मद्य निषेध/समकक्षीय पद, सहायक आयुक्त मद्य निषेध, उपायुक्त मद्य निषेध, संयुक्त आयुक्त मद्य निषेध।

तथा समय-समय पर इस सेवा में सृजित होनेवाले अन्य पद।

(vii) ''सदस्य'' या ''सेवा के सदस्य'' से अभिप्रेत है बिहार मद्य निषेध सेवा में नियुक्त व्यक्ति;

(viii) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात 1 अप्रैल से प्रारम्भ होकर अगले वर्ष 31 मार्च को समाप्त होने वाला वर्ष; तथा

(ix) ''उपलब्ध रिक्ति'' से अभिप्रेत है किसी वर्ष में बिहार मद्य निषेध सेवा के नए पदो ंके सृजन अथवा किसी अन्य कारण से उत्पन्न रिक्ति।

3. सेवा की संरचना।

(क) यह सेवा मद्य निषेध, उत्पाद एवं निबंधन विभाग के प्रशासनिक नियंत्रण के अधीन होगा, जिसके प्रधान सचिव/सचिव इस सेवा के नियंत्री पदाधिकारी होगें। राज्य सरकार समय-समय पर, इस सेवा का अधिकृत बल विनिश्चित कर सकेगी और आवश्यकतानुसार स्थायी/अस्थायी पदो ंके सृजन/प्रत्र्यपण की स्वीकृति दे सकेगी।

(ख) इस सेवा की संरचना निम्नवत होगी :-

(i) अधीक्षक, मद्य निषेध/समकक्ष पद - मूल कोटि - राजपत्रित (ii) सहायक आयुक्त, मद्य निषेध - प्रथम प्रोन्नति स्तर - राजपत्रित (iii) उपायुक्त, मद्य निषेध - द्वितीय प्रोन्नति स्तर - राजपत्रित (iv) संयुक्त आयुक्त, मद्य निषेध - तृतीय प्रोन्नति स्तर - राजपत्रित (ग) इसे सेवा के विभिन्न पदों का वेतनमान/वेतन स्तर वही होगा, जैसा वित्त विभाग, बिहार सरकार द्वारा समय-समय पर निर्धारित किया जायगा। अध्याय-II : भÙÙÙÙाीर्

4. भर्ती का ोत। इस सेवा में भर्ती निम्नलिखित रीति से की जायगी। (क) इस नियमावली के अध्याय-III के अनुसार सीधी भर्ती द्वारा। (ख) इस नियमावली के अध्याय-IV के अनुसार निरीक्षक, मद्य निषेध के पद से प्रोन्नति के द्वारा। 5. आरक्षण। राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर विहित नियम एवं प्रक्रिया के अनुसार नियुक्ति एवं प्रोन्नति में आरक्षण/रोस्टर नीति का अनुपालन आवश्यक होगा।

6. रिक्तियों का निर्धारण एवं आयोग को संसूचना। राज्य सरकार प्रत्येक वर्ष की पहली अप्रैल को सीधी भर्ती तथा प्रोन्नति से भरी जाने वाली रिक्तियों की गणना करेगी तथा सीधी भर्ती हेतु आरक्षण कोटिवार रिक्तियों की अधियाचना 30 अप्रैल तक आयोग को भेजेगी।

अध्याय-III : सीधी भÙÙÙÙाीर्

7. संयुक्त प्रतियोगिता परीक्षा द्वारा सीधी भर्ती। विभाग से आरक्षण कोटिवार रिक्तियों की अधियाचना प्राप्त होने पर आयोग विज्ञापन निकाल कर संयुक्त प्रतियोगिता परीक्षा के आधार पर बिहार मद्य निषेध सेवा की मूल कोटि में 50 प्रतिशत पदों पर सीधी भर्ती के लिए पात्र अभ्यर्थियों से आवेदन प्राप्त करेगा।

