9/लि0सं0-10-01/2018.गृ0आ0/8631—भारत संविधान के अनुच्छेद 309 के परन्तुक के अधीन भारत संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार पुलिस के क्षेत्रीय लिपिकीय संवर्ग में भर्त्ती एवं सेवा शर्तों को प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार पुलिस के क्षेत्रीय लिपिकीय संवर्ग में भर्त्ती एवं सेवा शर्तों को प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल बिहार पुलिस के क्षेत्रीय लिपिकीय संवर्ग में भर्त्ती एवं सेवा शर्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः-

निम्नलिखित नियमावली बनाते हैंः-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

(i) यह नियमावली 'बिहार पुलिस क्षेत्रीय लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त) नियमावली, 2019' कही यह नियमावली 'बिहार पुलिस क्षेत्रीय लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त) नियमावली, 2019' कही यह नियमावली 'बिहार पुलिस क्षेत्रीय लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त) नियमावली, 2019' कही जा सकेगी।

(ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा।

2. परिभाषाएँ।- इस नियमावली में, जबतक कि संदर्भ से अन्यथा अपेक्षित नहीं हो -

(i) 'संवर्ग ' से अभिप्रेत है बिहार पुलिस क्षेत्रीय लिपिकीय संवर्ग;

'संवर्ग ' से अभिप्रेत है बिहार पुलिस क्षेत्रीय लिपिकीय संवर्ग;

(ii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग;

'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग;

(iii) 'नियुक्ति' प्राधिकार से अभिप

'नियुक्ति' प्राधिकार से अभिप्रेत है पुलिस महानिरीक्षक (मुख्यालय), बिहार, पटना;

(iv) 'नियत तिथि' से अभिप्रेत है इस नियमावली के प्रवृत होने की तिथि;

(vi) 'अनुकम्पा के आधार पर नियुक्ति' से अभिप्रेत है सेवाकाल में मृत सरकारी सेवकों के आश्रितों में 'अनुकम्पा के आधार पर नियुक्ति' से अभिप्रेत है सेवाकाल में मृत सरकारी सेवकों के आश्रितों में से किसी एक की प्रासंगिक परिपत्रों/अनुदेशों के अनुसार अनुकम्पा के आधार पर नियुक्ति। से किसी एक की प्रासंगिक परिपत्रों/अनुदेशों के अनुसार अनुकम्पा के आधार पर नियुक्ति। से किसी एक की प्रासंगिक परिपत्रों/अनुदेशों के अनुसार अनुकम्पा के आधार पर नियुक्ति।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 17171717 अ(cid:23)तूअ(cid:23)तूअ(cid:23)तूअ(cid:23)तूबरबरबरबर 2019201920192019 3. संवर्ग की संरचना।- लिपिकीय संवर्ग की संरचना निम्नानुसार होगी-

(आरक्षी शाखा) द्वारा समय-समय पर निर्धारित किया जायेगा।

5. भर्त्ती।-

(क) निम्नवर्गीय लिपिक का 85 प्रतिशत पद सीधी भर्त्ती से भरा जायेगा और 15 प्रतिशत पद पुलिस संगठन के क्षेत्रीय कार्यालयों के इण्टरमीडिएट योग्यताधारी सुयोग्य कार्यालय परिचारी/परिचारी (विशिष्ट) कर्मियों से प्रोन्नति द्वारा राज्य वरीयता-सह-योग्यता के आधार पर भरा जायेगा। सीधी भर्त्ती के 85 प्रतिशत पदों में से 10 प्रतिशत पद अनुकम्पा के आधार पर नियुक्ति के लिए आरक्षित रहेगा।

(ख) सीधी भर्तियाँ आयोग की अनुशंसा पर निम्नवर्गीय लिपिक की कोटि में की जायेंगी। (ग) नियुक्ति प्राधिकार प्रत्येक वर्ष 1ली अप्रैल की स्थिति के अनुसार रिक्तियों की गणना करेगा और 30 अप्रैल तक रिक्ति की सूचना पुलिस मुख्यालय को देगा।

