la0 02/ई0-परिवहन-06/2018-6272/परि॰—मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59, 1988) की धारा- 211 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार मोटरवाहन करारोपण अधिनियम, 1994 (समय-समय पर यथा संशोधित) के नियम-64 में संशोधन करना चाहते हैं, जिसका अधिनियम की धारा-212 द्वारा यथापेक्षित निम्नलिखित प्रारूप, एतद् द्वारा, उससे प्रभावित होने वाले व्यक्तियों के सूचनार्थ प्रकाशित किया जाता है और उसके द्वारा सूचना दी जाती है कि इस अधिसूचना के प्रकाशन से 30 दिनों तक परिवहन विभागीय वेबसाईट transport.bih.nic.in पर उपलब्ध रहेगा। तदोपरान्त प्राप्त आपत्ति/सुझाव के आलोक में सम्यक् विचारोपरान्त निर्णय लिया जायेगा।
संषोधन प्रारूप मोटरयान अधिनियम, 1988 (अधिनियम संख्या 59, 1988) की धारा 212 (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार मोटरगाड़ी नियमावली, 1992 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं, जिसका उक्त अधिनियम की धारा 212 के अधीन अपेक्षित पूर्व प्रकाशन अधिसूचना संख्या-................., दिनांक-....................... द्वारा किया जा चुका है।
1. संक्षिप्त नाम, विस्तार और आरंभ ।- (1) यह नियमावली बिहार मोटरगाड़ी (संशोधन) नियमावली, 2019 कही जा सकेगी । (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह अधिसूचना बिहार राजपत्र में इसके अंतिम प्रकाशन की तिथि से प्रवृा होगी ।
2. बिहार मोटरवाहन नियमावली, 1992 के नियम-64 को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-
''64 (1) निबंधन पदाधिकारी प्रत्येक मोटर वाहन को एक निबंधन चिन्ह एक सीरिज में आवंटित करेगा जिसका प्रारम्भ अधिनियम की धारा-41 की उप-धारा-(6) के अधीन आवंटित निबंधन चिन्ह राज्य कोड संख्या और वह निबंधन पदाधिकारी को समुनुदेशित एवं तत्पश्चात राज्य परिवहन आयुक्त द्वारा आवंटित वर्णाक्षर यदि कोई हो, से होगा परन्तु निबंधन पदाधिकारी नये वर्णाक्षर से कोई सीरिज तबतक प्रारम्भ नहीं करेगा, जबतक कि वह राज्य परिवहन आयुक्त की पूर्व अनुमति लिखित रुप में न प्राप्त कर ले।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 7 अग(cid:7)त 2019 (2) मोटर वाहन के निबंधन हेतु आवेदन प्राप्त होने पर निबंधन पदाधिकारी इस नियम के उप-नियम-(3) के अध्यधीन निबंधन चिन्ह का आवंटन, आवेदनों की प्राप्ति के क्रमानुसार करेगा। प्रत्येक आवेदन पर समनुदेशित निबंधन संख्या उसके ठीक पहले वाले आवेदन पर समनुदेशित निबंधन संख्या के बाद वाली संख्या होगी, परन्तु अधिमान निबंधन संख्या लेने वाले वाहन स्वामियों को निर्धारित प्रक्रिया एवं देय शुल्क पर अधिमान निबंधन संख्या आवंटित किया जा सकेगा।
(3) बिहार राज्य के अन्तर्गत मोटरवाहनों को आवंटित किये जाने वाले प्रत्येक निबंधन सिरीज के निम्नलिखित निबंधन संख्या को अधिमान (Fancy) निबंधन संख्या के रुप में चिन्हित किया जाता है एवं उसके सम्मुख अंकित न्यूनतम जमा राशि गैर परिवहन वाहनों एवं परिवहन वाहनों के लिए अलग- अलग निम्न तालिका द्वारा निर्धारित किया जाता है :- तालिका

(4) उपर्युक्त अधिमान निबंधन संख्या का आवंटन पारदर्शी तरीके से ऑनलाईन निलामी (ई0-निलामी) के माध्यम से की जायेगी।
