सं॰ 11/एम(स्वा॰)-08/2018-831(11)—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार राज्यपाल स्वास्थ्य विभाग के अधीन, बिहार मलेरिया निरीक्षक संवर्ग नियमावली, 2015 एवं बिहार मलेरिया निरीक्षक संवर्ग (संशोधन) नियमावली, 2017 को निरसित करते हुए, निम्नलिखित नियमावली बनाते है :-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

(1) यह नियमावली "वेक्टर रोग नियंत्रण पदाधिकारी संवर्ग नियमावली, 2019" कही जा सकेगी । (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह इसके राजपत्र में प्रकाशन की तिथि से प्रवृत्त होगी।

2. परिभाषाएँ। - जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-

(i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; ( ii) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; ( iii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ( iv) 'नियुक्ति प्राधिकार' से अभिपे्रत है निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बिहार; (v) 'निदेशालय ' से अभिप्रेत है निदेशालय, स्वास्थ्य सेवाएँ, बिहार , ( vi) 'संवर्ग' से अभिपे्रत है वेक्टर रोग नियंत्रण पदाधिकारी संवर्ग; ( vii) 'रिक्ति वर्ष' से अभिप्रेत है 01 अपै्रल से 31 मार्च तक की अवधि; तथा ( viii) 'परिशिष्ट' से अभिपे्रत है इस नियमवली का परिशिष्ट ।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 (cid:6)सत(cid:9)बर 2019 3. संवर्ग का गठन।-

(1) वेक्टर रोग नियंत्रण पदाधिकारी संवर्ग राज्य स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा, समय-समय पर, अवधारित की जाय।

(2) पूर्व से मलेरिया निरीक्षक एवं वरीय मलेरिया निरीक्षक के पद पर कार्यरत कर्मी क्रमशः वेक्टर रोग नियंत्रण पदाधिकारी एवं अपर वेक्टर रोग नियंत्रण पदाधिकारी के रूप में पदनामित करते हुए इस संवर्ग में शामिल समझे जायेंगे और उनकी वरीयता अक्षुण्ण रहेगी।

(3) इस संवर्ग की विभिन्न कोटियाँ/पदसोपान निम्नवत्‌ होगीः-

नोटः-

उपर्युक्त सभी कोटि/पदसोपान का वेतन बैंड/ग्रेड-पे/पे-लेवल वही होगा जो सरकार द्वारा समय-समय पर, अवधारित किया जाय।,

4. भर्ती।- इस संवर्ग में नियुक्ति मूल कोटि (वेक्टर रोग नियंत्रण पदाधिकारी) के पद पर, आयोग की अनुशंसा के आधार पर, सीधी भर्ती से होगी।

5. अर्हताएँ ।-

(1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता किसी मान्यता प्राप्त विश्वविद्यालय से विज्ञान संकाय में स्नातक या इसके समकक्ष होगी।

(2) वेक्टर रोग नियंत्रण पदाधिकारी संवर्ग में सीधी भर्ती के लिए न्यूनतम आयुसीमा 21 वर्ष और अधिकतम आयुसीमा वही होगी जो सरकार द्वारा समय-समय पर आरक्षण कोटिवार विनिश्चित की जाय।

(3) संबंधित वर्ष की 1 ली अगस्त, उम्र के निर्धारणार्थ, कट ऑफ डेट मानी जायेगी।

6. भर्ती की प्रक्रिया। -

(1) नियुक्ति प्राधिकार, वर्ष की 1 ली अपै्रल की स्थिति के आधार पर रिक्ति की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को सामान्य प्रशासन विभाग के माध्यम से 30 अपै्रल तक भेजेगा।

(2) बिहार कर्मचारी चयन आयोग (परीक्षा संचालन) नियमावली, 2010 के प्रावधानों के अनुसार आयोग स्नातक स्तरीय प्रतियोगिता परीक्षा के लिए रिक्तियों में इन अधियाचित रिक्तियों में इन अधियाचित रिक्तियों को जोड़ेगा और तदनुसार इन अधियाचित रिक्तियों को भी विज्ञापित करेगा। परीक्षा की प्रक्रिया एवं पाठ्‌यक्रम का अवधारण आयोग द्वारा किया जायेगा।

