No. 303 A :---The Judicial Officers of the rank of Civil Judge (Junior Division) named in column no. 2 of the table given below are appointed as Munsif (Civil Judge, Jr. Div.) in the judgeship to be stationed ordinarily at the place mentioned in column no. 3 of the table.
As mentioned in column no. 4, the officers are also vested with the powers under Sub-section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (Act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar Amendment Act, 2013 (Act 14 of 2014) to try under ordinary procedure original suits of Pecuniary and Territorial Jurisdiction.
As further mentioned in column no. 4, the officers are also vested with powers of the Court of small causes for the trial of suits cognizable by such a Court with the necessary Pecuniary and Territorial Jurisdiction.
The powers vested as per column no. 4, should not be exercised by the officers concerned unless it is published in the Bihar Gazette or in the District Gazette.

सं0 314 A नि0 :--सभी मुख्य न्यायिक दण्डाधिकारी, अपर मुख्य न्यायिक दण्डाधिकारी एवं न्यायिक दण्डाधिकारी, प्रथम श्रेणी जो इस रूप में कम-से-कम तीन साल की सेवा पूरी कर चुके हैं और जो व्यवहार न्यायालय में आगामी दुर्गापूजा अवकाश में कार्यरत रहेगें उन्हें उस अवधि के लिए इसके द्वारा आवश्यक वस्तु (संशोधन) अधिनियम, 1964 (47-1964) द्वारा यथा संशोधित आवश्यक वस्तु अधिनियम 1955 के अन्तर्गत उनके अपने-अपने जिलों/अनुमंडलों में उक्त अधिनियम की धारा-3 के अधीन बने किसी ऐसे आदेश जिसे राजपत्र अधिसूचित आदेश द्वारा उस संबंध में उल्लेखित है, के उल्लंघन के9 बिहार गजट, 18 दिसम्बर 2019 संबंध में हुए अपराधों के विषय में दंड प्रक्रिया संहिता 1973 (अधिनियम 2, 1974) की धारा 260(1) (सी) के अधीन संक्षिप्त विचारण करने की शक्तियाँ अस्थायी रूप से प्रदान की जाती है।

No. 314 A :---All the Chief Judicial Magistrate, Additional Chief Judicial Magistrate and Judicial Magistrate, 1st Class who have completed at least three years of service as such and who are detained during ensuing Civil Court's Durga Puja Vacation are hereby vested temporarily, for this period only, with the powers u/s 260(1)(c) of the code of Criminal Procedure 1973 (Act 2 of 1974) for the summary trial of offences arising generally within their respective Districts/Sub-Divisions relating to the contravention of any order made under sections 3 of the Essential commodities Act as amended by Essential Commodities (Amendment) Act 1964 (no. 47 of 1964) and duly notified in the official Gazette as laid down in section 12A of the Essential Commodities Act 1955.

------ संकल्प 2 दिसम्बर 2019 श्री सुरेश पासवान (बि0प्र0से0), कोटि क्रमांक 442/11, तत्कालीन विशेष सचिव, अनुसूचित जाति एवं जनजाति कल्याण विभाग, बिहार, पटना के विरूद्ध राज्य के बाहर विभिन्न तकनीकी संस्थानों/महाविद्यालयों में अध्ययनरत अनुसूचित जाति/जनजाति के छात्रों तथा छात्राओं को वर्ष-2013-14 एवं इसके पूर्व के वर्षो में छात्रवृत्ति भुगतान में हुई अनियमितताआें के लिए निगरानी थाना कांड संख्या-127/16 दिनांक 26.11.2016 दर्ज होने की सूचना निगरानी विभाग के पत्रांक 2756 दिनांक 06.12.2016 द्वारा उपलब्ध करायी गयी। उक्त के आलोक में बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9 (ग) में निहित प्रावधानों के तहत श्री पासवान को विभागीय संकल्प ज्ञापांक 531 दिनांक 16.01.2017 द्वारा तत्काल प्रभाव से निलंबित किया गया था। 2. अनुशासनिक प्राधिकार के स्तर पर की गयी सम्यक विचारोपरांत श्री पासवान को संकल्प निर्गत की तिथि से निलंबन मुक्त किया जाता है। इनके विरूद्ध संचालित विभागीय कार्यवाही पर अलग से निर्णय लिया जायगा। 3. श्री पासवान सामान्य प्रशासन विभाग, बिहार, पटना (पदस्थापन की प्रतीक्षा में) में योगदान देंगे। 4. निलंबन अवधि के संबंध में अलग से निर्णय लिया जायगा। आदेशः-आदेश दिया जाता है कि इस संकल्प की प्रति बिहार राजपत्र के अगले अंक में प्रकाशित किया जाय तथा इसकी प्रति सभी संबंधित को भेज दी जाय।

