सं॰ 02/विविध-09/2019-5834/परि॰—केन्द्रीय मोटरवाहन नियमावली, 1989 के अन्तर्गत निर्गत भारत सरकार की अधिसूचना संख्या-1183 (अ), दिनांक 29.12.2016 के नियम-32 एवं 81 के परन्तुक द्वारा राज्य सरकार को प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार मोटर गाड़ी नियमावली, 1992 में निम्नलिखित संशोधन करना चाहते हैं, जिसका निम्नलिखित प्रारुप एतद्‌ द्वारा मोटरयान अधिनियम, 1988 की धारा-212 के अध्यापेक्षाओं की पूर्ति हेतु प्रकाशित किया जाता है और उक्त प्रारुप के संबंध में आपाियाँ और सुझाव आमंत्रित करते हुए, उसके द्वारा प्रभावित होने वाले व्यक्तियों की जानकारी के लिए, इसके द्वारा सूचना दी जाती है कि उक्त प्रारुप प्रकाशन की तिथि से 15 दिनों तक परिवहन विभागीय वेबसाईट transport.bih.nic.in पर उपलब्ध रहेगा। तदोपरान्त प्राप्त आपत्ति/सुझाव के आलोक में सम्यक्‌ विचारोपरान्त निर्णय लिया जायेगा।

संषोधन प्रारूप

मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59, 1988) की धारा 211 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय मोटरवाहन नियमावली, 1989 के अन्तर्गत निर्गत भारत सरकार की अधिसूचना संख्या-1183 (अ), दिनांक 29.12.2016 के नियम-32 एवं 81 के परन्तुक में निम्नलिखित संशोधन करते हैं, जिसका उक्त अधिनियम की धारा-212 के अधीन अपेक्षित पूर्व प्रकाशन अधिसूचना संख्या- .............., दिनांक ....................... द्वारा किया जा चुका है। 1. संक्षिप्त नाम, विस्तार और आरंभ ।- (1) बिहार मोटरगाड़ी (संशोधन) नियमावली, 2019 । (2) यह अधिसूचना बिहार राजपत्र में इसके प्रकाशन की तिथि से प्रवृा होगी । (3) इसका विस्तार संपूर्ण बिहार राज्य में होगा।

2. बिहार मोटरगाड़ी नियमावली, 1992 के नियम-14 में उपनियम-3, नियम-6 में एक उपनियम-10, नियम-44 में एक उपनियम-11 एवं नियम-54 में एक उपनियम-5 निम्न रुप से अंतःस्थापित किया जाता है :-

ॢबह(cid:4)र गजट (cid:24)[स(cid:4)ध(cid:4)रण(cid:26)! 24 जुलाई 2019 ''14 (3) चालक अनुज्ञप्ति को संबंधित वाहन चालक द्वारा उपलब्ध कराये गये पते पर निबंधित डाक/स्पीड पोस्ट से विभाग द्वारा भेजा जायेगा, जिसके साथ नियम-6 अन्तर्गत विहित शुल्क देय होगा, परन्तु यदि संबंधित वाहन चालक द्वारा उपलब्ध कराये गये पते पर निबंधित डाक/स्पीड पोस्ट से भेजा गया चालक अनुज्ञप्ति यदि पता अधूरा रहने या पता सही नहीं रहने या अन्य किसी भी कारण के आधार पर विभाग में वापस आता है तो पता सही नहीं रहने पर चालक अनुज्ञप्ति में पता परिवर्तन कराना होगा एवं पता में परिवर्तन हेतु निर्धारित फीस एवं इस हेतु नियम-6 में विहित फीस पुनः देय होगी।'' ''6 (10) नियम-14 के उपनियम-3 के अधीन चालक अनुज्ञप्ति (स्मार्ट कार्ड सहित) के डाक से वितरण हेतु प्रत्येक चालक अनुज्ञप्ति (स्मार्ट कार्ड सहित) के डाक खर्च हेतु ` 50/- (पचास रुपये) ।'' ''54 (5) निबंधन प्रमाण-पत्र (RC) को संबंधित वाहन स्वामी द्वारा उपलब्ध कराये गये पते पर निबंधित डाक/स्पीड पोस्ट से विभाग द्वारा भेजा जायेगा। जिसके साथ नियम-44 के उपनियम-(11) के अन्तर्गत विहित शुल्क देय होगा, परन्तु यदि संबंधित वाहन स्वामी द्वारा उपलब्ध कराये गये पते पर निबंधित डाक/स्पीड पोस्ट से भेजा गया निबंधन प्रमाण-पत्र (RC) यदि पता अधूरा रहने या पता सही नहीं रहने या अन्य किसी भी कारण के आधार पर विभाग में वापस आता है, तो पता सही नहीं रहने पर निबंधन प्रमाण-पत्र (RC) में पता परिवर्तन कराना होगा एवं पता में परिवर्तन हेतु निर्धारित फीस एवं इस हेतु नियम-44 के उपनियम-(11) में विहित फीस पुनः देय होगी।''

