सं॰ मं0मं0-01/मंत्रिपरिषद-36/2012/1093—भारत संविधान के अनुच्छेद-166 के खंड (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल एतद्‌द्वारा बिहार कार्यपालिका नियमावली, 1979 (समय समय पर यथा संशोधित) में निम्नलिखित संशोधन तुरंत के प्रभाव से करते हैं :-

संशोधन

''4. ऐसे मामलों का अनुपालन जिसमें माननीय उच्चतम न्यायालय/मा॰ उच्च न्यायालय द्वारा अंतिम रूप से न्यायादेश पारित किये गये हों एवं उनके विरूद्ध कोई अपील/ पुनर्विचार याचिका दायर करना संभव नहीं हो;	वित्त विभाग/सामान्य प्रशासन विभाग एवं विधि विभाग की सहमति के पश्चात्‌ मुख्य सचिव की अध्यक्षता में गठित समिति के समक्ष, प्रशासी विभाग मामले को प्रस्तुत करेगा। मुख्य सचिव की अध्यक्षता में गठित समिति की अनुशंसा को ध्यान में रखते हुए प्रशासी विभाग, प्रभारी मंत्री का आदेश प्राप्त कर, कार्यान्वयन आदेश ससमय निर्गत करना सुनिश्चित करेगा। समिति का गठन निम्नवत होगा :- i) मुख्य सचिव - अध्यक्ष ii) प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग - सदस्य iii) प्रधान सचिव/सचिव, वित्त विभाग - सदस्य iv) प्रधान सचिव/सचिव, विधि विभाग - सदस्य v) संबंधित प्रशासी विभाग के प्रधान सचिव/सचिव - सदस्य''
इस समिति का नोडल विभाग विधि विभाग होगा।

इस समिति का नोडल विभाग विधि विभाग होगा।

of Article 166 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following amendment in the Rules of Executive Business, of Bihar, 1979 (as amended from time to time) with immediate effect :—

Amendment

After Serial No-(3) of part (D) of fourth Schedule in the Rules of Executive Business,

Bihar, 1979 (as amended from time to time) Deligation of Power in legal matters a new serial

no 4 shall be added :-

"4. Compliance of such matters in which final adjudications have passed by Hon'ble Supreme Court/ High Court and if not possible to file Appeal/Review petition against them.	After taking consent of Finance Department, General Administration Department and Law Department the Administrative Department will place the matter before the committee Constituted under the Chairmanship of Chief Secretary. In view of the recommendation of the Committee, the Administrative Department will ensure to issue implementing order in time after taking approval of Minister in Charge. The constitution of the Committee will be as follows :— i) Chief Secretary - Chairman ii) Principal Secretary/Secretary, General Administration Department - Member iii) Principal Secretary/Secretary, Finance Department - Member iv) Principal Secretary/Secretary, Law Department - Member v) Principal Secretary/Secretary of Concerned Administrative Department- Member"
Law Department will be the Nodal Department for this Committee.