बिहार-राज्यपाल के आदेश स,े, राम बिशुन राय, अवर सचिव।21 बिहार गजट, 18 दिसम्बर 2019 सं0 08/आरोप-01-25/2014,सा॰प्र॰-15185 ------- संकल्प 8 नवम्बर 2019 श्री संजय कुमार, बि॰प्र॰से॰, (कोटि क्रमांक-1112/11) के विरूद्ध वरीय उप समाहर्त्ता-सह-प्रभारी जिला योजना पदाधिकारी, मधुबनी के पदस्थापन काल में सांसद स्थानीय विकास योजना अन्तर्गत सौर ऊर्जा संयंत्रों के क्रय एवं अधिष्ठापन में वित्तीय एवं प्रशासनिक अनियमितता बरतने संबंधी आरोपों के लिए योजना एवं विकास विभाग, बिहार, पटना के पत्रांक-4679 दिनांक 30.10.2013 द्वारा आरोप प्रपत्र 'क' अनुशासनिक कार्रवाई हेतु प्राप्त हुआ। उक्त प्रतिवेदित आरोप पत्र की प्रति संलग्न करते हुए विभागीय पत्रांक-18138 दिनांक 27.11.2013 द्वारा श्री कुमार से स्पष्टीकरण की माँग की गयी। श्री कुमार से प्राप्त स्पष्टीकरण (दिनांक 11.06.2014) की प्रति संलग्न करते हुए विभागीय पत्रांक-12939 दिनांक 17.09.2014 द्वारा जिला पदाधिकारी, मधुबनी से मंतव्य की माँग की गयी। जिला पदाधिकारी, मधुबनी के पत्रांक-1006 दिनांक 30.03.2015 द्वारा प्राप्त मंतव्य में श्री कुमार के स्पष्टीकरण को स्वीकार योग्य नहीं पाया गया। योजना एवं विकास विभाग, बिहार, पटना द्वारा श्री कुमार के विरूद्ध प्रतिवेदित आरोप पत्र के आधार पर विभागीय स्तर पर पुनर्गठित एवं अनुशासनिक प्राधिकार द्वारा अनुमोदित आरोप-पत्र की प्रति संलग्न करते हुए विभागीय पत्रांक-7824 दिनांक 01.06.2016 द्वारा श्री कुमार से स्पष्टीकरण की माँग की गयी। श्री कुमार से प्राप्त स्पष्टीकरण (दिनांक 16.05.2017) की प्रति संलग्न करते हुए विभागीय पत्रांक-11155 दिनांक 30.08.2017 द्वारा जिला पदाधिकारी, मधुबनी सेे मंतव्य की माँग की गयी। स्मारोंपरांत जिला पदाधिकारी, मधुबनी से मंतव्य अप्राप्त रहा। तत्पश्चात श्री कुमार के विरूद्ध गठित आरोप-पत्र, प्राप्त स्पष्टीकरण एवं जिला पदाधिकारी, मधुबनी से पूर्व में प्राप्त मंतव्य की समीक्षा अनुशासनिक प्राधिकार के स्तर पर की गयी तथा आरोपों की विस्तृत जाँच की आवश्यकता पायी गयी। अतएव सम्यक विचारोपरांत श्री संजय कुमार, बि॰प्र॰से॰, कोटि क्रमांक-1112/11 के विरूद्ध प्रतिवेदित आरोपों की विस्तृत जाँच बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली-2005 के नियम 17 (2) के प्रावधानों के तहत कराने का निर्णय अनुशासनिक प्राधिकार द्वारा लिया गया है। इस विभागीय कार्यवाही के संचालन पदाधिकारी आयुक्त, दरभंगा प्रमंडल, दरभंगा एवं प्रस्तुतीकरण/उपस्थापन पदाधिकारी, जिला पदाधिकारी, मधुबनी द्वारा नामित कोई वरीय पदाधिकारी होगें। श्री कुमार से अपेक्षा की जाती है वे अपने बचाव बयान के संबंध में अपना पक्ष रखने हेतु जैसा की संचालन पदाधिकारी अनुमति दे, उनके समक्ष स्वयं उपस्थित होगें। आदेशः-आदेश दिया जाता है कि इस संकल्प की प्रति बिहार राजपत्र के अगले अंक में प्रकाशित किया जाय तथा इसकी प्रति सभी संबंधित को भेज दी जाय।

श्री ओम प्रकाश प्रसाद, बि0प्र0से0 (कोटि क्रमांक 499/11) तत्कालीन अपर समाहर्त्ता, बेगूसराय को निगरानी धावादल के द्वारा दिनांक 17.11.2018 को 6,00,000.00 (छः लाख) रूप्या रिश्वत लेते रंगे हाथ गिरफ्तार कर आदर्श केन्द्रीय कारा, बेऊर (पटना) भेजे जाने तथा उनके विरूद्ध निगरानी थाना काण्ड सं॰ 049/2018 दर्ज किये जाने की सूचना प्राप्त होने के उपरांत तत्कालीन अपर समाहर्त्ता, बेगूसराय, (श्री ओम प्रकाश प्रसाद) को विभागीय संकल्प ज्ञापांक 16538 दिनांक 29.
12.2018 द्वारा बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9(i)(क) एवं (ग)तथा नियम-9(2) में निहित प्रावधानों के तहत न्यायिक हिरासत की तिथि (दिनांक 17.11.2018) के प्रभाव से अगले आदेश तक के लिये निलंबित किया गया। उस समय निलंबित पदाधिकारी के काराधीन रहने के कारण कारामुक्त होने के उपरांत उनकी निलंबन अवधि के लिये मुख्यालय निर्धारित नहीं किया जा सका।
आरोपित पदाधिकारी दिनांक 05.08.2019 को माननीय उच्च न्यायालय, पटना द्वारा पारित आदेश के आलोक में दिनांक 15.08.2019 से कारामुक्त हो गये हैं, किन्तु वे अभी भी निलंबन में ही है।22 बिहार गजट, 18 दिसम्बर 2019 निलंबन अवधि में श्री प्रसाद का मुख्यालय प्रमंडलीय आयुक्त का कार्यालय, पूर्णियां प्रमंडल, पूर्णिया निर्धारित किया जाता है।
आदेशः-आदेश दिया जाता है कि इस संकल्प की प्रति बिहार राजपत्र के अगले अंक में प्रकाशित किया जाय तथा इसकी प्रति सभी संबंधित को भेज दी जाय।