(5)(क) ई-नीलामी में भाग लेने वाले वाहन स्वामियों को मात्र एक हजार रुपये पंजीकरण शुल्क जमा करना होगा जो Non-Refundable होगा एवं एक से अधिक अधिमान (Fancy) निबंधन संख्या के लिए अलग-अलग पंजीकरण शुल्क जमा करना होगा, जो इस हेतु निर्धारित शीर्ष/मद में जमा होगा। (ख) ई-निलामी में लगाई गई बोली की राशि संबंधित जिला परिवहन कार्यालय के बैंक खाते में ऑनलाईन अथवा बैंक ड्राफ्ट के माध्यम से विहित समय-सीमा के अन्दर जमा करना होगा। (6) ई-नीलामी के लिए एक पंजीकृत प्रतिभागी के भाग लेने पर अधिमान (Fancy) निबंधन संख्या आवंटित किया जा सकेगा। एक से अधिक प्रतिभागी होने पर नीलामी प्रक्रिया के क्रम में न्यूनतम निर्धारित राशि से बोली प्रारंभ होगी तथा दूसरे प्रतिभागी कम से कम 1000 के गुणक में उँची राशि की बोली लगा सकेंगे। यह प्रक्रिया सड़क परिवहन और राजमार्ग मंत्रालय, भारत सरकार के लिए NIC द्वारा बनाये गये सॉफ्टवेयर के माध्यम से होगी।
(7)(क) उच्चाम राशि की बोली लगाने वाले को H-1 घोषित किया जायेगा एवं उन्हें सात दिनों के अन्दर लगायी गयी बोली की संपूर्ण राशि जमा करनी होगी। तत्पश्चात उन्हें अधिमान (Fancy) निबंधन संख्या आवंटित होगा, जो अहस्तांतरणीय होगा तथा उनके स्वामित्व के वाहन में ही व्यवहृत हो सकेगा। साथ ही ई-नीलामी की तिथि से अधिकाम 90 दिनों के अन्दर संबंधित वाहन जिला परिवहन पदाधिकारी के समक्ष निबंधन हेतु प्रस्तुत करना होगा अन्यथा अधिमान (Fancy) निबंधन संख्या स्वतः रद्द हो जायेगा एवं इस हेतु जमा राशि जब्त कर ली जायेगी एवं H-2 को उक्त4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 7 अग(cid:7)त 2019 अधिमान (Fancy) निबंधन संख्या का आवंटन कर दिया जायेगा तथा H-2 द्वारा राशि नहीं जमा किये जाने की स्थिति में रद्द अधिमान (Fancy) निबंधन संख्या पुनः ई-नीलामी हेतु जारी कर दी जायेगी।
(ख) एक बार ई-निलामी हेतु जारी अधिमान (Fancy) निबंधन संख्या यदि निलामी में नहीं बिकती है, तो इस अधिमान (Fancy) निबंधन संख्या को अव्यवहृत एवं असमनुदेशित माना जायेगा, परन्तु इन्हें पुनः ई-निलामी हेतु जारी किया जा सकेगा।
(8) राज्य सरकार के स्वामित्व वाले वाहन को इस नियमावली की तालिका में कोई भी अव्यवहृत असमनुदेशित अधिमान (Fancy) निबंधन संख्या बिना किसी शुल्क के भुगतान समनुदेशित की जा सकेगी एवं इस हेतु ई-निलामी की प्रक्रिया शिथिल मानी जायेगी :
परन्तु विशेष परिस्थिति में राज्य सरकार के स्वामित्व वाले किसी वाहन के लिए सक्षम स्तर से प्राप्त अनुरोध के आलोक में ई-निलामी को शिथिल करते हुए राज्य परिवहन आयुक्त, बिहार के आदेश पर अधिमान (Fancy) निबंधन संख्या बिना किसी शुल्क के आवंटित की जा सकेगी। (9) मनपसंद निबंधन संख्या- चिन्हित अधिमान (Fancy) निबंधन संख्या के अतिरिक्त, सामान्य क्रम में आवंटित होने वाले चालू सिरीज के अन्तर्गत यदि कोई वाहन स्वामी उसी सिरीज के परन्तु क्रमानुसार आवंटित होने वाले निबंधन संख्या से भिन्न कोई मनपसंद निबंधन संख्या के लिए इच्छुक हो उन्हें इस नियमावली की तालिका के कंडिका-(e) के अनुरुप अतिरिक्त राशि जमा करने पर वह निबंधन संख्या आवंटित किया जा सकेगा एवं अग्रिम में लिये गये अधिमान (Fancy) निबंधन संख्या पर 30 दिनों के अन्दर वाहन का निबंधन कराना अनिवार्य होगा। इसके लिए पंजीकरण शुल्क देय नहीं होगा तथा इसके लिए नीलामी भी नहीं होगी।
