laŒ 05/स्था0-01-19/2018&6302— भारत के संविधान के अनुच्छेद-309 के परंतुक सह-पठित मोटरयान अधिनियम, 1988 की धारा-213 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल ''बिहार परिवहन (तकनीकी) संवर्ग नियमावली, 2003'' में संषोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम, विस्तार और प्रारंभ ।- (1) यह नियमावली "बिहार परिवहन (तकनीकी) संवर्ग (संषोधन) नियमावली, 2019" कही जा सकेगी।

(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाशन की तिथि से प्रवृत होगी। 2. बिहार परिवहन (तकनीकी) संवर्ग नियमावली, 2003 के नियम 2(ग) का प्रतिस्थापन।- उक्त नियमावली, 2003 के नियम-2 का उपनियम (ग) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-

(ग) "आयोग" से अभिप्रेत है "बिहार लोक सेवा आयोग"A 3. बिहार परिवहन (तकनीकी) संवर्ग नियमावली, 2003 के नियम-4 का प्रतिस्थापन।- उक्त नियमावली, 2003 के नियम-4 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-

''(4) सीधी भर्ती ।- संवर्ग में सीधी भर्ती केवल मोटरयान निरीक्षक के पद पर बिहार लोक सेवा आयोग की अनुषंसा पर की जायगी" ।

4. बिहार परिवहन (तकनीकी) संवर्ग नियमावली, 2003 के नियम-5 का प्रतिस्थापन।- उक्त नियमावली, 2003 के नियम-5 निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा :-

या यांत्रिक इंजीनियरिंग में डिप्लोमा (तीन वर्षीय पाठ्‌यक्रम); और (iii) गियर वाली मोटर साईकिल और हल्के मोटरयान चलाने के लिए अधिकृत चालन अनुज्ञप्ति का धारण करना" ।

No.:-05/Astha-01-19/2018/6302—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India read with section 213 of the Motor Vehicles Act, 1988 the Governor of Bihar makes the following Rules to amend the Bihar Transport (Technical) Cadre Rules, 2003 :-

1. Short title, extension and commencement.—(1) These Rules may be called The Bihar transport (Technical) Cadre ( Amendment) Rules, 2019.

(2) It shall extend to the whole of State of Bihar. (3) It shall come into force from the date of its publication in the official gazette. 2. Substitution of Rule-2(c) of the said The Bihar Transport (Technical) Cadre Rules, 2003.- Sub rule (c) of Rule-2 of the said Rules, 2003 shall be substituted by the following :-

" (c) Commission" means "Bihar Public Service Commission." 3. Substitution of Rule-4 of the said The Bihar Transport (Technical) Cadre Rules, 2003.- Rule-4 of the said Rules, 2003 shall be substituted by the following .—

"(4) Direct Recruitment- Direct Recruitment in the Cadre shall be made on the post of motor vehicles inspector on the basis of recommendation of the Bihar Public Service Commission."

4. Substitution of Rule-5 of the said The Bihar Transport (Technical) Cadre Rules, 2003.- Rule-5 of the said. The Rules, 2003 shall be substituted by the following .—

"(5) Eligibility.—The Minimum eligibility criterion for candidate for direct recruitment in the cadre on the post of motor vehicles inspector shall be the following .—

(i) 10th standard pass from any recognized Board: and (ii) a Diploma in Automobile Engineering (three year course); or a Diploma in Mechanical Engineering (three year course), awarded by any institution recognized by the Central Government or State Government; and

(iii) holding a driving license authorizing to drive motor cycle with gear and light motor vehicles".
