सं॰ 11/फि0(स्था0)-03/2013-172(11)—भारत संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार-राज्यपाल, ''बिहार फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट संवर्ग नियमावली, 2014'' (समय-समय पर यथा संशोघित) में संशोधन करने हेतु निम्नलिखित नियमावली बनाते है :-
1. संक्षिप्त नाम, विस्तार एवं आरम्भ।-(1) यह नियमावली बिहार फिजियोथेरापिस्ट /अकुपेशनलथेरापिस्ट संवर्ग (द्वितीय संशोधन) नियमावली, 2019 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त प्रवृत होगी। 2. बिहार फिजियोथेरापिस्ट/अकुपेशनल थेरापिस्ट संवर्ग नियमावली 2014 के नियम 2 के खण्ड (iii) का प्रतिस्थापन।- उक्त नियमावली के नियम 2 का खण्ड (iii) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः- ''(iii) 'आयोग' से अभिप्रेत है, बिहार तकनीकी सेवा आयोग,'' 3. बिहार फिजियोथेरापिस्ट/अकुपेशनल थेरापिस्ट संवर्ग नियमावली 2014 (समय-समय पर यथा संशोधित) के नियम 7 के उपनियम (2) एवं (3) निम्नलिखित द्वारा प्रतिस्थापित किए जायेंगेः-
''(2) सामान्य र्काव्य उपसंवर्ग में नियुक्ति मूल कोटि (फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट) के पद पर सीधी भर्ती से आयोग की अनुशंसा के आधार पर की जायेगी।
विशेषज्ञ उपसंवर्ग में भी नियुक्ति मूल कोटि (विशेषज्ञ फिजियोथेरापिस्टों/ अकुपेशनलथेरापिस्टों के पद पर सीधी भर्ती से आयोग की अनुशंसा के आधार पर की जायेगी।
(3) सामान्य र्काव्य उपसंवर्ग (फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट) :- अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखित आधार पर मेघासूची तैयार करेगाः-
(क) बैचलर-इन-फिजियोथेरापी/बैचलर-इन-अकुपेशनलथेरापी कोर्स में प्राप्तांक के लिए - 60 अंक2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11114444 फरवर(cid:15)फरवर(cid:15)फरवर(cid:15)फरवर(cid:15) 2019201920192019 (ख) उच्चतर डिग्री के लिए - 15 अंक (ग) राज्य के सरकारी अस्पतालों/सरकार के अन्य विभागों में कार्यानुभव के लिए (प्रत्येक पूर्ण वर्ष के लिए 5 अंक,
अधिकतम 25 अंक)
- 25 अंक
कुल 100 अंक टिप्पणी।- बैचलर-इन-फिजियोथेरापी/बैचलर-इन-अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.6 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% × 0.6 = 30 अंक दिये जायेंगे।
(4) विशेषज्ञ उप-संवर्ग (विशेषज्ञ फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट ) :-
अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखत आधार पर मेघासूची तैयार करेगाः-
(क) मास्टर्स-इन-फिजियोथेपी/मास्टर्स-इन- अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए - 60 अंक (ख) उच्चतर डिग्री के लिए - 15 अंक (ग) राज्य के सरकारी अस्पतालों में स्नातकोार डिग्री धारकों द्वारा कार्यानुभव के लिए (प्रत्येक पूर्ण वर्ष के लिए 5 अंक, अधिकतम 25 अंक)
-25 अंक कुल 100 अंक टिप्पणी।- मास्टर्स-इन-फिजियोथेरापी/मास्टर्स-इन-अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.6 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% × 0.6 = 30 अंक दिये जायेंगे।''
4. बिहार फिजियोथेरापिस्ट/अकुपेशनल थेरापिस्ट संवर्ग नियमावली, 2014 के परिशिष्ट-1 का प्रतिस्थापन।-उक्त नियमावली का परिशिष्ट-1 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

सं॰ 11/फि0(स्था0)-03/2013-173(11) अधिसूचना संख्या 172 (11) दिनांक 13 फरवरी 2019 का निम्नलिखित अँग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से, एतदद्वारा प्रकाशित किया जाता है जो भारत का संविधान के अनुच्छेद-348 के खंड (3) के अंतर्गत अँग्रेजी भाषा में उक्त अधिसूचना का प्राधि—त पाठ समझा जायेगा।

No. 11/Phy. (Astha.)-03/2013-172(11) /In exercise of powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to amend the Bihar Physiotherapist/Occupational therapist Cadre Rules, 2014 (as amended from time to time) :-
1. Short title, extent & commencement.- (1) These Rules may be called as the "Bihar Physiotherapist/Occupational therapist Cadre (Second Amendment) Rules, 2019."
(2) It shall extend to the whole State of Bihar. (3) It shall come into force at once. 2. Subsitution of clause (iii) Rule-2 of the Bihar Physiotherapist/Occupational therapist cadre Rules, 2014.- Clause (iii) of Rule-2 of the said Rules shall be substituted by the following:-
"(iii) 'Commission' means the Bihar Technical Service Commission;" 3. Subrules (2) and (3) of Rule-7 of the Bihar Physiotherapist/Occupational Therapist Cadre Rules, 2014 (as amended from time to time) shall be substituted by the following:-
"(2) Appointment in General Duty Subcadre shall be made by direct recruitment in the basic categary (Physiotherapist/Occupational therapist) on the recommendation of the Commission.
In the Specialist subcadre also, appointment shall be made by direct recruitment in the basic categary (Specialist Physiotherapists/Occupational therapists) on the recommendation of the Commission.
(3) General Duty Subcadre (Physiotherapist/Occupational therapist):- In the light of requisition, the Commission shall invite applications after advertising vacancies and prepare merit list on following ground:- (a) For marks obtained in Bachelor in physiotherapy /Bachelor in Occupational therapy examination – 60 marks (b) For higher degree – 15 marks (c) For work experience in Government Hospitals of Bihar State/ In Other Department (5 marks for each completed year, maximum 25 marks) – 25 marks Total 100 marks Note:—The determination of marks to be given to a candidate for marks obtained in the Bachelor in Physiotherapy/Bachelor in Occupational therapy Course examination shall be made by multiplying percentage of total marks obtained in the aforesaid courses examination by multiple of 0.6. For example, if a candidate has obtained 50% marks he will be given 50% X 0.6 = 30 marks.
(4) Specialist Subcadre (Specialist Physiotherapist/Occupational therapist):-
In the light of requisition the Commission shall invite applications after advertising vacancies and prepare merit list on following grounds:-
(a) For marks obtained in Masters in physiotherapy
/Masters in Occupational therapy degree examination – 60 marks (b) For higher degree – 15 marks (c) For work experience by postgraduate degree holders in
Government Hospitals of the State

For example, if a candidate has obtained 50% marks he will be given 50% X 0.6 = 30 marks.
4. Subsitution of Appendix-1 of the Bihar Physiotherapist/Occupational therapist Cadre Rules, 2014.- Appendix-1 of the said Rules shall be substituted by the following:—
