सं॰ 06/टैक्सी सेवा/2018-403/परि-मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59, 1988) की धारा 93 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए,''बिहार टैक्सी एग्रीगेटर परिचालन निदेष 2018'' बनाने हेतु परिवहन विभाग, बिहार सरकार की अधिसूचना संख्या-7676, दिनांक-04.12.2018 द्वारा मोटरयान अधिनियम, 1988 की धारा 212 की उपधारा (1) की अपेक्षानुसार उन सभी व्यक्तियों से जिनके उससे प्रभावित होने की संभावना थी, प्रारूप अधिसूचना की प्रति जनता के लिए उपलब्ध करा दी गयी थी, 30 दिन की अवधि के समाप्ति से पहले आपाि और सुझाव आमंत्रित करते हुए प्रकाषित किये गये थे।

उक्त नियमों की बावत जनता से कोई आपाि/सुझाव प्राप्त नहीं हुए है। अतः मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59, 1988) की धारा 93 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, शहरी गतिषीलता को प्रोत्साहित करने हेतु सड़क परिवहन एवं राजमार्ग मंत्रालय, भारत सरकार (MORTH) द्वारा निर्गत दिषानिर्देषो एवं बिहार मोटरगाड़ी नियमावली, 1992 के नियम 103 में अंतर्निहित प्रावधानों के आलोक में बिहार राज्य के अधीन तकनीकी आधारित टैक्सी सेवा प्रदाता कम्पनी/कम्पनियों के परिचालन को विनियमित करने के लिए परिवहन विभाग, बिहार सरकार एतद्‌द्वारा निम्नलिखित निदेष, यथा ''बिहार टैक्सी एग्रीगेटर परिचालन निदेष 2019'' बनाती है।

बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ-(i) यह अनुदेष ''बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019'' कहा जाएगा।

(ii) ये निदेष सम्पूर्ण बिहार राज्य में परिचालित टैक्सी एग्रीगेटर पर लागू होंगे । (iii) यह अधिसूचना के बिहार गजट में प्रकाषन की तिथि से प्रवृत्त होंगे ।

2. परिभाषाएँ-(1) इन निदेषों में जबतक कोई बात विषय या संदर्भ में अपेक्षित न हो-

(i) ''अधिनियम'' से अभिप्रेत है मोटर वाहन अधिनियम, 1988; (ii) ''एग्रीगेटर'' से अभिप्रेत है, वह व्यक्ति जो एक प्रचालक या एक मध्यस्थ/बाजार स्थल हो, जो यात्रियों को किसी टैक्सी/मोटरसाइकिल अथवा किसी अन्य सार्वजनिक सेवा वाहन द्वारा यात्रा के लिए पक्ष-प्रचार करता या सलाह देता या सुकर करता हो और जो यात्रियों/इच्छुक यात्रियों को किसी टैक्सी या किसी अन्य सार्वजनिक सेवा वाहन के चालक से, फोन कॉल,2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11111111 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 इंटरनेट वेब आधारित सेवाओं या जी0पी0एस0/जी0पी0आर0एस0 आधारित सेवाओं के माध्यम से संबंध स्थापित करता हो चाहे ऐसी सेवाओं को उपलब्ध करने के लिए कोई भाड़ा, फीस, कमीषन, दलाली या अन्य प्रभारों का संग्रहण किया जाता हो या नहीं;

(iii) ''प्रपत्र'' से अभिप्रेत है इस बिहार टैक्सी एग्रीगेटर परिचालन नीति से संलग्न प्रपत्र; (iv) ''अनुज्ञप्ति'' से अभिप्रेत है ऐसी अनुज्ञप्ति; जो बिहार टैक्सी एग्रीगेटर परिचालन के अधीन जारी की गई हो;

(v) ''अनुज्ञप्तिधारी'' से अभिप्रेत है ऐसा ''एग्रीगेटर'' जो बिहार टैक्सी एग्रीगेटर नीति के अधीन जारी अनुज्ञप्ति धारण करता हो;

(vi) ''अनुज्ञापन प्राधिकारी'' से अभिप्रेत है राज्य परिवहन आयुक्त, बिहार सरकार; (vii) ''टैक्सी'' से अभिप्रेत है कोई मोटरवाहन जिसके परिचालन के लिए वैध परमिट एवं भारत के नियमों के अनुसार अन्य कागजात उपलब्ध हो, जो कि बिहार राज्य के लिए वैध हो;

(viii) ''मोटर साइकिल'' से अभिप्रेत है मोटरवाहन अधिनियम 1988 की धारा 2 (27) के तहत परिभाषित ऐसा द्विचक्रीय मोटर वाहन जिसमें अलग करनेवाला अतिरिक्त चक्रयुक्त पाष्र्वकार जुड़ा हो और नौका, सड़क परिवहन और राजमार्ग मंत्रालय, की अधिसूचना संख्या-1248(E) दिनांक-05.11.04 गैरव्यवसायिक एवं व्यवसायिक कोटि दोनों के अधीन मोटरसाइकिल के निबंधन की स्वीकृति देता है;

(ix) ''सार्वजनिक सेवा यान'' से अभिप्रेत है अधिनियम की धारा 2(35) में यथा परिभाषित कोई ऐसा वाहन जो यात्रियों को भाड़े अथवा पारिश्रमिक हेतु ढोने के लिए उपयोग किया जाने वाला अथवा उपयोग किए जाने के लिए परिवर्तित किया गया कोई वाहन;

(x) ''जाँच पदाधिकारी'' से अभिप्रेत है जिला परिवहन पदाधिकारी अथवा इस निमित राज्य परिवहन आयुक्त द्वारा विनिर्दिष्ट रूप से प्राधिकृत पदाधिकारी ।

(2) बिहार टैक्सी एग्रीगेटर परिचालन निदेष में प्रयुक्त किन्तु इसमें अपरिभाषित शब्दों और अभिव्यक्तियाँ के वही अर्थ होंगे, जो मोटर वाहन अधिनियम, 1988, केन्द्रीय मोटर वाहन नियमावली, 1989 एवं बिहार मोटर वाहन नियमावली, 1992 में उनके प्रति क्रमषः समनुदेषित किए गए हों ।

3. अनुज्ञप्ति-

(क) अनुज्ञप्ति की अनिवार्यता-कोई भी कम्पनी बिहार राज्य के भीतर तबतक टैक्सी एग्रीगेटर के रूप में कार्य नहीं करेगी जबतक कि ऐसी कंपनी अनुज्ञापन प्राधिकारी से अभिकर्ता की अनुज्ञप्ति प्राप्त न कर लें।

(ख) अनुज्ञप्ति हेतु आवेदन-इस ''बिहार टैक्सी एग्रीगेटर परिचालन निदेष 2019'' के अधीन अनुज्ञप्ति के लिए आवेदन, इस प्रयोजनार्थ परिषिष्ट-I के यथा विनिर्दिष्ट प्रपत्र-I में अनुज्ञापन प्राधिकारी को लिखित में दिया जाएगा, और इसमें दी गई सूची के अनुसार समर्थक दस्तावेज साथ में संलग्न किए जाएंगे ।

