परिवहन विभाग ------ अधिसूचना 29 जनवरी 2020 सं0 05/स्था0-10/2016-941--भारत - संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार परिवहन सेवा का गठन और उसमें भर्ती की प्रक्रिया तथा सेवा शर्तो को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैंः- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - (i) यह नियमावली बिहार परिवहन सेवा नियमावली, 2020 कही जा सकेगी। (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (iii) यह तुरंत प्रवृत होगी। 2. परिभाषाएँ।- जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में - (i) ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग; (ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है बिहार कार्यपालिका नियमावली में यथानिर्धारित नियुक्ति प्राधिकार; (iii) ''राज्यपाल'' से अभिप्रेत है बिहार के राज्यपाल; (iv) ''राज्य सरकार'' या ''सरकार'' से अभिप्रेत है बिहार की राज्य सरकार; (v) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात 01 अप्रैल से अगले वर्ष 31 मार्च तक की अवधि; (vi) ''वर्ष के अन्दर रिक्ति'' से अभिप्रेत है सेवा में नये पदों के सृजन, सेवानिवृति, मृत्यु, सेवा से हटाये जाने और पदच्यूत किये जाने से उपलब्ध रिक्ति; (vii) ''विभाग'' से अभिप्रेत है परिवहन विभाग; (viii) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है सरकार द्वारा समय-समय पर गठित विभागीय प्रोन्नति समिति; (ix) ''सेवा'' से अभिप्रेत है बिहार परिवहन सेवा; (x) ''सदस्य या सेवा सदस्य'' से अभिप्रेत है इस नियमावली के उपबंधों के अधीन बिहार परिवहन सेवा में नियुक्ति एवं शामिल व्यक्ति;

(xi) ''संवर्ग नियंत्रण प्राधिकार'' से अभिप्रेत है अपर मुख्य सचिव/प्रधान सचिव/सचिव, परिवहन विभाग। (xii) ''नियत तिथि'' से अभिप्रेत है, इस नियमावली के प्रवृत्त होने की तिथि। 3. सेवा की संरचना।-इस सेवा के विभिन्न कोटि में पदों की संरचना निम्नवत्‌ होगी।-