(10) परिवहन विभाग विगत दस वर्षों के अव्यवहृत अधिमान (Fancy) संख्या को भी एकत्रित कर e- Auction हेतु शामिल कर सकेगी।
(11) किसी अधिमान निबंधन संख्या के समनुदेशन के लिए जमा की गयी राशि किसी भी दशा में वापस नहीं की जायेगी।
(12) किसी मोटरवाहन को एक बार समनुदेशित निबंधन चिन्ह किसी भी परिस्थिति में परिवर्तित नहीं की जायेगी।
(13) अधिमान (Fancy) निबंधन संख्या के e- Auction करने की विहित प्रक्रिया की विस्तृत सूचना परिवहन विभाग द्वारा अलग से भी प्रकाशित की जा सकेगी।
(14) (क) ई-नीलामी कार्यान्वयन में किसी प्रकार का व्यावधान परिलक्षित होने पर परिवहन विभाग द्वारा इसका निराकरण किया जायेगा।
(ख) ई-निलामी के उपर्युक्त नियमों में तथा तालिका में अंकित आधार शुल्क में विभाग द्वारा परिवर्धन, संशोधन, परिवर्तन अथवा रुपांतरण कर सकेगा
(ग) परिवहन विभाग बिना कोई कारण बताये ई-नीलामी की तिथि में परिवर्तन कर सकेगा, स्थगित कर सकेगा या रद्द कर सकेगा।
(घ) संक्षिप्त अंतराल, जब भी आवश्यक हो परिवहन विभाग द्वारा इसकी समीक्षा कर चिन्हित अधिमान (Fancy) निबंधन संख्या में परिवर्तन अथवा न्यूनतम जमा राशि में परिवर्तन किया जा सकेगा। (ङ) उपर्युक्त उपबंधों में अन्तर्विष्ट किसी बात के होते हुए भी पूर्व उपबंधों के अधीन किये गये कार्यों पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा।
(15) यदि उपर्युक्त उपबंध के निर्वचन के संबंध में कोई शंका उत्पन्न हो तो इस मामले में राज्य परिवहन आयुक्त, बिहार का विनिश्चिय विधि विभाग के परामर्श के पश्चात अंतिम होगा।''

Draft of Notification In exercise of the powers conferred by sec-211 of the Motor Vehicle Act 1988, (Act 59,1988) the Governor of Bihar is pleased to make the following amendment in The Bihar Motor Vehicle Rule, 1992 the Prior publication of which required under section 212 of the Act has been done through Notification No.- ......... dated ………....
1. Short name, extension & commencement.—(1) These Rule may be called the Bihar Motor Vehicle (Amendment) Rule 2019. (2) It shall extend to the whole of State of Bihar. (3) It shall come into force from the date of its final publication in the Bihar Gazette. 2. Rule 64 of Bihar Motor Vehicle Rule, 1992 shall be substituted by following :-
''64 (1) The registering authority shall allot to the vehicle a registration mark in series which shall begin with the registration mark allotted to the State under sub-Section (6) of Section 41 of the Act and shall be followed by State Code number assigned to the registering authority and then by the figure (alphabet), if any, allotted by the State Transport Commissioner, but the registering authority shall not start series in new alphabet until he had obtained prior written permission of the State Transport Commissioner.''
