एस0 ओ0 39 दिनांक 27 फरवरी 2019—न्यूनतम मजदूरी अधिनियम, 1948 (1948 का 11) की धारा-5 के साथ वर्णित उक्त अधिनियम की धारा-3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल अनुबद्व अनुसूची-1(ब)के स्तंभ-2 में अंकित अनुसूचित नियोजनों में नियोजित विभिन्न श्रेणियों के कर्मचारियों के लिए निर्धारित/पुनरीक्षित न्यूनतम मजदूरी के दरों पर परिवत्र्तनशील मंहगाई भत्ता लागू करने की घोषणा करते हैं । अनुसूची -1(ब) के स्तभं -02 में उल्लिखित नियोजनों में नियोजित कर्मचारियों पर परियोज्य उपभेाक्ता मूल्य सूचकांक, उक्त अनुसूची-1(अ) के स्तंभ-01 के प्रदर्शित मासों के हेतु उक्त अधिनियम की धारा-2 के खंड (डी) के प्रयोजन के निमित अनुसूची 1(अ) के स्तम्भ-04 में यथा प्रदर्शित रूप में होंगे।

अनुसूची -II

परिवर्तनशील महंगाई भत्ता की दरें अखिल भारतीय उपभोक्ता मूल्य सूचकांक के उस औसत बिन्दु पर आधारित होगा जिस पर उपर्युक्त अनुसूचित नियोजनों में परिवर्तनशील महंगाई भत्ता की दरें निर्धारित/पुनरीक्षित की गई है। उपर्युक्त सूचकांक में यथास्थिति वृद्धि अथवा ह्नास के अनुसार न्यूनतम मजदूरी की दरों में उपर्युक्त अनुसूची के स्तंभ-4 में अंकित दर से वृद्धि या कमी की जायेगी और उसे परिवर्तनशील महंगाई भत्ता का अंश समझा जायेगा। परन्तु यदि सूचकांक उस विन्दु से कम हो जाय जिस विन्दु पर न्यूनतम मजदूरी की दरें निर्धारित/पुनरीक्षित की गई हो, तो निर्धारित/पुनरीक्षित न्यूनतम मजदूरी में कोई परिवर्त्तन नहीं होगा। उक्त परिवर्तनशील महंगाई भत्ता का भुगतान उपर्युक्त दर से जुलाई-दिसम्बर,2018 के औसत के आधार पर 01 अप्रैल, 2019 से देय होगा और इसके बाद प्रत्येक छः महीने के औसत अखिल भारतीय उपभोक्ता मूल्य सूचकांक के आधार पर परिवर्तनशील महंगाई भत्ता की राशि में वृद्धि अथवा कमी संबंधित छमाहीं के तीन महीने बाद से लागू होगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 27272727 फरफरफरफरवर(cid:15)वर(cid:15)वर(cid:15)वर(cid:15) 2019201920192019 स्पष्टीकरण - अधिसूचना के प्रयोजनार्थ

(क) राज्य सरकार कामगारों के उन्नयन का आधार निम्न रूपेण निर्धारित करती है, जैसे - (i) किसी कोटि (अकुशल एवं अर्द्धकुशल) में पाँच या पाँच वर्षों से अधिक तक का कार्य अनुभव होने पर, कामगार को उस कोटि से तत्काल ऊपर की कोटि में उन्नत माना जायेगा तथा कामगार को उन्नत कोटि के न्यूनतम मजदूरी का भुगतान किया जायेगा। उदाहरणस्वरूप अगर कोई कामगार पाँच या पाँच वर्षों से अधिक अकुशल कामगार के रूप में कार्य किया हो तो वह अर्द्धकुशल कामगार के न्यूनतम मजदूरी का हकदार होगा। इसी प्रकार अर्द्धकुशल कोटि के कामगार भी पाँच या पाँच वर्षों से अधिक का कार्य अनुभव होने पर अपनी कोटि से तत्काल ऊपर की कोटि में उन्नत माने जायेंगे।

परंतु कुशल से ऊपर कोटि में उन्नयन हेतु प्रमाणीकरण आवश्यक होगा।

(ii) अगर किसी कामगार ने National Skill Qualification Framework (NSQF) संबद्ध प्रशिक्षण प्राप्त किया हो तथा कामगार के प्रमाण-पत्र में उनके द्वारा प्राप्त स्तर (Level) का उल्लेख हो तो उस कामगार को उनके द्वारा प्राप्त स्तर (Level) के अनुसार निम्न रूपेण विभिन्न कोटियों में कोटिबद्ध किया जाता है-

