सं0 1/मु0स्था0रा0भू0(विधायी)11-002/2007-872(1)—भारत के संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, बिहार गजेटियर्स के शोध पदाधिकारी के पद पर नियुक्ति एवं उनकी सेवा शर्तों के विनियमन के लिए निम्नलिखित नियमावली बनाते हैं : -
1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। -
(1) यह नियमावली ''बिहार गजेटियर्स शोध पदाधिकारी सेवा संवर्ग नियमावली, 2018'' कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त प्रवृत होगी।
2. परिभाषाएँ । - इस नियमावली में, जब तक संदर्भ में अन्यथा अपेक्षित न हो -
(i) ''सरकार'' से अभिप्रेत है बिहार राज्य सरकार ; (ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है राज्य सरकार ; (iii) ''संवर्ग नियंत्री प्राधिकार'' से अभिप्रेत है प्रधान सचिव, राजस्व एवं भूमि सुधार विभाग, बिहार ; (iv) ''विभाग'' से अभिप्रेत है राजस्व एवं भूमि सुधार विभाग, बिहार ; (v) ''आयोग'' से अभिप्रेत है, बिहार लोक सेवा आयोग, पटना ; (vi) ''गजेटियर'' से अभिप्रेत है, भौगोलिक शब्दकोष, जिसमें जिला गजेटियर एवं राज्य गजेटियर का प्रकाशन, भारत सरकार के द्वारा विनिश्चित शीर्ष एवं उपशीर्ष के अधीन होगा।
3. सेवा-संवर्ग का गठन । -

(2) उप नियम (1) में यथा विनिर्दिष्ट पदों का स्वीकृत पद बल, वेतनमान एवं वर्गीकरण वही होगा जो राज्य सरकार द्वारा समय-समय पर, विनिर्दिष्ट किया जाए।
(3) इस नियमावली के लागू होने के पूर्व से शोध पदाधिकारी के पद पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस संवर्ग के समकक्ष पद पर शामिल समझे जायेंगे।
4. आरक्षण। - सेवा के पदों पर नियुक्ति एवं प्रोन्नति में राज्य में तत्समय प्रवृत्त आरक्षण अधिनियम एवं रोस्टर संबंधी प्रावधान ही लागू होंगे।
5. भर्ती/नियुक्ति । - शोध पदाधिकारी (मूल कोटि) के पद पर सीधी नियुक्ति, विभाग द्वारा की जाने वाली अधियाचना के आधार पर आयोग द्वारा आयोजित प्रतियोगिता परीक्षा एवं साक्षात्कार के आधार पर तैयार मेधासूची एवं तदनुसार आयोग द्वारा की गई अनुशंसा के आधार पर किया जायेगा। प्रतियोगिता परीक्षा में एक वैकल्पिक विषय तथा सामान्य अध्ययन के प्रश्न पत्र होंगे। वैकल्पिक विषय तथा सामान्य अध्ययन का पाठ्यक्रम आयोग द्वारा विभाग से विमर्शाेपरांत संयुक्त प्रतियोगिता परीक्षा के पाठ्यक्रमों के अनुरूप अवधारित किए जायेंगें।
6. अर्हता ।-
(1) इतिहास अथवा अर्थशास्त्र अथवा सामाजिक विज्ञान में उच्च द्वितीय श्रेणी (कम से कम 55%) से स्नातकोत्तर उपाधि अनिवार्य होगा।
(2) सरकारी या सरकार द्वारा मान्यता प्राप्त सामाजिक शोध संस्थान अथवा विश्वविद्यालय से कम से कम दो वर्षों के शोध कार्य के अनुभव के आधार पर साक्षात्कार में 10 अंक की अधिमानता दी जायेगी।
(3) आयु सीमाः-नियुक्ति हेतु न्यूनतम आयु 21 वर्ष और अधिकतम उम्र सीमा वही होगी जो समय-समय पर राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा निर्धारित किया जायेगा।
7. परिवीक्षा अवधि ।-नव नियुक्त शोध पदाधिकारी (मूल कोटि) की परिवीक्षा अवधि दो वर्षों की होगी, जो राज्य सम्पादक, बिहार गजेटियर्स के अधीन होगी। लिखित रूप में अभिलिखित किये जानेे वाले कारणों से, परिवीक्षा अवधि एक और वर्ष के लिए बढा़यी जा सकेगी। विस्तारित परिवीक्षा अवधि में भी सेवा संतोषजनक नहीं पाये जाने पर संबंधित कर्मी को सेवा मुक्त किया जा सकेगा।
8. प्रशिक्षण ।-राज्य सरकार द्वारा समय-समय पर आवश्यकतानुसार प्रशिक्षण उपलब्ध कराया जायगा। 9. विभागीय परीक्षा एवं पाठ्यक्रम ।-मूल कोटि के पदों पर नियुक्त पदाधिकारी को राजस्व पर्षद द्वारा निर्धारित विभागीय परीक्षा में उत्तीर्ण होना आवश्यक होगा। विभागीय परीक्षा की प्रक्रिया, विषय एवं पाठ्यक्रम का अवधारण राजस्व पर्षद द्वारा विभाग के परामर्श से किया जाएगा।