अनुज्ञप्ति हेतु आवेदन के साथ बिहार मोटरवाहन नियमावली 1992 के नियम 103(क) के अनुसार उचित फीस के भुगतान का प्रमाण साथ में संलग्न किया जायेगा ।

(ग) आवेदन हेतु आवष्यक दस्तावेज- आवेदन के साथ निम्नलिखित दस्तावेज संलग्न किए जायेंगे- (i) आवेदक कंपनी, कंपनी अधिनियम, 1956 अथवा 2013 एवं अन्य लागू विधियों के सुसंगत प्रावधानों के अधीन रजिस्ट्रीकृत है, का सबूत;

(ii) बिहार राज्य में संगठन के पता का सबूत और बिहार राज्य में संगठन प्रभारी पदाधिकारी का टेलीफोन नंबर, वेब-पता एवं ई-मेल आई डी का ब्यौरा;

(iii) विगत एक वर्ष के लिए आवेदक को प्रचालन में होना चाहिए-निगमन के प्रमाण पत्र की प्रति; (iv) जी0एस0टी0 निबंधन प्रमाण पत्र की प्रति एवं पैन का विवरण (v) विगत एक वित्तीय वर्ष का अंकेक्षित वित्तीय विवरण, (vi) इस प्रभाव का वचनबंध कि ''बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019'' के अधीन स्वीकृत अनुज्ञप्ति की निबंधन और शर्त्तों के साथ-साथ मोटरवाहन अधिनियम, 1988, केन्द्रीय मोटरवान नियमावली, 1989 एवं बिहार मोटर वाहन नियमावली, 1992 के आवष्यक एवं लागू प्रावधान तथा देष की लागू सभी विधियों का पूर्णरूप से अनुपालन किया जाएगा, (vii) अनुज्ञप्तिधारी अपने स्वामित्व का अथवा परमिटधारी टैक्सी के वाहन मालिक या निजी वाहन मालिकों के साथ विहित प्रारूप में इस प्रभाव का करार कि लाइसेंस मिलने के 30 दिनों के भीतर उक्त निजी वाहन का सम्परिवर्तन व्यवसायिक वाहन में करने हेतु सक्षम प्राधिकार से परमिट प्राप्त कर लिया जायेगा के माध्यम से 50 टैक्सयों का कम से कम एक बेड़ा संधारित करेगा;

(viii) अनुज्ञप्तिधारी अपने स्वामित्व का अथवा वाहन मालिक के साथ विहित प्रारूप में इस प्रभाव का करार कि लाइसेंस मिलने के 30 दिनों के भीतर निजी वाहन का सम्परिवर्तन व्यवसायिक वाहन में करने हेतु सक्षम प्राधिकार से परमिट प्राप्त कर लिया जायेगा, 50 मोटर साईकिलों का कम से कम एक बेड़ा संधारित करेगा;

(ix) आवेदक कम्पनी के प्रबंधक निदेषक का नाम, पता, दूरभाष नम्बर, वेबसाईट का पता, ई-मेल आई-डी संबंधी विवरण;

(x) आवेदक कम्पनी द्वारा एग्रीगेटर के रूप में कार्य करने संबंधी विकसित एम0आई0एस0 एवं उपलब्ध अन्य तकनीकी विषिष्टियों का विवरण समेकित कर आवेदन के साथ समर्पित करना होगा;

(xi) प्रचालन के लिए, कॉल सेन्टर, वेबपोर्टल तथा मोबाइल एप का ब्यौरा उपलब्ध पार्किग सुविधाओं का ब्यौरा।

(घ) औपबंधिक अनुज्ञप्ति- आवेदक द्वारा परिषिष्ट-1 के प्रपत्र-1 में अनुज्ञप्ति स्वीकृति हेतु आवेदन देना होगा एवं आवेदक द्वारा बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019 के अधीन अनुज्ञप्ति की स्वीकृति हेतु शर्तों के अनुपालन से संतुष्ट होने की स्थिति में परिषिष्ट-1 के प्रपत्र-2 में ''औपबंधिक अनुज्ञप्ति'' अनुज्ञापन प्राधिकार द्वारा निर्गत किया जा सकेगा । औपबंधिक अनुज्ञप्ति 30 दिनों के लिए वैध होगी और इस अवधि में आवेदक ''औपबंधिक अनुज्ञप्ति'' में वर्णित सभी शर्त्तों के अनुपालन प्रतिवेदन अवष्य प्रस्तुत करेगा । अनुज्ञापन प्राधिकार के निदेषानुसार औपबन्धिक अनुज्ञप्ति को अगले 30 दिनों के लिए विस्तारित किया जा सकेगा तथा औपबंधिक अनुज्ञप्ति की विस्तारित अवधि की समाप्ति तक सभी मानदंड पूर्ण नहीं करने की दषा में औपबंधिक अनुज्ञप्ति को रद्द किया जा सकेगा।

(ङ) अनुज्ञप्ति की स्वीकृति-

(i) इसका समाधान होने पर कि आवेदक ने बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019 के अधीन अनुज्ञप्ति की स्वीकृति के लिए विहित शर्तों का संतोषप्रद अनुपालन कर लिया है, अनुज्ञापन प्राधिकार संलग्न परिषिष्ट-1 के प्रपत्र-2 में ''स्थायी अनुज्ञप्ति'' को स्वीकृत करेगा।

(ii) अनुज्ञप्ति की वैधता निर्गत तिथि से तीन वर्षों के लिए होगी । (iii) ''अनुज्ञापन प्राधिकार'' अनुज्ञप्ति प्रदान करने के पूर्व जाँच पदाधिकारी से वैसी रीति से जाँच करवा सकेगा, जैसा वह आवष्यक समझता हो ।

(च) अनुज्ञप्ति नवीकरण-

(i) इन नियमों के अधीन स्वीकृत, अनुज्ञप्ति वैधता की अवधि के समाप्त होने के कम से कम दो माह पूर्व परिषिष्ट-1 के विहित प्रपत्र-3 में नवीकरण हेतु समर्पित आवेदन बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019 के निबंधनों और शर्तों के अनुसार अनुज्ञप्तिधारी के संतोषजनक अनुपालन के अधीन रहते हुए नवीकृत किया जा सकेगा ।

(ii) अनुज्ञप्ति नवीकरण हेतु बिहार मोटरवाहन नियमावली, 1992 के नियम 103 (क) में विहित फीस के साथ नवीकरण आवेदन समर्पित किया जायेगा,

(iii) अनुज्ञप्ति नवीकरण आवेदन के साथ संलग्न किये जाने वाले अभिलेख :-

1. दी गई अनुज्ञप्ति की मूल प्रति, 2. अनुज्ञप्तिधारक द्वारा अनुज्ञप्ति की वैधता अवधि में प्रयुक्त टैक्सी/मोटरबाईक

टैक्सी का परमिट का ब्यौरा;