8. पात्रता। सेवा में सीधी भर्ती के लिए उम्मीदवारों की उम्र, शैक्षणिक योग्यता, आरक्षण आदि राज्य सरकार एवं आयोग ंद्वारा समय-समय पर निर्धारित नियमों एवं प्रावधानों के अनुसार होगा। न्यूनतम शैक्षणिक योग्यता मान्यता प्राप्त विश्वविद्यालय से स्नातक की डिग्री होगी।

9. मौखिक/अंतर्वीक्षा परीक्षा। आयोग द्वारा संचालित संयुक्त प्रतियोगिता परीक्षा की प्रारंभिक एवं मुख्य लिखित परीक्षा में प्राप्त अंकों के आधार पर चयनित अभ्यर्थियों को मौखिक/अंतर्वीक्षा परीक्षा के लिए आयोग द्वारा गठित बोर्ड के समक्ष उपस्थित होना होगा। मौखिक/अंतर्वीक्षा परीक्षा के लिए अधिकतम अंको का निर्धारण आयोग द्वारा किया जाएगा।

10. चिकित्सा परीक्षा। नियुक्ति के लिए चुने गये प्रत्येक अभ्यर्थियों को राज्य सरकार द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा परीक्षा के लिए उपस्थित होना पड़ेगा। पदीय कर्त्तव्यों को दक्षता पूर्वक निष्पादित करने की दृष्टि से जो अभ्यार्थी अपनी अपेक्षित शारीरिक योग्यता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में सफल होंगें, उन्हें नियुक्त करने पर विचार किया जा सकेगा।

11. आयोग द्वारा अभ्यर्थियों की अनुषंसा। लिखित एवं मौखिक परीक्षा के आधार पर आयोग मेधा सूची तैयार कर प्र्राप्त अधयाचना के अनुरूप अभ्यर्थियों की अनुषंसा राज्य सरकार को करेगा। उक्त अनुषंसा विभाग में प्राप्ति की तिथि से एक वर्ष तक ही वैध रहेगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 19 नव(cid:23)बर 2018 अध्याय-IV : प्रोन्नति के द्वारा भÙÙÙÙाीर्

12. प्रोन्नति के द्वारा नियुक्ति। मद्य निषेध उत्पाद एवं निबंधन विभाग के निरीक्षक मद्य निषेध (अराजपत्रित) से मूल कोटि अधीक्षक मद्य निषेध (राजपत्रित) में 50% प्रतिषत पदों पर आयोग के अध्यक्ष/सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुषंसा के आधार पर प्रोन्नति द्वारा नियुक्त किए जा सकेंगे।

13. सीधी भर्ती एवं निरीक्षक, मद्य निषेध के पद से प्रोन्नति के आधार पर नियुक्ति का अनुपात। इस सेवा की मूल कोटि के पदों पर सीधी भर्त्ती एवं प्रोन्नति के आधार पर नियुक्ति का अनुपात 50ः50 प्रतिषत रहेगा। 14. उम्मीदवारों की पात्रता।

(1) निरीक्षक मद्य निषेध के पद पर सरकार द्वारा निर्धारित कालावधि में संतोषजनक सेवा। (2) मद्य निषेध निरीक्षक के लिये विहित प्रशिक्षण तथा विभागीय परीक्षा नियमावली के अनुसार विभागीय परीक्षा में उत्तीर्णता।

(3) चारित्रिक अभ्युक्तियों का कम से कम ''अच्छा'' कोटि का होना। (4) वरीयता।

अध्याय-V

15. परिवीक्षा अवधि।

(1) किसी मौलिक पद के विरूद्ध नियुक्त प्रत्येक पदाधिकारी को पदग्रहण की तिथि से दो वर्षो की अवधि तक परिवीक्षा पर रहना होगा। परिवीक्षा अवधि में सेवा संतोषजनक नहीं रहने पर लिखित रूप से अभिलिखित किये जा सकने वाले कारणों से परिवीक्षा अवधि एक वर्ष के लिए बढ़ायी जा सकेगी।

