सं॰ 8@fofo/k&10&74@2017&6628@fofo/k&10&74@2017&6628@fofo/k&10&74@2017&6628@fofo/k&10&74@2017&6622222/गृ0आ0—भारत संविधान के अनुच्छेद 309 के परंतुक-सहपठित-बिहार पुलिस अधिनियम, 2007 की धारा 55 एवं धारा-97 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल 'बिहार पुलिस चालक संवर्ग नियमावली, 2017' में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम एवं प्रारम्भ।-

(1) यह नियमावली 'बिहार पुलिस चालक संवर्ग (संशोधन) नियमावली, 2019' कही जायेगी। (2) यह संपूर्ण बिहार राज्य में लागू होगी। (3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत्त होगी।

2. 'बिहार पुलिस चालक संवर्ग नियमावली, 2017' के नियम-6 के उपनियम-(2) के खंड (iv) के अंतिम वाक्य के स्थान पर निम्नलिखित एक नया खंड (v) प्रतिस्थापित किया जायेगाः-

"(v) उपर्युक्त नियम, 6 के उप नियम (2) के खंड (ii) (क) एवं (ii) (ख) में अर्हक अंक न्यूनतम 08 (आठ) होंगे तथा खंड (ii) (ग) में उल्लेखित जाँच अनिवार्य नहीं होगा। इसमें भारी मोटरवाहन (HMV) चालन अनुज्ञप्तिधारी ही भाग ले सकेंगे। प्राप्त अंक अभ्यर्थी के मेधा अंक में जोड़े जाएँगे। उप नियम (2) के खंड (iii) एवं (iv) में वर्णित प्रत्येक जाँच में न्यूनतम 6 अंक प्राप्त नहीं करने वाले अभ्यर्थी असफल घोषित होंगे। उपर्युक्त उप नियम (2) के खंड (ii) (ग) को छोड़कर सभी जाँचों में न्यूनतम अर्हक अंक प्राप्त करना अनिवार्य होगा।"

3. 'बिहार पुलिस चालक संवर्ग नियमावली, 2017' के नियम, 7 का उप नियम (1) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः-

''(1)(i) अंतिम रूप से सफल अभ्यर्थियों की मेधा सूची वाहन चालन दक्षता परीक्षा में प्राप्त अंकों के आधार पर रिक्तियों के अनुरूप आरक्षण कोटि वार तैयार की जायेगी :

परंतु बिहार पुलिस संगठन में चालक सिपाही के पद पर पूर्व में अथवा पूर्व से संविदा नियोजित अभ्यर्थियों को उनकी वास्तविक संविदा नियोजन अवधि के आधार पर प्रति पूर्ण वर्ष के लिए 5 अंकों, अधिकतम 25 अंकों, की अधिमानता दी जा सकेगी।

(ii) वाहन चालन दक्षता परीक्षा में प्राप्त अंकों को 0.75 से गुणा कर उसमें संविदा नियोजन अवधि के लिए अधिमानता के आधार पर प्राप्त अंको के योग के आधार पर मेधा सूची का निर्माण किया जा सकेगा। उदाहरण के लिए, यदि किसी अभ्यर्थी को वाहन चालन दक्षता परीक्षा में 95 अंक प्राप्त होते हैं और संविदा नियोजन अवधि के आधार पर 25 अंक प्राप्त होते हैं, तो अंकों की गणना निम्न प्रकार होगी-

वाहन चालन दक्षता परीक्षा में प्राप्त अंक - 95 x 0.75 = 71.25

संविदा नियोजन अवधि के लिए अधिमानता अंक - 25 = 25 कुल अंक = 96.25

परंतु यदि किसी अभ्यर्थी को संविदा नियोजन अवधि के लिए अधिमानता प्राप्त नहीं हो और उसे वाहन चालन दक्षता परीक्षा में 95 अंक प्राप्त हो, तो उसे 95 x 0.75 = 71.25 अंक प्राप्त होंगे।''

4. 'बिहार पुलिस चालक संवर्ग नियमावली, 2017' का नियम, 10 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-

"10. उम्र।-अभ्यर्थियों की उम्र सीमा निम्नवत्‌ होगीः-

(क) सामान्य कोटि के लिए न्यूनतम 20 वर्ष और अधिकतम 25 वर्ष ; (ख) पिछड़ा वर्ग कोटि एवं अत्यन्त पिछड़ा वर्ग कोटि के पुरुषों के लिए न्यूनतम 20 वर्ष और अधिकतम 27 वर्ष ;

