बिहार औद्योगिक निवेश प्रोत्साहन अधिनियम, 2016 की धारा 14 और 16 तथा बिहार औद्योगिक निवेश प्रोत्साहन नियमावली, 2016 के नियम 13 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य में औद्योगिक निवेश हेतु औद्योगिक वित्त सम्पोषण के लिए राज्य सरकार निम्नलिखित दिशा निर्देश अधिसूचित करती हैः- बिहार औद्योगिक निवेश विा सम्पोषण मार्गदर्शक सिद्धान्त, 2019

बिहार भारत में तीव्रतर विकासशील राज्यों में से एक है। राज्य सरकार के व्यापक घरेलू सुधार कार्यक्रम का ही परिणाम है कि विगत कुछ वर्षों में बिहार में आर्थिक क्षेत्र में हुए विकास एवं परिर्वान परिलक्षित हो रहे हैं। ये सुधार सार्वजनिक विा के प्रबंधन और सरकारी व्यय में सुधार, आधारभूत संरचनाओं के निर्माण में सार्वजनिक पूंजी निवेश और सबसे महत्वपूर्ण विधि एवं व्यवस्था तंत्र में सुधार है। इन्हीं परिर्वान ने राज्य में निजी निवेश एवं विस्तृत औद्योगिक प्रतिबद्धता का अनुकूल वातावरण उपलब्ध कराया है।

राज्य में औद्योगिकीकरण के लिए विा की व्यवस्था/ उपलब्धता एक महत्वपूर्ण अवयव है। औद्योगिक निवेश विा सम्पोषण नीति का उद्देश्य औद्योगिक निवेश को प्रोत्साहित करने के लिए उद्यम-सहचर्य (industry-friendly) वातावरण पैदा करना है। इसका व्यापक उद्देश्य राजस्व में वृृद्धि एवं रोजगार के सृृजन के लिए राज्य के प्राकृतिक संसाधनों को अधिकतम मूल्य संवर्द्धन प्रदान करने के लिए सम्पूर्ण राज्य में उद्योगों को सहायता प्रदान करना है। औद्योगिक निवेश विा सम्पोषण नीति का क्रियान्वयन राज्य में औद्योगिकीकरण को सुगम बनाने, रोजगार सृृजन करने और समग्र विकास में सहायक होगा।

2. निम्नलिखित राज्य विा संस्थानों को औद्योगिक ईकाइयों को विाीय सहायता प्रदान करने के लिए चिन्हित किया गया हैः-

(क) बिहार राज्य औद्योगिक विकास निगम (BSIDC); (ख) बिहार राज्य साख एवं विनियोग निगम (BICICO); (ग) बिहार राज्य विाीय निगम (BSFC) ।

3. निम्नलिखित प्रकार की विाीय सहायता प्रदान की जाएगीः-

(क) बिहार राज्य औद्योगिक विकास निगम द्वारा औद्योगिक ईकाई को परिर्वानीय प्रथम स्वेच्छा वाला ईक्विटी शेयर के रूप में विा पोषण किया जाएगा;

छोड़कर स्थायी परिसम्पाियाँ सृजित करने के लिए औद्योगिक ईकाई को सावधिक ऋण प्रदान किया जाएगा;

(ग) बिहार राज्य विाीय निगम द्वारा औद्योगिक ईकाई को कार्यशील पूँजी (लघुकालीन ऋण) प्रदान किया जाएगा।

4. राज्य विा संस्थानों के द्वारा अन्य प्रकार के विाीय सम्पोषण, यथा, गृह-विा, वाहन-विा आदि जो उनके पात्रता और बाजार की मांग पर आधारित हो, भी किया जाएगा। राज्य विा संस्थानों के द्वारा विाीय सम्पोषण के लिए औद्योगिक तथा अन्य पात्र प्रक्षेत्र की परामर्शी सूची अनुसूची-1 में दी गई है।