(2) राज्य सरकार परिवीक्षा की अवधि में या उसकी समाप्ति के समय इस सेवा में भर्ती किए गये किसी पदाधिकारी की नियुक्ति समाप्त कर सकती है या निरीक्षक मद्य निषेध से प्रोन्नति के आधार पर आये किसी पदाधिकारी को उसके मौलिक पद पर प्रत्यावर्तित कर सकती है, यदि उक्त पदाधिकारी नियुक्ति संबंधी शर्तो को पूरा नहीं करता हो अथवा वह परिवीक्षा अवधि में सेवा संतोषजनक नहीं रहने या अन्य कारणों से इस सेवा में सम्पुष्टि के योग्य नहीं हो।

(3) परिवीक्षा अवधि के बाद विहित विभागीय परीक्षा में उत्तीर्ण होने के बाद ही वार्षिक वेतनवृद्धि अनुमान्य होगी।

16. सम्पुष्टि।

(1) इस सेवा में नियुक्त पदाधिकारी को परिवीक्षा की अवधि की संतोषजनक समाप्ति होने पर सेवा में सम्पुष्ट किया जा सकेगा, यदि वह विहित मापदण्ड के अनुसार विभागीय परीक्षा एवं अन्य परीक्षा उत्तीर्ण हो, विहित प्रषिक्षण सफलतापूर्वक पूरा किया हो और राज्य सरकार उसे सम्पुष्टि के योग्य समझे।

(2) सम्पुष्टि के पूर्व विभागीय परीक्षा नियमावली के प्रावधानानुसार राजस्व पर्षद द्वारा संचालित लिखित एवं मौखिक परीक्षा उत्तीर्ण करना आवष्यक होगा।

17. वरीयता।

(i) इस नियमावली के अध्याय-III नियम-7 के अनुसार सीधी भर्त्ती से अधीक्षक, मद्य निषेध के पद पर नियुक्त कर्मियों की आपसी वरीयता आयोग द्वारा तैयार मेधा क्रमानुसार अवधारित होगा।

(ii) इस नियमावली के अध्याय- IV नियम-12 के अनुसार प्रोन्नति से अधीक्षक, मद्य निषेध के पद पर नियुक्त कर्मियों की आपसी वरीयता पद के प्रोन्नति की तिथि के क्रमानुसार अवधारित होगी।

(iii) किसी वर्ष में प्रोन्नति से नियुक्त अधीक्षक, मद्य निषेध उसी वर्ष सीधी भर्त्ती से नियुक्त अधीक्षक, मद्य निषेध से वरीय होंगे।

18. प्रषिक्षण। सेवा के पदाधिकारियों के लिये सरकार द्वारा कार्यपालक आदेष से निर्धारित विषयों पर निर्धारित समय के लिए प्रषिक्षण प्राप्त करना, जिसमें व्यावहारिक प्रषिक्षण भी शामिल है, अनिवार्य होगा। इसके अतिरिक्त पुलिस प्रषिक्षण केन्द्र से घुड़सवारी तथा अन्य परीक्षा भी उत्तीर्ण होना अनिवार्य होगा।4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 19 नव(cid:23)बर 2018 अध्याय-VI : सेवा में प्रोन्नति

19. (1) सेवा की मूल कोटि से भिन्न सभी पद विभागीय प्रोन्नति समिति की अनुषंसा के आधार पर प्रोन्नति द्वारा भरे जायेगें।

(2) प्रोन्नति के लिए राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित न्यूनतम कालावधि को पूरा किया जाना आवष्यक होगा।

(3) प्रोन्नति के लिए राज्य सरकार द्वारा लागू आरक्षण नीति/रोस्टर का अनुपालन आवष्यक होगा। (4) प्रोन्नति का आधार वरीयता-सह-योग्यता होगा।

अध्याय-VII : अन्य सेवा शÙÙÙÙोर्ं

20. इस सेवा के लिए अन्य सेवा शर्ते, यथा- अनुषासनिक कार्रवाई, छुट्‌टी, देय सेवानिवृति लाभ, सुनिष्चित वृत्ति उन्नयन योजना इत्यादि जो इस नियमावली से आच्छादित नहीं हैं या जो इस सेवा के लिए पृथक रूप से अधिसूचित नहीं है, बिहार सरकारी सेवक (वर्गीकरण नियंत्रण एवं अपील) नियमावली 2005, बिहार सरकारी सेवक आचार नियमावली 1976, बिहार सेवा सहिता, राज्य सरकार द्वारा समय-समय पर निर्गत अन्य सुसंगत नियमावलियों, आदेषों तथा परिपत्रों आदि द्वारा नियंत्रित होंगी।

