सं0 380 नि0ः--निम्न तालिका के स्तम्भ-2 में उल्लिखित न्यायिक पदाधिकारी (असैनिक न्यायाधीश, वरीय कोटि) को उसी तालिका के स्तम्भ-3 में उनके नाम के सामने निर्देशित जजी एवं स्थान जहाँ पर वे अधिष्ठित रहेंगे तथा स्तंभ 4 में दी गई श्रृंखला में अवर न्यायाधीश नियुक्त किया जाता है।
तदोपरान्त, दण्ड प्रक्रिया संहिता, 1973 (अधिनियम 2, 1974) की धारा 11 की उपधारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय द्वारा निम्न तालिका के स्तम्भ-2 में उल्लिखित अवर न्यायाधीश को स्तम्भ-5 में उल्लिखित उनके नाम के सामने निर्देशित जिला के लिए प्रथम श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ प्रदान की जाती है।
साथ ही उपर्युक्त संहिता की धारा 12 की उपधारा (1) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उक्त पदाधिकारी को तालिका के स्तम्भ-3 में उनके नाम के सामने निर्देशित जिला के लिए मुख्य न्यायिक दंडाधिकारी भी नियुक्त किया जाता है और दण्ड प्रक्रिया संहिता, 1973 (अधिनियम 2, 1974) की धारा 9 की उपधारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय द्वारा निम्न तालिका के स्तम्भ-2 में उल्लिखित न्यायिक पदाधिकारी को उनके नाम के सामने स्तम्भ-5 में अंकित सत्र प्रमण्डल के लिए सहायक सत्र न्यायाधीश नियुक्त किया जाता है।

सं0 381 नि0ः--सभी मुख्य न्यायिक दण्डाधिकारी, अपर मुख्य न्यायिक दण्डाधिकारी एवं न्यायिक दण्डाधिकारी, प्रथम श्रेणी जो इस रूप में कम-से-कम तीन साल की सेवा पूरी कर चुके हैं और जो व्यवहार न्यायालय में आगामी दुर्गापूजा अवकाश में कार्यरत रहेगें उन्हें उस अवधि के लिए इसके द्वारा आवश्यक वस्तु (संशोधन) अधिनियम, 1964 (47-1964) द्वारा यथा संशोधित आवश्यक वस्तु अधिनियम 1955 के अन्तर्गत उनके अपने-अपने जिलों/अनुमंडलों में उक्त अधिनियम की धारा-3 के अधीन बने किसी ऐसे आदेश जिसे राजपत्र अधिसूचित आदेश द्वारा उस संबंध में उल्लेखित है, के उल्लंघन के संबंध में हुए अपराधों के विषय में दंड प्रक्रिया संहिता 1973 (अधिनियम 2, 1974) की धारा 260(1) (सी) के अधीन संक्षिप्त विचारण करने की शक्तियाँ अस्थायी रूप से प्रदान की जाती है।

आदेश सं0 कौन/भी-401/2018-353/सी0--बिहार वित्त सेवा के पदाधिकारी श्री शशिकान्त चतुर्वेदी, राज्य कर उपायुक्त, खगड़िया अंचल, खगड़िया को निगरानी अन्वेषण ब्यूरो, पटना के गठित धावादल द्वारा दिनांक 10.10.2018 को परिवादी श्री राहुल कुमार से रूपये 1,00,000/- (एक लाख रूपये) रिश्वत लेते रंगे हाथ गिरफ्तार किया गया। गिरफ्तार किये जाने के उपरान्त श्री चतुर्वेदी को माननीय विशेष न्यायाधीश, निगरानी-II , पटना के न्यायालय में प्रस्तुत किया गया। माननीय निगरानी न्यायालय के आदेशानुसार श्री चतुर्वेदी को न्यायिक हिरासत में आदर्श केन्द्रीय कारा बेउर, पटना भेज दिया गया है। उक्त आरोप के फलस्वरूप निगरानी अन्वेषण ब्यूरो, पटना द्वारा श्री चतुर्वेदी के विरूद्ध निगरानी थाना कांड सं0-045/2018, दिनांक 10.10.18, धारा-7 (a) भ्र0नि0अधि0, 1988 (संशोधित अधिनियम 2018) दर्ज किया गया है। श्री शशिकान्त चतुर्वेदी, राज्य कर उपायुक्त, खगड़िया अंचल खगड़िया द्वारा किया गया उपरोक्त कृत्य भ्रष्टाचार एवं आपराधिक मामला है, जो अन्वेषण, जाँच या विचारण के अधीन है। साथ ही, श्री चतुर्वेदी को अड़तालिस घंटों से अधिक अवधि के लिए, अभिरक्षा में निरूद्ध किया गया है ।
रिश्वत लेते रंगे हाथ पकड़े जाने के आरोप में श्री शशिकान्त चतुर्वेदी, राज्य कर उपायुक्त, खगड़िया अंचल खगड़िया के विरूद्ध निम्नांकित निर्णय लिया जाता हैः-
1. श्री शशिकान्त चतुर्वेदी, राज्य कर उपायुक्त, खगड़िया अंचल खगड़िया सम्प्रति काराधीन (आदर्श केन्द्रीय कारा, बेउर, पटना) को बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम-9(2)(क) के प्रावधानानुसार कारा-निरोध की तिथि 10.10.2018 के प्रभाव से निलंबित किया जाता है।
2. निलंबन अवधि में अनुमान्य जीवन निर्वाह भत्ता के अतिरिक्त कुछ भी देय नहीं होगा। उपरोक्त प्रस्ताव पर सक्षम प्राधिकार का अनुमोदन प्राप्त है।