3. अनुज्ञप्ति की वैधता अवधि में इस सेवा का उपयोग करने वाले यात्रियों की संख्या

का ब्यौरा;

4. अनुज्ञप्ति की वैधता अवधि में सेवा के संबंध में यात्रियों के प्राप्त षिकायत एवं

उसके निवारण का ब्यौरा;

5. विगत तीन वर्षों के आय-व्यय का अंकेक्षित प्रतिवेदन, 6. वैधता अवधि में की गई किसी कार्रवाई का ब्यौरा, 7. अनुज्ञापन प्राधिकार अनुज्ञप्ति नवीकरण करने के पूर्व जाँच पदाधिकारी से वैसी

रीति से जाँच करवा सकेगा, जैसा वह आवष्यक समझता हो ।

(iv) अनुज्ञप्ति के नवीकरण की तिथि से अगले तीन वर्ष के लिए अनुज्ञप्ति वैध होगी, (v) बिहार टैक्सी एग्रीगेटर परिचालन निदेष, 2019 में यथा वर्णित शर्तों के संतोषप्रद अनुपालन पर अनुज्ञापन प्राधिकारी परिषिष्ट-1 के प्रपत्र-2 में अनुज्ञप्ति नवीकृत करेगा।4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11111111 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 (ध) अनुज्ञप्ति निलंबन या रद्द करने का अनुज्ञापन प्राधिकार का अधिकार-

(i) अनुज्ञापन प्राधिकार, अनुज्ञप्तिधारी को सुनवाई का अवसर देने के बाद अनुज्ञप्ति को निलंबित या रद्द कर सकेगा, यदिः- (क) अनुज्ञप्तिधारी इस निदेष किसी निबंधनों और शर्ताें में से किसी अनुपालन करने में

असफल रहता है; अथवा

(ख) अनुज्ञप्तिधारी का कोई कर्मचारी अथवा अनुज्ञप्तिधारी से सम्बद्ध वाहन का चालक

किसी यात्री के साथ दुव्र्यवहार अथवा कदाचार का दोषी सिद्ध होता है, अथवा (ग) किसी यात्री द्वारा अनुज्ञप्तिधारी के विरूद्ध की गयी षिकायत संदेह से परे सही साबित होता है, तो अनुज्ञापन प्राधिकारी विनिर्दिष्ट अवधि के लिए अनुज्ञप्ति निलंबित कर सकेगा अथवा अनुज्ञप्ति रद्द कर सकेगा

परन्तु कोई भी अनुज्ञप्ति तब तक निलम्बित या रद्द नहीं किया जाएगा जबतक

अनुज्ञप्ति के धारक को अपना स्पष्टीकरण देने का अवसर न दे दिया गया हो । (घ) यदि अनुज्ञापन प्राधिकार का यह समाधान हो जाता है कि अनुज्ञप्तिधारक अनुज्ञप्ति निबंधनों और शर्तों में से किसी का अनुपालन करने में असफल रहा है, तो वह अनुज्ञप्ति का नवीकरण, लिखित रूपों में अभिलिखित किए जाने वाले कारणों से, अनुज्ञिप्त नवीकरण अस्वीकृति के लिए उत्तरदायी होगा ।

(ii) जब अनुज्ञप्ति निलंबित अथवा रद्द कर दी गई हो तो अनुज्ञप्तिधारी; अनुज्ञापन प्राधिकार को अनुज्ञप्ति अभ्यर्पित करेगा ।

(छ) अनुज्ञप्ति की द्वितीयक प्रति का निर्गमन-जहाँ अनुज्ञप्ति खो जाती है अथवा नष्ट हो जाती है, तो दूसरी प्रति निर्गत करने के लिए एक आवेदन बिहार मोटरगाड़ी नियमावली, 1992 के नियम 103 (क) में विहित फीस के साथ किया जाएगा । इस प्रकार निर्गत अनुज्ञप्ति की दूसरी प्रति पर लाल स्याही से ''दूसरी प्रति'' अंकित की जाएगी।

4. अपील।-

(i) अनुज्ञप्ति से संबंधित मामलों में अपीलीय प्राधिकार प्रधान सचिव/सचिव, परिवहन विभाग, बिहार, पटना होंगे।

(ii) अनुज्ञापन प्राधिकार के किसी आदेष से व्यथित अनुज्ञप्तिधारी आदेष प्राप्ति की तिथि से 30 दिनों के भीतर; प्रधान सचिव/सचिव, परिवहन विभाग, बिहार सरकार, पटना के समक्ष अपील दायर कर सकेगा।

(iii) अपील दो प्रति में संक्षिप्त ज्ञापन के रूप में होगा, जिसमें अपील के आधार का वर्णन होगा तथा इसके साथ ऐसा फीस संलग्न होगी जो सरकार द्वारा बिहार मोटरवाहन नियमावली, 1992 में विनिर्दिष्ट की गयी हो।

(iv) प्रधान सचिव/ सचिव, परिवहन विभाग, बिहार सरकार,पटना द्वारा पक्षकारों को सुनवाई का अवसर देने और ऐसी जाँच करने के पश्चात्‌ जो वह उचित समझे, उपयुक्त आदेष पारित कर सकेगा ।

5. किराया-

(i) मोटरवाहन अधिनियम 1988 की धारा 67 (1) के अनुसार राज्य सरकार, समय-समय पर, गजट में प्रकाषित अधिसूचना द्वारा टैक्सी के लिए अधिकतम और न्यूनतम किराए एवं भारक नियत करने के संबंध में निदेष निर्गत कर सकेगी।

(ii) अनुज्ञप्तिधारी, किराया दर प्रदर्षित करेगा और वेबसाइट, इंटरनेट समर्थित ऐप पर (मोबाइल ऐप सहित) अथवा अनुज्ञप्तिधारी द्वारा चालक और यात्री को जोड़ने के लिए प्रयुक्त डिजिटल प्लेटफार्म किराया दर आकलक उपलब्ध रहेगा ।

6. परिचालन हेतु आधारभूत संरचना-

(क) वाहन संबंधी आधारभूत संरचना-

(i) अनुज्ञप्तिधारक द्वारा ऐसी कोई टैक्सी/मोटर बाईक टैक्सी किसी एग्रीगेटर के माध्यम से भाड़े पर नहीं दी जाएगी जो इन नियमों के तहत निबंधित न होे।

(ii) अनुज्ञप्तिधारी यह सुनिष्चित करेगा कि सभी टैक्सी/मोटर बाईक टैक्सी के पास अधिनियम के अधीन निर्गत वैध फिटनेष प्रमाण पत्र और मोटरवाहन अधिनियम, 1988 के सुसंगत प्रावधानों के अधीन व्यवसायिक निबंधन प्रमाण पत्र, विहित बीमा प्रमाण पत्र, प्रदूषण नियंत्रण प्रमाण पत्र के साथ, स्वीकृत परमिट के अधीन प्रचालित हो रहा है । (iii) इस निदेष के अधीन प्रचालित हरेक वाहन के पास या तो वाहन से लगा अथवा वाहन के चालक के मोबाइल से लगा जी0पी0एस0/जी0पी0आर0एस0 आधारित यंत्र होना होगा, जो की गयी यात्रा का मार्ग तथा कुल आच्छादित दूरी को प्रदर्षित करेगा । टैक्सी भाड़े पर परिचालन के दौरान अनुज्ञप्तिधारी के नियंत्रण कक्ष से लगातार सम्पर्क में रहेगी।5 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11 11 11 11 जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) 2019201920192019 (iv) इस निदेष के अधीन प्रचालित कोई वाहन मोबाइल, रेडियो, वेब अथवा अनुज्ञप्तिधारी के