21. इस नियमावली के प्रावधानों को कार्यरूप देने के लिए सरकार द्वारा विनियमावली का निर्माण किया जा सकेगा।

22. इस नियमावली के लागू होने की तिथि के पूर्व से बिहार उत्पाद सेवा के विभिन्न पदों यथा, निरीक्षक उत्पाद, अधीक्षक उत्पाद, सहायक आयुक्त उत्पाद, उपायुक्त उत्पाद एवं संयुक्त आयुक्त उत्पाद पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस सेवा में शामिल समझे जायेंगे।

23. शिथिलीकरण की शक्ति। जहाँ सरकार की राय हो कि ऐसा करना आवश्यक या समीचीन है, वहाँ लिखित रूप से अभिलिखित किये जाने वाले कारणों से व्यक्ति या पद के किसी वर्ग या कोटि के संबंध में इस नियमावली के किन्हीं प्रावधानों को शिथिल किया जा सकेगा।

24. प्रकीर्ण विषय। इस नियमावली या इसके अधीन जारी किये गये आदेशों से अनाच्छादित मामलों के संदर्भ में इस सेवा के सदस्य, राज्य सरकार के समुचित स्तर के कार्मिकों के संबंध में लागू संहितायें/नियमावली/संकल्प/अनुदेश आदि से शासित होंगे।

25. निर्वचन। इस नियमावली के किसी उपबंध के निर्वचन के संबंध में शंका उत्पन्न होने पर उसे विभाग को निर्देशित (Refer) किया जायेगा और इस संंबंध में विभाग द्वारा विधि विभाग के परामर्श के पश्चात्‌ किया गया विनिश्चय अंतिम होगा।

26. निरसन एवं व्यावृति -

(1) इस नियमावली के प्रवृत होने की तिथि से बिहार उत्पाद सेवा (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2009 एवं अन्य संबंधित संकल्प/विनियमावली/आदेश निरसित समझे जायेंगे।

(2) ऐसा निरसन के होते हुए भी बिहार उत्पाद सेवा (भर्त्ती एवं सेवा शर्त्ते) नियमावली, 2009 एवं अन्य संबंधित संकल्प/विनियमावली/आदेश के अधीन किया गया कोई कार्य या की गई कोई कार्रवाई, इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्ति का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत्त थी, जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गई थी।

No. V/उ०-3-04/2017-3704—In exercise of the powers conferred by proviso of Article 309 of the Constitution of India, the Governor of Bihar makes the following Rules for regulating the procedure of recruitment and service conditions in Bihar Prohibition Services:-

CHAPTER-I

PRELIMINARY

1. Short title, Extent and Commencement— (1) These Rules may be called 'Bihar Prohibition Service (Recruitment and service conditions) Rules, 2018.

(2) They shall be extended to the whole of the State Bihar. (3) The date from which it will come effect shall be notified by the State Government separately.

2. Definitions. In these rules, unless there is anything repugnant in the subject or context— (i) "State Government" means the Government of Bihar. (ii) "Governor" means the Governor of Bihar; (iii) "Commission" means the Bihar Public Service Commission. (iv) "Department" means the Prohibition, Excise and Registration Department. (v) "Service" means the Bihar Prohibition Service; (vi) "Bihar Prohibition Service" means the different posts of Bihar Prohibition Service, i.e.:-

Superintendent, Prohibition or equivalent post, Assistant Commissioner, Prohibition, Deputy Commissioner, Prohibition, Joint Commissioner, Prohibition. and other posts that may be created in this service from time-to- time.

(vii) "Member" or "Member of Service" means a person appointed in Bihar Prohibition Service.

(viii) "Year" means the financial year i.e. the year beginning form 1st April and ending on 31st March next year.