(3) आयोग स्नातक स्तरीय संयुक्त प्रतियोगिता परीक्षा के परिणाम के आधार पर मेधासूची तैयार करेगा और मेधासूची तैयार करने के पश्चात नियुक्ति प्राधिकार के सहयोग से, प्रमाण-पत्रों की प्रारम्भिक जॉच एवं स्वास्थ्य जाँच करायेगा और तत्पश्चात अधियाचित रिक्तियों के अनुरूप, आरक्षण कोटिवार अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजेगा। नियुक्ति प्राधिकार के स्तर पर भी, प्रमाण पत्रों की जाँच एवं स्वास्थ्य जाँच के पश्चात अनुशंसित अभ्यर्थियों के पूर्ववृत्त का सत्यापन करा लिया जायेगा। पूर्ववृत्त का सत्यापन की कार्रवाई के क्रम में विहित प्रपत्र में अभ्यर्थियों से घोषणा पत्र ले लिया जायेगा।

(4) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा समय-समय पर निर्गत अनुदेशो का अनुपालन आवश्यक होगा।

7. परिवीक्षा अवधि ।- नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षो की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नही पाये जाने की दशा में, परिवीक्षा अवधि का विस्तार एक वर्ष के लिए गुण-दोष के आधार पर किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे वेक्टर रोग नियंत्रण पदाधिकारी को सेवामुक्त कर सकेगा।

8. प्रशिक्षण ।- परिवीक्षा अवधि में वेक्टर रोग नियंत्रण पदाधिकारी को ऐसे प्रशिक्षण को सफलतापूर्वक पूर्ण करना होगा, जो विभाग द्वारा अवधारित किया जाय।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 12 (cid:20)सत(cid:22)बर 2019 9. विभागीय परीक्षा ।-

(1) वेक्टर रोग नियंत्रण पदाधिकारी को केन्द्रीय परीक्षा समिति, राजस्व पर्षद द्वारा आयोजित विभागीय परीक्षा उत्तीर्ण करनी होगी। विभागीय परीक्षा का पाठ्‌यक्रम राजस्वय पर्षद द्वारा विभाग के परामर्श से निर्धारित किया जायेगा।

(2) प्रथम वेतनवृद्धि के बाद अगली वेतनवृद्धि तभी मिलेगी जब विहित विभागीय परीक्षा उत्तीर्ण कर ली जाय।

10. सम्पुष्टि ।- परिवीक्षा अवधि में संतोषजनक सेवा होने, प्रशिक्षण सफलतापर्वक पूरा करने और विभागीय परीक्षा उत्तीर्ण करने पर वेक्टर रोग नियंत्रण पदाधिकारी को सेवा में संपुष्ट किया जा सकेगा।

11. वरीयता ।- वेक्टर रोग नियंत्रण पदाधिकारियों की आपसी वरीयता आयोग के द्वारा अनुशंसित मेधासूची के अनुसार अवधारित की जायेगी।

12. प्रोन्नति के सोपान ।-

(1) सेवा में सम्पुष्ट वेक्टर रोग नियंत्रण पदाधिकारियों को, रिक्तियो की उपलब्धता के अधीन रहते हुए, वरीयता-सह-योग्यता के अनुसार प्रोन्नति दिये जाने पर विचार किया जा सकेगा। (2) प्रोन्नति के लिए सरकार द्वारा समय-समय पर निर्गत 'कालावधि' संबंधी अनुदेश का अनुपालन आवश्यक होगा।

(3) सरकार द्वारा समय-समय पर निर्गत प्रोन्नति संबंधि और चारित्री या पी॰ ए॰ आर॰ संबंधी, आरोप, विभागीय कार्यवाही/आपराधिक कार्यवाही आदि संबंधी अनुदेशों का, प्रोन्नति पर विचार के समय, अनुपालन करना अपेक्षित होगा।