10. सम्पुष्टि । -परिवीक्षा अवधि पूरी करने एवं विभागीय परीक्षा में उत्तीर्ण होने के उपरान्त राज्य सम्पादक, बिहार गजेटियर्स की अनुशंसा पर संवर्ग नियंत्री प्राधिकार द्वारा सेवा सम्पुष्ट की जा सकेगी।
11. पदस्थापन ।-नियुक्त शोध पदाधिकारियों का पदस्थापन राज्य सम्पादक, बिहार गजेटियर्स, राजस्व एवं भूमि सुधार विभाग के कार्यालय में होगा।
12. प्रोन्नति। -
(1) सेवा के विभिन्न ग्रेडों में प्रोन्नति विभाग द्वारा गठित विभागीय प्रोन्नति समिति की अनुशंसा पर दी जायेगी। प्रोन्नति हेतु सरकार द्वारा अवधारित कालावधि पूरी करना आवश्यक होगा।
(2) उप राज्य संपादक का रिक्त पद शोध पदाधिकारी के पद से प्रोन्नति द्वारा भरा जायेगा। उप राज्य सम्पादक के पद पर प्रोन्नति के लिए मानदण्ड, वरीयता-सह-योग्यता होगा।
(3) संयुक्त राज्य सम्पादक का रिक्त पद उप राज्य संपादक से प्रोन्नति द्वारा भरा जायेगा। संयुक्त राज्य सम्पादक के पद पर प्रोन्नति के लिए मानदण्ड वरीयता-सह-योग्यता होगा।
13. दायित्व । -उप राज्य सम्पादक, शोध पदाधिकारियों द्वारा तैयार प्रारम्भिक पाण्डुलिपि का अध्ययन एवं आवश्यक संशोधन के पश्चात संयुक्त राज्य सम्पादक के समक्ष प्रस्तुत करेंगे। संयुक्त राज्य सम्पादक जिलों के नोडल पदाधिकारी एवं विशेषज्ञों के साथ बैठक आयोजित करेंगें तथा उप राज्य सम्पादक द्वारा उपस्थापित पाण्डुलिपि के लिए, विभिन्न जिलों से संग्रहित सांख्यिकी एवं तथ्यों का संबंधित जिलों से सत्यापन करा कर राज्य सम्पादक के समक्ष अंतिम सम्पादन हेतु उपस्थापित करेंगे। राज्य सम्पादक की अनुपस्थिति में, संयुक्त राज्य सम्पादक उनके दायित्वों का निर्वहन करेंगे। इसके अतिरिक्त सभी पदाधिकारी राज्य सरकार द्वारा समय-समय पर अवधारित दायित्व का भी निर्वहन करेंगें। 14. अवशिष्ट मामले। -इस नियमावली में जिन विषयों का विशिष्ट रूप से प्रावधान नहीं किया जा सका है, उनके लिए राज्य सरकार के समुचित स्तर के पदाधिकारियों/कर्मचारियों के लिए लागू सेवा-संहिता/नियमावली/संकल्प/अनुदेश आदि के प्रावधान लाबू होंगे।
15. निर्वचन। - इस नियमावली के किसी उपबंध के निर्वचन में अगर कोई संदेह हो तो विधि विभाग के परामर्श से विभाग का निर्णय अंतिम होगा।
16. कठिनाईयों का निराकरण । - यदि इस नियमावली के उपबंधो के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग ऐसी किसी कठिनाई का निराकरण, विधि विभाग के परामर्श के पश्चात्, किसी ऐसा सामान्य या विशेष आदेश द्वारा कर सकेगा जो इस नियमावली के प्रावधानों से असंगत न हो।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11117777 (cid:22)दस(cid:24)ब(cid:22)दस(cid:24)ब(cid:22)दस(cid:24)ब(cid:22)दस(cid:24)बर र र र 2018201820182018 17. निरसन एवं व्यावृति ।- (1) इस सेवा के संबंध में विभाग द्वारा पूर्व में समय-समय पर निर्गत नियमावली/संकल्प/आदेश/अनुदेश आदि एतद् द्वारा निरसित किये जाते हैं। (2) ऐसा निरसन के होते हुए भी उक्त नियमावली/संकल्प/आदेश/अनुदेश आदि के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत्त थी, जिस तिथि को ऐसा कुछ किया गया था या ऐसी कोई कार्रवाई की गयी थी।

No.- 1/Mu.Stha.Ra.Bhu.(Legislative)11-002/2007-872(1)—In exercise of the powers conferred under proviso of Article-309 of the Constitution of India, the Governor of Bihar makes the following Rules for appointment to the posts of Research Officer for Bihar Gazetteers and regulation of their service conditions :-
1. Brief title, extent and commencement—
(1) hese Rules may be called the "Bihar Gazetteers Research Officer Service Cadre Rule, 2018".
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.
