सं॰ 01/चौ0-90-16/2016-गृ0आ0/8229—भारत-संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल एतद् द्वारा बिहार चौकीदार संवर्ग नियमावली 2006 (समय-समय पर यथा संशोधित) का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
(1) संक्षिप्त नाम विस्तार एवं प्रारम्भ।-
(I) यह नियमावली ''बिहार चौकीदार संवर्ग (संशोधन)नियमावली, 2019'' कही जा सकेगी। (II) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (III) यह तुरंत प्रवृत्त होगी।
(2) बिहार चौकीदार संवर्ग नियमावली, 2006 (समय-समय पर यथा संशोधित) के नियम-5 के उपनियम-(7) के परंतुक के पश्चात् दो नये उपनियम, क्रमशः (8) एवं (9), निम्नवत् जोड़े जायेंगे, यथा :-
''(8). परिचालनात्मक नियंत्रण।-इस संवर्ग के सदस्यों पर परिचालनात्मक (Operational) नियंत्रण संबंधित जिला के वरीय पुलिस अधीक्षक/पुलिस अधीक्षक का होगा। संबंधित जिला के वरीय पुलिस अधीक्षक/पुलिस अधीक्षक इनके वेतनादि का भुगतान करेंगे, जिसके लिए उन्हें आवंटन उपलब्ध कराया जाएगा। इस हेतु अलग बजट शीर्ष सृजित किया जायेगा।
(9). अनुशासन।-कदाचार, अक्षमता अथवा कर्त्तव्य की अवहेलना आदि कारणों से नियुक्ति प्राधिकार द्वारा संवर्ग के कर्मियों के विरूद्ध बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 (समय-समय पर यथा संशोधित) के प्रावधानो के तहत अनुशासनिक कार्रवाई की जा सकेगी;
परंतु किसी पुलिस जिला में पदस्थापित इस संवर्ग के सदस्यों के विरूद्ध संबंधित पुलिस जिले के वरीय पुलिस अधीक्षक/पुलिस अधीक्षक द्वारा आवश्यकतानुसार निलंबन अथवा लघु दंड हेतु अनुशासनिक कार्रवाई की जा सकेगी।'' 2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 1111 अ(cid:27)टूअ(cid:27)टूअ(cid:27)टूअ(cid:27)टू बरबरबरबर 2019201920192019 1 अक्टूबर 2019 सं0 01/चौ0-90-16/2016 गृ0आ0-8230 अधिसूचना सं0 8229 दिनांक 01.10.2019 का निम्नलिखित अंग्रेजी अनुवाद बिहार राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है जो भारत-संविधान के अनुच्छेद-348 के खण्ड-(3) के अधीन अंग्रेजी भाषा में उक्त अधिसूचना का प्राधिकृत पाठ समझा जायेगा।

No. 01/chau-90-16/2016H.P-8229—In exercise of the powers conferred under Proviso to Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to amend the 'Bihar Chaukidar Cadre Rules. 2006 (as amended from time to time):-
1. Short title, extent and commencement.—
(1) These Rules may be called "The Bihar Chaukidar Cadre (Amendment) Rules, 2019 .
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force at once.
2. After the proviso of Sub Rule (7) of Rule-5 of the Bihar Chaukidar Cadre Rules, 2006 (as amended from time to time), two new Sub Rules, respectively (8) and (9), shall be added as follows:-
"(8) Operational Control.- Operational Control on the members of this cadre shall be of Senior Superintendent of Police/Superintendent of Police of concerned district. Senior Superintendent of Police/ Superintendent of Police of concerned district shall pay their salary etc, for which allotment shall be made available to them. For this purpose separate Budget-head shall be created.
(9) Discipline .- Disciplinary action against the members of the cadre for act of misconduct, inefficiency and incompetence etc. may be taken by the appointing authority under the provisions of Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time);
provided, that Senior Superintendent of Police/ Superintendent of Police of concerned Police district may initiate for suspension or disciplinary proceeding for minor punishment as required against the members of cadre posted in concerned police district.