5. निम्नलिखित प्रकार की औद्योगिक ईकाइयाँ (अनुसूची-1 में सूचीबद्ध विभिन्न औद्योगिक प्रक्षेत्र के अंदर) विाीय सहायता प्राप्त करने के लिए पात्र होंगीः-

(क) नई औद्योगिक ईकाइयाँः-नई औद्योगिक ईकाई से तात्पर्य वैसी ईकाई से है जो इस नीति के प्रभावी होने के बाद वाणिज्यिक उत्पादन प्रारम्भ की हो;

(ख) विद्यमान औद्योगिक ईकाइयाँः-विद्यमान औद्योगिक ईकाई से तात्पर्य वैसी ईकाई से है जो इस नीति के प्रभावी होने के पूर्व वाणिज्यिक उत्पादन प्रारम्भ की हो;

(ग) रूग्ण औद्योगिक ईकाइयाँः-रूग्ण औद्योगकि ईकाई से तात्पर्य वैसी सूक्ष्म, लघु एवं मध्यम ईकाई से है जो राष्ट्रीय कंपनी विधि अभिकरण (NCLT) या सूक्ष्म, लघु एवं मध्यम उद्यमों के पुनर्वास हेतु उद्योग निदेशक की अध्यक्षता में गठित राज्य स्तरीय समिति के द्वारा रूग्ण घोषित हो। 6. औद्योगिक विा सम्पोषण के लिए उपर्युक्त संस्थानों का क्षेत्राधिकार सम्पूर्ण बिहार राज्य होगा। बिहार राज्य में अवस्थित कोई भी औद्योगिक ईकाई इस निर्देशिका के अंतर्गत विाीय सहायता के लिए विचारणीय होंगे। 7. (1) उद्योग निदेशक की अध्यक्षता में सूक्ष्म, लघु एवं मध्यम उद्यम के पुनर्वास हेतु गठित राज्य स्तरीय समिति (शीर्ष समिति) इस निर्देशिका के क्रियान्वयन एवं अनुश्रवण के लिए उारदायी होगी। (2) शीर्ष समिति के द्वारा औद्योगिक विा सम्पोषण के लिए उद्योग विभाग, बिहार के अनुमोदन से उपयुक्त र्शाों का निर्धारण किया जाएगा।

(3) शीर्ष समिति आवेदन की प्राप्ति, उनके मूल्यांकन एवं स्वीकृति के लिए उारदायी होगी। औद्योगिक ईकाइयों से आवेदन आमंत्रित करने और स्वीकृति प्रदान करने के लिए एक ऑनलाईन वेब पोर्टल विकसित किया जाएगा।

(4) शीर्ष समिति के निम्नलिखित सदस्य पाक्षिक आधार पर विाीय सहायता हेतु प्राप्त प्रस्तावों के मूल्यांकन एवं स्वीकृृति के लिए बैठक करेंगेः-

(i) उद्योग निदेशक, बिहार, पटना; (ii) निदेशक, सांस्थिक विा, बिहार, पटना या निदेशक के प्राधिकृत प्रतिनिधि; (iii) प्रबंध निदेशक, बिहार राज्य साख एवं विनियोग निगम या प्रबंध निदेशक के प्राधिकृत प्रतिनिधि;

(iv) प्रबंध निदेशक, बिहार राज्य विाीय निगम या प्रबंध निदेशक के प्राधिकृत प्रतिनिधि; (v) प्रबंधक, सिडबी, बिहार, पटना; (vi) संयोजक, राज्य स्तरीय बैंकर्स समिति;

प्रबंध निदेशक, बिहार राज्य औद्योगिक विकास निगम या प्रबंध निदेशक के प्राधिकृत प्रतिनिधि भी उक्त पाक्षिक बैठक में भाग लेंगे।