(2) The registering authority, on receipt of an application for registration of a motor vehicle, shall assign registration mark under sub-section (3) of State Rules in order of receipt of applications. The registration number to an application shall be next to the registration number alloted to an application but the fancy number could be alloted to the applicants by following established procedure and depositing due fee.
(3) Following registration numbers of every registration series which is allotted to the Motor Vehicles registered in the State of Bihar are being marked here as Fancy registration numbers and the base price for them are fixed separately for transport vehicles and non-transport vehicles in the following table :-

(4) Above fancy registration numbers shall be alloted through the online e-auction process in a transparent manner.
(5)(a) One thousand rupees (Rs. 1000) shall be deposited by the owners as registration fee for participating in e-auction, which shall be non-refundable and separate registration fees shall have to be deposited with application for more than one fancy numbers.
(b) The corresponding bid amount of the e-auction shall be deposited in the bank account of the respective District Transport Offices through online payment or bank draft within the stipulated time as outlined herein.
(6) Fancy Registration Number shall be allotted to the only registerd applicant if only one applicant participates. In case of participation of more than one applicant, bid shall be made in the multiple of Rs. 1000 by the other applicants. This process shall be carried out on the e-auction portal developed by NIC for the Ministry of Road Transport and Highways, Government of India.
(7)(a) The applicant with the maximum bid amount shall be adjudged as the successful bidder (H-1) and he shall have to deposit the entire amount of the bid within 7 days. Thereafter, the Fancy registration number shall be given to the successful bidder which shall be non-transferable and shall be used for the vehicle owned by the successful bidder only. Moreover, the successful bidder shall have to produce the vehicle for registration within 90 days from the date of e-auction, otherwise the Fancy Registration number shall be null and void itself and registration amount shall be forfeited and this fancy number shall be alloted to the H-2 bidder and if H-2 bidder fails to deposit the amount, this fancy number shall be available for another e-auction. (b) Any fancy number that remains un-auctioned after undergoing the first auction process shall be designated as 'unassigned fancy number' and shall be available for further e-auction.
(8) On the request made by the competent departmental authority, 'unassigned fancy numbers' could be allotted to the vehicles of the State Government without any base price.
Provided that under extraordinary circumstances, the State Transport Commissioner, Bihar may assign any fancy/choice number of series that is yet to be auctioned at no cost to government vehicles.
(9) Choice Registration Number - If any applicant applies for any registration number other than the registration number of the same series the same could be serial alloted to him after depositing additional amount by him as contained in clause-e of the table of this rule and it shall be mandatory to let the vehicle registered on the fancy registration number within 30 days. Process of bid and payment of registration fee shall not be necessary for this.
8 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 7 अग(cid:7)त 2019(10) Fancy Registration numbers, which are not allotted in last ten years could be enlisted and included in e-auction by the Transport Department.
(11) The fee deposited for assignment of preference of any registration number shall not be refunded in any case.
(12) The registration number once assigned to any motor vehicle shall not be changed under any circumstances.
(13) Detailed information about the process of e-auction for the allotment of fancy numbers will be published separately by the Transport Department. (14)(a) If any issue arises in the execution of the process of e-auction, it shall be resolved by the Transport Department.
(b) Transport Department shall be able to enlarge, amend, change and transform the above rules of e-auction and the base price specified in the table.
(c) Transport Department shall be able to change, adjourn and cancel the date of e-auction without specifying any reason.
(d) Whenever necessary, in short period, after its examination, the marked fancy numbers and their base price could be changed by the Transport Department. (e) Notwithstanding anything contained in this rule, the work done on the basis of repealled regulation, shall be deemed as status quo, as it is still in existence.
(15) If any confusion arises about the interpretation of any clause of this rule then decision made by the State Transport Commissioner, Bihar after consultation of the Law Department, Bihar shall be final."
