05/2018,सा॰प्र॰/17174--."बिहार तकनीकी सेवा आयोग अधिनियम, 2014" धारा-14(1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल निम्नलिखित विनियमावली बनाते हैं :- 14(1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल निम्नलिखित विनियमावली बनाते हैं :- 14(1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल निम्नलिखित विनियमावली बनाते हैं :- 1. संक्षिप्त नाम, विस्तार एवं प्रारंभ। - सदस्यों की सेवा-शर्त्त) विनियमावली, 2019 (ii) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (iii) यह 18.06.2017 के प्रभाव से प्रवृत समझी जायेगी। 2. परिभाषाएँ ।- इस विनियमावली में, जब तक का (क) "राज्य सरकार" से अभिप्रेत है बिहार की राज्य सरकार; (ख) "अधिनियम" से अभिप्रेत है "बिहार तकनीकी सेवा आयोग अधिनियम, 2014" (बिहार से अभिप्रेत है "बिहार तकनीकी सेवा आयोग अधिनियम, 2014" (बिहार से अभिप्रेत है "बिहार तकनीकी सेवा आयोग अधिनियम, 2014" (बिहार अधिनियम 13, 2014) (समय (ग) "आयोग" से अभिप्रेत (घ) "अध्यक्ष" से अभिप्रेत है अधिनियम की धारा आयोग का अध्यक्ष; (ड़) "सदस्य" से अभिप्रेत है अधिनियम की धारा आयोग के सदस्य; (च) "सचिव" से अभिप्रेत है राज्य सरकार द्वारा नियुक्त आयोग का सचिव और इसमें वह पदाधिकारी भी ्रेत है राज्य सरकार द्वारा नियुक्त आयोग का सचिव और इसमें वह पदाधिकारी भी ्रेत है राज्य सरकार द्वारा नियुक्त आयोग का सचिव और इसमें वह पदाधिकारी भी शामिल है जो सचिव की अनुपस्थिति में सचिव का कार्य करने हेतु अध्यक्ष द्वारा प्राधिकृत किया जाय; शामिल है जो सचिव की अनुपस्थिति में सचिव का कार्य करने हेतु अध्यक्ष द्वारा प्राधिकृत किया जाय; शामिल है जो सचिव की अनुपस्थिति में सचिव का कार्य करने हेतु अध्यक्ष द्वारा प्राधिकृत किया जाय; (छ) "मूल सेवा" से अभिप्रेत है आयोग के अध्यक्ष या सदस्य, की सरकार के अधीन ऐसी सेवा जिसमें से अभिप्रेत है आयोग के अध्यक्ष या सदस्य, की सरकार के अधीन ऐसी सेवा जिसमें वह से अभिप्रेत है आयोग के अध्यक्ष या सदस्य, की सरकार के अधीन ऐसी सेवा जिसमें ऐसे अध्यक्ष या सदस्य के रूप में नियुक्त होने से पहले, नियोजित था ; ऐसे अध्यक्ष या सदस्य के रूप में नियुक्त होने से पहले, नियोजित था ; (झ) "मूल सेवा पेंशन" से अभिप्रेत है वह पेंशन जो मूल सेवा अथवा सदस्य को दी गयी हो।
अथवा सदस्य को दी गयी हो।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11119999 fnlEcj fnlEcj fnlEcj fnlEcj 2019201920192019 3. आयोग के अध्यक्ष/सदस्य के वेतन-भत्ते एवं सेवा की अन्य शर्त्तें ।- (i) वेतन एवं भत्ते ।- (क) राज्य सरकार में कार्यरत आयोग के अध्यक्ष/सदस्य को अपना पदीय वेतन एवं विभागीय सचिव को अनुमान्य सभी सुविधाएँ प्राप्त होंगी। (ख) आयोग के अध्यक्ष एवं सदस्य, जो मूल सेवा से निवृत्ति के उपरांत राज्य सरकार द्वारा आयोग के अध्यक्ष/सदस्य के पद पर नियुक्त किये गये हों, का वेतन उनकी सेवानिवृत्ति के समय देय वेतन में से पेंशन की कुल राशि घटा कर दिया जायेगा। इसके अतिरिक्त उन्हें विहित दर पर अनुमान्य भत्ते तथा विभागीय सचिव को अनुमान्य सुविधाएँ (आवासीय कार्यालय की सुविधा छोड़कर) देय होंगी। (ii) छुट्टी।- आयोग के अध्यक्ष एवं सदस्यों को निम्नवत् छुट्टी देय होगी ।