सं॰ 04/STA(सम्पूर्ण भारत पर्यटक परमिट)-32/2018-1119/परि0—मोटरयान अधिनियम, 1988 की धारा 68 की उपधारा-(5) के साथ पठित धारा-96 द्वारा प्रदा शक्तियों का प्रयोग करते हुए राज्य सरकार इस नियमावली को बनाने का प्रस्ताव करती है और इस अधिनियम की धारा 212 की उप धारा (1) के आलोक में, इसके द्वारा प्रभावित होने वाले सभी व्यक्तियों की जानकारी हेतु एतद् द्वारा प्रकाशित किया जाता है ।
एतद् द्वारा सूचित किया जाता है कि उनके द्वारा प्रारूप प्रकाशन की तिथि से 10 दिनों के भीतर अपनी आपत्ति अथवा सुझाव सचिव, परिवहन विभाग, बिहार/राज्य परिवहन आयुक्त, बिहार के विश्वेश्वरैया भवन, द्वितीय तल, बेली रोड, पटना-800015 स्थित उनके कार्यालय में समर्पित किया जा सकता है । विनिर्दिष्ट अवधि की समय-सीमा में उक्त प्रारूप नियमावली के संबंध में किसी भी व्यक्ति से प्राप्त होने वाली आपत्तियों या सुझावों पर विभाग द्वारा विचार कर अग्रेतर कार्रवाई की जायेगी ।
प्रारूप नियम
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ -(1)यह बिहार मोटरयान (संशोधन) नियमावली,2019 कही जा सकेगी। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह बिहार के राजपत्र में इसके अंतिम प्रकाशन की तिथि से प्रवृत्त होगी।
2. बिहार मोटरगाड़ी नियमावली, 1992 के नियम 68 के उपनियम (1) में प्रयुक्त शब्द ''संयुक्त परिवहन आयुक्त'' के पश्चात् शब्द ''संयुक्त आयुक्त-सह-सचिव, क्षेत्रीय परिवहन प्राधिकार'' एवं ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें । 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 6 फरवर(cid:15) 2019 4. बिहार मोटरगाड़ी नियमावली, 1992 के नियम-69 के उपनियम (1) में प्रयुक्त शब्द ''सचिव, प्रादेशिक परिवहन प्राधिकार्/प्रादेशिक परिवहन कार्यालय'' के पश्चात् शब्द ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें ।
5. बिहार मोटरगाड़ी नियमावली, 1992 के नियम-69 के उपनियम (2) में प्रयुक्त शब्द ''सचिव, प्रादेशिक परिवहन प्राधिकार्/प्रादेशिक परिवहन कार्यालय'' के पश्चात् शब्द ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें ।

No. 04/STA(सं0भा0पर्य0प0)-32/2018,-1119/परि0—in exercise of the powers conferred by Section-96 read with section-68(5) of Motor Vehicle Act. 1988 the State Government proposes to make these rules and hereby published as required by sub-section (1) of section 212 of the said Act, for information of all persons likely to be affected thereby.
Notice is hereby given that any objections or suggestions on the said Draft of Rules may be filed by them in the office of Secretary Transport Department Bihar/State Transport Commissioner, Bihar situated in second floor, Visvesvaraya Bhawan, Bailey Road, Patna 800015 within ten days from the date of the Draft publication. After consideration by the Department on Objections or suggestions received from any person in respect of the said Draft within the time limit of the specified period, further action will be taken.
DRAFT RULE
1. Name, extent and Commencement.— (1) These Rules may be called Bihar Motor Vehicle (Amendment) Rules, 2019.
(2) It shall extend to whole of the State of Bihar (3) It shall come into force from the date of its final publication in the Bihar Gazette. 2. After the word "Joint Transport Commissioner" used in sub rule (1) of rule 68 of Bihar Motor Vehicle Rules, 1992 the words "Joint Commissioner-cum-Secretary, Regional Transport Authority" and "District Transport Officer" shall be inserted.
3. After the word "Joint Transport Commissioner" used in sub rule (2) of rule 68 of Bihar Motor Vehicle Rules, 1992 the words "Joint Commissioner-cum-Secretary, Regional Transport Authority" and "District Transport Officer" shall be inserted.
4. After the words "Secretary, Regional Transport Authority/ Regional Transport Office" used in sub rule (1) of rule 69 of the said Rules, 1992 the word "District Transport Officer" shall be inserted.
5. After the words "Secretary, Regional Transport Authority/ Regional Transport Office" used in sub rule (2) of rule 69 of the said Rules, 1992 the word "District Transport Officer" shall be inserted.
