(स(cid:28)(cid:25) पटन(cid:4) 3(cid:31) ) पटन(cid:4)! म(cid:28)गलव(cid:4)र! 12 माच(cid:24) 2019 Je lalk/ku foHkkx ——— प्रारूप प्रारूप प्रारूप प्रारूप अधिसूचनाअधिसूचनाअधिसूचनाअधिसूचना 8 मार्च 20198 मार्च 20198 मार्च 20198 मार्च 2019 एस0ओ0 64, दिनांक 12 मार्च 2019— न्यूनतम मजदूरी अधिनियम, 1948 (11, 1948) की धारा-3 की उपधारा (1) के खंड (बी) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल, बिहार राज्य में निम्नांकित नियोजनों में नियोजित अर्द्धकुशल कोटि के कर्मचारियों के लिए राज्य सरकार की विभिन्न अधिसूचनाओं में निर्धारित न्यूनतम मजदूरी की दरों का पुनरीक्षण करना चाहते हैं, उससे संबंधित प्रस्ताव का निम्नलिखित प्रारूप उक्त अधिनियम की धारा-5 की उपधारा (1) के खंड (ख) की अपेक्षानुसार इसके द्वारा प्रभावित हो सकने वाले व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और इसके द्वारा सूचना दी जाती है कि बिहार गजट में इस अधिसूचना के प्रकाशन की तारीख से दो महीने के बाद उक्त प्रस्ताव पर विचार किया जायेगा। दो महीने की उक्त अवधि की समाप्ति की तारीख को या उसके पहले इस प्रस्ताव के संबंध में किसी व्यक्ति से जो भी आपत्ति या सुझाव प्राप्त होगा उस पर राज्य सरकार विचार करेगी।

टिप्पणी :-
(क) वर्तमान में पर्यवेक्षीय एवं लिपिकीय कोटि के कामगार का मासिक न्यूनतम मजदूरी समतुल्य है एवं यह कुशल कामगार के न्यूनतम मजदूरी से भी कम है, हाँलाकि पर्यवेक्षीय कामगार को कुशल कामगारों के कार्यों का भी पर्यवेक्षण करना पड़ता है।
(ख) प्रस्ताव के अनुसार लिपिकीय कोटि के कामगार का न्यूनतम मजदूरी कुशल कोटि के कामगार के सामान होगा एवं पर्यवेक्षीय कोटि के कामगार का न्यूनतम मजदूरी अतिकुशल कोटि के कामगार के सामान होगा।
(ग) न्यूनतम मजदूरी की उपर्युक्त प्रस्तावित दरों में सात दिनों की अवधि में विश्राम के दिन के लिए कर्मचारियों को देय पारिश्रमिक शामिल है।
(घ) साप्ताहिक विश्राम के दिन अथवा अन्य किसी दिन समयोपरि कार्य के लिए कामगार बिहार न्यूनतम मजदूरी नियमावली, 1951 के नियम-25 में विहित दर से समयोपरि काम का दो गुणा मजदूरी भुगतान पाने का हकदार होगा।
(ड.) पुरूष या स्त्री कामगार एक ही काम या उसी प्रकार के काम के लिए समान दर पर मजदूरी पायेंगे। नोट :- लिपिकीय एवं पर्यवेक्षीय कोटि से अभिप्रेत है-
(i) उपरोक्त विक्रय प्रोत्साहन नियोजन में कार्य करने वाले लिपिकीय कोटि के कामगार यथा- लिपिक, भंडार लिपिक (मैट्रिकुलेट), मिलान लिपिक, बुक कीपर, कार्य मुंशी, (अधीनस्थ) लेखालिपिक, संगणक, टेलीफोन प्रचालक, बुकिंग क्लर्क, टंकक या अन्य कोई प्रवर्ग चाहे जिस नाम से पुकारा जाए, जो कि लिपिकीय प्र—ति के हों।
(ii) उपरोक्त विक्रय प्रोत्साहन नियोजनों में कार्य करने वाले पर्यवेक्षीय कोटि के कामगार यथा-मुंशी (न्यूनतम मैट्रिकुलेट), भंडारपाल, भंडार रक्षक (मैट्रिकुलेट), सुपरवाईजर, अधीक्षक, टास्कमास्टर, या अन्य कोई प्रवर्ग चाहे जिस नाम से पुकारा जाए, जो कि पर्यवेक्षीय प्र—ति के हों।
(iii) वैसा NSQF संबद्ध कौशल प्रशिक्षित कामगार जिनके प्रमाणीकरण पर स्तर (Level) 8, 9 अथवा 10 अंकित हो।

The 8th March 2019
S.O. 64, dated 12th march 2019— The following draft of proposal is to revise the minimum rates of wages fixed by the State Government in semi-skilled category of employees employed in the following Employment in the State of Bihar, which the Governor of Bihar proposes to make in exercise of powers conferred by clause (a) of sub-section (1) of section 3 of the said Act and is hereby published as required by clause (b) of sub-section (1) of section-5 of the said Act for the information to persons likely to be affected thereby and notice is hereby given that the said proposal will be taken into consideration after two months from the date of publication of this notification in the Gazette of Bihar. Any objection or suggestion which may be received from any person in respect of the said proposal on or before the date of expiry of the said period of two months shall be considered by the State Government.

Note: - (a) Currently the monthly minimum wage of supervisory and clerical category is equal and even less then the minimum wage of skilled worker. However, supervisory worker has to perform the supervision work of skilled worker.
(b) According to the proposal, the minimum wages of clerical category will be equal to the skilled category and the minimum wages of the supervisory category workers will be equal to the highly skilled category.
(c) The above mentioned rates of minimum wages include remuneration payable to the worker for a day of rest during the seven days period.
(d) For weekly work on the day of rest or any other day, the worker will be entitled to get two times wages payment of overtime work at the rate prescribed in rule-25 of the Bihar Minimum Wage Rules, 1951.
(e) Male or female workers will get wages at the same rate for the same work or similar work.

(i) The worker working as Clerical worker in the above mentioned sales promotion employment for example-Clerk, Store clerk (Matriculate), Time Keeper, Book Keeper, Work Munshi (Subordinate) Account Clerk, Telephone Operator, Computer Operator, Booking clerk, Typist or any other worker by whatever name so called and the execution of work are of clerical nature.
(ii) The worker working as Supervisory worker in the above mentioned sales promotion employments, for example Munshi (Matriculate), Storekeeper, Store Keeper (Matriculate), Supervisor, Superintendent, Taskmaster or any other worker by whatever name so called and the execution of work are of supervisory nature. (iii) Such worker who has done NSQF allied training and Level 8,9 or Level 10 is marked on his/her certificate.