13. विभागीय प्रोन्नति समिति ।- प्रोन्नति विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर दी जा सकेंगी। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

14. आरक्षण ।- नियुक्ति एवं प्रोन्नति में सरकार के आरक्षण नियमों तथा आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

15. इस नियमावली के प्रवृत्त होने के पूर्व से नियुक्त/प्रोन्नत एवं कार्यरत मलेरिया निरीक्षक/वरीय मलेरिया निरीक्षक इस संवर्ग में स्वतः शामिल समझे जायेगे।

16. अवशिष्ट मामले ।- इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएॅ/नियमावली/संकल्प/ अनुदेश के प्रावधान लागू होंगे।

17. निर्वचन ।- यदि इस नियमावली के किसी उपबंध के निर्वचन में कोई कठिनाई उत्पन्न हो तो उसे विधि विभाग के परामर्श के पश्चात्‌ विभाग द्वारा विनिश्चित किया जायेगा और इस संबंध में विभाग का विनिश्चय अन्तिम होगा।

18. कठिनाई का निराकरण ।- यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण विधि विभाग और सामान्य प्रशासन विभाग के परामर्श के पश्चात, ऐसे सामान्य या विशेष आदेश, जो इस नियमावली के प्रावधानों से असंगत न हों, द्वारा किया जा सकेगा। 19. निरसन एवं व्यवृति ।-

(1) बिहार मलेरिया निरीक्षक संवर्ग नियमावली, 2015 तथा बिहार मलेरिया निरीक्षक संवर्ग (संशोधन) नियमावली, 2017 एतद्‌ द्वारा निरसित की जाती हैं।

(2) ऐसा निरसन के होते हुए भी उक्त नियमावलियों के अधीन लिया गया कोई निर्णय या की गई कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जाएगी मानो यह नियमावली उस तिथि को प्रवृत्त थी जिस तिथि को ऐसा कुछ किया गया था या ऐसी कोई कार्रवाई की गयी थी ।

No. 11/एम(स्वा॰)-08/2018-831(11)—In exercise of powers conferred by proviso to Article- 309 of the Constitution of India, the Governor of Bihar is pleased to make the following new Rules under the Health Department by repealing Bihar Malaria Inspector Cadre Rules, 2015 and Bihar Malaria Inspector Cadre (Amendment) Rules, 2017 :-

1. Short title, extent & commencement.—

(1) These Rules may be called as the "Vector Disease Control Officer Cadre Rules, 2019".

(2) It will extend to the whole State of Bihar. (3) It will come into force form the date of its publication in the official gazette.

2. Definitions.— In these Rules, unless otherwise required in the subject or

context .—

(i) 'Government' means State Government of Bihar; (ii) 'Department' means Health Department; (iii) 'Commission' means Bihar Staff Selection Commission; (iv) 'Appointing Authority' means Director-in-Chief, Health Services, Bihar;

(v) "Directorate" means Directorate, Health Services, Bihar; (vi) "Cadre" means the Vector Disease Control Officer Cadre ; (vii) "Vacancy Year" means the period from 1st April 31st March; and (viii) "Appendix" means appendix to these Rules.

3. Constitution of cadre.—

(1) The Vector Disease Control Officer Cadre shall be State level. In this cadre, number of posts in every category and total number of posts of the cadre shall be as many as are sanctioned by the Government, from time to time.

(2) The staff working on the posts of Pre-existing Malaria Inspector and Senior Malaria Inspector shall be deemed to be included in this cadre by converting the name of post as Vector Disease Control Officer and Additional Vector Disease Control Officer respectively and their seniority will remain the same.

NOTE – The pay band, grade pay and pay level of all aforesaid

categories and chain of post shall be such as may be determined

by the Government, from time to time.

4. Recruitment.—Appointment in this cadre shall be by direct recruitment to the post of basic category (Vector Disease Control Officer) on the basis of recommendation of the Commission.

5. Qualifications.—

(1) For appointment by direct recruitment to the post of basic category, minimum educational qualification shall be Graduate in Science or its equivalent faculty from any recognised university.

