सं॰ 11/अंधा0(नियं)स्था0-05/2014-251(11)—भारत संविधान के अनुच्छेद -309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार राज्यपाल, ''बिहार ऑफ्थालमिक सहायक (भर्ती एवं सेवाशर्त) नियमावली, 2011'' में संशोधन करने हेतु निम्नलिखित नियमावली बनाते है :-

1. संक्षिप्त नाम, विस्तार एवं आरम्भ।-(1) यह नियमावली ''बिहार ऑफ्थालमिक सहायक संवर्ग (भर्ती एवं सेवाशर्त)(संशोधन) नियमावली, 2019'' कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त प्रवृत होगी। 2. बिहार ऑफ्थालमिक सहायक संवर्ग (भती एवं सेवाशर्त) नियमावली, 2011 के नियम 02 की खण्ड (ii) एवं (iv) का प्रतिस्थापन।- उक्त नियमावली के नियम 02 के खण्ड (ii) एवं (iv) को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

''(ii) ''संवर्ग'' से अभिप्रेत है निदेशालय एवं संलग्न कार्यालयों में कार्यरत ऑफथालमिक सहायक, वरीय ऑफ्थालमिक सहायक एवं ऑफथालमिक पदाधिकारी, का संवर्ग;''

''(iv) ''आयोग'' से अभिप्रेत है बिहार तकनीकी सेवा आयोग;''

3. बिहार ऑफ्थालमिक सहायक संवर्ग (भती एवं सेवाशर्त) नियमावली, 2011 के नियम 3 के उपनियम (1) तथा उपनियम (02) का प्रतिस्थापन।- उक्त नियमावली के नियम 3 के उपनियम (1) तथा उपनियम (02) निम्नलिखित द्वारा प्रतिस्थापित किए जायेंगेः-

''(1) विभिन्न पदों का वर्गीकरण तथा नियुक्ति प्राधिकार :- संवर्ग में सम्मिलित विभिन्न पदों एवं उनके वर्गीकरण तथा उनके नियुक्ति प्राधिकार निम्नवत्‌ अथवा समय-समय पर राज्य सरकार द्वारा यथावधारित प्रक्रिया के अनुसार होगें :-

नोटः- उपरोक्त पदों के लिए सरकार द्वारा, समय-समय पर, स्वीकृत वेतनमान अनुमान्य होगा। 4. बिहार ऑफ्थालमिक सहायक संवर्ग (भती एवं सेवाशर्त) नियमावली, 2011 के नियम 04, 05, 06 एवं 07 का प्रतिस्थापन।- उक्त नियमावली के नियम 04, 05, 06 एवं 07 को निम्नलिखित द्वारा क्रमशः प्रतिस्थापित किया जायेगाः-

''4. भर्ती।- इस संवर्ग में नियुक्ति मूल कोटि (ऑफ्थालमिक सहायक) के पद पर सीधी भर्त्ती द्वारा, आयोग की अनुशंसा के आधार पर होगी। ऑफ्थालमिक सहायक से उच्चार सभी पदों की रिक्तियाँ उनके ठीक निचले पदों से प्रोन्नति द्वारा भरी जाएगी। प्रोन्नति के प्रस्ताव में विभागीय प्रोन्नति समिति की अनुशंसा/सहमति प्राप्त की जाएगी।

5. अर्हताएँ।- (1) मूल कोटि के पद पर सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक योग्यता इंटरमीडिएट/102 र्उाीण (भौतिक विज्ञान, रसायनशास्त्र, जीव विज्ञान, अंग्रेजी के साथ) उत्तीर्णता होगी। इसके अतिरिक्त सरकार द्वारा मान्यता प्राप्त संस्थान से ऑफ्थालमिक सहायक के डिप्लोमा कोर्स में उत्तीर्णता एवं एत्‌दसंबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा।

(2) इस संवर्ग में सीधी भर्त्ती के लिए न्यूनतम आयु सीमा 18 वर्ष होगी और अधिकतम आयु-सीमा वही होगी, जो सरकार द्वारा, समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाय।

(3) उम्र के निर्धारणार्थ कट ऑफ डेट (संबंधित वर्ष की 1ली अगस्त को) माना जायेगा। 6. भर्ती की प्रक्रिया।- (1) नियुक्ति प्राधिकार वर्ष की 1ली अप्रैल की स्थिति के आधार पर रिक्तियों की गणना कर एवं रोस्टर क्लीयरेन्स कराकर आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा। (2) अधियाचना के आलोक में आयोग, रिक्तियों को विज्ञापित कर, आवेदन-पत्र आमंत्रित करेगा और निम्नलिखित आधार पर मेधासूची तैयार करेगा :-