(5) शीर्ष समिति विाीय सहायता हेतु प्राप्त प्रस्तावों के मूल्यांकन के लिए विशेषज्ञ/ कार्यक्रम प्रबंधन संस्था कोे नियोजित कर सकती है/ बैंक और/या भारतीय रिजर्व बैंक द्वारा अनुमोदित गैर बैंकिंग विाीय कंपनी की सेवा प्राप्त कर सकती है। विाीय सहायता हेतु प्राप्त प्रस्तावों पर आवश्यक निर्णय (स्वीकृृति/ अस्वीकृति/ परिमार्जन) लेने के लिए विशेषज्ञ/ कार्यक्रम प्रबंधन संस्था/ बैंक और/या भारतीय रिजर्व बैंक द्वारा अनुमोदित गैर बैंकिंग विाीय कंपनी प्रस्ताव के मूल्यांकन एवं अपनी अनुशंसा पाक्षिक बैठक में प्रस्तुत करने के लिए उारदायी होंगे। 8. (1) स्वीकृत विाीय सहायता का वितरण एवं वितरण के बाद उस पर नियंत्रण, पर्यवेक्षण और अनुश्रवण संबंधित राज्य विा संस्थान (जैसा कि कंडिका-2 में निर्दिष्ट है) के द्वारा किया जाएगा। इसमें आवश्यक अभिलेखों को तैयार करना, साख का अनुश्रवण तथा राशि का समयबद्ध पुनर्भुगतान/ वसूली सम्मिलित होगा।

(2) राज्य विा संस्थानों के द्वारा ईकाई को विाीय सहायता प्रदान करने के विरूद्ध दोनो प्रकार प्राथमिक (Primary) एवं प्रमाणीकृत प्रतिभूति (Collateral Security) प्राप्त किया जाएगा। यह 100 प्रतिशत प्राथमिक प्रतिभूति सहित ऋण की राशि का 200 प्रतिशत तक होगा। प्रमाणीकृत3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18181818 जनवर(cid:15)जनवर(cid:15)जनवर(cid:15)जनवर(cid:15) 2019201920192019 प्रतिभूति (Collateral Security) का प्रतिशत उद्योग के स्थान एवं प्रकृति तथा ऋण की प्रकृति पर निर्भर करेगा।

(3) रूग्ण ईकाइयों के मामले में पर्याप्त प्राथमिक प्रतिभूति के अभाव में दोनों प्राथमिक (Primary) एवं प्रमाणीकृत प्रतिभूति (Collateral Security) तक प्रमाणीकृत प्रतिभूति (Collateral Security) प्राप्त किया जाएगा।

(4) निम्नलिखित परिसम्पाियाँ प्रमाणीकृत प्रतिभूति (Collateral Security) के लिए प्राथमिकता के आधार पर विचारणीय होंगेः- i. बंधक मुक्त खाली भूखण्ड; ii. भवन/ गृह/ अपार्टमेंट; iii. फिक्स डिपॉजिट; iv. किसान विकास पत्र/ राष्ट्रीय बचत पत्र/ जीवन बीमा पॉलिसी आदि

जहाँ आवश्यक होगा, प्रतिभूति का मूल्य एक अनुमोदित/ सूचीबद्ध मूल्यांकनर्काा के द्वारा प्रमाणित होना चाहिए। जेवरात आदि प्रमाणीकृत प्रतिभूति के रूप में स्वीकार्य नहीं होंगे।

(5) किसी भी प्रकार की विाीय सहायता की अधिसीमा रू0 2 (दो) करोड़ होगी। (6) बिहार राज्य औद्योगिक विकास निगम मात्र कंपनी में ही परिर्वानीय प्राथमिक स्वेच्छा वाला शेयर के रूप में निवेश करेगा जो कंपनी के पेड अप शेयर कैपिटल के 20 प्रतिशत तक या रू0 2 (दो) करोड़ रूपया, इसमें से जो कम हो, तक होगा।