(i) नियत तिथि को सेवा के किसी पद पर कार्यरत व्यक्ति स्वतः इस सेवा में सम्मिलित समझे जायेंगे। (ii) उक्त पदों का वेतनमान/वेतन स्तर वही होगा जैसा समय-समय पर वित्त विभाग, बिहार सरकार द्वारा अनुमान्य किया जाय। (iii) सेवा के विभिन्न कोटि के पदों का स्वीकृत बल वही होगा जैसा समय-समय पर राज्य सरकार द्वारा स्वीकृत किया जाय। (iv) जिला परिवहन पदाधिकारी के 17 पद, उप परिवहन आयुक्त का 01 पद एवं संयुक्त परिवहन आयुक्त के 02 पद पर पूर्व की भाँति बिहार प्रशासनिक सेवा के पदाधिकारियों के लिए चिन्हित रहेगें। (v) बिहार प्रशासनिक सेवा के चिन्हित पदाें को छोड़कर शेष पदों पर जब तक सेवा में नियुक्ति/प्रोन्नति से किसी कोटि के पद की रिक्ति के विरूद्ध पर्याप्त संख्या में पदाधिकारी उपलब्ध नहीं होते हैं, तब तक ऐसे पद भी बिहार प्रशासनिक सेवा के पदाधिकारियों की प्रतिनियुक्ति से भरे जा सकेंगे। 4. रिक्तियों की अवधारण।- विभाग द्वारा प्रत्येक वर्ष 31 मार्च की स्थिति के आधार पर 1ली अप्रैल को मूल कोटि के पद की आरक्षण कोटिवार रिक्तियो की गणना की जाएगी तथा आयोग को आरक्षण कोटिवार अधियाचना प्रत्येक वर्ष 30 अप्रैल तक उपलब्ध करायी जाएगी। आयोग द्वारा संयुक्त प्रतियोगिता परीक्षा के आधार पर योग्य अभ्यर्थियों का चयन कर नियुक्ति हेतु आरक्षण कोटिवार अनुशंसा विभाग को उपलब्ध कराया जाएगाा। 5. आरक्षण।- इस सेवा में नियुक्ति एवं प्रोन्नति में सरकार द्वारा समय-समय पर अवधारित आरक्षण के प्रावधान लागू होगें। 6. उम्र सीमा।- सीधी भर्ती के लिए उम्मीदवार की न्यूनतम आयु विज्ञापन वर्ष के 1 ली अगस्त को 21 वर्ष होगी। अधिकतम आयु सीमा वही होगी जैसा राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर अवधारित किया जाय। 7. कालावधि।- सेवा के उच्चत्तर पदों पर प्रोन्नति हेतु न्यूनतम कालावधि वही होगा, जैसा राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित किया जाय। 8. मूलकोटि के पद पर नियुक्ति।- (i) मूल कोटि के 50% पदों पर नियुक्ति सीधी भर्ती से बिहार लोक सेवा आयोग की अनुशंसा के आधार पर की जायेगी। आयोग द्वारा अभ्यर्थियों का चयन ऐसे तरीके से किया जायेगा जैसा वह उचित समझे। (ii) मूल कोटि के शेष 50% पद बिहार परिवहन (तकनीकी) संवर्ग एवं बिहार परिवहन (प्रवर्तन शाखा) संवर्ग के योग्य सदस्यों की प्रोन्नति से निम्नवत्‌ भरा जायेगा- (क) बिहार परिवहन (तकनीकी) संवर्ग :-उपलब्ध रिक्ति का 60% पद। (ख) बिहार परिवहन (प्रवर्तन शाखा) संवर्गः- उपलब्ध रिक्ति का 40% पद। (iii) सेवा के उच्चत्तर कोटि के पदों पर प्रोन्नतियाँ (प्रोन्नति हेतु चिन्हित पदों के ठीक नीचे वाले पदों से) वरीयता-सह-योग्यता के आधार पर विभागीय प्रोन्नति समिति की अनुशंसा से भरी जायेगी। (iv) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा अलग आदेश से किया जाएगा।3 बिहार गजट (असाधारण), 3 Qjojh 2020 9. परिवीक्षा।- (क) सीधी भर्ती से नियुक्त होनेवाला प्रत्येक पदाधिकारी नियुक्ति की तिथि से दो वर्षो की अवधि के लिए परिवीक्षाधीन रहेगा (ख) परिवीक्षा अवधि पूरी होने पर पदाधिकारी का आचरण एवं सेवा संतोषजनक नही पाये जाने पर, परिवीक्षा अवधि एक और वर्ष बढ़ायी जा सकेगी। विस्तारित अवधि में भी आचरण एवं सेवा संतोषजनक नही पाये जाने पर सेवा समाप्त की जा सकेगी। (ग) नियुक्ति के बाद प्रथम वेतन वृद्धि के पश्चात अगली वेतन वृद्धि तभी अनुमान्य होगी जब विहित विभागीय परीक्षा में उर्तीणता प्राप्त कर ली जाय। (घ) विभागीय परीक्षा के विषय, पाठ्‌यक्रम एवं प्रक्रिया का निर्धारण तथा परीक्षा का आयोजन केन्द्रीय परीक्षा समिति, राजस्व पर्षद, बिहार द्वारा किया जा सकेगा। 10. प्रशिक्षण।- नवनियुक्त पदाधिकारियों को विभाग द्वारा निर्धारित प्रशिक्षण पूरा करना होगा। प्रशिक्षण की अवधि तथा अन्य प्रावधान संवर्ग नियंत्रण प्राधिकार द्वारा विनियमावली के माध्यम से किया जा सकेगा। 11. सम्पुष्टि।- परीक्ष्यमान रूप में नियुक्त पदाधिकारी की सेवा परिवीक्षा अवधि समाप्त होने पर निम्नलिखित शर्तो के अधीन सम्पुष्टि किया जा सकेगा- (क) विहित विभागीय परीक्षा में उतीर्णता प्राप्त कर लिया हो; (ख) समय-समय पर विहित किया जाने वाला प्रशिक्षण प्राप्त कर लिया हो और प्रशिक्षण के अंत में, यदि परीक्षा हो, तो उसमें उर्तीण हो चुका हो, एवं

(ग) इस अवधि में उसका आचरण एवं सेवा संतोषजनक रहा हो । 12. वरीयता।- (i) मूल कोटि की वरीयता-एक ही वर्ष में प्रोन्नति से नियुक्त पदाधिकारी सीधी भर्त्ती से नियुक्त पदाधिकारी से वरीय होंगे। (ii) बिहार परिवहन (तकनीकी) संवर्ग में नियुक्त कर्मी/पदाधिकारी एवं बिहार परिवहन (प्रवर्तन शाखा) संवर्ग में नियुक्त कर्मी/पदाधिकारी की वरीयता, प्रोन्नति आदेश निर्गत तिथि से निर्धारित होगी। एक ही तिथि में प्रोन्नति आदेश निर्गत होने पर उक्त संवर्गों के मूल कोटि में पहले नियुक्त पदाधिकारी/कर्मी वरीय होगें।