स्तर (Level)-1 की योग्यता धारण करने वाले कामगार को अकुशल माना जायेगा।

स्तर (Level)-2 एवं 3 की योग्यता धारण करने वाले कामगार को अर्द्धकुशल माना जायेगा। स्तर (Level)-4 एवं 5 की योग्यता धारण करने वाले कामगार को कुशल माना जायेगा। स्तर (Level)-6 एवं 7 की योग्यता धारण करने वाले कामगार को अतिकुशल कामगार माना जायेगा।

स्तर (Level)-8, 9 एवं 10 की योग्यता धारण करने वाले कामगार को पर्यवेक्षीय या लिपिकीय माना जायेगा।

ऐसे कामगार जिन्होंने National Skill Qualification Framework (NSQF) के अन्तर्गत किसी कोटि का स्तर (Level) प्राप्त किया हो एवं उस स्तर पर उनके द्वारा पाँच या पाँच वर्षों से अधिक का कार्य अनुभव हो तो उन्हें अगली कोटि में उन्नत माना जायेगा। उदाहरण स्वरूप-अगर कोई कामगार स्तर (Level)-2 अथवा स्तर (Level)-3 के अन्तर्गत अर्द्धकुषल कामगार है एवं उनके द्वारा अर्द्धकुषल कामगार के रूप में पाँच या पाँच वर्षों से अधिक का कार्य अनुभव प्राप्त कर लिया गया है तो उसे कुषल कामगार की न्यूनतम मजदूरी का भुगतान किया जायेगा।

(iii) अगर किसी कामगार ने किसी केन्द्र/राज्य अधिनियम अथवा नियमावली के अन्तर्गत प्रशिक्षण प्राप्त किया हो तो वह कामगार प्राप्त प्रशिक्षण के पश्चात्‌ धारित योग्यता के अनुसार अर्द्धकुशल अथवा कुशल कोटि के न्यूनतम मजदूरी का हकदार होगा।

(ख) राज्य सरकार निम्न रूपेण विभिन्न कोटियों में कामगारों का वर्गीकरण करती है। यह वर्गीकरण नितांत उदाहरणस्वरूप है तथा यह कार्य की प्र—ति के अनुसार घट अथवा बढ़ सकता है- अकुशल बजरी (गिट्टी/छर्री) फैलाने वाला, बेलदार, बाल्टी वाला, वाहक (पत्थर), वाहक (पानी), गाडी़वाहक, केयरटेकर (पुल), सफाई कर्मचारी, चौकीदार, कंक्रीट (हाथ से मिलाने वाला), दफादार, गाड़ीवान (बैल, ऊँट, गधा, खच्चर), श्रमिक (गार्डन), मजदूर, होल कटर, पेट्रोलमैन, तलाशीकर्त्ता, स्वीपर, वाचमैन, घास काटनेवाला या अन्य कोई भी प्रवर्ग जो कि अकुशल प्र—ति के हों जिसमें बहुत ही कम या कुछ भी कुशलता या अनुभव की आवश्यकता नहीं होती चाहे वे किसी भी नाम से पुकारे जाए।

अर्द्धकुशल भिश्ति (मूशक सहित), नाववाला (प्रधान), भंजक (चट्‌टान, पत्थर प्रस्तर धातु, पत्थर), बेंत बुनने वाला, चारपाई कसने वाला, सुरक्षा गार्ड (शस्त्र रहित), दफ्तरी, फायरमैन, फायरमैन (ईंटो का भट्‌टा, स्टीम रोड रोलर), गेटकीरपर, सहायक (कारीगर), सहायक (आराकश), श्रमिक (चट्‌टानकर्तन), फिटर गैंग, खलासी, टर्नर, मजदूर (भारी वजन), रात्रिगार्ड, सहायक चाय बनाने वाला, परोसने वाला, (सर्विस मैन), बैरा, वेटर, भंडारवाला, फिटर (सहायक4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 27272727 फरफरफरफरवर(cid:15)वर(cid:15)वर(cid:15)वर(cid:15) 2019201920192019 अर्द्धकुशल), जमादार (अर्द्धकुशल), पम्प अटेंडेंट, डांडी फराश, सहायक (लोको, क्रेन/ट्रक), खलासी, नाव वाला, मसालची, तोपकार (बड़े पत्थर तोड़नेवाला) या अन्य कोई भी प्रवर्ग जो कि अर्द्धकुशल प्र—ति के हों जिनमें कार्य अनुभव/प्रशिक्षण के आधार पर कुछ कुशलता या क्षमता की आवश्यकता होती है और जो कुशल कर्मचारी के पर्यवेक्षण/मार्गदर्शन में किया जा सकता है, चाहे वे किसी भी नाम से पुकारे जाय।