9. राज्य स्तरीय समिति (शीर्ष समिति) के द्वारा इस नीति के अधीन स्वीकृत मामले में विाीय सहायता का वितरण में हुई प्रगति तथा वसूली कार्यक्रम का अनुश्रवण भी किया जाएगा और राज्य विा संस्थान को आवश्यक निर्देश जारी कर सकेगा। संबंधित राज्य विा संस्थान वैसे मामले जिन्हें विाीय सहायता स्वीकृत की गई है, की स्थिति, किश्त का भुगतान एवं ऋण की वसूली की प्रगति के संबंध में सामयिक प्रतिवेदन समिति को प्रस्तुत करेंगे। आवश्यकता पड़ने पर प्रगति को सुगम बनाने और मध्यावधि सुधार हेतु इस नीति का सामयिक मूल्यांकन किया जाएगा।

10. राज्य विा संस्थान को यह विकल्प रहेगा कि वह सिडबी आदि विाीय संस्थानों से पुनर्विा प्राप्त कर सकेगा।

11. निम्नलिखित सूची की ईकाइयाँ नकारात्मक सूची की ईकाइयाँ मानी जाएँगी और इस नीति के अधीन किसी भी प्रकार की सहायता के लिए पात्र नहीं होंगीः-

(क) मादक औषधि निर्माता ईकाइयाँ; (ख) अल्कोहल पेय निर्माता ईकाइयाँ; (ग) तम्बाकू आधारित ईकाइयाँ; (घ) एस्बेस्टस निर्माता ईकाइयाँ। राज्य सरकार को किसी ईकाई को नकारात्मक सूची की ईकाई घोषित करने का अधिकार होगा और तदनुसार उपर्युक्त सूची में संशोधन कर सकती है।

12. सामान्य सिद्धान्त के अनुसार वातावरण पर विपरीत प्रभाव डालने वाले उद्योग को राज्य पूंजी निवेश के लिए हतोत्साहित करेगी। उक्त प्रकार के उद्यम इस नीति के अंतर्गत किसी भी प्रकार के विाीय सहायता के लिए पात्र नहीं होंगे तथा उपर वर्णित नकारात्मक सूची में डाल दिए जाएँगे।

13. किसी प्रकार के मदभेद अथवा किसी शब्द की व्याख्या/विवाद के सभी मामलों में निर्णय औद्योगिक विकास आयुक्त/ प्रधान सचिव, उद्योग विभाग द्वारा विधि विभाग के परामर्श के पश्चात्‌ लिया जायेगा। उक्त व्याख्या/ निर्णय अंतिम और सभी संबंधितों के लिए बाध्यकारी होगा।

14. इस नीति की अनुसूची-1 में दी गई परिभाषाएँ इस नीति के अंग मानी जाएँगी। 15. यह नीति इस संकल्प के निर्गत होने की तिथि से प्रभावी होगी। 16. इस निर्देशिका के किसी भी कंडिका में संशोधन या परिर्वान और उनका सामयिक समीक्षा का अधिकार विभाग के पास सुरक्षित रहेगा।

1. औद्योगिक ईकाईः- औद्योगिक ईकाईं से तात्पर्य है ऐसी ईकाई/प्रतिष्ठान जो निम्नलिखित श्रेणी में उत्पादन/प्रसंस्करण/सेवा उद्योगों में रत हो अथवा रत होने वाला हो।

((((कककक)))) समय-समय पर यथा संषोधित औद्योगिक (विकास एवं विनियमन) अधिनियम, 1951 के प्रथम अनुसूची अधीन सूचीबद्ध उद्योग।

((((खखखख)))) सूक्ष्म, लघु एवं मध्यम उद्यम विकास अधिनियम, 2006 (समय-समय पर यथासंषोधित) के अधीन परिभाषित एवं सूक्ष्म, लघु एवं मध्यम उद्यम।

((((गगगग)))) अन्य श्रेणियां :

(i) खनन अथवा खान विकास;

In exercise of the powers conferred under Section 14 and 16 of The Bihar Industrial

Investment Promotion Act, 2016 and Rule 13 of The Bihar Industrial Investment Promotion Rules,