(iii) प्रोन्नत पदों की वरीयता-प्रोन्नत पदों की वरीयता प्रोन्नति आदेश निर्गत तिथि से निर्धारित होगी। 13. नियंत्रण।- (क) इस संवर्ग के सदस्यों पर प्रशासनिक नियंत्रण अपर मुख्य सचिव/प्रधान सचिव/सचिव, परिवहन विभाग के अधीन होगा।

(ख) इस सेवा के सदस्यों पर परिचालनात्मक नियंत्रण संबंधित जिला पदाधिकारी/प्रमण्डलीय आयुक्त, जिस जिले/प्रमण्डल में तत्समय पदस्थापित हों, को होगा।

14. अवशिष्ट मामले।- इस नियमावली से अनाच्छादित शेष मामलों, जिनके संदर्भ में इस नियमावली में विशिष्ट रूप से प्रावधान नहीं किया गया है, के संदर्भ में सेवा के सदस्य राज्य सरकार द्वारा समय-समय पर समान स्तर के कर्मियों के लिए निर्गत सुसंगत नियमावलियों, आदेशों तथा परिपत्रों आदि से शासित होंगे। 15. निरसन एवं व्यावृत्ति।- (क) इस नियमावली के प्रवृत होने के उपरान्त पूर्व में निर्गत एतद्‌ विषयक संकल्प, परिपत्र, निर्णय, निदेश आदि निरसित समक्षे जायेंगे। (ख) अन्य सेवाओं से जिला परिवहन पदाधिकारी के पद पर प्रोन्नति हेतु पूर्व से निर्गत पत्रांक-01-ई0-103/72 परि0-1429, दिनांक-04.03.1972 इस अधिसूचना के निर्गत होने की तिथि से स्वतः समाप्त समझी जायेगी। (ग) ऐसे निरसन के होते हुए भी पूर्व के संकल्प, परिपत्र, निर्णय, निदेश आदि के अधीन प्रदा शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्ति का प्रयोग करते हुए किया गया कोई कार्य या कोई कार्रवाई समझी जायेगी मानो यह नियमावली उस तिथि को प्रवृत थी जिस तिथि से ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गई थी।

No. 05/Estt-10/2016-941---In exercise of the powers conferred under Article-309 of the Constitution of India, the Governor of Bihar, hereby please to make the following rules to constitute Bihar Transport Service, its recruitment procedures & to regulate its Service conditions, as follows:- 1. Short title, extent and Commencement:- (i) This rule may be called as " Bihar Transport Service Rules,2020". (ii) It shall extend to the State of Bihar. (iii) It shall be effective with date of notification. 2. Definitions:- Unless referred otherwise, requires in the subject or contexts in these rules, (i) "COMMISSION" means Bihar Public Service Commission.

(ii) "APPOINTING AUTHORITY" means Appointing Authority as determined in Rules of Executive Business.

(iii) "GOVERNOR" means Governor of Bihar. (iv) "STATE GOVERNMENT" or "GOVERNMENT" ,means Government of Bihar.

(v) "YEAR" means Financial Year beginning from 1st April to 31st March of next Year.

(vi) "VACANCY WITHIN YEAR" means created new posts for the service , accured of vacancy by virtue of retirement, death, dismissed or discharged from the service.

(vii) "DEPARTMENT" means Transport Department.

(viii) "DEPARTMENTAL PROMOTION COMMITTEE" means Departmental Promotion Committee Constituted from time to time by the Government. (ix) "SERVICE" means Bihar Transport Service. (x) "MEMBER OR MEMBER OF THE SERVICE" means Person working under this Service or appointed within this Service, under the provision of this rule. (xi) "CADRE CONTROLLING AUTHORITY" means Addl. Chief Secretary/ Principal Secretary/ Secretary, Transport Department. (xii) "FIXED DATE" means coming into effect of this rule. 3. Structure of Service:-Structure of posts in different levels/grades of this Service shall be as follows:-

(i) On the fixed date, person working upon any post of this Service shall suo motto be treated included in this service.

(ii) Pay Scale/ Grade Pay for above mentioned posts will be same, as approved by the Finance Department, Govt of Bihar, from time to time .

(iii) Sanctioned strength for different levels/grades of this service will be same as approved by the state Govt. from time to time.