(2) For direct recruitment in the Vector Disease Control Officer Cadre, minimum age-limit shall be 21 years and maximum age- limit shall be the same as may be determined reservation category-wise by the Government, from time to time.

(3) 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

6. Procedure of Recruitment.—

(1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared shall send reservation category-wise requisition to the Commission through the General Administration Department latest by 30th April.

(2) The Commission shall add these requisitioned vacancies in the vacancies for Graduate Level Competitive Examination according to Bihar Staff Selection Commission (Conduct of Examination) Rules, 2010 and accordingly advertise these requisitioned vacancies also. The Commission shall determine the procedure and syllabus of Examination.

(3) The Commission shall prepare the merit list on the basis of result of the Graduate Level Combined Competitive Examination and after preparation of merit list, shall cause preliminary scrutiny of the Certificates and medical check-up with the co-operation of the Appointing Authority, and thereafter shall send reservation category-wise final recommendation in accordance with the requisitioned vacancies to the Appointing Authority. At the level of the Appointing Authority also, antecedents of candidates shall be caused to be verified after scrutiny of certificates and medical check-up. In course of verification of authority a declaration in the prescribed form shall be obtained from the candidates.

(4) After recommendation of the Commission, compliance of instructions issued by the Government, from time to time, with respect to procedure of appointment, shall be necessary.

7. Probation period.—After appointment, the candidates will be on probation. Probation period will be of two years. In case of the service not found satisfactory during probation period, the probation period may be extended on the basis of merit for one year. If the service is not found satisfactory in extended period also, then the Appointing Authority may terminate the service of such Vector Disease Control Officer.

8. Training.—During probation period, the probationer Vector Disease Control Officer shall have to successfully complete such training as may be determined by the Department.

9. Departmental Examination.—

(1) The Vector Disease Control Officer shall have to pass the departmental examination held by Central Examination Council, Board of Revenue. The syllabus of departmental examination will be determined by the Board of Revenue with consultation of Department.

(2) Further increment after the first increment will be admissible only after passing the prescribed departmental examination.

10. Confirmation.—On being satisfactory service in the probation period, successful completion of training and passing of departmental examination, an Vector Disease Control Officer may be confirmed in the service.

11. Seniority.— The inter-se seniority of Vector Disease Control Officer shall be determined according to the merit list prepared by the Commission.

12. Chains of Promotion.—

(1) Subject to availability of vacancy, confirmed Vector Disease Control Officer may be considered to be promoted according to the seniority-cum-merit.

(2) For promotion, compliance of instructions with respect to "KALAWADHI' issued by the Government, from time to time , shall be necessary.

(3) Compliance of instructions issued by the Government, from time to time, with respect to promotion and Character Roll/P.A.R., allegation/departmental proceedings/ criminal proceedings etc., shall be required at the time of consideration of promotion.

13. Departmental Promotion Committee.— Promotions may be given on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department. 14. Reservation.— It shall be necessary to comply the Rules of Reservation of the Government and reservation roster in recruitment and promotion.

15. The personnel already appointed/promoted and working on the posts of Malaria Inspector/Senior Malaria Inspector before coming into force of these Rules shall be deemed to be automatically included in this cadre.

16. Residue matters.—The subjects for which provisions have not been made in these Rules, the provisions of concerned Codes/Rules/ Resolutions/ Instructions of the Government shall apply.

17. Interpretation.— If any difficulty arises with respect to the interpretation of any provision of these Rules, it shall be determined by the Department in consultation with the Law Department and in this respect decision of the Department shall be final.

18. Removal of Difficulties.— If any difficulty arises in implementation of provisions of these Rules, the Department may remove such difficulty by general or special order which is not inconsistent with the provisions of these Rules after consultation with the Law Department and General Administration Department.

19. Repeal & Savings.—

(1) The Bihar Malaria Inspector Cadre Rules, 2015 and Bihar Malaria Inspector Cadre (Amendment) Rules, 2017 are hereby repealed. (2) Not with standing such repeal, any decision taken or any action taken under the said Rules shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such a thing was done or such an action was taken.
