संं॰ संं॰ संं॰ संं॰ वि0(27)पे0को0-47/2018वि0(27)पे0को0-47/2018वि0(27)पे0को0-47/2018वि0(27)पे0को0-47/2018-77-77-77-77/वि0/वि0/वि0/वि0—भारत के संविधान के अनुच्छेद-309 के परंतुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल एतद्‌ द्वारा बिहार पेंशन नियमावली, 1950 में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

1111.... संक्षिप्त नाम, विस्तार एवं आरंभसंक्षिप्त नाम, विस्तार एवं आरंभसंक्षिप्त नाम, विस्तार एवं आरंभसंक्षिप्त नाम, विस्तार एवं आरंभ ।-।-।-।-

(1) यह नियमावली बिहार पेंशन (संशोधन) नियमावली,2018 कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत होगी ।

2222.... बिहार पेंशन नियमावली, 1950 का नियम-27 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा बिहार पेंशन नियमावली, 1950 का नियम-27 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा ः-ः-ः-ः- बिहार पेंशन नियमावली, 1950 का नियम-27 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा बिहार पेंशन नियमावली, 1950 का नियम-27 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा ''27-नियम-43(घ) के अधीन मामलों को छोड़कर, पेंशन में उपदान शामिल है।'' नियमावली, 1950 के नियम-43 के खंड(ग) के बाद निम्नलिखित एक नया 3333.... बिहार पेंशनबिहार पेंशनबिहार पेंशनबिहार पेंशन नियमावली, 1950 के नियम-43 के खंड(ग) के बाद निम्नलिखित एक नया नियमावली, 1950 के नियम-43 के खंड(ग) के बाद निम्नलिखित एक नया नियमावली, 1950 के नियम-43 के खंड(ग) के बाद निम्नलिखित एक नया खंड(घ) जोड़ा जाएगाखंड(घ) जोड़ा जाएगाखंड(घ) जोड़ा जाएगाखंड(घ) जोड़ा जाएगा ः-ः-ः-ः-

(घ)-यदि सेवा निवृत्ति की तिथि को सरकारी सेवक के विरूद्ध विभागीय अथवा न्यायिक कार्यवाही लम्बित हो, उपदान की पूर्ण राशि विभागीय अथवा न्यायिक कार्यवाही के अन्तिम निष्कर्ष एवं तदनुसार आदेश निर्गत होने तक रोक रखी जा सकेगीः

Cell-47/2018-77/F—In exercise of the powers conferred under Article-309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to amend the Bihar Pension Rules, 1950 :-

1. Short title, extent and commencement.—

(1) These Rules may be called The Bihar Pension (Amendment) rules, 2018. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.

2. Rule- 27 of the Bihar Pension Rules,1950 shall be substituted by the following:-

"27- Pension includes gratuity except the cases under rule 43(d)."

3. The following a new clause (d) shall be added after clause(c) of rule-43 of Bihar

Pension Rules, 1950 :-

"(d)- if any departmental or judicial proceeding is pending against the govt. servant at the time of retirement, full amount of gratuity may be with held till the final conclusion of the departmental or judicial proceeding and issuance of order accordingly

Provided that where Departmental proceedings has been instituted under Rule 19 of Bihar Government Servant Classification, Control and Appeal Rules, 2005 (As amended from time to time) for imposing minor penalties under rule 14(i) (ii) and (v) of the said rules, payment of gratuity may be made to the government servant.''