दुतरफा प्रणाली पर आधारित डिजीटल प्लेटफार्म से सुसज्जित होगा।

(v) चालक का फोटो, अनुज्ञप्ति संख्या, लोक सेवा के लिए प्रयुक्त वाहन (PSV)का बैच संख्या, वाहन का रजिस्ट्रीकरण चिन्ह रखने वाले ब्यौरे वाहन के भीतर प्रमुखता से प्रदर्षित किए जाएंगे ताकि यह यात्रियों को प्रत्यक्ष रूप से दिखाई दे । ये ब्यौरे ऐप में तथा उपभेक्ता को निर्गत बिल (इनवाईस) में भी प्रदर्षित होंगे।

(vi) वाहन के भीतर वाले भाग में जिला परिवहन कार्यालय, पुलिस एवं महिला हेल्प लाईन का फोन नम्बर प्रमुखता से प्रदर्षित किया जायेगा।

(vii) इस अनुदेष के अधीन प्रचालित कोई वाहन प्राथमिक उपचार पेटी से सुसज्जित होगा तथा उसमें बिहार मोटर वाहन नियमावली, 1992 में विनिर्दिष्ट सामग्री उपलब्ध होगी। (viii) इस अनुदेष के तहत परिचालित किसी वाहन को स्वच्छ र्इंधन से परिचालित किया जाएगा। ये वाहन परिवहन प्राधिकार/सड़क परिवहन एवं राजमार्ग मंत्रालय द्वारा, समय- समय पर, जारी उत्सर्जन मानकों का पालन करेंगे।

(ix) वाहन में यात्रियों को आसानी से मिलनेवाली एक फीडबैक पंजी रखी जाएगी । (x) मोटर साइकिल (बाइक टैक्सी) की स्थिति में, उपरोक्त खंड के अतिरिक्त निम्नलिखित शर्तों को पूरा करने की आवष्यकता होगी- (क) अव्यस्कों को भाड़े का वाहन उपलब्ध करने की अनुमति नहीं होगी, (ख) पिछली सीट पर एक से ज्यादा यात्री के वहन की अनुमति नहीं होगी, परन्तु अभिभावक के संरक्षण में 5 वर्ष तक के एक बच्चे को यह अनुमति होगी, (ग) सेवा प्रदाता कम्पनी द्वारा चालक के अतिरिक्त यात्रियों के लिए स्वीकृत मानकों

के अनुरूप 'क्रैष हेलमेट' प्रदान किया जाएगा,

(घ) भाड़े पर लेने वाले को बहुत सीमित मात्रा में व्यक्तिगत सामान जैसे सामान्य

आकार का बैक-पैक अथवा छोटा ब्रीफकेस आदि रखने की अनुमति दी जाएगी, (ख) चालक प्रोफाईल।-

(i) चालक को एक दुपहिया वाहन अथवा हल्के मोटरवाहन के परिचालन के लिए जैसी आवष्यकता हो, एक वैध चालक अनुज्ञप्ति प्राप्त होनी चाहिए।

(ii) चालक को प्रचालन क्षेत्र के मार्गों एवं सड़कों की पर्याप्त जानकारी रखनी होगी ताकि यात्रियों को कोई असुविधा न हो।

(iii) चालक कर्तव्य के दौरान अनुज्ञापन प्राधिकार द्वारा अनुमोदित अथवा कंपनी के डिजाइन के अनुसार वर्दी धारण करेगा।

(iv) चालक बिना किसी आपराधिक रिकार्ड के अच्छे नैतिक आचरण वाला होगा। कोई व्यक्ति, जो मादक द्रव्य अथवा अल्कोहल के प्रभाव में पिछले 7 वर्षों के भीतर वाहन चालन के अन्तर्गत दोषसिद्ध ठहराया गया हो अथवा दण्ड प्रक्रिया संहिता 1973 के अधीन किसी संज्ञेय अपराध के लिए कभी भी सिद्धदोष ठहराया गया हो, जिसमें कपट, यौन अपराध, मोटरवाहन का इस्तेमाल कर संज्ञेय अपराध, संपत्ति विवाद और/अथवा चोरी वाले अपराध, हिंसा अथवा आतंक फैलाना शामिल हो, को अनुज्ञप्तिधारी द्वारा नियोजित नहीं किया जाएगा।

(v) अनुज्ञप्तिधारक, चालकों की गुणवत्ता, उनके पुलिस सत्यापन एवं यात्रियों के प्रति उनके द्वारा किए गए व्यवहार के लिए, उत्तरदायी होगा । अनुज्ञप्तिधारी यह भी सुनिष्चित करेगा कि चालक सुरक्षित, विष्वसनीय और ईमानदार है ।

(vi) वाहनों के स्वामित्व की सूचना और चालकों के प्रोफाइल, जिसमें पुलिस सत्यापन शामिल है, अनुज्ञप्तिधारी द्वारा सुनिष्चित किया जाएगा तथा अनुज्ञापन प्राधिकार के साथ-साथ यातायात पुलिस को उपलब्ध किया जाएगा।

(vii) चालकों द्वारा वाहन के निम्नलिखित अद्यतन कागजातों की छायाप्रति (संगत मूल पत्रों से सत्यापन के बाद) संधारित की जायेगी-

1. निबंधन प्रमाण पत्र; 2. फिटनेष प्रमाण पत्र; 3. वाहन का परमिट; 4. वाहन का इंजन एवं चेचिस नम्बर; 5. अधिनियम में विहित तृतीय पक्षकार को आच्छादित करनेवाला वाणिज्यिक बीमा

पॉलीसी;

6. नियंत्रण के अधीन प्रदूषण प्रमाण पत्र ।6 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11111111 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 (viii) यदि अनुज्ञप्तिधारी किसी ऐसे वाहन का उपयोग करता है अथवा देता है अथवा किसी रीति से उपयोग करने की अनुमति देता है, जो अधिनियम के उपबंधों द्वारा प्राधिकृत नहीं हो तो अनुज्ञप्तिधारी और चालक किसी व्यक्ति, जिसमें चालक सम्मिलित है, द्वारा की गई क्षति, चोट, अपराध के लिए अनुज्ञप्तिधारी और चालक संयुक्त रूप से जवाबदेह होगा, (ix) चालक यात्री के साथ हमेषा विनम्र और षिष्ट रीति से व्यवहार करेगा, (x) चालक आवाज लगाकर यात्रियों को नहीं बैठाएगा ।

