(स(cid:28)(cid:25) पटन(cid:4) 3(cid:31)(cid:31)) पटन(cid:4) म(cid:28)गलव(cid:4)र 12 माच(cid:24) 2019 Je lalk/ku foHkkx ——— प्रारूप प्रारूप प्रारूप प्रारूप अधिसूचनाअधिसूचनाअधिसूचनाअधिसूचना 8 मार्च 20198 मार्च 20198 मार्च 20198 मार्च 2019 एस0ओ0 66, दिनांक 12 मार्च 2019— न्यूनतम मजदूरी अधिनियम, 1948 (11, 1948) की धारा-3 की उपधारा (1) के खंड (बी) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल, बिहार राज्य में निम्नांकित नियोजनों में नियोजित अर्द्धकुशल कोटि के कर्मचारियों के लिए राज्य सरकार की विभिन्न अधिसूचनाओं में निर्धारित न्यूनतम मजदूरी की दरों का पुनरीक्षण करना चाहते हैं, उससे संबंधित प्रस्ताव का निम्नलिखित प्रारूप उक्त अधिनियम की धारा-5 की उपधारा (1) के खंड (ख) की अपेक्षानुसार इसके द्वारा प्रभावित हो सकने वाले व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है और इसके द्वारा सूचना दी जाती है कि बिहार गजट में इस अधिसूचना के प्रकाशन की तारीख से दो महीने के बाद उक्त प्रस्ताव पर विचार किया जायेगा।
दो महीने की उक्त अवधि की समाप्ति की तारीख को या उसके पहले इस प्रस्ताव के संबंध में किसी व्यक्ति से जो भी आपत्ति या सुझाव प्राप्त होगा उस पर राज्य सरकार विचार करेगी।

टिप्पणी :-
(क) वर्तमान में अकुशल कोटि के कामगार एवं अर्द्धकुशल कोटि के कामगार के न्यूनतम मजदूरी का अंतर बेहद कम है, एवं ये अंतर केवल `10/- का है।
(ख) अर्द्धकुशल कोटि के कामगारों के पुनरीक्षण का आधार दिनांक-01.10.2018 को लागू अकुशल एवं कुशल कोटि के कामगारों हेतु निर्धारित न्यूनतम मजदूरी का औसत अथवा अधिसूचना प्रवृत होने की तिथि को लागू अकुशल एवं कुशल कोटि के कामगारों हेतु निर्धारित न्यूनतम मजदूरी का औसत होगा।
(ग) मासिक न्यूनतम मजदूरी की दरों का दैनिक मजदूरी की दरों में अथवा दैनिक मजदूरी की दरों का मासिक मजदूरी की दरों में भुगतान 26 से भाग/गुणा करके किया जायेगा।
(घ) न्यूनतम मजदूरी की उपर्युक्त प्रस्तावित दरों में सात दिनों की अवधि में विश्राम के दिन के लिए कर्मचारियों को देय पारिश्रमिक शामिल है।
(च) साप्ताहिक विश्राम के दिन अथवा अन्य किसी दिन समयोपरि कार्य के लिए कामगार बिहार न्यूनतम मजदूरी नियमावली, 1951 के नियम-25 में विहित दर से समयोपरि काम का दो गुणा मजदूरी भुगतान पाने का हकदार होगा।
(छ) पुरूष या स्त्री कामगार एक ही काम या उसी प्रकार के काम के लिए समान दर पर मजदूरी पायेंगे। नोट :- अर्द्धकुशल कोटि से अभिप्रेत है-
(i) उपरोक्त अनुसूचित विक्रय प्रोत्साहन नियोजन में कार्य करने वाले अर्द्धकुशल कोटि के कामगार। (ii) भिश्ति (मूशक सहित), नाववाला (प्रधान), भंजक (चट्टान, पत्थर प्रस्तर धातु, पत्थर), बेंत बुनने वाला, चारपाई कसने वाला, सुरक्षा गार्ड (शस्त्र रहित), दफ्तरी, फायरमैन, फायरमैन (ईंटो का भट्टा, स्टीम रोड रोलर), गेटकीरपर, सहायक (कारीगर), सहायक (आराकश), श्रमिक (चट्टानकर्तन), फिटर गैंग, खलासी, खलासी, टर्नर, मजदूर (भारी वजन), रात्रिगार्ड, सहायक चाय बनाने वाला, परोसने वाला, (सर्विस मैन), बैरा, वेटर, भंडारवाला, फिटर (सहायक अर्द्धकुशल), जमादार (अर्द्धकुशल), पम्प अटेंडेंट, डांडी फराश, सहायक (लोको, क्रेन/ट्रक), खलासी, नाव वाला, मसालची, तोपकार (बड़े पत्थर तोड़नेवाला) या अन्य कोई भी प्रवर्ग जो कि अर्द्धकुशल प्र—ति के हों जिनमें कार्य अनुभव/प्रशिक्षण के आधार पर कुछ कुशलता या क्षमता की आवश्यकता होती है और जो कुशल कर्मचारी के पर्यवेक्षण/मार्गदर्शन में किया जा सकता है, चाहे वे किसी भी नाम से पुकारे जाय। (iii) वैसा अकुशल कामगार जिन्होंने पाँच या पाँच वर्षों से अधिक का कार्य अनुभव प्राप्त किया हो। (iv) वैसा NSQF संबद्ध कौशल प्रशिक्षित कामगार जिनके प्रमाणीकरण पर स्तर (Level) 2 अथवा स्तर (Level) 3 अंकित हो।

