सं॰ 6/एन0-07-35/2010 (अंश)-1258(6)—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अधीन महिला स्वास्थ्य कार्यर्काा (ऑक्जीलियरी नर्स मिडवाईफ-ए0एन0एम0) संवर्ग में नियुक्ति, प्रोन्नति एवं सेवा शर्तो को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं। -

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - (1) यह नियमावली "बिहार महिला स्वास्थ्य कार्यर्काा (ऑक्जीलियरी नर्स मिडवाईफ) संवर्ग नियमावली, 2018" कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त प्रवृत होगी। 2. परिभाषाएँ। - जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :- (i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; (ii) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; (iii) 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित जिला के असैनिक शल्य चिकित्सक-सह-मुख्य चिकित्सा पदाधिकारी;

(iv) 'ए0एन0एम0' से अभिप्रेत है ऑक्जीलियरी नर्स मिडवाईफ; (v) 'आयोग' से अभिप्रेत है बिहार तकनीकी सेवा आयोग; (vi) 'संवर्ग' से अभिप्रेत है बिहार महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) संवर्ग; (vii) 'परिशिष्ट' से अभिप्रेत है इस नियमावली के अंत में अंकित परिशिष्ट; तथा (viii) 'मान्यता प्र्राप्त संस्थान' से अभिप्रेत है भारतीय उपचर्या परिषद, नई दिल्ली/स्वास्थ्य विभाग, बिहार, पटना से ऑक्जीलियरी नर्स मिडवाइफरी कोर्स के लिए मान्यता प्राप्त संस्थान।

3. संवर्ग का गठन। - बिहार महिला स्वास्थ्य कार्यर्काा (ऑक्जीलियरी नर्स मिडवाईफ) का संवर्ग जिला स्तरीय होगा। संवर्ग में कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की जायः। परन्तु आवश्यकतानुसार चिकित्सा महाविद्यालय अस्पताल एवं सुपर स्पेशलिटी अस्पतालों में ए0एन0एम0 की प्रतिनियुक्ति संबंधित जिला संवर्ग से की जा सकेगी।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 10 (cid:21)दस(cid:23)बर 2018 4. संवर्ग का पदसोपान।- इस संवर्ग की विभिन्न कोटियाँ एवं पदसोपान परिशिष्ट के अनुसार होगें। 5. भर्त्ती। - इस संवर्ग में नियुक्ति मूल कोटि के पद पर सीधी भर्ती से, आयोग की अनुशंसा के आधार पर होगी।

6. अर्हताएँ। - (1) मूल कोटि के पद पर सीधी भर्त्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता मान्यता प्राप्त संस्थान से भारतीय उपचर्या परिषद द्वारा समय-समय पर अवधारित अवधि का ऑक्जीलियरी नर्स मिडवाईफ में प्रशिक्षण कोर्स में उत्तीर्णता एवं तत्संबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा। अभ्यर्थी को बिहार परिचारिका निबंधन परिषद से निबंधित रहना भी अनिवार्य होगा।

(2) सीधी भर्त्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1 ली अगस्त को उम्र के अवधारण के लिए कट ऑफ डेट माना जायेगा। 7. भर्त्ती की प्रक्रिया।- (1) नियुक्ति प्राधिकार वर्ष की 1 ली अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर और रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना विभाग को भेजेगा। विभाग द्वारा सभी जिलों की रिक्तियों का संकलन कर अधियाचना आयोग को 30 अप्रैल तक भेजी जाएगी।

(2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन पत्र आमंत्रित करेगा और निम्नलिखित के आधार पर मेधासूची तैयार करेगा :-

(क) ए0एन0एम0 कोर्स की परीक्षा में प्राप्तांक के लिए - 60 अंक (ख) उच्चतर कोर्स के लिए (यदि हो ) - 15 अंक (ग) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक कुल - 100 अंक स्पष्टीकरण :- ए0एन0एम0 कोर्स के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंको का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंको के प्रतिशत को 0.6 के गुणक से गुणा कर करना होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50 प्रतिशत अंक प्राप्त किया गया हो तो उसे 50 x 0.6 = 30 अंक दिये जायेंगे।

(3) आयोग उपर्युक्त उपनियम (2) के आधार पर तैयार मेधासूची एवं अधियाचित रिक्तियों के अनुरूप आरक्षण कोटिवार अनुशंसा विभाग को भेजेगा। विभाग अनुशंसित अभ्यर्थियों के प्रमाण पत्रांें की जाँच किये जाने के पश्चात्‌ उनका संवर्ग आवंटन करेगा। तत्पश्चात्‌ संबंधित नियुक्ति प्राधिकार स्वास्थ्य जाँच, पूर्ववृत्त सत्यापन आदि कराते हुए सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्गत नियुक्ति संबंधी दिशानिदेशों का पालन करते हुए नियुक्ति करेगा।

8. परिवीक्षा अवधि। - नियुक्ति के उपरान्त परिवीक्षा अवधि दो वर्षो की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार लिखित रूप में अभिलिखित किए जाने वाले कारणाें से एक वर्ष के लिए किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जाय तो नियुक्ति प्राधिकार ऐसी महिला स्वास्थ्य कार्यर्काा (ए0एन0एम0) को सेवामुक्त कर सकेगा।