(क) इंटरमीडिएट/102 कोर्स की परीक्षा में प्राप्तांक के लिए - 35 अंक (ख) ऑफ्थालमिक सहायक के डिप्लोमा कोर्स की परीक्षा के प्राप्तांक के लिए - 40 अंक (ग) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव

के लिए (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक कुल- 100 अंक टिप्पणी।- परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का निर्धारण इंटरमीडिएट/102 कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.35 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 60% अंक प्राप्त किया गया हो तो उसे 60×0.35=21 अंक दिये जायेंगेतथा ऑफ्थालमिक सहायक के डिप्लोमा कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.40 के गुणक से गुणा करके होगा।

7. मेघा सूची की वैधता ।-(1) साक्षात्कार की प्रक्रिया का अवधारण बिहार तकनीकी सेवा आयोग के द्वारा किया जायेगा।

(2) आयोग, उपरोक्त नियम 6 के उपनियम-(2) के आधार पर मेधासूची तैयार करेगा। मेधासूची तैयार करने के पश्चात्‌ आयोग के द्वारा, प्रमाणपत्र की प्रारम्भिक जाँच करायी जायेगी और तत्पश्चात्‌ रिक्तियों की अधियाचना के अनुसार अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजी जायेगी। नियुक्ति प्राधिकार के स्तर पर भी प्रमाणपत्रों की जाँच के पश्चाात्‌ एवं सिविल सर्जन द्वारा निर्गत स्वास्थ्य प्रमाण पत्र के प्रस्तुत करने के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृत्त का सत्यापन करा लिया जायेगा।

(3) (क) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा, समय-समय पर, निर्गत अनुदेश का अनुपालन आवश्यक होगा।

(ख) आयोग की अनुशंसा, प्राप्ति की तिथि के प्रभाव से, एक वर्ष के लिए वैध होगी जिसे अगले एक और वर्ष के लिए नवीकृत किया जा सकेगा।''3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 6666 माच(cid:23)माच(cid:23)माच(cid:23)माच(cid:23) 2019201920192019 5. बिहार ऑफ्थालमिक सहायक संवर्ग (भती एवं सेवाशर्त) नियमावली, 2011 के नियम-8, 9, एवं 10 का प्रतिस्थापन।- उक्त नियमावली के नियम-8, 9, एवं 10 को निम्नलिखित द्वारा क्रमशः प्रतिस्थापित किया जायेगा :-

9. प्रोन्नति के लिए चयन का मानदण्ड ।- (1) संवर्ग के अधीन प्रथम एवं द्वितीय प्रोन्नति के लिए अभ्यर्थियों की उपयुक्तता का मानदण्ड ''वरीयता-सह-योग्यता'' का सिद्वान्त होगा।

(2) प्रोन्नति के लिए राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर अवधारित अर्हक कालवधि का पूरा होना आवश्यक होगा।

10. चयन की प्रक्रिया :- विभागीय प्रोन्नति समिति द्वारा प्रोन्नति के लिए विचार किया जाएगा जिसका गठन संवर्ग नियंत्री प्राधिकार द्वारा पृथक आदेश निर्गत कर, किया जाएगा।

सं॰ 11/अंधा॰ (निय) स्था॰-05/2014-252 (11) अधिसूचना संख्या 251 (11) दिनांक 6 मार्च 2018 का निम्नलिखित अँग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से, एतदद्वारा प्रकाशित किया जाता है जो भारत का संविधान के अनुच्छेद-348 के खंड (3) के अंतर्गत अँग्रेजी भाषा में उक्त अधिसूचना का प्राधि—त पाठ समझा जायेगा।

No. 11/Andha. (Niya.) Astha -05/2014-251(11)—In exercise of powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to amend the Bihar Ophthalmic Assistants Cadre (Recruitment and Service Conditions) Rules, 2011:—

1. Short title, extent & commencement.—(1) These Rules may be called as the "Bihar Ophthalmic Assistants Cadre (Recruitment and Service Conditions) (Amendment) Rules, 2019."

(2) It shall extend to the whole State of Bihar.

(3) It shall come into force at once.