(ग) अनुज्ञप्तिधारी द्वारा पालन करने हेतु सामान्य शर्तें।-

(i) अनुज्ञप्तिधारी पर्याप्त कर्मचारियों के साथ हर समय (24x7) टैक्सी सेवा एवं नियंत्रण कक्ष बनाए रखेगा,

(ii) अनुज्ञप्तिधारी सभी टैक्सियों के लिये पर्याप्त पड़ाव स्थल की उपलब्धता सुनिष्चित करेगा, (iii) अनुज्ञप्तिधारी कार्यस्थल पर महिलाओं के यौन उत्पीड़न (प्रतिषेध और निवारण) अधिनियम, 2013 (सं0 14, /अधिनियम, 2013) के अधीन यथा निर्धारित महिलाओं के अधिकारों की सुरक्षा के लिए तंत्र सुनिष्चित करेगा,

(iv) अनुज्ञप्ति में यथोल्लिखित अपने कारोबार का न तो स्थान बदलेगा और न शाखा तथा अनुज्ञापन प्राधिकार से लिखित अनुमति के बिना कोई नई शाखा नहीं खोलेगा, (v) अपने नियंत्रण वाली सभी टैक्सी एवं मोटर बाईक टैक्सी का दैनंदिन आधार पर डिजिटल रूप में हरेक वाहन द्वारा प्रचालित बारी, वाहन में यात्रा करने वाले यात्रियों के ब्यौरे, यात्रा का उद्‌गम और गन्तव्य तथा वसूले गए किराया का अभिलेख संधारित करेगा । इस प्रकार संधारित अभिलेख, अनुज्ञापन प्राधिकार द्वारा नामित किसी पदाधिकारी के द्वारा किसी भी समय जाँच के लिए खुला रहेगा,

(vi) अनुज्ञप्तिधारी, अनुज्ञापन प्राधिकार को प्रत्येक त्रैमासिक आधार पर एवं मांगे जाने पर चालकों की सूची, उनकी अनुज्ञप्ति संख्या, वाहन रजिस्ट्रीकरण संख्या तथा चेचिस एवं इंजन संख्या और उसके द्वारा प्रचालित टैक्सी के परमिट का ब्यौरा उपलब्ध करेगा; (vii) चालकों से संबंधित निम्नलिखित अद्यतन ब्यौरे की प्रति (मूल से सत्यापन के पश्चात्‌) संधारित करेगाः

1. चालक का फोटो; 2. चालक अनुज्ञप्ति; 3. आवास प्रमाण-पत्र के सबूत के साथ घर का वर्तमान पता; 4. भारतीय रिजर्व बैंक के अनुसार के0वाई0सी0 सहित बैंक खाते का ब्यौरा; 5. पैन कार्ड एवं मतदाता परिचय पत्र की स्वअभिप्रमाणित छायाप्रति; 6. दो पारिवारिक सदस्यों का संपर्क ब्यौरा और पता ।

(viii) किसी चालक पर लागू मादक द्रव्य अथवा अल्कोहल के प्रयोग पर शून्य सहन नीति कार्यान्वित करेगा, अपने वेबसाइट पर ''शून्य सहन नीति'' का नोटिस के साथ ही जब यात्री को समुचित रूप से शंका हो कि चालक गाड़ी चलाने के दौरान मादक द्रव्य अथवा अल्कोहल के प्रभाव में था तो यात्रियों द्वारा चालक के बारे में षिकायत करने की प्रक्रिया उपलब्ध करेगा । अनुज्ञप्तिधारी ''शून्य सहन नीति'' के कथित उल्लंघन की यात्री की षिकायत प्राप्त होने पर, ऐसे चालक की प्लेटफार्म तक पहुँच को तुरत अक्रियाषील अथवा निलंबित कर देगा । अनुज्ञप्तिधारी द्वारा जाँच की अवधि के दौरान चालक का निलंबन जारी रहेगा।

(ix) अनुज्ञप्तिधारी अपने चालकों के लिए संरचित रिफ्रेषर प्रषिक्षण कार्यक्रम, जो केवल सुरक्षित चालन-कौषल तक सीमित नहीं होगा, आयोजित करेगा जिसमें लैंगिक संवेदीकरण, यात्री षिष्टाचार आदि विषय शामिल हों । अनुज्ञप्तिधारी सुनिष्चित करेगा कि चालक कैलेंडर वर्ष में कम से कम एक बार रिफ्रेषर प्रषिक्षण में भाग ले । ऐसा प्रषिक्षण कार्यक्रम अनुज्ञप्तिधारी द्वारा सम्य्‌क रूप से प्रलेखित होना चाहिए।

(x) चालक के फोटो के साथ वाहन रजिस्ट्रीकरण संख्या तथा चालक के अन्य ब्यौरे वाहन पर चढ़ने से पहले उपभोक्ता के मोबाइल पर भेजेगा।

(xi) टैक्सी किराया, अपना प्लेटफार्म अथवा एप टैक्सी के रजिस्ट्रीकरण, टैक्सी के स्वामी और/अथवा चालक के साथ भाड़े की जानकारी साझा करते हुए, यात्रियों की सुरक्षा आदि पर अपनी नीति पहले ही प्रकाषित करेगा।

(xii) अनुज्ञप्तिधारी सुनिष्चित करेगा कि चालक वार्षिक स्वास्थ्य जाँच कराए ताकि वाहन चलाने की उसकी योग्यता सुनिष्चित की जा सके।7 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11 11 11 11 जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) 2019201920192019 (xiii) यात्रा के दौरान किसी भी अप्रिय घटना की स्थिति में, अनुज्ञप्तिधारी इसे अनुज्ञप्ति जारी करने वाले प्राधिकार के साथ-साथ क्षेत्राधिकार वाली पुलिस को तुरंत सूचित करेगा। (xiv) वाहन भौतिक आपात बटन की सुविधा तथा दबाने पर विहित आवाज/प्रकाष उत्सर्जित करने की व्यवस्था से सुसज्जित होना चाहिए ताकि सहजदृष्य स्थान में और भाड़े पर लेने वालों की तुरंत पहुँच वाले स्थान में वाहन में एवं यात्री/चालक की पूर्ण सुरक्षा सुनिष्चित की जा सके । वाहन उसके स्वामी द्वारा लगाए गए जी0पी0एस0 यंत्र से सुसज्जित होना चाहिए ।

7. षिकायत निवारण।-

(i) वेब पोर्टल संधारित करेगा जिसमें वाहन स्वामी से संबंधित सभी ब्यौरे, प्रदत्त सेवा, किराये की संरचना, बीमा दायित्व, नियंत्रण कक्ष का नम्बर, सम्यक्‌ रूप से नियुक्त षिकायत निवारण पदाधिकारी का नाम और सम्पर्क ब्यौरे रहेंगे।