9. विभागीय परीक्षा।- महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) को विभाग द्वारा आयोजित विभागीय परीक्षा उत्तीर्ण करनी होगी। विभागीय परीक्षा का पाठयक्रम विभाग द्वारा अवधारित किया जायेगा।

10. सम्पुष्टि।- परिवीक्षा अवधि में संतोषजनक सेवा होने और विभागीय परीक्षा उत्तीर्ण करने पर महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) को सेवा में सम्पुष्ट किया जा सकेगा।

11. वरीयता।- महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) की आपसी वरीयता आयोग द्वारा तैयार मेधासूची के अनुसार अवधारित की जायेगी।

12. इस नियमावली के परिशिष्ट में उल्लेखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से नियुक्त एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।

13. प्रोन्नति के सोपान।- (1) सेवा में सम्पुष्ट महिला स्वास्थ्य कार्यकर्त्ता (ए0एन0एम0) को, रिक्ति की उपलब्धता के अधीन रहते हुए एवं वरीयता-सह-योग्यता के अनुसार इस नियमावली के परिशिष्ट में उल्लेखित उच्चतर पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा।

(2) प्रोन्नति पर विचारार्थ, सामान्य प्रशासन विभाग द्वारा, समय-समय पर, निर्गत कालावधि संबंधी अनुदेश का अनुपालन आवश्यक होगा। प्रोन्नति संबंधी, चारित्री या पी0ए0आर0 संबंधी मुहरबन्द लिफाफा पद्धति आदि के संबंध में सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन, प्रोन्नति पर विचार करते समय आवश्यक होगा।

14. विभागीय प्रोन्नति समिति।-

(1) प्रोन्नतियॉ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर विचारणीय हाेंगी। (2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा अलग आदेश से किया जाएगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 10 (cid:21)दस(cid:23)बर 2018 15. आरक्षण।- सरकार के आरक्षण अधिनियम के प्रावधानों और सरकार द्वारा समय-समय पर सीधी भर्त्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. परिधान (यूनिफार्म)।- महिला स्वास्थ्य कार्यकर्त्ताओं के लिए कर्त्तव्य के दौरान विभाग द्वारा विनिश्चित परिधान धारित करना अनिवार्य होगा।

17. अवशिष्ट मामलें।- इस नियमावली में जिन विषयों के लिए प्रावधान नहीं किए हों उनके लिए सरकार की प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।

18. शंकाओं का निराकरण।- यदि इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई संशय हो तो विभाग को निर्देशित किया जायेगा और इस सम्बन्ध में विधि विभाग से परामर्श के पश्चात्‌, विभाग का विनिश्चय अन्तिम होगा।

19. कठिनाई का निराकरण।- यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग ऐसी कठिनाई का निराकरण विधि विभाग से परामर्श के पश्चात्‌, ऐसे आदेश द्वारा कर सकेगा जो इस नियमावली के प्रावधानों से असंगत न हो।

20. निरसन एवं व्यावृत्ति।- (1) बिहार महिला स्वास्थ्य कार्यर्काा (ऑक्जीलियरी नर्स मिडवाईफ) संवर्ग नियमावली, 2013 एतद्‌ द्वारा निरसित की जाती है।

(2) ऐसा निरसन के होते हुए भी, उक्त नियमावली के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेंगी, मानो यह नियमावली उस तिथि को प्रवृत थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

सं॰ 6/एन0-07-35/2010 (अंश)-1259 (6) सं॰ 1258 दिनांक 16 नवम्बर 2018 का निम्नलिखित अंग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से, एतद्‌ द्वारा प्रकाशित किया जाता है जो भारत के संविधान के अनुच्छेद-348 के खंड (3) के अन्तर्गत अंग्रेजी भाषा में उक्त अधिसूचना का प्राधिकृत पाठ समझा जायेगा।

No-6-N-07-35/10(Part)-1258(6)—In exercise of powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the appointment, promotion and service conditions in the Bihar Auxilliary Nurse Midwife - A.N.M. cadre under the Health Department :-

1. Short title, extent and commencement.— (1) These Rules may be called the "Bihar Lady Health Worker (Auxilliary Nurse Midwife) Cadre Rules, 2018."

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Definitions.- In these Rules, unless otherwise required in the subject or context— (i) 'Government' means Bihar State Government; (ii) 'Department' means Health Department;

(iii) 'Appointing Authority' means Civil Surgeon-Cum-Chief Medical Officer of the concerned District;

(iv) 'A.N.M.' means Auxilliary Nurse Midwife; (v) 'Commission' means Bihar Technical Service Commission; (vi) 'Cadre' means Bihar Auxilliary Nurse Midwife (A.N.M.) Cadre; (vii) 'Appendix' means appendix appended to these Rules; and (viii) ' Recognized Institutions' means the institution recognized by the Indian Nursing Council, New Delhi/Health Department, Bihar, Patna for Auxilliary Nurse Midwifery Course.