20l6,the State Government is pleased to notify the following guidelines for industrial finance to

promote industrial investment in the State of Bihar:-

Bihar Industrial Investment Finance Guidelines, 2019

Bihar is one of the fastest growing states in India. The scale and pace of economic change that Bihar has witnessed over past few years has been the result of a comprehensive, home-grown reform program initiated by the government. These reforms ranged from changes in managing public finance and reforming government expenditures, public investments in building infrastructure and most importantly revamping the law and order machinery. All these changes have provided an enabling environment for private investment in the state and greater industry commitment.For the industrialization of the state, availability of finance is an important factor. Department of Industries aims at creating industry-friendly financing environment for promoting industrial investment. The overall objective is to maximize the value addition to state's natural resources by supporting industries across the state, generating revenue and creating employment. The industrial finance activity will facilitate industrialization of the state, generate employment and add to its overall growth.

2. Following State Finance Organisations (hereinafter referred as "SFOs") shall be designated for extending financial assistance to the industrial units:—

(a) Bihar State Industrial Development Corporation (BSIDC); (b) Bihar State Credit and Investment Corporation Limited (BICICO); (c) Bihar State Financial Corporation (BSFC).

3. Following types of financial assistance shall be available:—

(a) Equity financing to an industrial unit shall be done by the BSIDC only in terms of redeemable preference shares;

(b) Term loan financing to an industrial unit shall be done by the BSIDC and BICICO for the creation of fixed assets except land;

(c) Working capital financing (Short term lending) to an industrial unit shall be done by the BSFC.

4. The SFOs shall also do other kinds of financing like Housing Finance, Vehicle Finance etc. through suitably designed financial products based on their eligibility and market requirements. An illustrative list of industrial and other eligible sectors for financing by the SFOs is at Annexure-I. 5. Following types of industrial units (across the various industrial sectors listed in Schedule-I) shall be eligible for availing finance:—

(a) New Industrial Units:—New Industrial Unit means an industrial unit, in which commercial production has commenced after the commencement of this Guideline;

(b) Existing Industrial Units:—Existing Industrial Unit means an industrial unit which has started its commercial production before commencement of this Guideline; (c) Sick Industrial Units:—Sick Industrial Unit means a MSME declared sick by the National Company Law Tribunal (NCLT) or by the State Level Committee for Rehabilitation of Micro, Small and Medium Enterprises headed by the Director of Industries, Bihar, Patna.

6. The jurisdiction of the abovementioned organisation for extending industrial finance shall be the whole of Bihar. Any industrial unit located in Bihar shall be considered for financing under this Guideline.

7. (1) The State Level Committee (Apex Committee) for the Rehabilitation of Micro, Small and Medium category sick units constituted under the Chairmanship of the Director of Industries, Patna, Bihar shall be responsible for the implementation and monitoring of these guidelines.

(2) The Apex Committee shall formulate relevant norms for industrial financing with the approval of the Department of Industries.

(3) The Apex Committee shall be responsible for the receipt of application, their appraisal and sanction of financial assistance to an industrial unit. An online web portal shall be developed to invite the applications and provide sanctions to the industrial units.

(4) Following members of the Apex Committee shall meet on fortnightly basis for assessment and approval of the proposals received for financial assistance:

(i) Director Industries, Bihar, Patna;

(ii) Director, Institutional Finance, Bihar, Patna or their authorised representative;

(iii) Managing Director, BICICO, Bihar, Patna or an authorised representative of the MD;

(iv) Managing Director, BSFC, Bihar, Patna or an authorised representative of the MD;

(v) Manager, SIDBI, Bihar, Patna;

(vi) Convener, State Level Bankers Committee;

The Managing Director, BSIDC, Bihar, Patna or an authorised representative of the MD shall also have to participate in the fortnightly meetings.