कुशल मिस्त्री, लोहार, बायलर मैन, ईट बिछानेवाला, ब्लास्टर, बढ़ई, सुरक्षा गार्ड (शस्त्र सहित), काष्टकार (साधारण), कंक्रीट मिश्रण मिश्रक, मोची, चालक, चालक मोटर वाहन, मोटर लारी चालक, चालक (इंजन स्थिर, स्टोन, क्रशर, बुलडोजर, रोड रोलर, और क्रेन), चालक (लोको/ट्रक), राजमिस्त्री, स्टोन टाइल फ्लोरिंग मिस्त्री, मोल्डर (ईंट, टाइल), पेंटर, नलसाज मिस्त्री, नलसाज-सह-फिटर, पोलिशगर, पॉलिशगर (फर्श), पम्प चालक, सहायक (वातानुकूल परिचालक), स्टोनकटर, दर्जी, दर्जी (अपहोजरी), ठठेरा, सोफाकाज, रंगसाज, रसोइया (प्रधान), बिजली मिस्त्री, यांत्रिक (नलकूप), मिस्त्री (ट्‌यूब-वेल, टेलीफोन), मीटर रीडर, मौसम प्रेक्षक, बावर्ची, कारीगर, हलवाई, महाराज, सहायक महाराज, सहायक रसोईया, रोटी कारीगर, आईस्क्रीम मिस्त्री, डोसा मास्टर, प्रधान वेटर, प्रधान बेरा या कुशल प्र—ति का कोई अन्य प्रवर्ग, जिनमें कार्य के अनुभव के आधार पर या किसी तकनीकी या किसी व्यवसायिक संस्थान में प्रशिक्षण के आधार पर अर्जित कुशलता या क्षमता की आवश्यकता होती है तथा जिसके निष्पादन के लिए पहल और विवेक की आवश्यकता होती है, उनके नाम कुछ भी हों।

अतिकुशल बायलरमैन, केबल संयोजक, मैकेनिक (वातानुकूलन), ओवरसियर, सड़क निरीक्षक, उप ओवरसियर (योग्यता प्राप्त), वेल्डर एवं फिटर, वायर मैन, वातानुकूल परिचालक, चित्रकार, प्रधान बावर्ची, प्रधान खानसामा, प्रधान महाराज, प्रधान कारीगर या कोई अन्य प्रवर्ग जो अति कुशल प्रवृत्ति का हों, जिनमें सघन तकनीकी या व्यवसायिक प्रशिक्षण या वर्षो के व्यवहारिक कार्य अनुभव के आधार पर अर्जित खास कार्यों के सम्पादन में पूर्णता की डिग्री तथा पूर्ण क्षमता की आवश्यकता होती है और इनके निष्पादन हेतु कामगारों में विवेक या विनिश्चय के लिए पूरी जवाबदेही की आवश्यकता होती है, वे किसी भी नाम से पुकारे जायें।

लिपिकीय/पर्यवेक्षकीय लिपिक, मुंशी (न्यूनतम मैट्रिकुलेट), भंडार लिपिक (मैट्रिकुलेट), भंडार रक्षक (मैट्रिकुलेट), मिलान लिपिक, बुक कीपर, कार्य मुंशी, (अधीनस्थ) लेखालिपिक, संगणक, टेलीफोन प्रचालक, बुकिंग क्लर्क, टंकक या अन्य कोई प्रवर्ग चाहे जिस नाम से पुकारा जाए, जो कि लिपिकीय अथवा पर्यवेक्षकीय प्र—ति के हों। उपरोक्त दरें 01 अप्रैल, 2019 से अगले आदेश तक प्रभावी होंगी

SCHEDULE -II

Consumer Price Index on which the minimum rates of wages has been fixed/revised in the above scheduled employments. There will be increase or decrease in rates of wages shown in column -4 with rise or fall as the case may be in aforesaid index of the above scheduled employments and will be deemed as Variable Dearness Allowance components . But even if the Index fall below the point on which minimum rates of wages have been fixed/ revised, there will not be any reduction in the minimum wages fixed/revised. The payment of variable Dearness Allowance on the basis of average index of July-December,2018 will be payable at the aforesaid rates from 01st April, 2019 and thereafter increase or decrease in the amount of Variable Dearness Allowance will be based on the average of All India Consumer Price Index number for every six months and will be applicable after the expiry of three months after said period of six months.

