सं॰ 11/न॰वि॰/मा॰प्लान(आ॰क्षे॰)-22/2016-1165-न॰वि॰आ॰वि॰—बिहार भवन उपविधि, 2014 के उपविधि-1(2)(v)(vi) में उपबंधित के अनुरूप राज्य सरकार एतद्द्वारा दरभंगा आयोजना क्षेत्र के अन्तर्गत ग्राम पंचायत क्षेत्रों में भवन सम्बन्धी क्रियाकलापों को विनियमित करने के उद्देश्य से बिहार भवन उपविधि, 2014 का कार्यान्वयन अधिसूचित करती है।
2. दरभंगा आयोजना क्षेत्र प्राधिकार के मुख्य कार्यपालक पदाधिकारी इन ग्रामीण क्षेत्रों में भवन/लेआउट योजना के नक्शे की स्वी—ति हेतु सक्षम प्राधिकार होंगे।
3. इन क्षेत्रों में भवन योजना/लेआउट योजना के नक्शे की स्वी—ति हेतु आवेदन दरभंगा आयोजना क्षेत्र प्राधिकार के कार्यालय में प्राप्त किये जायेंगे।
4. मुख्य कार्यपालक पदाधिकारी योजना की स्वी—ति के पूर्व आवश्यक जाँच/सत्यापन करेंगे एवं संतुष्ट हो लेंगे कि आवेदित योजना बिहार भवन उपविधि-2014, बिहार शहरी आयोजना तथा विकास अधिनियम, 2012 एवं बिहार शहरी आयोजना तथा विकास नियमावली, 2014 के प्रावधानों के अनुरूप है।
5. मुख्य कार्यपालक पदाधिकारी सम्यक सत्यापन एवं जाँच की प्रक्रिया पूर्ण करने के उपरान्त भवन/लेआउट योजना के नक्शे को स्वी—ति प्रदान करेंगे।
6. यह अधिसूचना तुरत प्रवृा होगी। 7. दरभंगा आयोजना क्षेत्र प्राधिकार में शामिल शहरी क्षेत्र में भवन/लेआउट योजना के नक्शे की स्वी—ति हेतु बिहार भवन उपविधि, 2014 पूर्व से प्रभावी है। इन शहरी क्षेत्रों में नक्शाें की स्वी—ति हेतु सम्बन्धित मुख्य नगरपालिका पदाधिकारी पूर्ववत् सक्षम प्राधिकार रहेंगे। 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 13131313 अगःतअगःतअगःतअगःत 2019201920192019 The 8th August 2019 No. 11/न॰वि॰/मा॰प्लान(आ॰क्षे॰)-22/2016-1165-UD&HD—In accordance with the provisions made in Bye Laws, 2014 No.-1(2)(v)(vi) of Bihar Building Bye Laws, 2014, the State Government, for the purpose of regulation of building construction activities in the Gram Panchyat Area(s) of Darbhanga Planning Area, do hereby, notify implementation of Bihar Building Bye Laws, 2014.
2. The Chief Executive Officer of Darbhanga Planning Area Authority shall be the Competent Authority for sanctioning of Building/Layout Plans in theses rural areas.
3. The application for Building/Layout Plan in these area shall be received in the office of Darbhanga Planning Area Authority.
4. Before sanctioning of Plan, the Chief Executive Officer, shall do required verification/ inspection and satisfy himself that the applied plan is in accordance with the provisions made in Bihar Building Bye Laws-2014, Bihar Urban Planning and Development Act, 2012 and Bihar Urban Planning and Development Rules, 2014.
5. After due verification and completing the process of enquiry, the Chief Executive Officer shall sanction the Building/Layout Plan.
6. This notification shall come into force at once. 7. Bihar Building Bye Laws, 2014 is already effective for sanctioning of Building/Layout Plan in Urban Area(s) of Darbhanga Planning Area Authority. For sanctioning of plan(s) in these urban area(s) concerned Chief Municipal Officer shall remain Competent Authority as earlier.