2. Substitution of clause (ii) and (iv) of rule-2 of the Bihar Ophthalmic Assistant Cadre (Recruitment and Service Conditions) Rules, 2011 .- Clause (ii) and (iv) of rule-2 of the said Ruls shall be substituted by the following:—

"(ii) 'Cadre' means the cadre of Ophthalmic Assistants, Senior Ophthalmic Assistants and Ophthalmic Officers working in the Directorate and attached offices." "(iv) 'Commission' means the Bihar Technical Service Commission;"

3. Substitution of clause (A) and (B) of subrule (1) and subrule (2) of rule-3 of the Bihar Ophthalmic Assistant Cadre (Recruitment and Service Conditions) Rules, 2011.- Subrule (1) and subrule (2) of rule-3 of the said Ruls shall be substituted by the following:-

"(1) Classification of different posts and Appointing Authority.—Different posts included in the cadre and their classification and their appointing authorities shall be as follows or as per the criteria determined by the State Government, from time to time:-

shall be admissible."

4. Substitution of rule-4, 5, 6 and 7 of the Bihar Ophthalmic Assistants Cadre (Recruitment & Service Conditions) Rules, 2011.- Rule-4, 5, 6 and 7 of the said Rules shall be substituted by the following respectively:-

"4. Recruitment.- Appointment in this cadre shall be made by direct recruitment on the post of basic category (Ophthalmic Assistant) on the recommendation of the Commission. The Vacancies to all the posts higher to the Ophthalmic Assistant shall be filled by promotion from just lower posts. The recommendation/concurrence of the Departmental Promotion Committee shall be obtained in the proposals of promotion.

5. Qualifications.— (1) For direct recruitment to the post of basic category post, minimum educational qualification shall be Intermediate/10+2 pass (with Physics, Chemistry, Biology and English). In addition to this, passing in the Diploma course of Ophthalmic Assistant from Government recognized institute and a certificate to that effect shall be necessary.

(2) For direct recruitment in this cadre, the minimum age limit shall be 18 years and maximum age limit shall be the same as may be determined reservation categorywise by the Government, from time to time.

(3) 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

6. Procedure of recruitment. – (1) the appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April.

(2) In light of requisition, the Commission shall invite applications after advertising vacancies and shall prepare merit list on following basis:-

(a) For marks obtained in Intermediate/10+2 course examination – 35 marks (b) For marks obtained in diploma course examination of Ophthalmic Assistant – 40 marks (c) For work experience in Government Hospitals of Bihar State (5 marks for each year, maximum 25 marks) – 25marks Total 100 marks Note:—The marks to be given to a candidate for marks obtained in the Intermediate/10+2 course examinations shall be determined by multiplying percentage of total marks obtained in the aforesaid examinations by multiple of 0.35. For example, if a candidate has obtained 60% marks, he will be given 60% X 0.35 = 21 marks and Diploma Course of Ophthalmic Assistants examinations shall be determined by multiplying percentage of total marks obtained in the aforesaid examinations by multiple of 0.4.

7. Validity of Merit list.- (1) The procedure for interview shall be determined by the Bihar Technical Service Commission.

(2) The Commission shall prepare merit list on the basis of subrule (2) of rule-6. After preparation of merit list, preliminary scrutiny of the certificates shall be caused to be done by the Commission and thereafter final recommendation, in accordance with the requisitioned vacancies, shall be sent to the Appointing Authority. At the level of Appointing Authority also, after scrutiny of certificates and production of Health5 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 6666 माच(cid:23)माच(cid:23)माच(cid:23)माच(cid:23) 2019201920192019 certificate issued by the Civil Surgeon, antecedents of recommended candidates shall be caused to be verified.

(3) (a) After receipt of recommendation of the Commission, if shall be necessary to follow instructions issued by the Government, from time to time, with respect to procedure of appointment.

(b) The recommendation of the Commission shall be valid for one year w.e.f. the date of its receipt in the department which may be renewed for next one more year."

5. Substitution of rule-8, 9 and 10 of the Bihar Ophthalmic Assistant Cadre (Recruitment & Sercvice Condition) Rules, 2011.- Rule-8, 9 and 10 of the said Rules shall be substituted by the following respectively:-

"8. Promotion to higher grades from the general grade (basic grade) may be made

9. Selection Criterion for Promotion- (1) The criterion of determination of suitability of candidates for promotion under the cadre shall be the principle of 'Seniority-cum-merit' for first and second promotion.

(2) The completion of qualifying KALAWADHI for promotion determined, from time to time, by the State Government (General Administration Department) shall be essential.

10. Selection Procedure.— Promotions shall be considered by the Departmental Promotion Committee which shall be constituted by the Cadre Controlling Authrority by issuing separate order."