(ii) यात्रियों के फीडबैक और षिकायतों को प्राप्त करने के लिए पर्याप्त तंत्र सुनिष्चित करेगा । यह टैक्सी में रखी फीडबैक पंजी जो हमेषा यात्रियों के लिए उपलब्ध रहेगी, के माध्यम से तथा टौल फ्री नम्बर उपलब्ध कराकर सुनिष्चित किया जा सकेगा।

(iii) यह सुनिष्चित करेगा कि यात्रियों अथवा किसी अन्य व्यक्तियों की प्राप्त षिकायत अथवा परिवाद उसके द्वारा नियुक्त षिकायत पदाधिकारी द्वारा सुने जायेंगे, एवं निरीक्षी प्राधिकारों द्वारा मांग किये जाने पर उनके समक्ष भी उपलब्ध किए जायेंगे ।

(iv) अनुज्ञप्तिधारी द्वारा यात्रियों के षिकायत निवारण के स्थिति की समीक्षा, समय-समय पर,परिवहन विभाग द्वारा भी की जा सकेगी और समीक्षा के क्रम में अनुज्ञप्तिधारक को जाँच पदाधिकारी के समक्ष वैसे सभी दस्तावेज प्रस्तुत करना आवष्यक होगा, जैसा जाँच पदाधिकारी आवष्यक समझे । समीक्षोपरान्त आवष्यकता होने पर विभाग ऐसे समुचित निदेष निर्गत कर सकेगा जैसा वह आवष्यक समझता हो ।

8. कठिनाई दूर करने की शक्ति।-

(i) परिवहन विभाग आवष्यकतानुसार इस निदेष में संषोधन हेतु सक्षम प्राधिकार होगा। (ii) अनुज्ञापन प्राधिकारी, अनुज्ञप्तिधारी को कम से कम 30 दिनों की पूर्व नोटिस के पश्चात्‌ किसी शर्तों को परिवर्तित कर सकेगा अथवा नई शर्त जोड़ सकेगा ।

9. प्रकीर्ण।- इस अनुदेष के अधीन कोई उपबंध यदि मोटर वाहन अधिनियम 1988, केन्द्रीय मोटरवाहन नियमावली 1989, बिहार मोटर वाहन नियमावली 1992 एवं बिहार मोटरवाहन करारोपन अधिनियम 1994 तथा एतद्‌धीन निर्मित नियमावली के किसी उपबंध के विरूद्ध पाया जाता है, तो उन अधिनियमों एवं नियमावलियों में विहित प्रावधानों का अभिभावी प्रभाव होगा ।

10. निरसन और व्यावृत्ति।- इस संबंध में पूर्व में निर्गत कोई भी दिषा निदेष, कार्यपालक आदेष आदि पर ''बिहार टैक्सी एग्रीगेटर परिचालन निदेष2019'' में विहित प्रावधानों का अभिभावी प्रभाव होगा और पूर्व के आदेश इस हद तक निरसित समझे जायेंगे।

No.-06/Taxi Sewa/2018-403—In exercise of powers conferred under Section 93 of the Motor Vehicle Act, 1988 (Act No. 59) Bihar Taxi Aggregator Operational Directives 2018 was published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby; and notice was given by the Government of Bihar for thirty days from the date on which the draft notification was published in the Official Gazette for objections or suggestions on or before the aforesaid period. No objections/suggestions were received from the people in general.

Hence in exercise of powers conferred under section 93 of Motor Vehicle Act, 1988 (Act No. 59,1988) to promote urban mobility according to guidelines issued by Ministry of Road Transport and highways (MoRTH), Govt. of India and in view of the existing provisions of rule 103 of Bihar Motor Vehicles Rules 1992 to regulate the operational activities of the Transportation Technologies Aggregator, the Department of Transport, Government of Bihar hereby issue the following set of directives namely "Bihar Taxi Aggregator Operational Directives 2019". These directives will be effective from the date of issuing notification to this effect in the Gazette of Bihar.

BIHAR TAXI AGGREGATOR OPERATIONAL DIRECTIVES, 2019

1. Short title, application and commencement.— (i)These guidelines may be called the Bihar Taxi Aggregator Operational Directives 2019.

(i) These directives shall be applicable to the Aggregator operating in the State of Bihar.

(ii) They shall come into force from the date of its publication in the Official Gazette.

2. Definitions.—(1) In these directives, unless anything required in the subject or

context -

(i) "Act" means the Motor Vehicles Act, 1988; (ii) "Aggregator" means a person who is an operator or an intermediary / marketplace who canvasses or solicits or facilitates passengers for travel by a taxi/motor cycle or any other public service vehicle and who connects the passenger / intending passenger to a driver of a taxi or any other public service vehicle through phone calls, internet, web-based services or GPS/GPRS based services whether or not any fare, fee, commission, brokerage or other charges are collected for providing such services;

(iii) "Form" means forms append to these Bihar Taxi Aggregator Policy; (iv) "Licence" means a Licence issued to an aggregator under these Bihar Taxi Aggregator Policy;

(v) "Licencee" means an aggregator who holds licence issued under these Bihar Taxi Aggregator Policy;

(vi) "Licensing Authority" means the State Transport Commissioner, Government of Bihar;

(vii) "Taxi" means a motor vehicle having valid permit under the applicable laws of India, as the case may be and must be valid in the State of Bihar.

(viii) "Motor Cycle" means as per Section 2(27) of Motor Vehicles Act 1988 which provides the definition of a Motor Cycle which "means a two-wheeled motor vehicle, inclusive of any detachable side-car having an extra wheel, attached to the motor vehicle" and the Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways) vide notification number 1248(E) dated 5.11.2004 allows registration of "Motor Cycle" both under Transport and Non-Transport categories;

(ix) In terms of Section 2(35) of the Act "Public Service Vehicles" means any Motor Vehicle used or adapted to be used for the carriage of passenger for hire or reward;

(x) "Inspection Authority" means District transport officer or any other officer authorized in this behalf specifically by the State Transport Commissioner12 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11111111 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 (2) Words and expressions used in these Bihar Taxi Aggregator Policy and not defined herein shall have the same meanings respectively assigned to them in the Motor Vehicles Act, 1988, Central Motor Vehicles Rules, 1989 and Bihar Motor Vehicles Rules, 1992 shall have the meaning assigned to them therein.

3. License –

(A) Requirement of License.—No company shall act as a Taxi Aggregator within the State of Bihar unless such a company has obtained an Agent's license from the Licensing Authority. (B) Application for the issue of licence:-

(i) Application for license under this Bihar Taxi Aggregator Operational Directives2019 shall be made in writing to the Licensing Authority in the Form-1 of Appendix-I as specified for the purpose and shall be accompanied by the supporting documents as listed herein.

(ii) Application for grant of license shall be accompanied by proof of payment of appropriate fee as per Section 103 A of Bihar Motor Vehicles Rules 1992.