(ix) "Available Vacancy" means vacancies available in any year due to creation of new posts in Bihar Prohibition Service or due to any other reasons.

3. Structure of Service.— (A) The said service shall be under the administrative control of Prohibition, Excise and Registration Department, the Principal secretary/secretary of which shall be its controlling officer. The state government may determine the authorized strength of service from time-to-time and may sanction the creation or surrender of permanent/temporary posts of this service.

(B) The structure of this service shall be as follows-

(i) Superintendent, Prohibition / equivalent post - Basic grade - Gazetted (ii) Assistant Commissioner, Prohibition - First level of promotion - Gazetted (iii) Deputy Commissioner, Prohibition - Second level of promotion - Gazetted (iv) Joint Commissioner, Prohibition - Third level of promotion - Gazetted (C) The pay scale/pay level of the different posts of this service shall be such as decided by the Finance Department, Government of Bihar.

CHAPTER-II

RECRUITMENT

4. Source of Recruitment. The recruitment in this service shall be made in the following manner:-

(a) By direct recruitment as per Chapter-III of these Rules.

(b) By promotion from the Post of Inspector, Prohibition as per chapter-IV of these Rules.

5. Reservation.— While making appointment and giving promotion, it shall be necessary to follow the reservation/roster policy in accordance with the Rules and procedure prescribed by the state Government (General Administration Department) from time-to-time.

6. Assessment of vacancies and communication to the Commission.— The state Government shall calculate the vacancies to be filled by direct recruitment and promotion on 1st April every year and shall send the requisition of reservation category wise vacancies for direct recruitment to the Commission by 30th April.

CHAPTER-III

DIRECT RECRUITMENT

7. Direct recruitment through joint competitive examination.—On receipt of requisition of reservation category wise vacancies from the department, the Commission shall issue advertisement and call applications from eligible candidates for direct recruitment on 50 percent basic grade posts belonging to Bihar Prohibition Service on the basis of joint competitive examination.

8. Eligibility.— For direct recruitment in service, the age, educational qualifications, reservation etc. of candidates shall be in accordance with prescribed rules and provisions laid down by the State Government and Commission from time to time. The minimum educational qualification for eligibility shall be a graduate degree from any recognized university.

9. Viva-voce/interview.— On the basis of marks obtained in the preliminary and main written joint competitive examination conducted by the Commission, the selected candidates shall have to appear before the Board, constituted by the Commission for viva-voce/interview. The Commission shall determine the maximum marks for viva-voce/interview.

10. Medical examination.— Every candidate selected for appointment shall have to appear before the medical board, constituted by the state government for medical examination. Such candidate, who may satisfy the medical board about his desired physical fitness from the point of view of discharging official duties efficiently, shall be considered for appointment.

11. Recommendation of candidates by the commission—. After preparing the merit list on the basis of written examination and interview, the Commission, shall make recommendation of candidates as per requisition received. The panel shall remain valid for a period of one year from the date of its receipt in the Department.

CHAPTER-IV

RECRUITMENT BY PROMOTION

12. Appointment by promotion.—On the basis of recommendation of Department Promotion Committee constituted under the chairmanship of Chairman/Member of the Commission, Inspector Prohibition belonging to Prohibition, Excise & Registration Department may be appointed on 50% basic grade (Superintendent Prohibition) posts by promotion.

13. Ratio of appointment on the basis of promotion from the post of Inspector Prohibition and direct recruitment. The ratio of appointment on the basis of promotion and direct recruitment on the posts of basic grade of this service shall be 50:50.

14. Eligibility of candidates.— (1) Satisfactory service during the period prescribed (kalawadhi) by the government on the post of Inspector Prohibition.

(2) Having successfully completed the prescribed training and passed the departmental examination in accordance with the departmental examination rules for Inspector Prohibition.

(3) Character remarks to be at least 'Good'. (4) Seniority.

CHAPTER-V

15. Probation period.— (1) Each officer appointed against any substantial post of basic grade, shall be placed on probation for a period of two years from the date of joining. For reasons to be recorded in writing the period of probation may be extended further for one year in case, his service is not found satisfactory during the probation period.