''44 (11) नियम-54 के उपनियम-5 के अधीन निबंधन प्रमाण-पत्र (RC) (स्मार्ट कार्ड सहित) के डाक से वितरण हेतु प्रत्येक निबंधन प्रमाण-पत्र (RC) (स्मार्ट कार्ड सहित) के डाक खर्च हेतु- 50/- रुपये (पचास रुपये) ।

यह शुल्क चालक अनुज्ञप्ति/निबंधन प्रमाण-पत्र की द्वितीयक प्रति, नवीकृत चालक अनुज्ञप्ति एवं अन्य वैसे सभी मामले जिसमें नये सिरे से स्मार्ट कार्ड निर्गत किया जाना हो, पर भी लागू होगा।''

The 24th July 2019 No. 02/विविध-09/2019-5834/परि॰—In exercise of the power given to the State Government by the proviso of rule-32 and 81 of CMV rule, 1989 which has been amended through notification no.-1183 (A), dated-29-12-2016 of the Ministry of Road Transport and Highways, Government of India, the Governor of Bihar pleased to make following amendment in the Bihar Motor Vehicle Rule, 1992 (as amended from time to time) by the following draft which is hereby published for the information of the persons to be affected by it as required by section 212 of the MV Act, 1988 and it is hereby given notice that the said draft will be available on the website of Transport Department transport.bih.nic.in for 30 days for inviting objections and suggestions related to the said draft. Final decision shall be taken after considering objections/saggestions received on the said draft.

Draft of Notification In exercise of the powers conferred by sec-211 of the Motor Vehicle Act 1988, (Act 59,1988) the Governor of Bihar is pleased to make the following amendment in The Bihar Motor Vehicle Rule, 1992 the Prior publication of which required under section 212 of the Act has been done through Notification No.- ......... dated ………....

1. Short name, extension & commencement.—(1) Bihar Motor Vehicle (Amendment) Rule, 2019.

(2) It shall come into force on the date of its final publication in the Bihar Gazette.

(3) It shall extend to the whole of State of Bihar.

2. One subrule-5 in rule-54, one subrule 11 in rule 44, one subrule-10 in rule-6 and one subrule-3 in rule-14 of Bihar Motor Vehicle Rule, 1992 is inserted in following way :-

''14 (3) Driving License shall be sent on the address provided by the concerned driver, through registered post/speed post, Fee shall be payeble for this under rule-6, but if the driving license sent through registered post/speed post returns back to the department owing to incomplete address or incorrect address or due to any other reason, then address specified in DL shall have to be changed and fee for change in address and the fee specified in rule-6 for this, shall be charged.'' ''6 (10) For the delivery through post, for every driving license (with smart card), 50 rupees postal cost as specified in subrule-3 of rule-14.''

''54 (5) Registration Certificate shall be delivered at the address provided by the owner of the vehicle, through registered post/ speed post fee specified under rule-44 shall be payable with this, but if the Registration Certificate send through registered post/speed post returns back to the department owing to incomplete address or incorrect address or due to any other reason, then address specified in Registration Certificate shall have to be changed and fee for change in address and the fee specified in rule-44 (11) for this, shall be charged.''

''44 (11) For the delivery through post, for every registration certificate (with smart card), 50 rupees as postal cost as specified in subrule-5 of rule-54. This fee shall be charged on the delivery of duplicate copy of driving license/registration certificate, renewed driving license and in all such cases in which new smart card has to be issued.''