(घ) सीधी भर्ती द्वारा निम्नवर्गीय लिपिक के भरे जाने वाले पदों पर नियुक्ति के लिए अभ्यर्थियों का चयन बिहार कर्मचारी चयन आयोग द्वारा प्रतियोगिता परीक्षा के माध्यम से किया जाएगा। आयोग को विहित प्रपत्र में एक अधियाचना भेजी जाएगी, जिसमें आरक्षण कोटिवार रिक्त पदों की संख्या की सूचना दी जाएगी।

(ड.) आयोग रिक्तियों को विज्ञापित करेगा और प्रतियोगिता परीक्षा के आधार पर सफल अभ्यर्थियों का चयन करने के बाद नियुक्ति प्राधिकार को मेधाक्रम में अभ्यर्थियों के नाम की अनुशंसा करेगा। (च) सम्यक छानबीन के बाद नियुक्ति प्राधिकार नियमानुसार अभ्यर्थी की नियुक्ति परिवीक्षा पर दो वर्षो के लिए करेगा।

6. अर्हता।-शैक्षणिक योग्यता-

(i) निम्न वर्गीय लिपिक के मूल पद पर भर्ती हेतु न्यूनतम शैक्षणिक अर्हता कम्प्यूटर संचालन एवं कम्प्यूटर टंकण ज्ञान के साथ इण्टरमीडिएट (102) परीक्षा या समकक्ष परीक्षा उत्तीर्ण होना अनिवार्य होगा।

(ii) भर्त्ती के लिए न्यूनतम उम्र सभी कोटि के लिए 18 वर्ष होगी और अधिकतम उम्र वही होगी जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित की जाय।

7. आरक्षण।-भर्त्ती एवं प्रोन्नति में, राज्य सरकार द्वारा समय-समय पर अधिसूचित आरक्षण/रोस्टर का अनुपालन आवश्यक होगा।

8. प्रोन्नति द्वारा भर्त्ती।-

(1) नियुक्ति प्राधिकार निम्नवर्गीय लिपिक के पद पर प्रोन्नति द्वारा नियुक्ति के लिए पुलिस संगठन के क्षेत्रीय कार्यालयों के इण्टरमीडिएट उत्तीर्ण तथा कम्प्यूटर संचालन एवं कम्प्यूटर टंकण ज्ञान रखने वाले सुयोग्य कार्यालय परिचारी/परिचारी (विशिष्ट) की वरीयता सूची तैयार करायेगा। (2) प्रोन्नति राज्य वरीयता-सह-योग्यता के अनुसार पुलिस महानिदेशक, बिहार द्वारा नामित पुलिस उप-महानिरीक्षक पंक्ति के पदाधिकारी की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा पर दी जायेगी।

9. परिवीक्षा।- इस संवर्ग में नियुक्त प्रत्येक कर्मी दो वर्षो के लिए परिवीक्षा पर रहेंगे और विशेष परिस्थितियों में इसका विस्तार एक वर्ष के लिए नियुक्ति प्राधिकार द्वारा किया जा सकेगा, यदि परिवीक्षा अवधि संतोषजनक नहीं हो। ऐसा अवधि विस्तार तभी होगा जब नियुक्ति प्राधिकार की राय में परिवीक्षाधीन कर्मी में सुधार की गुजाईश हो। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाया जाता है तो संबंधित कर्मी को सेवामुक्त किया जा सकेगा।

10. लिपिकों की विभागीय परीक्षा।-

(1) इस सवंर्ग में नियुक्त लिपिकों की विभागीय परीक्षा का आयोजन तथा एतदर्थ विषय, पाठ्‌यक्रम एवं प्रक्रिया का निर्धारण केंद्रीय परीक्षा समिति, राजस्व पर्षद, बिहार द्वारा किया जायेगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 17171717 अ(cid:23)टूअ(cid:23)टूअ(cid:23)टूअ(cid:23)टू बरबरबरबर 2019201920192019 (2) विभागीय परीक्षा उत्तीर्ण निम्न वर्गीय लिपिक/उच्च वर्गीय लिपिक ही कार्यालय के लेखा संबंधी कार्यों के निष्पादन करने हेतु प्राधिकृत किए जाएंगे।

11. प्रशिक्षण।- निम्न वर्गीय लिपिक का बुनियादी प्रशिक्षण 120 कार्यदिवसों का होगा। प्रशिक्षण का पाठ्‌यक्रम पुलिस महानिदेशक (प्रशिक्षण) द्वारा पुलिस महानिदेशक, बिहार के अनुमोदन से निर्धारित किया जाएगा।