(2) At any time, during or at the end of the period of probation, the State Government may cancel the appointment of any officer recruited in this service or may revert the services of any officer who has been appointed on promotion from the post of Inspector, Prohibition to his basic post, if the said officer does not fulfil the conditions relating to appointment or his services is not found satisfactory during probation period or not considered fit for confirmation in the said service due to some other reasons.

(3) After probation period, annual increment shall be admissible only after passing the prescribed departmental examination.

16. Confirmation.— (1) Officer appointed in this service shall be confirmed on completion of probation period satisfactorily, if he has passed the departmental examination and other examination as per the laid down criterion, successfully completed the prescribed training and the state Government considered him fit for confirmation.

(2) Before confirmation, it shall be mandatory to pass the written examination as well as viva, conducted by the Board of Revenue, as per provisions prescribed in departmental examination rules.

17. Gradation. (i) The inter se-seniority of direct recruited officers on the post of Superintendent, Prohibition as per Chapter-III rule-7 of these Rules shall be determined according to the merit list prepared by the Commission.

(ii) The inter se-seniority of officers recruited by promotion on the post of Superintendent, Prohibition as per Chapter-IV rule-12 of these Rules shall be determined according to the date of their promotion.

(iii) In any year, officers recruited by promotion on the post of Superintendent, Prohibition shall be senior to those who are directly recruited on the post of Superintendent, Prohibition

18. Training.—Officers belonging to this service shall have to undergo training on prescribed syllabus for a fixed period by the executive order of the government in which practical training is also included. In addition to it, it shall be mandatory to pass the examination of horse riding from Police Training Centre and other examinations.

CHAPTER-VI

PROMOTION IN SERVICE

19. (1) On the basis of recommendation of Departmental Promotion Committee, all posts other than basic grade of service shall be filled up by promotion.

(2) It shall be mandatory to complete the minimum time period (kalawadhi) for promotion, prescribed by the State Government (General Administration Department) from time-to-time.

(3) It shall be mandatory to follow reservation policy/roster as prescribed by the State Government (General Administration Department) for promotion.

(4) The basis of promotion shall be seniority cum merit.

CHAPTER-VII

OTHER SERVICE CONDITIONS

20. Other service conditions for the said service, e.g.-disciplinary action, leave admissible, retirement benefit, Assured Career Progression scheme (A. C. P.) etc. which are not covered under these Rules or not notified separately for this service, shall be regulated by the Bihar Government Servant (Classification, Control and Appeal) Rules, 2005, the Bihar Government Servant Conduct Rules 1976, Bihar Service Code and other relevant rules, orders and circulars etc., issued by the State Government from time-to-time.

21. The State Government may make regulations in order to implement the provisions of these Rules.

22. Prior to the date of these rules coming into force, persons appointed and working on different posts of Bihar Excise Service, i.e. Inspector Excise, Superintendent Excise, Assistant Commissioner Excise, Deputy Commissioner Excise and Joint Commissioner Excise , shall deemed to be included in this service automatically.

23. Power for relaxation.— Where it is in considered by the Government that it is essential or expedient, it may relax the provision for the reasons to be recorded in writing for any class or grade of person or post.

24. Miscellaneous subjects.— In context of matters which are not covered under the provisions of these rules or orders issued under it, members of this service shall be guided by the Codes/Rules/Memorandum/Instructions etc., applicable to the adequate level personals of the state government.

25. Interpretation—. If any doubt arises in the interpretation of any provision of these Rules, it may be referred to the department and after consultation with the Law Department decision of the department shall be final.

26. Repeals and savings—. (1) The Bihar Excise Service (Recruitment and Service Condition) Rules, 2009 and other related Resolution/Regulation/Order etc., shall deemed to be repealed From the date, these Rules comes into force.

(2) Not with standing any such repeal, if any work or any action is done or taken in exercise of powers under Bihar Excise service (Recruitment and service condition) rules 2009 the same shall deemed to have been done or taken by these rules or in exercise of powers conferred by these Rules, as if these Rules were effective on the said date on which such work had been done or such action had been taken.
