भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का -1353(4)--भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल ''बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014'' का संशोधन करने के लिए प्रयोग करते हुए बिहार राज्यपाल ''बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014'' का संशोधन करने के लिए प्रयोग करते हुए बिहार राज्यपाल ''बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014'' का संशोधन करने के लिए निम्नलिखित नियमावली बनाते हैं :- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ ।- नियमावली 2019'' कही जा सकेगी ।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह राजपत्र में इसको प्रकाशन की तिथि से प्रवृत होगी ।
इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । यह राजपत्र में इसको प्रकाशन की तिथि से प्रवृत होगी ।
संवर्ग नियमावली, 2014 के नियम-2(iii)(iv) का
) का प्रतिस्थापन।-उक्त निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा-

नियमावली, 2014 के नियम-3 का प्रतिस्थापन।-उक्त नियमावली के नियम-3 उक्त नियमावली के नियम-3
नियमावली, 2014 के नियम-6 का प्रतिस्थापन।-उक्त नियमावली के नियम-6 उक्त नियमावली के नियम-6 2. बिहार प्रयोगशाला प्रावैधिक नियमावली के नियम 2(iii)(iv) निम्नलिखित द्वारा प्रतिस्थापित किया जाएगा- ''(iii) 'आयोग से अभिप्रेत है, बिहार तकनीकी सेवा आयोग,'' ''(iv) नियुक्ति प्राधिकार से अभिप्रेत है निदेशक प्रमुख, स्वास्थ्य सेवायें, 3. बिहार प्रयोगशाला प्रावैधिक नियमावली, 2014 के नियम-3 का प्रतिस्थापन।- को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- ''3. संवर्ग का गठनः-प्रयोगशाला प्रावैधिक का संवर्ग राज्यस्तरीय होगा। इस सवंर्ग में प्रत्येक कोटि के पदो संवर्ग का गठनः-प्रयोगशाला प्रावैधिक का संवर्ग राज्यस्तरीय होगा। इस सवंर्ग में प्रत्येक कोटि के पदों की संख्या संवर्ग का गठनः-प्रयोगशाला प्रावैधिक का संवर्ग राज्यस्तरीय होगा। इस सवंर्ग में प्रत्येक कोटि के पदो त की जाय।'' तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा, समय-समय पर, स्वी—त की जाय।'' तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा, समय-समय पर, स्वी 4. बिहार प्रयोगशाला प्रावैधिक नियमावली, 2014 के नियम-6 का प्रतिस्थापन।- को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- ''6. अर्हताएँ ।-(1) मूल कोटि के पद पर सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक अर्हता इंटरमीडियेट/2 (भौतिक (1) मूल कोटि के पद पर सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक अर्हता इंटरमीडियेट/2 (भौतिक (1) मूल कोटि के पद पर सीधी भर्त्ती के लिए न्यूनतम शैक्षणिक अर्हता इंटरमीडियेट/2 (भौतिक विज्ञान, रसायनशास्त्र, जीव विज्ञान, अंग्रेजी के साथ) उत्तीर्णता होगी। इसके अतिरिक्त संघ एवं अन्य राज्य सरकार द्वारा विज्ञान, रसायनशास्त्र, जीव विज्ञान, अंग्रेजी के साथ) उत्तीर्णता होगी। इसके अतिरिक्त संघ एवं अन्य राज्य सरकार द्वारा विज्ञान, रसायनशास्त्र, जीव विज्ञान, अंग्रेजी के साथ) उत्तीर्णता होगी। इसके अतिरिक्त संघ एवं अन्य राज्य सरकार द्वारा में उत्तीर्णता/बैचलर ऑफ मेडिकल लेबोरेटरी टेक्नॉलॉजी प्रयोगशाला प्रावैधिक डिप्लोमा कोर्स में उत्तीर्णता/बैचलर ऑफ मेडिकल लेबोरेटरी टेक्नॉलॉजी मान्यता प्राप्त संस्थान से प्रयोगशाला प्रावैधिक कोर्स में उत्तीर्णता एवं तत्संबंधी प्रमाण पत्र रहना आवश्यक होगा। कोर्स में उत्तीर्णता एवं तत्संबंधी प्रमाण पत्र रहना आवश्यक होगा।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 7777 tuojh 2020tuojh 2020tuojh 2020tuojh 2020 (2) प्रयोगशाला प्रावैधिक संवर्ग में सीधी भर्त्ती के लिए न्यूनतम आयु-सीमा 18 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा, समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाए। संबंधित वर्ष की 1ली अगस्त उम्र के अवधारणार्थ, कट ऑफ डेट माना जायेगा।'' 5. बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014 के नियम 7 का प्रतिस्थापन।- उक्त नियमावली के नियम 7 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा।ः- ''7. भर्त्ती की प्रक्रिया ।- (2) चयन हेतु निम्नलिखित के अनुसार 100(एक सौ) पूर्णाक होगा- (क) इन्टरमीडियेट/2 में प्राप्तांक के लिए - 30 अंक (ख) प्रयोगशाला प्रावैधिक के डिप्लोमा/बैचलर ऑफ मेडिकल लेबोरेटरी टेक्नॉलॉजी कोर्स की परीक्षा में प्राप्तांक के लिए - 25 अंक (ग) प्रयोगशाला प्रावैधिक कोर्स में उच्चतर शिक्षा (बी0एस-सी0/एम0एस-सी) के लिए - 20 अंक (घ) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव के लिए प्राचार्य/अधीक्षक/निदेशक/ सिविल सर्जन से प्रतिहस्ताक्षरीत अनुभव प्रमाण पत्र (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक कुल 100 अंक टिप्पणीः- इंटरमीडियेट/2, एवं प्रयोगशाला प्रावैधिक के डिप्लोमा कोर्स की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जानेवाले अंको का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को क्रमशः 0.3 या 0.25 के गुणक से गुणा कर करना होगा। यथा, यदि किसी अभ्यर्थी द्वारा क्रमशः 50 प्रतिशत अंक प्राप्त किया गया हो तो उसे 50X0.3=15 या 50X0.25=12.5 अंक दिये जायेंगे।
(3) आयोग उपनियम(2) के आधार पर तैयार मेधासूची एवं अधियाचित रिक्तियों के अनुरूप आरक्षण कोटिवार अनुशंसा विभाग को भेजेगा। विभाग अनुशंसित अभ्यर्थियों के प्रमाण पत्रों की जाँच किये जाने के पश्चात् उनका संवर्ग आवंटन करेगा। तत्पश्चात् संबंधित नियुक्ति प्राधिकार स्वास्थ्य जाँच, पूर्ववृत्त सत्यापन आदि कराते हुए सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, निर्गत नियुक्ति संबंधी दिशानिर्देशों का पालन करते हुए नियुक्ति करेगा।
(4) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, निर्गत अनुदेशों का अनुपालन आवश्यक होगा।
6. बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014 के नियम 13 का प्रतिस्थापन।-उक्त नियामवली के नियम-13 निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-
''13. प्रोन्नति के सौपान।-(1) सेवा में प्रयोगशला प्रावैधिकी को, रिक्तियों के उपलब्धता के अधीन रहते हुए, वरीयता-सह-योग्यता के अनुसार परिशिष्ट-1 में उल्लेखित उच्चतर पदों पर प्रोन्नति दिए जाने हेतु विचार किया जा सकेगा।
(2) प्रोन्नति पर विचारार्थ, सामान्य प्रशासन विभाग द्वारा, समय-समय पर, निर्गत, कालावधि संबंधी अनुदेश का अनुपालन आवश्यक होगा। प्रोन्नति के संदर्भ में चारित्री या पी0ए0आर0, मुहरबन्द लिफाफा के अनुशंसा रखे जाने आदि के संबंध में सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन, प्रोन्नति पर विचार करते समय आवश्यक होगा।''
7. बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, 2014 के परिशिष्ट-1 का प्रतिस्थापन।-उक्त नियमावली के परिशिष्ट-1 को निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-
''परिशिष्ट-1 {नियम-2 (vi), 4, 13, 16, 17 द्रष्टव्य} प्रयोगशाला प्रावैधिक संवर्ग का सोपान

सं॰ 4/प्रा0-12-13/2013-1354(4) अधिसूचना सं॰ 1353(4), दिनांक 17 सितम्बर 2019 का निम्नलिखित अँग्रेजी अनुवाद, बिहार राज्यपाल के प्राधिकार से, एतद द्वारा प्रकाशित किया जाता है जो भारत-संविधान के अनुच्छेद-348 क खंड (3) के अधीन अँग्रेजी भाषा में उक्त अधिसूचना का प्राधि—त पाठ समझा जायेगा।

No:. 4/Pra-12-13/2013-1353(4)--In exercise of the powers conferred by provisio to Article 309 of the Constitution of India, the Governor of Bihar is Pleased to make the following Rules to amend the "Bihar Lab Technician Cadre Rules, 2014":- 1. Shorttitle, extent and commencement.- (1) These Rules may be called the "Bihar Lab Technician Cadre (Amendment) Rules, 2019."