12. हिन्दी टिप्पण एवं प्रारूपण परीक्षा।- नवनियुक्त निम्न वर्गीय लिपिकों को बिहार सरकार के मंत्रिमंडल विभाग (राजभाषा) द्वारा आयोजित होने वाली हिन्दी टिप्पण एवं प्रारूपण परीक्षा में उत्तीर्ण होना आवश्यक होगा। उक्त परीक्षा उत्तीर्ण होने पर ही द्वितीय एवं अग्रतर वेतनवृद्धि देय होगी।

13. सम्पुष्टि।- परिवीक्षाधीन कर्मी की परिवीक्षा अवधि की संतोषजनक समाप्ति, हिन्दी टिप्पण प्रारूपण परीक्षा, विभागीय परीक्षा तथा बिहार सरकारी सेवक (सम्पुष्टि के लिए सक्षमता) नियमावली, 2011 के अनुसार कम्प्यूटर सक्षमता परीक्षा उत्तीर्ण होने के बाद सम्पुष्ट किया जा सकेगा।

14. वरीयता।- संवर्ग के सदस्य की मूल कोटि में आपसी राज्य वरीयता की गणना आयोग द्वारा संचालित लिखित परीक्षा में प्राप्त अंकों एवं बुनियादी प्रशिक्षण में प्राप्त अंकों के योग के अनुसार पुलिस मुख्यालय द्वारा निर्धारित की जाएगी। संवर्ग के उच्चतर कोटि के पदों पर आपसी वरीयता का निर्धारण सरकार द्वारा समय-समय पर निर्गत वरीयता संबंधी निर्देश/आदेश के अनुरूप विनिश्चित की जाएगी, परन्तु इस नियमावली के प्रवृत होने के पूर्व विनिश्चित कर्मियों की आपसी वरीयता अपरिवर्त्तनीय रहेगी :

परंतु यह कि अनुकम्पा के आधार पर नियुक्त व्यक्ति उन व्यक्तियों से कनीय होंगे जो संबंधित भर्ती वर्ष में प्रतियोगिता परीक्षा के आधार पर नियुक्त किये जायेंगे। किसी भर्ती वर्ष में प्रोन्नति द्वारा नियुक्त व्यक्ति संबंधित भर्ती वर्ष में प्रतियोगिता परीक्षा द्वारा नियुक्त व्यक्तियों से वरीय होगें।

15. प्रोन्नति।-

(1) मूल कोटि से उच्चतर पंक्ति में प्रोन्नति निर्धारित कालावधि के पूरा होने पर पुलिस महानिदेशक, बिहार द्वारा नामित पुलिस उप-महानिरीक्षक पंक्ति के पदाधिकारी की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा पर दी जायेगी।

(2) विभागीय प्रोन्नति समिति का गठन पुलिस महानिदेशक, बिहार द्वारा किया जायेगा। (3) प्रोन्नति वरीयता-सह-योग्यता के आधार पर दी जाएगी। निम्नवर्गीय लिपिक की उच्चतर कोटि में प्रोन्नति के लिए कर्मी का सम्पुष्ट होना एवं निर्धारित कालावधि पूर्ण करना आवश्यक होगा। कालावधि का निर्धारण सामान्य प्रशासन विभाग के संकल्पों के प्रावधानानुसार होगा।

16. स्थानांतरण।- इस संवर्ग के किसी भी कर्मी को एक जिला में अधिकतम 06 वर्ष एवं क्षेत्र में 10 वर्ष की अवधि पूर्ण होने के पश्चात्‌ स्थानान्तरित किया जा सकेगा, परंतु कार्यहित एवं प्रशासनिक आधार पर आवश्यकतानुसार संवर्ग के कर्मियों को कभी भी किसी स्थान पर स्थानांतरित किया जा सकेगा। स्थानांतरण पुलिस महानिदेशक, बिहार द्वारा किया जाएगा।

17. अवशिष्ट मामले।- ऐसे मामलों के संबंध में जो इस नियमावली द्वारा विशिष्ट रूप से आच्छादित नहीं हाें, संवर्ग के सदस्य राज्य सरकार के समुचित स्तर के पदाधिकारियों/कर्मचारियों के लिए लागू नियमावली/विनियमावली या आदेशों से शासित होंगे।