2. Definitions- In these Rules, unless referred otherwise in the context —
(i) 'Government' means the Government of Bihar; (ii) 'Appointing Authority' means the Government of Bihar; (iii) 'Cadre Controlling Authority' means the Principal Secretary, Department of Revenue and Land Reforms, Bihar;
(iv) 'Department' means Department of Revenue and Land Reforms, Bihar; (v) 'Commission ' means the Bihar Public Service Commission, Patna; (vi) 'Gazetteer' means Geographical Dictionary, in which the publication of the District Gazetteer and State Gazetteer will be under the Head and Sub-Head determined by the Government of India .
3. Constitution of service cadre—
(1) Posts of different categories in the service/cadre and its classification shall be as

(2) The strength of sanctioned posts, pay scale and classification as specified in sub-rule (1) shall be the same as it may be determined by the State Government, from time to time.
(3) Personnel already appointed and working on the post of Research Officer before the application of these Rules, shall be deemed to have been automatically included in the equivalent post of this cadre.
4. Reservation—In the appointment and promotion to the posts, the Reservation Act and provisions relating to the Roster, enforced for the time being in the state shall be applicable.
5. Recruitment/Appointment—Direct appointment to the post of Research Officer (Basic Category) shall be made as per requisition of the Department based on the merit list prepared through a competitive examination and an interview conducted by the Commission and on the basis of recommendation by the Commission accordingly. The competitive examination shall consist of4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11117777 (cid:22)दस(cid:24)ब(cid:22)दस(cid:24)ब(cid:22)दस(cid:24)ब(cid:22)दस(cid:24)बर र र र 2018201820182018 one optional subject and question paper of General Studies. The syllabus of the optional subject and General Studies shall be determined by the Commission after consultation with the Department which will be in conformity with the syllabus of the Combined Competitive Examination.
6. Qualifications—
(1) High Second Class (at least 55%) in Post-Graduation in History or Economics or Social Sciences shall be compulsory.
(2) Preference of 10 marks shall be given to the candidates having at least two years of research work experience from a university or from a Government or Government- recognised Social Research Institute.
(3) Age limit—The minimum age for recruitment shall be of 21 years and the maximum age limit will be applicable as determined by the Government (General Administration Department) from time to time.
7. Probation Period—The Probation period of newly appointed Research Officer (Basic Category) shall be of two years which will be under the State Editor, Bihar Gazetteers. The probation period may be extended, with reasons to be recorded in writing, for further one year. On being found not satisfactory service even in the extended probation period, the candidate concerned may be removed from the service.
8. Training—Training shall be made available by the State Government, from time to time, as per the requirement.
9. Departmental Examination and Syllabus—It will be compulsory for officers appointed to the posts of Basic Category to pass the Departmental Examination conducted by the Board of Revenue. The procedure, subject and syllabus for the examination shall be determined by the Board of Revenue in consultation with the Department.
10. Confirmation—The service shall be confirmed by the Cadre Controlling Authority on the recommendation of the State Editor, Bihar Gazetteer after satisfactory completion of the probation period and on passing of the Departmental Examination.
11. Posting—The appointed Research Officers shall be posted in the office of the State Editor, Bihar Gazetteers under Department of Revenue and Land Reforms, Bihar.
12. Promotion—
(1) Promotion in different grades of the service shall be granted on the basis of recommendation of the Departmental Promotion Committee constituted by the Department. For promotion, fulfillment of 'kalawadhi' determined by the government shall be essential.
(2) The vacant post of Deputy State Editor shall be filled up by promotion from the post of Research Officer (Basic Category). For promotion to the post of Deputy State Editor, seniority-cum-merit shall be the criterion.
(3) The vacant post of Joint State Editor shall be filled up by promotion from the post of Deputy State Editor. For promotion to the post of Joint State Editor, seniority-cum- merit shall be the criterion.
13. Liability—The Deputy State Editor will study the initial manuscript prepared by the Research Officers and after required amendment shall put up the same before the Joint State Editor. The Joint State Editor will conduct a meeting with the District Nodal Officer and Specialists, and after verification by District of the facts and data collected from the concerned Districts, the Deputy State Editor will put up the manuscript before the State Editor for its final edition. In the absence of the State Editor, the Joint State Editor will perform the duties of the State Editor. Other than these, all officers shall carry out the liabilities as determined by the State Government, from time to time 14. Residual affairs—Matters for which provisions have not been made specifically in this Rule, relevant provisions of Service Code/Rules/Resolution/Instructions applicable to Government the Officers/ Employees of appropriate level of the State Government for them will be applicable.
15. Interpretation-If any doubt arises as to the interpretation of any provision of this Rule, the decision taken by the Department, in consultation with the Department of Law, shall be final.
16. 17. Repeal and Saving—
(1) Rules/Resolutions/Orders/Instructions etc issued earlier, from time to time, by the Department with regard to this service, are hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the said Rules/Resolutions/Orders/Instructions shall be deemed to have been done or taken under these Rules, as if these Rules were come into force on the date on which such proceeding was done or such action was taken.