(2) It shall extend to the whole state of Bihar.
(3) It shall come into force from the date of its publication in the official gazatte. 2. Substitution of rule-2 (iii) of the "Bihar Lab Technician Cadre Rules, 2014.- Rule 2 (iii) of the said Rules shall be substituted by the following:- "(iii) 'Commission' means the Bihar Technical Service Commission;" "(iv)'Appointing Authority' means Director-in-Chief, Health Services, Bihar. 3. Substitution of rule-3 of the Bihar Lab Technician Cadre Rules, 2014.- Rule - 3 of the said Rules shall be substituted by the following:- "3. Constitution of cadre.-The Lab Technician shall be state level cadre. In this cadre, number of posts in every categary and total number of posts in the cadre shall be as many as may be sanctioned by the Government, from time to time." 4. Substitution of rule-6 of the Bihar Lab Technician Cadre Rules, 2014.- Rule -6 of the said Rules shall be substituted by the following:- "6 Qualification:- (1) For direct recruitment to the basic category posts, minimum educational qualification shall be pass in Intermediate/+2(Physics, Chemistry, Biology with English) pass. In addition to this, it shall be necessary to have passed Lab Technician Diploma Course/Bachelor in Medical Laboratory Technology fromUnion of India and other States government recognized Institution and it shall be necessary to have a Certificate related thereto. (2) For the direct recruitment in Lab Technician Cadre, minimum age-limit shall be 18 years and maximum age-limit shall be such as may be determined reservation categorywise, from time to time, by the Government. 1st August of the concerned year shall be deemed to be cut off date for determination of age." 5. Substitution of Rule-7 of the Bihar Lab Technician Cadre Rule-2014. Rule-7 of the said Rules shall be substituted by the following:- "7 Procedure of recruitment.-(1) The appointing authority, after calculating vacances on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Department latest by30th April and the consolidated requisition shall be sent to the Commission by the Department latest by 15th May. (2) For the selection, full marks will be 100 (one hundred) as follows:- (a) For the marks obtained in Intermediate/+2 - 30 Marks4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 7777 tuojh 2020tuojh 2020tuojh 2020tuojh 2020 (b) For marks obtained in Diploma in Lab Technician Course examination - 25Marks (c) For higher degree in course of Lab Technician (B.Sc/M.Sc) - 20 Marks (B.Sc.-10 marks and M.Sc.- 10 marks) (d) For Work experience in Government Hospitals- (5 marks per year, Maximum 25 Marks) - 25 Marks Total 100 Marks Note:The marks to be given to a candidate for marks obtained in Intermediate/+2 and Diploma Course in Lab Technician examinations shall be determined by multiplying percentage of total marks obtained in the examinations of said courses by a multiple of 0.3 or 0.25 respectively. For example, if a candidate has obtained 50% marks, he will be given 50x0.3=15 or 50x 0.25= 12.50 marks respectively.
(3) The Commission shall send recommendation to the Department according to the merit list prepared on the basis of sub-rule (2) as well as requisitioned vacancies. After scrutiny of certificates of the recommended candidates the Department shall allot their cadre. Thereafter, the Appointing Authority concerned shall make appointments after causing medical check-up, verification of antecedents, etc following the guidelines issued by the Government (General Administration Department), from time to time.
(4) After recommendation of the Commission, compliance of instructions issued by the Government (Gneral Administration Department), from time to time, with respect to procedure of appointment, shall be necessary." 6. Substitution of rule-13 of the Bihar Lab Technician Cadre Rule 2014 .- Rule 13 of the said Rules shall be substituted by the following:- "13. Chain of Promotion.-(1) Subject to availability of vacancies, confirmed Lab Technicians may be considered for promotion, according to seniority-cum-merit, to the higher posts mentioned in the Appendix-1. (2) For consideration of promotion, compliance of instructions regarding KALAWADHI issued by the General Administration Department, from time to time, shall be necessary. Compliance of instructions issued by the General Administration Department regarding Character Roll or PAR, maintenance of recommendation in the sealed cover, etc in the context of promotion, shall be necessary at the time of consideration of promotion." 7. Substitution of Appendix-1 of the Bihar Lab Technician Cadre Rules, 2014.-The Appendix-1 of the said Rules shall be substituted by the following:-