18. कठिनाई का निराकरण।- गृह विभाग (आरक्षी शाखा) समय-समय पर विधि विभाग के परामर्श के बाद, ऐसा सामान्य या विशिष्ट निर्देश जारी कर सकेगा जो इस नियमावली के प्रावधानों में से किसी के क्रियान्वयन में आ रही कठिनाइयों के निराकरण के लिए आवश्यक हो।

19. निर्वचन।- जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो, वहाँ मामला गृह विभाग (आरक्षी शाखा) द्वारा विधि विभाग के परामर्श के बाद, विनिश्चित किया जायेगा और उसका निर्णय अंतिम होगा।

20. निरसन एवं व्यावृति।-

(1) इस संवर्ग के संबंध में पूर्व में निर्गत सभी संकल्प एवं अनुदेश (बिहार पुलिस हस्तक, 1978 के संबंधित प्रावधान सहित) एतद्‌ द्वारा निरसित किये जाते हैं।

(2) ऐसे निरसन के होते हुए भी, ऐसे संकल्पों/अनुदेशों में प्रदत्त किसी शक्ति के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन प्रदत्त शक्तियों के अधीन किया गया कार्य या की गयी कार्रवाई समझी जायेगी, मानो यह नियमावली उस दिन प्रवृत थी, जिस दिन ऐसा कार्य या कार्रवाई की गयी थी।

No-9/Clerical Cadre-10-01/2018 H.P -8631—In exercise of the powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules for regulating the recruitment and conditions of service of the Regional Clerical cadre of Bihar Police:-

1. Short title, extent and commencement.—

(i) These Rules may be called as the Bihar Police Regional Clerical Cadre (Requirement and conditions of service) Rules, 2019

(ii) It Shall extend to whole of the State of Bihar. (iii) It Shall come into force from the date of its Publication in the official gazette .

2. Definitions.- In these Rules, unless the context otherwise requires.—

(i) "Cadre" means the Regional Clerical Cadre of Bihar Police. (ii) "Commission" means the Bihar Staff Selection Commission; (iii) "Appointing Authority" means the Inspector General of Police (Headquarter), Bihar, Patna;

(iv) "Appointed day" means the date of commencement of these Rules; (V) "Member" means person appointed in the cadres and includes all the persons appointed in the cadres before commencement of these Rules.

(vi) "Appointment on compassionate ground" means appointment of any one of the dependents of the government servant dying in harness, as per relevant circulars/instructions.

5. Recruitment.-

(a) 85% posts of L.D.C shall be filled up through direct recruitment and 15% posts shall be filled up from eligible Office Attendants (Karyalay Parichari) of regional offices of Police organization having Intermediate qualification. Out of the 85% posts for direct recruitment, 10% shall be reserved for the appointment on compassionate ground.

(b) Direct recruitments shall be made to the Category of Lower Division Clerk on the recommendation of the Commission.

(c) The Appointing Authority shall calculate the vacancies on the basis of 1st April every year and shall send the information of Vacancies to the Police Headquarter by the 30th April.

(d) Selection of Candidates for direct recruitment on the post of Lower Division Clerk shall be made through the Competitive Examination by The Bihar Staff Selection Commission. A requisition will be sent to the Commission in the prescribed Performa, in which information regarding number of reservation category wise vacant posts shall be reported.

(e) The Commission shall advertise the vacancies and after selection of successful candidates on the basis of competitive examination shall recommend the name of the candidates in order of merit to the appointing authority.

(f) The appointing authority, after due scrutiny, shall appoint the candidate on probation for two years.

6. Qualification.—

(i) The minimum educational qualification for appointment on the post of Lower Division Clerk shall be Intermediate (10+2) Examination or equivalent Examination pass with knowledge of computer operation and computer typing.

(ii) Minimum age for recruitment shall be eighteen years for all categories and maximum age shall be the same as determined by the State Government (General Administration Department), from time to time.

7. Reservation.— Compliance of reservation/roster in recruitment as well as promotion, as notified by the State Government, from time to time, shall be necessary.

8. Recruitment by promotion.—

(1) The appointing authority shall prepare the gradation list of Intermediate pass Office Attendant/Attendant (Special) (Parichari Vishisht) of Regional Offices of Police organization having knowledge of computer operation and computer typing.