(5) The Apex Committee can hire experts/ Programme Management Agency/ avail the services of banks and/or NBFCs approved by RBI to appraise the proposals received for financing. The experts/ Programme Management Agency/ banks and/or NBFCs approved by RBI shall be responsible for appraisal of the proposal for financial assistance and place their recommendation in the fortnightly meetings for necessary decision (approval/rejection/ modification etc.). 8. (1) Disbursement of approved financial assistance and post-disbursal control, supervision and monitoring shall be done by the respective SFOs (as mentioned in Clause No. 2). This shall include necessary documentation, credit monitoring and timely repayment/recovery of the funds.

(2) Both primary and collateral securities shall be obtained against the financial assistance extended to the units by the SFOs. This shall be maximum up to 200% of the loan amount, including 100% of the primary security. The percentage of Collateral Security shall depend on the location and nature of the industry and nature of loan.

(3) In case of sick units, in absence of adequate primary security, the collateral security shall be obtained up to the required extent for both primary and Collateral Security.

(4) Following assets shall be considered preferable as collateral security:

(i) Non-encumbered vacant land;

(ii) Building/ House/ Apartments;

(ii) Fixed Deposits;

(iv) KVP, NSC, LIC policies etc.

Wherever applicable, value of the security should be certified by an approved/ empanelled valuer. Further, ornaments, etc., shall not be accepted as collateral security.

(5) The maximum limit for any type of financial assistance given to a unit shall be Rs.

2 Crore.

(6) BSIDC will invest only in companies limited by shares in form of Redeemable Preference Shares up to 25% of the paid-up share capital of the company, or Rs. 2 Crore, whichever is less.

9. The Apex Committee shall also monitor the progress of disbursement of approved financial assistance and repayment schedule made under this guideline and issue necessary direction to SFOs. The SFOs shall do periodic reporting to the Apex Committee on the progress status of the cases to which financial assistance has been sanctioned, repayment of instalments and recovery of the funds. The guidelines shall be periodically reviewed for necessary facilitation and mid-course correction, wherever necessary.

10. The SFOs shall have the option to seek re-finance from financial institutions like SIDBI, etc.

11. Following list of units shall be considered as the negative list of units and shall not be eligible for any support under this Guideline:-

(a) Units manufacturing narcotic drugs; (b) Units manufacturing alcoholic beverages; (c) Tobacco based industries; (d) Units manufacturing asbestos.

The State Government shall have the right to decide whether a unit falls under the negative list and can modify the above list accordingly.

12. As a general principle, any industry which impacts the environment adversely will be discouraged by the State Government for investment. Such industries will not be eligible for any kind of financial assistance under this Guideline and be placed in the abovementioned negative list.

13. All matters of interpretation/disputes shall be decided by the Industrial Development Commissioner/ Principal Secretary, Department of Industries, after consultation with the Law Department. Such interpretation/decision shall be final and binding for all concerned parties.

14. The definitions given in the Schedule-I to this Guideline shall be treated as part of this Guideline.

15. This Guideline will come into effect from the date of issue of this Resolution.

16. The Department reserves the authority to amend or change any of the above clauses of the Guideline and review them periodically.

Schedule- I

1. Industrial unit shall mean any unit/ establishment engaged or to be engaged in manufacturing/processing/servicing industry under the following categories:

a. Industries listed under the First Schedule of the Industries (Development and Regulation) Act, 1951, as amended from time to time.

b. Micro, Small and Medium Enterprise (MSME) as defined under MSMED Act, 2006, as updated from time to time.

c. Other Categories:

i. Mining or development of mines ii. The maintenance, repair, inspection or servicing of any type of machinery of any description or vehicles or vessels or motorboats or trailers or tractors. iii. Tourism iv. Advertising v. Logistics, Warehousing and Transportation vi. Healthcare vii. Real Estate viii. Housing

ix. Education x. IT and ITeS xi. Any unit considered as industrial unit under the prevailing industrial incentive policy

d. Proposal approved by SIPB e. Proposal certified under Bihar Start Up Policy f. Proposal approved under Chief Minister SC/ST Entrepreneurs Scheme 2. The above list is only illustrative and can be amended/ revised by the Apex Committee with the approval of the Department of Industries from time to time.