(C) Documents for Application for the issue of licence.—Following documents

(i) Documents certifying that the applicant company is registered under the Companies Act, 1956 or 2013 and under the relevant provisions of all the applicable laws;

(ii) Proof of address of the organization within the State of Bihar and details of the Telephone Number, web address and e-mail id of the Office-in-Charge of the organization in the State of Bihar;

(iii) The Applicant should be in operation for the last one year - Copy of

Certificate of Incorporation;

(iv) GST Registration Certificates and PAN details; (v) Audited financial statements for the last one financial years; (vi) An undertaking to the effect that the terms and conditions of the license as granted under Bihar Taxi Aggregator Operational Directives2019 along with necessary & applicable provisions of Motor Vehicle Act 1988, Central Motor Vehicles Rules 1989, Bihar Motor Vehicles Rules 1992 and all the applicable laws of the land will be fully complied;

(vii) The licensee shall maintain a minimum fleet of 50 taxis either owned or through an agreement with individual taxi permit holders in prescribed form to the effect that for private vehicles, permit will be procured from competent authority to convert the vehicle into commercial vehicle within 30 days of grant of license;

(viii) The licensee shall maintain a minimum fleet of 50 Motor Cycles either owned or through an agreement with individual permit holders in prescribed form to the effect that for private vehicles, permit will be procured from competent authority to convert the vehicle into commercial vehicle within 30 days of grant of license;

(ix) Detail of the Telephone Number, web address and e-mail id of the

Managing Director of the Company;

(x) The applicant company will have to submit a developed MIS integrated with other details of technical specifications to operate as an aggregator;

(xi) Details of call center, web portal and Mobile App for operation,

details of parking facility available;

(D) Provisional License:—The Applicant must apply for grant of license in Form I of Appendix -IIand on being satisfied that the applicant has complied with all the conditions prescribed for grant of a licence under this Bihar Taxi Aggregator Operational Directives2019, the licensing authority shall issue a Provisional Licence to the applicant.The Provisional License will be valid for 30 days and within which the Applicant must submit a compliance report with all the terms and conditions as mentioned in the Provisional License. The Provisional License may be extended for a further period of 30 days as per discretion of the Licensing Authority and in case of eligibility criterial being not fulfilled till lapse of extended period of provisional license, the provisional license may be subject to cancellation.

(E) Grant of License:-

(i) On satisfactory compliance of the conditions as mentioned in the Provisional License within the specified period under this Bihar Taxi Aggregator Operational Directives 2019, the Licensing Authority will granted the Final License in Form I of Appendix-II. (ii) The License shall be valid for a period of 3 (three) years from the

date of grant.

(iii) Prior to issuance of license, the licensing authority through

inspection authority can conduct an enquiry as deemed necessary.

(F) Renewal of License:-

(i) The licence granted under these rules may be renewed subject to the satisfactory performance of the Licensee as per terms and conditions of this Bihar Taxi Aggregator Operational Directives 2019 on an application atleast before one month from the expiry of the license. The application should be made on Form I of Appendix -III.

(ii) The renewal application shall be submitted along with the

prescribed fee u/s 103 (A) of Bihar Motor Vehicles Rules 1992.

(iii) Documents to be attached with License renewal application:-

1. Original copy of the granted license; 2. Details of the permit of the taxi/ motor bike taxis operated

under the Licensee during the License valid period;

3. Details of the passengers availed the service under the

Licensee during the License valid period;

4. Details of complains and their redressal under the Licensee

during the License valid period;

5. Audited report of last three years of financial statements; 6. Details of any proceeding during the License valid period; 7. Prior to renewal of license, the licensing authority through inspection authority can conduct an enquiry as deemed necessary.

(iv) The License shall be valid for next three years from the date of

renewal of the License.

(v) On satisfactory compliance of the conditions as mentioned in this Bihar Taxi Aggregator Operational Directives 2019, the Licensing Authority will renew the License as per Form I of Appendix -II.

(G) Power of Licensing Authority to Suspend or Cancel the License:-

(i) The licensing authority may, after giving an opportunity of being heard

to the Licensee, suspend or cancel the licence, if,-

(a) the licensee has failed to comply with any of the terms and

conditions of these rules; or,14 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11111111 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 (b) an employee of licensee or driver of vehicle attached to the licensee is guilty of any misbehavior or misconduct with any passenger; or,

(c) a complaint against the licensee by any passenger has been proved beyond reasonable doubt, the licensing Authority may suspend the license for a specified period or cancel the license. (d) the licensee has failed to comply with any of the terms and conditions of these rules then the renewal license will be liable for rejection, with reasons to be recorded in writing.

(ii) When the license is suspended or cancelled, the holder of the license

shall surrender the license to the licensing authority.

(H) Issue of Duplicate License.—Where the licence is lost or destroyed, an application for issue of a duplicate shall be made along with the prescribed fee u/s 103 (A) of Bihar Motor Vehicles Rules 1992. A duplicate Licence so issued shall be marked "Duplicate" in red ink.

4. Appeal :-

(i) The Principal Secretary/Secretary Transport Department, Govt of Bihar shall be the appellate authority in matters related to License.

(ii) The Licence aggrieved by any order of the licensing authority may within thirty days of the receipt of the order, make an appeal to the Principal Secretary/Secretary Transport Department, Govt of Bihar.

(iii) An appeal shall be in the form of a memorandum in duplicate setting forth the grounds of for the appeal and shall be accompanied by fee as may be specified in Bihar Motor Vehicles Rules 1992.

(iv) The Principal Secretary/Secretary Transport Department, Govt of Bihar may, after giving an opportunity of hearing to the parties and after such enquiry as it may be deem fit pass an appropriate order.

5. Fare: -

(i) As per Section 67 (1) of Motor Vehicles Act 1988, the State Government may, from time to time, by notification in the Official Gazette, issue directions regarding the fixing of fares and freight of taxies(including the maximum and minimum in respect thereof);

(ii) The Licensee shall display the fare rate and provide a fare rate estimator on the website, internet enabled application or digital platform used by the Licensee to connect driver and passenger.

6. Operational infrastructure:=

(A) Infrastructure related to Vehicle:-

(i) No Taxi/ Motor Cycle shall be offered for hire through an aggregator who is not registered under these rules.

(ii) The Licensee shall ensure that every Taxi/Motor Cycle has a valid fitness certificate issued under the Act, Insurance Certificate, PUC and shall be operating under permit granted under relevant provision of MV Act 1988 (iii) Each vehicle operating under these directives shall have either fitted in vehicle or separately in mobile application of the driver of the vehicle, GPS/GPRS based tracking device showing the path travelled and total distance covered. The device shall be in constant communication with the control room of the licensee while the taxi is on hire.

(iv) Any vehicle operating under these policy may be equipped with a mobile radio, Web or application platform based two way communication system of the licensee.

(v) The details containing the photograph of the driver, license number, Public Service Vehicle (PSV) Badge number and registration mark of the vehicle etc. shall be displayed prominently inside the vehicle, so that the15 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11 11 11 11 जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) जनवर(cid:15) 2019201920192019 same is directly visible to the passenger. These details shall also be made visible on the app and on the invoices issued to the customer.

(vi) Helpline numbers of DTO, Police and Women's Help line shall be prominently displayed inside the vehicle.

(vii) Any vehicle operating under these policy shall be equipped with a first aid box containing the articles specified in Bihar Motor Vehicle Rules, 1992.