- (क) राज्य सरकार में कार्यरत आयोग के अध्यक्ष को "अखिल भारतीय सेवाएँ (छुट्टी) नियमावली, 1955" के अधीन अनुमान्य छुट्टियाँ देय होंगी। (ख) आयोग में सदस्य के रूप में नियुक्त होने वाले राज्य सेवा के कार्यरत पदाधिकारियों को "बिहार सेवा संहिता" के तहत अनुमान्य छुट्टियाँ देय होंगी। (ग) मूल सेवा से निवृत्ति के उपरांत नियुक्त होने वाले आयोग के अध्यक्ष/सदस्य को उनके मूल सेवा के पद के आधार पर "अखिल भारतीय सेवाएँ (छुट्टी) नियमावली, 1955"/"बिहार सेवा संहिता" के तहत अनुमान्य छुट्टियाँ देय होंगी। (घ) अव्यवहृत संचित उपार्जित छुट्टी के बदले समतुल्य राशि भुगतेय नहीं होगा और छुट्टी-यात्रा रियायत की सुविधा देय नहीं होगी। (ड़) आयोग के अध्यक्ष की छुट्टी मंजूर करने की प्रक्रिया वहीं होगी जो समकक्ष पंक्ति के पदाधिकारियों पर लागू हो। (च) आयोग के सदस्यों की आकस्मिक छुट्टी के मंजूर करने की शक्ति आयोग के अध्यक्ष को होगी, परन्तु अन्य प्रकार की छुट्टी मंजूर करने की प्रक्रिया वही होगी, जो समकक्ष पंक्ति के पदाधिकारियों पर लागू हो। (छ) अध्यक्ष की छुट्टी अथवा अन्यथा अनुपस्थिति में आयोग का वरिष्ठतम् सदस्य अध्यक्ष के सामान्य प्रशासनिक कार्यों का प्रभार धारण करेगा। (iii) सरकारी आवास अथवा मकान किराया-भत्ता।- आयोग के अध्यक्ष एवं सदस्यों को राज्य सरकार के नियमों के अंतर्गत सरकारी आवास अथवा आवास अनुपलब्धता की स्थिति में उसके स्थान पर विहित दर पर मकान किराया-भत्ता देय होगा। (iv) यात्रा-भत्ता ।- आयोग के अध्यक्ष एवं सदस्यों को ऐसा यात्रा-भत्ता अनुमान्य होगा जो उनकी पंक्ति एवं स्तर के राज्य सरकार के पदाधिकारियों को अनुमान्य है। सदस्य को यात्रा की स्वीकृति आयोग के अध्यक्ष द्वारा दी जायेगी। आयोग के अध्यक्ष अपनी यात्रा की आवश्यकता का आकलन स्वयं कर सकेंगे। (v) चिकित्सा-भत्ता ।- (क) राज्य सरकार में कार्यरत आयोग के अध्यक्ष एवं सदस्यों को अपने पद के अनुरूप अखिल भारतीय सेवा/राज्य सेवा में लागू नियमों के अनुरूप चिकित्सा-भत्ता देय होगा। (ख) मूल सेवा से निवृत्ति के उपरांत नियुक्त होने वाले आयोग के अध्यक्ष/सदस्यों को चिकित्सा-भत्ता अनुमान्य नहीं होगा। (vi) चिकित्सा-प्रतिपूर्त्ति सुविधा ।- (क) राज्य सरकार में कार्यरत आयोग के अध्यक्ष एवं सदस्यों को अपने पद के अनुरूप अखिल भारतीय सेवा/राज्य सेवा में लागू नियमों के अनुरूप चिकित्सा-प्रतिपूर्त्ति की सुविधा अनुमान्य होगी। (ख) मूल सेवा से निवृत्ति के उपरांत नियुक्त होने वाले आयोग के अध्यक्ष/सदस्यों को चिकित्सा-प्रतिपूर्त्ति की सुविधा अनुमान्य नहीं होगी। (vii) आयोग के अध्यक्ष एवं सदस्यों की सेवा-अवधि "बिहार तकनीकी सेवा आयोग अधिनियम, 2014" (बिहार अधिनियम 13, 2014) (समय-समय पर यथा संशोधित) की धारा-4 के अनुसार होगी। 4. अन्यान्य ।- इस विनियमावली में आयोग के अध्यक्ष एवं सदस्यों की जिन सेवा-शर्त्तों के लिए स्पष्ट उपबंध नहीं किये गये हैं, उसके लिए राज्य सरकार आवश्यकतानुसार अलग से प्रावधान कर सकेगी।

सं॰ 21/त॰क॰च॰आ॰-05/2018,सा॰प्र॰/17175--सामान्य प्रशासन विभाग, बिहार, पटना की अधिसूचना संख्या 17174, दिनांक 17.12.2019 का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है जो भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन अँग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जायेगा।

No. 21/B.T.S.C-05/2018 Ka-17174--In exercise of the powers conferred by Section- 14(1) of Bihar Technical Service Commission Act, 2011 The Governor of Bihar is pleased to make the Following Regulations :-
1. Short name, extent and commencement- (1) These Regulations may be called "Bihar Technical Service Commission (Service Conditions of Chairman and Members) Regulations, 2019."