(iv) 17 posts of Distt. Transport officer , 1 post of Dy. Transport Commissioner, 2 posts of Joint Transport Commissioner shall remain identified for officers of Bihar Administrative Service as earlier.

(v) Those posts of this Service, other than identified Service shall be filled up for the time being from deputation of officers belonging to Bihar Administrative Service till officers are available from recruitment, promotion in this Service.

4. Calculation of vacancies:-Based upon vacancies existing till 31st March in "Basic Grade" it shall be calculated or assessed by the Deptt., reservation category wise , on 1st April of the year, followed by transmission of "Requisition" for recruitment in prescribed manner to the respective "Commission". The "Commission" will ensure selection of candidates based upon "Combined Competitive Examination", reservation category wise & will recommend the respective Department for appointment/ a list of candidates, reservation category wise.

5. Reservation:-Provision of Reservation shall be applicable to this Service as decided by the Govt. from time to time for Recruitment & Promotion.

6. Age Limit:-The candidate applying for recruitment to this service must have attained the minimum age of 21 Years on 1st August of Year of advertisement for recruitment. Maximum age limit would be in accordance with fixed by the State Govt. General Administration Department from time to time.

7. Time Bar:-Minimum time bar for promotion to higher posts of the service shall be as such, decided by the General Administration Department of State Govt. from time to time.

8. Appointment on Basic Grade Posts:-

(i) Appointment against 50% posts of Basic Grade, will be done on the basic of recommendations of Bihar Public Service Commission.

(ii) Rest 50% posts of Basic Grade will be filled up by way of promotion of suitable candidates from Bihar Transport (Technical) Cadre & Bihar transport (Enforcement Wing) as follows:-

(a) Bihar Transport (Technical) Cadre:- 60% post of available vacancies. (b) Bihar Transport (Enforcement Wing) Cadre:-40% posts of available vacancies.

(iii) Promotion to higher posts of this Service will be given (from just next junior level posts) based upon seniority cum merit basis as recommended by the D.P.C (Departmental Promotion Committee)

(iv) " Departmental Promotion Committee" shall be constituted by separate order to be issued by the department.

9. Probation:- (a) Each officer appointed by way of direct recruitment shall be on Probation for two Years. (b) After completion of probation period it can be extended further for one year provided conduct or performance of the officer is not found satisfactory by the6 बिहार गजट (असाधारण), 3 Qjojh 2020 Administrative Department. Even after extended probation period if conduct or performance of the officer is not found satisfactory, he shall be liable to be "Discharged" from the service. (c) As a result of appointment, after first "increment, further 'increments' shall be admissible subject to passing of prescribed departmental examinations. (d) Subjects, syllabus, formulation of procedure and conduct of examinations shall be done by Central Examination Committee, Board of Revenue, Bihar.

10. Training :- Newly appointed officers will have to complete training prescribed by the department. Duration of Training and other provisions shall be prescribed through ' Rules ' , Framed by Cadre Controlling Authority.

11. Confirmation:- Services of officers appointed on probation, can be confirmed subject to-

(a) They have passed departmental examination, (b) They have attained the prescribed training and have passed the examination if prescribed after completion of training (c) Their conduct & services are satisfactory.

12. Seniority:-

(i) In Basic Grade, officers appointed by way of promotion in same year shall be treated senior to those appointed as direct recruitment. (ii) Seniority of those officers promoted from 'Bihar Transport (Technical) Cadre and 'Bihar Transport (Enforcement wing) cadre shall be treated with effect from date of issuance for granting them promotion. Among officers promoted on same date, those appointed earlier in Basic grade of their own cadre, shall be treated senior. (iii) Seniority in promoted Cadre shall be treated with effect from date of issuance for their promotion.

13. Control:- Administrative control over members of this service will be with Addl. Chief Secretary/Principal Secretary/Secretary, Transport Department.

14. Pending cases:- Those cases, which are not covered within ambit of this rule, can be considered under relevant rules, orders & Circulars of the State Government, issued for same category of personnels.

15. Repeal and Saving:-

(a) With coming into effect of this rule, all circulars, orders notifications issued earlier in this regard shall be repealed. (b) Letter No:-01-ई0-103/72 परि0-1429, dated 04-03-1972 regarding promotion to the post of District Transport Officer from other services shall stand repealed from the date of notification of this Rule. (c) Not with Standing Such repeal & savings, any work done earlier or actions taken according to Previous Sankalp, circulars, orders, notifications etc, shall be treated to be done in exercise of this rule, as if this rule was in existence on that respective date.