Explanation - For the purpose of this notification

(A) The State Government prescribed the following base for upgradation of workers in next category-

(i) If a worker of any category (Unskilled and Semi-Skilled) has attain a working experience of five (5) or more than five (5) year in that particular category then he will be upgraded to the next immediate category and will be paid minimum wage of that upgraded category. For example, if a worker is working as unskilled worker for five (5) or more year then he/she will be entitled for the minimum wage of semi- skilled worker. Similarly semiskilled worker will be entitled for minimum wage of skilled worker after working for five (5) or more than five (5) year as semi-skilled worker.

However, for upgradation above skilled category, certification is necessary.

(ii) If a worker has attain any skill training allied through National Skill Qualification Framework (NSQF) and on his/her certificate, the level which he/she attain is mentioned, then following will be the categorization of levels which he/she is entitled-

The worker holding the certificate of qualification level 1 will be considered as unskilled.

The worker holding the certificate of qualification level 2 and level 3 will be considered as semi-skilled.

The worker holding the certificate of qualification level 4 and 5 will be considered as skilled.

The worker holding the certificate of qualification level 6 and 7 will be considered as highly skilled.

The worker holding the certificate of qualification level 8, 9 and 10 will be considered as Supervisory or Clerical.

If a worker has attain any category as per the National Skill Qualification Framework (NSQF) levels and he/she has work experience of five or more than five years on that particular category then he/she will be upgraded to the next category. For example, if worker is semi-skilled as per level 2 or level 3 and he/she has attain work experience of five or more than five years as semi-skilled then he she will be consider as skilled worker and will be paid minimum wage of skilled worker.

(iii) If a worker has attain any training as per the provision of Central/State Act or Rule, then he/she will be entitled for the minimum wages of semi-skilled or skilled category and will be as per the merit which he/she holds after training.

(B) The State Government Categorizes the different type of worker as per the following.

The categorization is only for example and can be increase or decrease as per the nature of work-

Unskilled

Mistry, Blacksmith, Boiler man, Brick layer, Blaster, Carpenter, Security guard (with arms), Carpenter (ordinary), Concrete mixure mixer, Cobbler, Driver, Driver Motor Vehicle, Driver (engine static, stone crusher, bulldozer, road roller and crane), Driver (loco/truck), Mason, Stone tile flooring mistry, Moulder (brick, tile), Painter, Plumber, Plumber-cum-Fitter, Polisher, Polisher (floor), Pump driver, Assistant (air-conditioning), Stonecutter, Tailor, Tailor (upholstery), Copper Smith, Sofa maker, Colour Washing man, Chef (head), Confectioner, Electrician, Mechanic (head), Mistry (tube-well, telephone), Meter reader, Weather observer, Cook, Artisan, Assistant Confectioner, Roti maker, Ice cream maker, Dosa master, Chief waiter, Chief Baira or any other worker whatever name so called and the execution of work requires skill, acquired by means of experience or by training in any vocational institute and also requires pro- activeness and patience for disposal of work.

Highly Skilled

Cable joiner, Mechanic (air-conditioner), Overseer, Road Inspector, Sub Overseer (Qualified) Welder and fitter, Wireman, Colour Artist, Head

Khansama, Head Cook, Head Maharaj, Head Artisan or any other worker by whatever name so called, which perform work of highly skilled nature and require intensive vocational or technical training, or long practical work experience apart from patience, decision making and responsible action.

Clerical/Supervisor

Clerk, Munshi (Matriculate), Store clerk (Matriculate), Store Keeper (Matriculate), Time Keeper, Book Keeper, Work Munshi (Subordinate) Account Clerk, Telephone Operator, Computer Operator, Booking clerk, Typist or any other worker by whatever name so called and the execution of work are of clerical or supervisory nature.

The above mentioned rates will be applicable from 01 April, 2019.