(2) Promotion shall be made according to State Seniority-cum-Merit on recommendation of Departmental Promotion Committee constituted in the Chairmanship of an officer of the rank of Deputy Inspector General of Police nominated by the Director General of Police, Bihar.

9. Probation.— Every employee recruited in this cadre shall be on probation for two years and it can be extended for one year in special circumstances by the appointing authority, if the probation period is not satisfactory. Such extension shall be done only if the appointing authority is of the opinion that the probationer has a chance to improve. If the service is not found satisfactory in the extended period also, the person concerned shall be removed from the service.

10. Departmental Examination for Clerk.—

(1) Conduct of departmental examination for clerks, appointed in this cadre, and for this purpose determination of subject, curriculum and procedure shall be done by the Central Examination Committee, Revenue Board, Bihar.

(2) Only departmental examination pass Lower Division Clerk/Upper Division Clerk may be authorised for the disposal of account related works.

11. Training.—Basic training of Lower Division Clerk shall be of 120 working days. Curriculum for training shall be determined by the Director General of Police (Training), with the approval of Director General of Police, Bihar.

12. Hindi Noting and Drafting test.—It shall be mandatory for newly appointed Lower Division Clerks to pass Hindi Noting and Drafting Examination conducted by the Cabinet (Official language) Department. Second and subsequent increment shall be given after passing of such examination.

13. Confirmation.—Employee on probation may be confirmed in service after satisfactory completion of probation period and passing the Hindi Noting- Drafting Examination, Departmental Examination and computer competency Examination according to The Bihar Government Servant (Competency for Confirmation) Rules, 2011.

14. Seniority.—State Inter-se seniority in the basic Category of the members of the cadre shall be determined by Police Headquarter by adding the marks obtained in written examination conducted by the Commission and marks obtained in basic training. Inter-se seniority in higher Categories of the cadre shall be determined according to the provisions of the circulars/orders, issued regarding seniority, by the Government, from time to time but the inter-se seniority decided before the commencement of these Rules shall remain unchanged.

Provided that the person appointed on the basis of compassionate ground shall be junior to such persons who have been appointed on the basis of competitive examination of concerned6 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 17171717 अ(cid:23)तूअ(cid:23)तूअ(cid:23)तूअ(cid:23)तूबरबरबरबर 2019201920192019 recruitment years. Persons appointed through promotion in a recruitment year shall be senior to the person appointed through competitive examination in the concerned recruitment year.

15. Promotions.—

(1) Promotion from basic Category to higher Category may be given on completion of KALAWADHI on the recommendation of The Departmental Promotion Committee constituted under the Chairmanship of an officer of the rank of Deputy Inspector General of Police, nominated by the Director General of Police, Bihar.

(2) The Departmental Promotion Committee shall be constituted by the Director General of Police, Bihar.

(3) Promotions will be given on the basis of seniority-cum-merit. For promotion to the higher Category from Lower Division Clerk, it will be mandatory for an employee to be confirmed in the service and have completed prescribed KALAWADHI. KALAWADHI shall be determined according to the provisions of Resolutions, issued by General Administration Department.

16. Transfer.— Any member of this cadre may be transferred after completion of 06 years in a district/10 years in a Range, but the members of this cadre may be transferred anytime, anywhere in the state as per exigency of work interest and administrative ground. Transfer shall be made by Director General of Police, Bihar.

17. Residuary Matters.— With Regard to matters not specifically covered by these Rules, the members of the cadres shall be governed by the Rules, Regulations or Orders applicable to the officers/employees of appropriate level of the State Government .

18. Removal of difficulties.- The Home Department (Police Branch) may, from time to time after consultation of the Law Department, issue such general or special direction, as may be necessary, to remove difficulties coming in the implementation of any of the provision of these Rules.

19. Interpretation.—Where any doubt arises as to the interpretation of any of the provisions of these Rules, the matter shall be decided by the Home Department (Police Branch) after consultation of The Law Department, whose decisions shall be final.

20. Repeal & Savings.—

(1) All resolutions and instructions (Including the relevant provisions of Bihar Police Manual, 1978) are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under such resolutions/instructions, shall be deemed to have been done or taken in exercise of the powers conferred by or under these Rules as if these Rules were in force on the day on which such thing or action was done or taken.