3. Constitution of cadre.—The cadre of Bihar Lady Health Worker ( Bihar Auxilliary Nurse Midwife) shall be at District level. In this cadre total number of posts in the cadre shall be such as may be sanctioned by the government from time to time:

Provided that according to necessity, A.N.M., may be deputed to a Medical College Hospital and Super Speciality Hospitals from the concerned District Cadre.

4. Chain of posts of cadre.—Different categories and chain posts of this cadre shall be according to the appendix.

5. Recruitment.—The appointment in this cadre shall be made by direct recruitment to the basic category posts, on the basis of recommendation of the Commission.

6. Qualifications.— (1) For appointment by direct recruitment to the basic category posts, minimum educational qualifications shall be pass in Auxilliary Nurse Midwifery training course of the period as determined by Indian Nursing Council from time to time, from a recognised institution and a certificate related thereto shall be necessary. Registration of candidates from Bihar Nurses Registration council shall also be necessary.

(2) For direct recruitment minimum age limit shall be 21 years and maximum age limit shall be the same as determined reservation categorywise from time to time by the Government (General Administration Department). 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

7. Procedure of Recruitment.— (1) The appointing Authority, after calculating the vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Department. The Department will compile the vacancy of all districts and send requisition to the Commission by 30th April. (2) In view of the requisition the Commission shall invite applications by advertising vacancies and shall prepare a merit list on the following basis:-

(a) For marks obtained in A.N.M. course examination - 60 Marks (b) For higher course (if any) - 15 Marks (c) For working experience in Government hospitals of Bihar - 25 Marks state (5 Marks per year, maximum 25 marks)

Total - 100 Marks Explanation:—The marks to be given to a candidate for A.N.M. course examination shall be determined by multiplying the percentage of total marks obtained in the aforesaid examination by the multiple of 0.6 For example, if a candidate has obtained 50% marks, then he will be given 50 X 0.6 = 30 marks.

(3) The Commission shall send merit list prepared on the basis of aforesaid sub-rule (2), and reservation categorywise recommendations in accordance with requisitioned vacancies to the Department. The Department will allocate the cadre after scrutiny of certificates of recommended candidates. Thereafter, the concerned Appointment5 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 10 (cid:21)दस(cid:23)बर 2018 Authority will make the appointments after conducting health check-up, verification of antecedents etc and after complying guidelines regarding appointment issued by the government (General Administration Department) from time to time.

8. Probation period.—After appointment, the probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year with reasons to recorded in writing. If the service is not found to be satisfactory even in the extended period, then the appointing authority may terminate the service of such Lady Health Worker(A.N.M.)

9. Departmental Examination.—The Lady Health Worker (A.N.M.) shall have to pass the departmental examination. The syllabus of departmental examination shall be determined by the Department.

10. Confirmation.—On being satisfactory service during probation period and passing of the departmental examination, a Lady Health Worker (A.N.M.) may be confirmed in the service.

11. Seniority.—The inter-se seniority of Lady Health Worker (A.N.M.) shall be determined according to the merit list prepared by the Commission.

12. The personnels appointed/promoted and working before the commencement of these Rules on the posts of this cadre mentioned in appendix of these rules shall be deemed to be automatically included in this cadre.

13. Chain of Posts of Promotion.—

(1) Subject to the availability of vacancies and according to seniority cum merit the Lady Health Workers(A.N.M.) may be considered to be promoted to the posts mentioned in the Appendix of these rules.

(2) For the consideration of promotion, compliance of instructions relating to the KALAWADHI, issued by the General Administration Department, from time to time, shall be compulsory. Compliance of instructions issued by the General Administration Department, from time to time, with respect to promotion and Sealed cover process method with respect to character Roll or P.A.R etc shall be compulsory at the time of consideration of promotion.

14. Departmental Promotion Committee.—

(1) Promotions will be considered on the basis of recommendations of the Departmental Promotion Committee.

(2) The Departmental Promotion Committee will be constituted with separate order by the Department.

15. Reservation.—Compliance of provisions of Reservation Act of the Government and reservation roster for direct recruitment and promotion issued, from time to time, by the Government shall be compulsory.

16. Uniform.—It shall be compulsory for the Lady Health Workers to wear uniform during duty as determined by the Department.

17. Residuary Matters.—For the subjects for which provisions have not been provided in these Rules, provisions of concerned Code/Rules/Resolutions/Instructions shall apply.

18. Removal of Doubt.—If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect the decision of the Department after consultation with the Law Department shall be final.

19. Removal of difficulties.—If any difficulty arises in implementation of provisions of these Rules, the department may remove such difficulty after consultation of the Law Department by such order which is not in consistent with provisions of these Rules.

20. Repeal and savings.—

(1) The Bihar Lady Health Worker (Bihar Auxilliary Nurse Midwife) Cadre Rules, 2013 is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the said Rules shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such thing was done or such action was taken.

Note:- The Pay Band, Grade Pay and Pay Level of all the aforesaid categories shall be the same as if may be determined by the Government, from time to time.