------ योजना एवं विकास विभाग ------ अधिसूचना 7 दिसम्बर 2018 सं0 यो0स्था04/2-18/2014-6532/यो0वि0--योजना एवं विकास विभाग के प्रशासनिक नियंत्रणाधीन स्थानीय क्षेत्र अभियंत्रण संगठन, कार्य प्रमंडल-01, बेतिया (प0 चम्पारण) में पदस्थापित कार्यपालक अभियंता की प्रोन्नति हो जाने तथा कार्य प्रमंडल-02, विक्रमगंज, रोहतास में कार्यरत कार्यपालक अभियंता के सेवानिवृत्त हो जाने के फलस्वरूप उक्त कार्य प्रमंडलों में कार्यपालक अभियंता के पद रिक्त हो गए हैं। 2. अतः उपर्युक्त के आलोक में स्थानीय क्षेत्र अभियंत्रण संगठन अन्तर्गत पदस्थापित निम्नांकित कार्यपालक अभियंता/तकनीकी सलाहकार का स्थानांतरण वर्तमान पदस्थापन से करते हुए कार्यपालक अभियंता के पद पर उनके नाम के सम्मुख अंकित कार्य प्रमंडल में अगले आदेश तक के लिए किया जाता है :-

Special Courts Rules 2010)
No. Ni. Vi. /Stha (Vi.Nya.)-06/2018-4221---WHEREAS, It is alleged that Sri Bikram Kumar Jha the then District Co-operative Officer, Nawada, S/o Sri Birendra Nath Jha, Address - (i) Flat No. 15/520, L.I.G. Hanuman Nagar, P.S. - Patrakar Nagar, District-Patna, Pin-800020 (ii) House No. - C/36, Vijay Nagar, Road No.-02, P.S. - Patrakar Nagar, District-Patna, Pin-800020 & (iii) Meena Kunj, Jaiprakash Colony, Madhubani Chowk, P.S. - Khajanchi Hat, District-Purnia, Pin - 854301 while holding the post of Sri Bikram Kumar Jha the then District Co- operative Officer, Nawada and serving in different capacities in the State of Bihar, committed an offence under clause (e) of sub-section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter was investigated in Vigilance P.S. Case No. Case No. 86/2016 dated 05-09-2016.
AND WHEREAS, on scrutiny of relevant materials available on record, the State Government is of the opinion that there is prima facie case of Commission of above mentioned criminal misconduct by said Sri Bikram Kumar Jha the then District Co- operative Officer, Nawada, S/o Sri Birendra Nath Jha, Address - (i) Flat No. 15/520, L.I.G. Hanuman Nagar, P.S. - Patrakar Nagar, District-Patna, Pin-800020 (ii) House No. - C/36, Vijay Nagar, Road No.-02, P.S. - Patrakar Nagar, District-Patna, Pin- 800020 & (iii) Meena Kunj, Jaiprakash Colony, Madhubani Chowk, P.S. - Khajanchi Hat, District-Purnia, Pin - 854301 while holding the post of Sri Bikram Kumar Jha the then District Co-operative Officer, Nawada who has accumulated properties disproportionate to his known sources of income by resorting to corrupt means. AND WHEREAS, it is felt necessary and expedient by the Government that the said offender should be tried for confiscation of the properties mentioned in the application by the Special Court Established under sub-section (1) of Section 3 of Bihar Special Courts Act, 2009; NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 5 of Bihar Special Courts Act, 2009, the State Government do hereby declare that the said offence be dealt with under the provision of Special Courts Act, 2009.

Vi. /Stha (Vi.Nya.)-03/2017-4299--WHEREAS, It is alleged that Sri Barun Kumar Sikdar the then Deputy Commissioner, Commercial Taxes, Bihar Sharif, Nalanda, S/o Late Ravindra Nath Sikdar, Address - At P.S. - Jainagar, Distt. - Madhubani at Present 2A, Sugandha Villa, Road No. 10B, Rajendra Nagar, Patna while holding the post of Sri Barun Kumar Sikdar the then Deputy Commissioner, Commercial Taxes, Bihar Sharif, Nalanda and serving in different capacities in the State of Bihar, committed an offence under clause (e) of sub-section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter was investigated in Vigilance P.S.
