सं0 04/STA(सम्पूर्ण भारत पर्यटक परमिट)-32/2018-1408/परि0—मोटरयान अधिनियम 1988 की धारा-68 की उपधारा-(5) सहपठित धारा 96 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल, बिहार मोटरगाड़ी नियमावली 1992 में संशोधन के लिए निम्नलिखित नियमावली बनाते हैं, जिसका पूर्व प्रकाशन उक्त अधिनियम की धारा-212 के आलोक में विभागीय ज्ञापांक-1119 दिनांक 06.02.2019 द्वारा किया जा चुका है ।
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ-(1) यह बिहार मोटरयान (संशोधन) नियमावली,2019 कही जा सकेगी। (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह बिहार के राजपत्र में इसके अंतिम प्रकाशन की तिथि से प्रवृत्त होगी।
2. बिहार मोटरगाड़ी नियमावली, 1992 के नियम 68 के उपनियम (1) में प्रयुक्त शब्द ''संयुक्त परिवहन आयुक्त'' के पश्चात् शब्द ''संयुक्त आयुक्त-सह-सचिव, क्षेत्रीय परिवहन प्राधिकार'' एवं ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें ।
3. बिहार मोटरगाड़ी नियमावली, 1992 के नियम 68 के उपनियम (2) में प्रयुक्त शब्द ''संयुक्त परिवहन आयुक्त'' के पश्चात् शब्द ''संयुक्त आयुक्त-सह-सचिव, क्षेत्रीय परिवहन प्राधिकार'' एवं ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें ।
4. बिहार मोटरगाड़ी नियमावली, 1992 के नियम-69 के उपनियम (1) में प्रयुक्त शब्द ''सचिव, प्रादेशिक परिवहन प्राधिकार्/प्रादेशिक परिवहन कार्यालय'' के पश्चात् शब्द ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें ।
5. बिहार मोटरगाड़ी नियमावली, 1992 के नियम-69 के उपनियम (2) में प्रयुक्त शब्द ''सचिव, प्रादेशिक परिवहन प्राधिकार्/प्रादेशिक परिवहन कार्यालय'' के पश्चात् शब्द ''जिला परिवहन पदाधिकारी'' अंतः स्थापित किये जाएंगें । 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 18 फरवर(cid:15) 2019 The 18th February 2019 No.04/STA(सं0भा0पर्य0प0)-32/2018-1408/परि0-In exercise of the powers conferred by Section-96 read with section-68(5), the Governor of Bihar make following rules for amendments in Bihar Motor Vehicle Rule, 1992, which was published by departmental memo no-1119 dated-06.02.2019 in light of the section-212 of the Act.
1. Short title, extent and commencement.— (1) These Rules may be called Bihar Motor Vehicle (Amendment) Rules, 2019.
(2) It shall extend to whole of the State of Bihar (3) It shall come into force from the date of its final publication in the Bihar Gazette.
2. After the words "Joint Transport Commissioner" used in sub rule (1) of rule 68 of Bihar Motor Vehicle Rules, 1992, the words "Joint Commissioner-cum-Secretary, Regional Transport Authority" and "District Transport Officer" shall be inserted.
3. After the words "Joint Transport Commissioner" used in sub rule (2) of rule 68 of Bihar Motor Vehicle Rules, 1992, the words "Joint Commissioner-cum-Secretary, Regional Transport Authority" and "District Transport Officer" shall be inserted.
4. After the words "Secretary, Regional Transport Authority/ Regional Transport Office" used in sub rule (1) of rule 69 of the said Rules, 1992 the words "District Transport Officer" shall be inserted.
5. After the words "Secretary, Regional Transport Authority/ Regional Transport Office" used in sub rule (2) of rule 69 of the said Rules, 1992 the words "District Transport Officer" shall be inserted.