एस0 ओ0 67, एस0 ओ0 66, दिनांक 12 मार्च 2019 का अंग्रेजी में निम्नलिखित अनुवाद बिहार राज्य के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारत संविधान के अनुच्छेद 348 के खंड (3) के अधीन प्राधिकृत पाठ समझा जायेगा।

S.O. 66, dated 12th march 2019— The following draft of proposal is to revise the minimum rates of wages fixed by the State Government in semi-skilled category of employees employed in the following Employment in the State of Bihar, which the Governor of Bihar proposes to make in exercise of powers conferred by clause (a) of sub-section (1) of section 3 of the said Act and is hereby published as required by clause (b) of sub-section (1) of section-5 of the said Act for the information to persons likely to be affected thereby and notice is hereby given that the said proposal will be taken into consideration after two months from the date of publication of this notification in the Gazette of Bihar. Any objection or suggestion which may be received from any person in respect of the said proposal on or before the date of expiry of the said period of two months shall be considered by the State Government.

Note :- (a) The difference between minimum wage for unskilled and semi-skilled worker is very low and at present the difference is only `10/-.
(b) The basis of revising minimum wage of semi-skilled category is to keep the wage between the average wage of unskilled & skilled category of worker or to keep it at average of minimum wages applicable for Unskilled & Skilled category at the time of notification.
(c) Conversion of the monthly rate of wages into daily rates of wages and vice-versa shall be worked out by dividing the monthly rates by 26 or by multiplying the daily rates by 26.
(d) The proposed rates of minimum wages above include of the remuneration payable to the employee in respect of the day of rest in every period of seven days.
4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 माच(cid:24) 2019(e) An employee shall for the work done on the weekly day of rest be entitled to overtime payment as the rate prescribed in rule 25 of the Bihar Minimum Wages Rule, 1951.
(f) Men and women workers shall get the same rates of wages for the same work or a similar nature.
Note :- Semi-skilled category means –
(i) The worker working as semi-skilled worker in the above mentioned sales promotion employments.
(ii) Bhisti (with Mushk), Boatman (Head), Breaker (stone, rock, rock stone, stone, metal), Cane weaver, Charpoy-Stringer, Security Guard (with out arms), Daftri, Fireman, Fireman (brick kiln, steam road roller), Gatekeeper, Helper (artisan), Helper (Sawyer), Labourer (Rock-cutting), Fitter Gang, Khalasi, Turner, Labourer (heavy weight), Night Guard, Assistant Tea Maker, Service man, Waiter, Bhandarwala, Fitter (Assistant Semi-skilled), Jamadar (Semi-Skilled), Pump attendant, Dandi Frash, Helper (loco, crane/truck), Boat man, Masalchi, Topkar (big stone breaker) or any other worker by whatever name so called and the execution of work require some skill or capacity, acquired either through experience or some training and which is done under the supervision of skilled worker. (iii) Such unskilled worker who has a work experience of five or more years. (iv) Such worker who has done NSQF allied training and Level 2 or Level 3 is marked on his/her certificate.