(viii) Any vehicle operating under these Rules should be driven on clean fuel. Such vehicle should meet emission standards as prescribed from time to time by the Transport Authority/MoRTH.

(ix) A feedback register easily accessible to the passenger shall be kept in the vehicle.

(x) In case of Motor Cycle (bike-taxis), in addition to above clause the following condition needs to be satisfied.

(a) Carriage of minors as hirers shall not be allowed. (b) More than one pillion rider shall not be allowed but under parental guidance a child not more than 5 years old shall be permitted for ride.

(c) Crash helmets for riders as per permissible specifications shall be

provided by the service provider.

(d) Carriage of personal effects by the hirer will be allowed on a very limited basis, like a normal size backpack or handheld briefcase, etc. of reasonable weight.

(B) Driver's Profile:—

(i) The driver needs to be a holder of any valid license to drive light motor vehicle or two-wheeler as the case may be.

(ii) The driver shall have adequate knowledge of the roads and routes of the area of operation so that the passengers are not inconvenienced.

(iii) The driver on duty shall be in uniform as approved by the Licensing Authority or as per company's design.

(iv) The driver shall be of good moral character without any criminal record. Any person who has been convicted within the past seven years of driving under the influence of drugs or alcohol, or has been convicted at any time for any cognizable offence under the Code of Criminal Procedure 1973, including fraud, sexual offences, use of a motor vehicle to commit a cognizable offence, a crime involving property dispute and/or theft, acts of violence or acts of terror shall not be engaged by the licensee.

(v) The Licensee shall be responsible for quality of drivers, their police verification, and their conduct with passengers. The Licensee shall also ensure that the drivers are safe, reliable and trustworthy.

(vi) Information regarding ownership of vehicles and the profile of drivers including their verification by the Police shall be ensured by the licensee and shall be provided to the Licensing Authority as well as Traffic Police.

(vii) Maintain the copies of the following up-dated records relating to the driver's vehicle (after verification with the originals): (a) Certificate of Registration; (b) Certificate of Fitness; (c) Permit of the vehicle; (d) Chassis and engine numbers and (e) Commercial insurance policy covering for third party risks as

prescribed in the Act.

(f) Pollution under control certificate.

(viii) lf the Licensee uses or causes or allows a vehicle to be used in any manner not authorized by the provisions of the Act mentioned herein, the Licensee and the driver shall be jointly and severally responsible for any injury, harm, offence or crime committed by any person, including the driver.

(ix) The driver shall always behave in a polite and courteous manner with the passenger.

(x) The driver will not pickup passenger by street hailing.

(C) General Conditions to be observed by a Licensee:-

(i) The licensee shall maintain a 24 X 7 control room with adequate manpower.

(ii) The licensee shall ensure availability of adequate parking space for all taxis.

(iii) The licensee shall ensure mechanism for protecting the rights of women employees as stipulated under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (14 of 2013).

(iv) Neithershift his place of business, nor any of his branches as mentioned in the licence nor open a new branch without a written permission from the licensing authority.

(v) Maintain records, in digital form of all the taxies & motor cycles at his control, indicating on a day to day basis, the trips operated by each vehicle, details of passengers who travelled in the vehicle, origin and destination of the journey and the fare collected. The records so maintained shall be open for inspection by an officer nominated by the licensing authority at any time.

(vi) Provide a list of drivers, their Licence numbers, the vehicle registration numbers and the chassis and engine numbers and permit details of Taxis operated by him to theLicensing Authority on a quarterly basis and also as & when required.

(vii) Maintain the copies of following up-dated records relating to the drivers (after verification with the originals): (a) a photograph of the driver; (b) driving licence; (c) Present home address with proof of residential address; (d) RBI compliance KYC bank account details; (e) Self-attested copies of EPIC card and PAN card. (f) Contact details and addresses of two family members. (viii) Implement a zero tolerance policy on the use of drugs or alcohol applicable to any driver, provide notice of the zero- tolerance policy on its website, as well as the procedure to report a complaint about a driver when a passenger reasonably suspects that the driver was under the influence of drugs or alcohol during the course of the ride' The Licencee shall-immediately deactivate or suspend such driver's access to the platform upon receipt of a passenger's complaint alleging violation of the zero tolerance policy. The suspension shall last or continue during the period of investigation by the Licencee.

(ix) The licensee shall conduct structured refresher training programs for its drivers including but not limited to safe driving skills, gender sensitization, passenger etiquette etc. The licensee shall ensure that the driver shall undertake such refresher trainings at least once in a calendar year. Such training programs should be duly documented by the licensee. (x) Send photo of the driver along with vehicle registration number and other details of the driver to the customer's mobile before boarding.

(xi) Publish beforehand its policy on taxi fare, registration of taxis and drivers with its platform or app, sharing of fares with taxi owners and/or drivers, safety of passengers, grievance redressal mechanism for passengers etc.

(xii) The licensee shall ensure that the driver undergoes an annual health checkup for ensuring his fitness to drive the vehicle.

(xiii) If any untoward incident occurs during the course of a ride, the Licencee shall inform the same to the licensing authority as well as to the jurisdictional police immediately.

(xiv) The vehicle MUST be equipped with the facility of a physical emergency button with the provision of emitting prescribed sound/light note, when pressed, for ensuring full safety and security of the passenger/driver on board in a conspicuous position and in a place having immediate access to the hirer. The vehicle must be equipped with a GPS tracking device fitted by the owner of the vehicle.

7. Grevience redressal.—

(i) maintain a web portal containing all details regarding the owners of the vehicles, services offered, fare structure, insurance liabilities, control room number, name and contact details of a duly appointed grievance redressal officer.

(ii) Ensure adequate mechanism for receiving passenger's feedback and grievances. This may be ensured through feedback register kept in the taxi, easily accessible to the passengers always and also by providing toll free phone numbers.

(iii) Ensure that the grievances or complaints of passengers or any other persons received, by him shall be attended by the grievance officer appointed by him and they must be made available to the inspecting authorities on demand.

(iv) The Transport Department can review from time to time,"grievance redressal" by the licensee, of complaints lodged by passengersand the licensee shall be liable to produce such relevant documents before inspection authority for such review. Based on review, the department can issue relevant instructions,as deemed necessary.

8. Power to remove difficulties:-

(i) The Transport Department shall be competent enough for any amendment in these directives, as deemed necessary.

(ii) The licensing authority can change conditions or add new conditions, after prior notice of 30 days to the licensee

9. Miscalleneous.—In case of any provisions under these directives are found contrary to any provisions of MV Act, 1988, CMVR, 1989, BMVR, 1992 and Bihar Motor Vehicle Taxation Act, 1994 with rules framed there under, then such provisions of selective act and rules will have overriding effect thereon.

10. Repeal and savings.—In case any directives or executive order etc., if issued in this regard prior to this, then provisions of Bihar Taxi Aggregator Operational Directives 2019 will be effective and previous instructions contradictory to this shall be treated to be repealed up to that extent.