(ग) पिछड़ा वर्ग कोटि एवं अत्यन्त पिछड़ा वर्ग कोटि के महिलाओं के लिए न्यूनतम 20 वर्ष और अधिकतम 28 वर्ष ;

(घ) अनुसूचित जाति एवं अनुसूचित जनजाति कोटि के पुरूषों एवं महिलाआें के लिए न्यूनतम 20 वर्ष और अधिकतम 30 वर्ष :

परंतु बिहार पुलिस संगठन में चालक सिपाही के पद पर पूर्व में अथवा पूर्व से संविदा नियोजित अभ्यर्थियों को अधिकतम उम्र सीमा में संविदा नियोजन की अवधि तक की छूट दी जा सकेगी।''

5. बिहार पुलिस चालक संवर्ग नियमावली, 2017' के नियम, 16 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-

"16. कालावधि।-चालक संवर्ग में उच्चतर पदों पर प्रोन्नति हेतु राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, अवधारित वेतनमान आधारित कालावधि के प्रावधान लागू होंगे।"बिहार-राज्यपाल के आदेश से, रंजन कुमार सिन्हा, सरकार के अपर सचिव। ——— 14 vxLr 2019

No. 8/Misc.-10-74/2017-6622/ H.D— In exercise of power conferred under the proviso to Article-309 of the Constitution of India read with Section-55 and Section 97 of Bihar Police Act, 2007, the Governor of Bihar is hereby pleased to make the following Rules to make amendment in 'Bihar Police Driver Cadre Rules, 2017':-

1. Short title, extent and commencement.—

(1) These Rules shall be called the "Bihar Police Driver Cadre (Amendment) Rules, 2019".

(2) It extent to whole State of Bihar. (3) It shall come into force from the date of its publication in the official Gazette.

2. In Place of last sentence of clause (iv) Sub Rule- (2) of Rule-6 of Bihar Police Driver

Cadre Rules, 2017 following a new clause (v) shall be substituted:—

"(v). In aforesaid clauses (ii) (a) and (ii) (b) of sub rule (2) of Rule-6 minimum qualifying marks shall be 08 (eight) and test mentioned in clause (ii)(c) shall not be compulsory. Only Drivers, having Heavy Motor Vehicle (HMV) driving license can appear for this. Marks obtained shall be added in the merit list of the candidate. Candidate, who doesn't obtain minimum 06 (six) marks in each test mentioned in clause (iii) and (iv) of sub rule (2) shall be disqualified. Obtaining minimum qualifying marks in each test except mentioned in above clause (ii) of sub Rule- (2) shall be compulsory."

3. Sub rule (1) Rule, 7 of 'Bihar Police Driver Cadre Rules, 2017' shall be replaced by the

following.—

"(1) (i) Merit list of finally successful candidates shall be prepared, reservation category-wise, on the basis of marks obtained in motor driving efficiency test according to vacancy.

Provided, weightage of 5 marks for each completed year, maximum 25 marks, may be given to the candidates working or have worked on contract on the post of Driver constable in Bihar Police organization.

(ii) Merit list shall be prepared by multiplying with 0.75 in the marks obtained in motor driving efficiency test and adding the marks of weightage for contractual service period. For example,- if a candidate gets 95 marks in motor driving efficiency test and 25 marks as weightage for contractual service period, his total marks shall be calculated as following:-

Marks obtained in motor driving efficiency test - 95 x 0.75 = 71.25 Weightage marks for contractual service period - 25 = 25 = 96.25

Provided, if a candidate has no mark for contractual service period and get 95 marks in motor driving efficiency test, he shall get 95 x 0.75 = 71.25 marks."

4. Rule-10 of 'Bihar Police Driver Cadre Rules, 2017' shall be substituted by the

following:—

"10. Age.-Age limit for the candidate shall be as follows:—

"Provided, candidate who has worked or is working on contract on the post of driver constable in Bihar Police Organization may be given age relaxation in maximum age, up to the period of his contractual service."4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 14 अग(cid:8)त 2019

5. Rule-16 of 'Bihar Police Driver Cadre Rules, 2017' shall be substituted by the

following:-

"16. Kalavadhi.- Provisions of pay scale based 'Kalavadhi', determined by State Government (General Administration Department) from time to time shall be apply in promotion to the higher post of Driver Cadre."