(ii.) It shall extant to the whole of the State of Bihar. (iii) it shall come in to force with effect from 18.06.2017.
2. Definitions - In these Regulations, unless there is any thing repugnant in the subject or the context :-
(a) "State Government" means The State Government of Bihar; (b) "Act" means "Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014) (As amended time to time)" ;
(c) "Commission " means Bihar Technical Service Commission ; (d) "Chairman" means The Chairman of The Bihar Technical Service Commission appointed by the State Government under Section-3 of the Act ;
(e) "Member "means The Member of the Commission appointed by the State Government under section-3 of the Act ;
(f) "Secretary " means Secretary of Commission appointed by the State Government and it includes also that officer who is authorized by the chairman to work as secretary in absence of secretary ;
(g) "Basic Service" means The Service of the Chairman or member under the Government in which he was employed before his appointment as Chairman or Member ; (f) "Basic Service Pension "means that pension which given to any chairman or member under Basic Service Rules.
3. "Pay - allowances and other Service Conditions of Chairman/Member of the
Commission." -
(i) Pay and allowances I- (a) Chairman and members of the Commission working in State Government shall be entitled to his pay of post and all facilities admissible to secretary of a Department.
(b) Chairman and Member of the Commission, who appointed on the post of chairman member of the Commission by the state Government after retirement from his basic service, will be paid as salary after deducting the total amount of pension from admissible pay at the time of his retirement. In addition he shall be entitled to admissible allowances on prescribed rate and facilities admissible to secretary of the department (except facility of residential office).
(ii) " Leave "- Leave to chairman and members of the Commission shall be admissible as follows :- (a) Leave to Chairman of the Commission working in State Government will be admissible according to "All India Services (Leave) Rules, 1955. "
(b) Leave to working officers of State Government appointed as member in Commission will admissible according to "Bihar Service Code ".
4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 11119999 fnlEcj fnlEcj fnlEcj fnlEcj 2019201920192019(c) Leave to Chairman/Member of Commission, who appointed after retirement from his basic service, will be admissible according to post of basic service under All India Services (Leave) Rules, 1955 /Bihar Service Code
(d) Equivalent amount in place of unutilized Earned Leave will not be payable and The facility of Leave Travel Consession will not be admissible.
(e) The Process of Leave Sanctioning to Chairman of the Commission will be same which may apply for the officers of same rank.
(f) The Chairman of the Commission will have power to sanction casual leave to members of the Commission, provided that the process of sanctioning leave of other type will be same, which may apply for the officers of same rank.
(g) Senior most member of the Commission will discharge the general administrative works of the chairman in leave or absence of the Chairman.
(iii) Government Quarter or house rent allowance I- According to rules of State Government, Government quarter or in condition of unavailability of quarter, house rent allowance on prescribed rate shall be admissible to the Chairman and Members of the Commission.
(iv) Traveling Allowance I- Traveling Allowance shall be admissible to the Chairman and members of the Commission which is admissible to the officers of same rank and Status of State Government
(v) Medical Allowance I- (a) The Medical Allowance shall be admissible to the Chairman and Members of the Commission working in the State Government, according to applicable rules to his post in All India Service/ State Service.
(b) Medical allowance shall not be admissible to the Chairman/ Members of the Commission, who appointed after retirement from basic service.
(vi) Facility of Medical Re-imbursment I- (a) Medical re-imbursment facility shall be admissible according to rules applicable to his post in All India Service/State Service to the Chairman/ Member of Commission, working in State Government. (b) Medical re-imbursment facility shall not be admissible to the Chairman/Members of the Commission, who appointed after retirement from basic service. (vii) The service period of Chairman and Members of the Commission shall be according to section - 4 of the Bihar Technical Service Commission Act, 2014 (Bihar Act 13, 2014) (as amended time to time 4. Others I- If there is no clear provision for which service conditions of Chairman and Members of the Commission in this Regulations, for that, the provisions may be made separately by the State Government according to need.
